The permit expires on 12/31/09. The action proposed in your submittal is to relocate the authorized sign to southern side of the marina entrance channel, reconfigure the screened gazebo/floating dock at the end of A -Dock, install additional pile -supported signs in the 30' buffer and to construct a wooden deck outside of the 30' buffer within Deep Point Marina, adjacent to the Cape Fear River, in Southport, Brunswick County. Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit #91- 96, as described in your letter dated July 1, 2009 and received July 2, 2009 & plans dated and received July 6, 2009. Please note this approval is subject to the condition that all signs are located on high ground, outside of all coastal and §404 wetlands. Please note this refinement does not alleviate the need to obtain any other state of federal permits or authorizations. By copy of this letter we are also notifying the U. S. Dear Ms. Coats: Included are five 24" x 36" color copies of drawing Deep Point Marina, Marina Area Update, Rev 1, dated & sealed 7-1-09, for the Bald Head Island Limited, LLC owned Deep Point Marina. This drawing shows previously approved items that have had a location shift in blue, and added information or items in red. Items not changed from the May 13, 2009 approved LOR drawing are in gray or black. The major driving item of this Letter of Refinement Request is to shift the location of the vee- shaped marina entrance sign (item S) from north of the north jetty to south of the south jetty. There were concerns by the Bald Head Island Limited, LLC Executive Committee that the previously permitted location north of the north jetty limited the views from the passenger terminal observation deck. The proposed location south of the south jetty is somewhat shielded by frees so is more favorable. I have also shown the approximate as -built location of the electrical transformers (items El -Ell) based on Brunswick Electric's selected locations for transformers inside of the AEC. The fuel attendant 14'x22' roofed station on the fuel dock has been mirrored, so that the roofed section is in slip A5, and the additional floating dock is in slip A6. This is shown in blue. I have noted in red the location of the emergency fuel shut -offs, and the location near the NE end of A -dock of a small fuel transition sump. To the north of the Contractor Ferry Landing, in red, I have shown item U5, 1300 sf of pervious wood decking outside of the marina buffer, but within the 75' AEC. This had been designed as a concrete plaza in conjunction with the sidewalk, but we decided to change it to the more eco-friendly wood decking. It's use is as a smoking area and also for bike racks. It is approximately 60 in length parallel to the bulkhead, and includes a planter and seating along its cap material. Per our meeting in Morehead City on June 22, 1 have made a listing of signs within the 30' buffer, not associated with the Passenger Ferry Terminals and Marine Maintenance Building. I came up with 181 signs. Many will be hung on structure such as the dock landing railings, kiosks and bulletin boards, and on dock pilings. Some will need to be on posts, which is allowable within the 30' marina buffer by exemption. Some signs will be very small. I hope my list is comprehensive enough. The sign people, harbormaster, etc may have alternate wording. Where possible, I indicated a post & sign location for several of the signs. I have not included parking signs that are almost entirely outside the AEC. Permitted development not shown on this drawing should not be construed as being abandoned. Underground utilities, site lighting, fire standpipes, landscape irrigation components, etc. previously approved in 12-11-08 Minor Mod as unlisted items are not shown.
