This is with reference to your request to modify State Permit #91-96, which was issued to Bald Head Island,
Limited on June 3, 1996. The permit expires on 11/15/16. (NOTE: The expiration date of this permit has been extended
in accordance with Session Law 2009406, as amended by Session Law 2010-177.) The action proposed in your submittal
is to reallocate 3 slips from the Harbormaster H-Dock to the A -Dock, reducing the authorized but unconstructed H-dock
from 125' to 50' in length, and to install 24 associated pilings (in the form of two sets of 4-pile dolphins and eight sets of
2-pile dolphins) adjacent to A -Dock. The proposed work is located within the Deep Point marina basin, adjacent to the
Cape Fear River, in Southport, Brunswick County and would not increase the total number of authorized slips (which
remains at 100 slips).
Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed
action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the
permit. This Letter of Refinement authorizes the modification of State Permit #91-96, as described in your letter and
plans dated and received September 19, 2012.
Please note this refinement does not authorize any plan changes not expressly described above and does not
alleviate the need to obtain any other state or federal permits or authorizations. By copy of this letter we are also notifying
the U. S. Army Corps of Engineers of our action. If you have any questions concerning the above or if I can be of any
other assistance, please advise.

Included are five color copies 24"x36" of Deep Point Marina Letter of Refinement Drawing seal dated
9/19/12 for Fuel Dock Slips/Piles. This is an update to my 9/4/12 submittal, with the addition of shortening
the future Harbormaster Skiffs H-Dock from 125' in Length to 50' x 6'-3"+/- per your comments. The
reason being the transfer of 3 of the original 5 H-Dock slip positions over to the fuel dock, to cover
overnight dockage along either or both of the fuel dock faces 75' & 155' in length.
The request is also for 8 new permanent piles (two 4-pile dolphins) and 16 temporary piles (eight 2-pile
dolphins) at the 155' fuel dock approximately per the drawings. The two 4-pile dolphins are for bow
lines for a larger vessel. The temporary piles are intended to allow a large vessel to be kept off of the
fuel dock if weathered in for a storm event. The cost to a captain to add piles is incidental to the cost
of paint job on a large vessel. With the nearness to the ferry terminal, keeping the vessel off the dock
with anchors is not feasible.
I am showing in the lower left hand detail the shortening of the future H-Dock to 50'. 1 have improved
the graphic layout on the slip piles throughout the marina and at the tug/barge slips. However, some of
the in -slip piles drawn to scale (8" diameter piles)still show up very lightly.
