Gregson Director August 24, 2009 Dee Freeman Secretary P1 FORIED AUG 3 1 2009 Morehead City DCM This is with reference to your request to modify State Permit #91-96, which was issued to Bald Head Island, Limited on June 3, 1996. The permit expires on 12/31/09. The action proposed in your submittal is to relocate the authorized sign south of the marina entrance channel, construct approximately 1,100 square feet of wooden, slatted decking outside of the 30' buffer, construct a 20' in length by 12' in width temporary dumpster pad outside of the 75' AEC, install a planter outside of the 30' buffer measuring approximately 45' in length by 5' in width, and to add 6 access landings to the maintenance pier, each measuring 4' in length by 5' in width. The proposed work is adjacent to the Deep Point marina basin and the Cape Fear River, in Southport, Brunswick County. Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit #91-96, as described in your letter and plans dated August 5, 2009 and received August 6, 2009. Please note this approval is subject to the condition that the marina entrance sign is located on high ground, above normal high water and outside of all coastal and §404 wetlands. Please note this refinement does not alleviate the need to obtain any other state of federal permits or authorizations. By copy of this letter we are also notifying the U. S. Dear Ms. Coats: Included are five 24" x 36" color copies of drawing Deep Point Marina, Marina Area Update, Rev 3, dated 8, sealed 8-5-09, for the Bald Head Island Limited, LLC owned Deep Point Marina. This drawing shows previously approved items that have had a location or shape change in blue, and new items in red. Items not changed from the July 6, 2009 approved LOR drawing are in gray or black. The major driving item of this Letter of Refinement Request is to shift the location of the vee- shaped marina entrance sign (item S) from immediately south of the south jetty to approximately 120' south of the south jetty. Per your Tuesday, August 4, 2009 site visit, the sign is shown per the agreed field staking landward of mean high water, and water ward of the 404/coastal wetland vegetation. The sign graphics detail has also been revised to reflect the arched top of the sign board and an increase in Width of 4', and the addition of an approximate 3' x 24' sign board indicating the (homeport of) the Bald Head Island Ferry, The size adjustment was made based on lettering size needed for readability by boats in the normal river channel. I have also added two sections of wood decking, outside of the 30' buffer. in item U4, I have added 100 sf of pervious wood decking inside of the 75' AEC to help transition around a sewer manhole and I have added 1000 sf of wood decking as item U6: 700 sf inside of the 75' AEC, and 300 sf outside of the AEC for potential use as a pick-up stgging area for bicycles coming off of the island. A temporary, screened dumpster pad, item Z, is shown outside of the AEC at the south end of the marina. Eventually, the dumpster will be relocated based on the restaurant and/or hotel final design. For now, this is an easy access location for the waste haulers to pick up the marina garbage. Nearby, a planter is shown in red letters outside of the buffer that helps create the grade transition for the marina access road, going down from the main loop road to the marina. We are almost complete with paving the marina parking lot and turnaround oval that is near the harbormaster building and the mixed use space. Hence, about 225' of previous indicated temporary wood boardwalk has been eliminated from this drawing. There is a small connector section of boardwalk near D-Dock that has been shifted to align better with the transition of the sidewalk outside of the buffer, around the above mentioned planter, and back to the D-Dock wood boardwalk. Per our discussion, I am also showing the six intended transition landings on the marine maintenance pier to access the ferries. The four pile dolphins to keep the vessels off of the pier In a hurricane extend out 4' from the pier. Quite a jump! Nominally, each landing is approximate 4' out by 5' wide. RECEIVED AUG 0 6 2009 DCM WILMINGTON, NC For safety and maintenance reasons, I have increased the size of the wood fenced enclosures around both pump out station holding tanks Gl & G2 to include space for the backflow preventer(s) and access to all sides of the pump/tank for maintenance. We have recently had a backflow preventer elsewhere on the site go missing, believed to be stolen for its copper fittings. These two wood fence "corrals" are lockable and intended to prevent anyone from messing with valves and/or stealing copper. Permitted development not shown on this drawing should not be construed as being abandoned. Underground utilities, site lighting, fire standpipes, landscape irrigation components, etc. previously approved in 12-11-08 Minor Mod as are not shown for clarity.
