Gregson Dee Freeman Director Secretary November 23, 2009 R9F ���� NOV s a ?009 Morehead City DCM This is with reference to your request to modify State Permit H91-96, which was issued to Bald Head Island, Limited on June 3, 1996. The permit expires on 12/31/12. (NOTE: The expiration date of this permit has been extended in accordance with Session Law 2009-406.) The action proposed in your submittal is to reduce the width of the crane pad to 30'; install an above ground 12,000 gallon diesel tank outside of the 30' buffer with associated fuel lines and dispensers; to construct an addition to each of the two ferry access landings at the maintenance pier, each measuring 4' in length by 3' in width; to construct four additional fixed, wooden platform additions to the maintenance pier, each measuring 2' in length by 5' in width; to construct three sets of 6' wide wooden steps leading from the marine maintenance building to the bulkhead walkway; to add additional piling support within the approved footprint of the marina entrance sign; and to construct a 7 square foot wooden, elevated platform addition to the D-dock landing (bringing the D-Dock platform to a maximum authorized area of 552 square feet). The proposed work is adjacent to the Deep Point marina basin and the Cape Fear River, in Southport, Brunswick County. Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit #91-96, as described in your letter and plans dated November 20, 2009 and received November 23, 2009. Please note this refinement does not authorize any plan changes not expressly described above and does not alleviate the need to obtain any other state of federal permits or authorizations. Dear Ms. Coats: Included are five 24" x 36" color copies of drawing Deep Point Marina, Marina Area Update, Rev 4, dated & sealed 11-20-09, for the Bald Head Island Limited, LLC owned Deep Point Marina. This is an updated version of my Nov. 3, 2009 Rev 4 submittal based upon your phone comments Friday, Nov 20, 2009. As typical formy update/revision drawings, previously approved items that have had a location or shape change are blue, and new items are red. Items not changed from the August 5, 2009 approved LOR rev 3 drawing and previous approved submittals are gray or black. The major driving item of this Letter of Refinement Request is to shift the location of Marine Maintenance Building entry road to outside of the 30' Buffer. W.K. Dickson had submitted this location of the 22' wide road, sidewalks and the concrete landing at the side door to the river side of the building in their 1-24-07 Minor Modification Master Site Plan drawing for the site, roadways & parking. Per our discussion, I have also changed the concrete landing & sidewalk to wooden deck/boardwalk. I am also showing in red, wood stairway/ramp access out of the Maintenance Bldg to the ferry docks. Per your comments, I have shown these all as 6' maximum width of pervious wood construction. I have reduced the width of my 32' wide crane pad within the 30' buffer to 30' wide, to allow for a 10' radius as shown on 2 sides of the pad. The 2' reduction in width x 25' of pad in, the buffer = 50 sq ft. Each 10' radius is 22 sf of area. We net out a little less than the already approved impervious. At the south end of the marina, near the D-Dock Landing, I have added an approximate 25"x40.5" piece of wood decking (7 sq ft), shown in red inside of the 30' buffer, to support/protect, the fire standpipes for D,E & F Docks. We had the standpipes break 3 times during installation because of lack of protective cover over the exposed pipe. The D-Dock Landing, approved at 20'x28'=560 sq ft, was built 19.9'x27.1' plus a piece 6'x .9' at the top of the gangway for a total of 545 sq ft. With The 7 sq ft wood platform, we are still under our permitted amount. gimensions are shown in blue. The 8' dimension shown is the distance between the 6' boardwalk and 6' piece at the gangway top. Also per our discussions, between the existing marina side last two "bumpouts" for ferry access on the maintenance pier, I am asking for permission to fill in the areas as indicated, approximately 3' x 4', each side. I planned the landings to align with the gates for my catamarans, Patriot and Ranger; however, when San Soucci or Adventure are alongside for maintenance, their gates do not line up safely with the landings. I am also showing four 2'x5' bumpouts for the shore power pedestals and for hose hangers. I am trying to keep the 12' drive aisle (only 11' wide between wood curbing) clear. I have added 3 piles to the marina entrance sign detail for a total of 9. One pile to each sign, in line with the previous 3 piles (now 4 piles at 7' on center rather than 3 piles at 9' on center), plus one pile behind the sign for the attachment of cross -bracing. The piles available for construction were shorter than I had used in my original wind calculations for embedment depth, so the additional piles allow for a reduced embedment. Dv„ n co..t n..+oA 1 1 .nnROV 2 3 21109 The final addition for this letter of refinement request is for the placement of a 12,000 gallon above ground double wall diesel fuel tank for the ferries, outside of the 30' buffer, but within the 75' AEC. I have indicated approximate piping locations, 3 land side hose reels with transition sumps, and a 25' +/- x 45' +/- wooden fence around the tank. We will, of course, submit for/ obtain any necessary fuel tank permits from the state. If you have any questions and/or comments, please call me at 910-228-2484.
