This correspondence is regarding the request you submitted to modify State Permit No. 91-96, acting as agent for Bald
Head Limited, LLC. The permit was issued on June 3,1996 and is due to expire on December 31, 2018. The action
proposed in your submittal, includes paving of the main parking lot expansion area near the main entrance/exit of Deep
Point Manna and completing the temporary parking lot previously authorized under refinement by this office on March
12, 2015.
In reviewing the information provided, the Division of Coastal Management has determined that the proposed action is
consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit.
The proposed main parking lot expansion is outside of the 75 ft. Estuarine Shoreline Area of Environmental Concern
and was has been reviewed and approved by State Stormwater (see Attached email dated May 23, 2017). This letter
of refinement authorizes the modification of State Permit No. 91-96, as described in your letter dated May 22, 2017
and parking lot plan dated received May 23, 2017. All permit conditions remain in effect.
Please note this refinement does not authorize any work not expressly described above, nor does it eliminate the need
to obtain any other additional state, federal or local permits, approvals or authorizations that may be required.
By copy of this letter we are notifying the US Army Corps of Engineers and the Division of Water Resources of our
action. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits.

Lot Expansion.
Dear Ms. MacPherson,
Bald Head Island Limited, LLC is planning on paving and pavement repair projects this year at its Deep
Point Marina Ferry Terminal and Parking Facility, 1301 Ferry Road, Southport, Brunswick County, NC.
One project is asphalt paving of the temporary/secondary Harbormaster Parking Lot, outside of the
30' Marina Buffer, and mostly within the 75' Marina AEC. I say "temporary" in that the site is CAMA 91-
96 permitted for a 3-story future building. This paving was approved by Stormwater SW8-951012 Plan
Modification on 3/31 /2015 and CAMA Letter of Refinement 3/12/2015.
The second project is paving of the main parking lot expansion near the main entrance/exit to the site.
You attended a DEMLR/Stormwater scoping meeting for this earlier this year, with S&ME as Project
Engineer. It is the subject of this Letter of Refinement Request.
For paving bid purposes, the paving contractor(s) typically ask for our CAMA approval(s). My file
research shows that the intended 3000+/- parking space ferry parking lot was part of the initial Upland
Development information on the MP-1 application, based on my 3-12-96 seal date SW8-951012
approved stormwater plan, sheet Sl/Bald Head Island Limited, LLC's 10-16-95 Land Use Plan. I am
enclosing one copy, 11 "x17" black and white, for your reference usage.
At that time, the project name was "Pfizer Tract", for the 176+/- acre property purchase from Pfizer.
Within the next couple of years, appx 100 acres were sold off for the Landings Subdivision and for the
State Ferry System Spoil Basin(s). By the time of the First Renewal in 1998, the Deep Point name was
being used.
As the main ferry parking is well outside of the AEC, I realize that a Letter of Refinement may not be
necessary for the paving of the parking lot expansion, but it would help our paperwork trail, since the
"Pfizer Tract" name hasn't been used in 20 years. A simple L.O.R. stating that the paving of the Deep
Point Marina parking lots are consistent with the 1996 Permit Intent would be wonderful.
