Dear Mr. Marek:
This is with reference to your request to modify State Permit #91-96, acting as agent for Bald
Head Island Limited, LLC. The permit was issued on June 3, 1996 and expires on November 15,
2016. The action proposed in your submittal, as submitted in your March 2, 2015 request, is to
modify the dimensions of the ferry maintenance dock. The dock was originally authorized at 95'
in length by 8' in width. The modified dock would include a 16' in length by 10' in width
floating ramp landing platform connecting to a 70' in length by 6.25' in width dock. Ferry access
dock steps leading to a cantilevered platform would be constructed approximately midway along
the dock. Twelve dolphin pilings, each consisting of 4 pilings, are also proposed along the dock.
In reviewing the information provided, the Division of Coastal Management has determined that
the proposed action is consistent with existing State rules and regulations and is in keeping with
the original purpose and intent of the permit. This Letter of Refinement authorizes the
modification of State Permit #91-96, as described in your letter dated March 12, 2015 and plan
labeled "Sheet: Deep Point Marina Floating Maintenance Dock", dated March 12, 2015. All
permit conditions remain in effect.
Please note this refinement does not authorize any work not expressly described above, nor does
it eliminate the need to obtain any other additional state, federal or local permits, approvals or
authorizations that may be required. By copy of this letter we are also notifying the U. S. Army
Corps of Engineers and the NC Division of Energy, Minerals & Land Resources of our action. If
you have any questions concerning the above or if I can be of any other assistance, please advise.

Dear Ms. Coats:
I am submitting 5 copies each 11 "x17" of my 3-12-15 seal date drawing "Deep Point Marina - Floating
Maintenance Dock" in support of this Letter of Refinement Request for Bald Head Island Limited, LLC.
Per our conversation yesterday, I could not submit both a parallel and perpendicular floating dock
alternative. This morning the decision was made to go with the as permitted perpendicular floating
dock.
An 8'x95'Fioating (Marine) Maintenance Finger has been in the Deep Point CAMA # 91-96 Permit since
at least 2009. Today's drawing is based on a/ my 5-13-09 seal date L.O.R. drawing. As you are aware,
CAMA #172-87 Minor Modification dated 1-15-15 allows for the re -configuration of the A -Dock slips at
Bald Head Island Marina. The reconfiguration eliminated one of the 70' x 6.25' +/- floating finger
docks. We wish to repurpose that floating dock and use it as the never built permitted 95' x 8' ferry
maintenance dock at Deep Point. We request to add a 10' wide x 16' Rooting dock, with an angle
gusset as depictied in the drawing, as the ramp landing floating dock.
With this Letter of Refinement Request, we are indicating extending the existing marine maintenance
holding tank pump -out lines to service the subject floating dock. As we are still unsure if the existing
pump can handle the extra length, we would like to qualify this request to allow installing a sufficient
size pump -out pump at the floating dock. If this qualifies for a State /CAMA grant, please advise us of
whom we should contact.
I have listed 16 items of "Anticipated Typical Dock/Marine Maintenance Items" that I feel are/should
be part of this project. It may not be totally complete, as the marine maintenance department may
have additional needs for maintaining the ferries. If any item(s) are not permit -able, please permit all
that are allowed. The 70' dock has already been delivered to Deep Point for final positioning.

construct a temporary parking lot outside of the 30' Estuarine Shoreline buffer and partially
within the 75' Estuarine Shoreline Area of Environmental Concern (AEC), adjacent to the
Harbour Master building and pool.

the proposed action is consistent with existing State rules and regulations and is in keeping with
the original purpose and intent of the permit. This Letter of Refinement authorizes the
modification of State Permit #91-96, as described in your letter dated March 2, 2015 and plan
labeled Sheet CI- Deep Point Marina Harbour Master Temp Parking Lot, dated March 2, 2015
(received by DCM March 3, 2015). All permit conditions remain in effect.

Dear Ms. Coats:
Included are five 24" x 36" copies of drawing Cl-Deep Point Marina Harbour Master Temporary)
Parking Lot, dated & sealed 3-2-15, for the Bald Head Island Limited, LLC owned Deep Point Marina.
As we have spoken, we are approved by both by CAMA and Stormwater SW8-951012 for 7500 sf of
building roofiine in the gross area landward of the retaining wall that is along the 30' marina buffer line.
As it works out, including the entrance and the potential exit, the asphalt lot is tributary to 3 stormwater
drainage basins. The largest part of the temporary lot, in drainage basin DB17A, has 7146 sf of
Allowable BUA. As drawn, including a 4" rock perimeter and 1' entrance curb, we are proposing using
7140 sf of that allowed amount. The entranceway is in drainage basin DB 25-1, which has an
allowable BUA of 39,537 sf, mostly for the future hotel and restaurant. With curbing I have designated
620 sf impervious, which is less than the 1100 sf that was tributary to DB25-1 frome one of the original
50'x50' roofiines. And lastly, there is 30 sf exit slab of 8"-10" thick concrete concrete in DB17, which
includes the existing marina parking lot, the "BHI oval" and the Harbour Master Store. This is in lieu of a
105 sf entrance walk for the still future 7500 sf building.
Within the three areas, my total is 7140 + 620 +30 = 7790 sf. A mere 0.6% of the 1,208,772 sf of Built Upon
Area Permitted for this mainland departure point/Parking Facility for the Bald Head Island Ferry.
Cl has plenty of background information, but I am also including one copy of 4 pages of the
December 17, 2008 Stormwater Permit Modification so that you can verity my Drainage Basin 17, 17A
and 25-1 numbers. I will be using the same Cl drawing for a stormwater plan revision if you or
Stormwater/DWQ deem it necessary.

The Wilmington Regional Office received a complete, modified Stormwater Management Permit
Application for Deep Point Marina on December 16, 2008. Staff review of the plans and specifications
has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in
Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 951012 Modification for the construction
of the subject project.
This permit modifies and replaces all previous permits and revisions issued for this project prior to this
date. This permit shall be effective from the date of issuance until February 15, 2017, and shall be
subject to the conditions and limitations as specified therein. Please pay special attention to the
Operation and Maintenance requirements in this permit. Failure to establish an adequate system for
operation and maintenance of the stormwater management system will result in future compliance
problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within thirty (30) days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150E of the North
Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447,
Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.

FOR THE
construction, operation and maintenance of two (2) wet detention ponds, twenty-four (24)
infiltration basins and six (6) infiltration trenches, in compliance with the provisions of 15A
NCAC 2H .1000 (hereafter referred to as the "stormwaterrulesl and the approved stormwater
management plans and specifications and other supporting data as attached and on file with
and approved by the Division of Water Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until February 15, 2017, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as
described in Section 1.7 (24 infiltration basins), Section 1.8 (6 infiltration trenches) and
Section 1.9 (2 wet detention ponds) on pages 3 and 4 of this permit. The total BUA for
this project is 1,208,772 square feet.
3. The tract will be limited to the amount of built -upon area indicated on pages 3 and 4 of
this permit, and per approved plans. There is no allotment for future built -upon area.
4. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this project must
be directed into the permitted stormwater control system.
6. This protect proposes that some of the basins will be interconnected and work together
T provide the required minimum storage volumes. The storage volume provided is based
on a controlling elevation which is the highest common elevation shared by the basins in
that system prior to overflow. No storage credit is given for volume stored in the pi

Drainage Basin 25-1 (61,339 sf) is to left of DB 17A
DB 25-1 has an allowable BUA of 39,537 sf, which includes the future hotel
and restaurant. 1100 sf of Structure 10 Roofline is in DB 25-1
Proposed DB25-1 564 sf of asphalt entrance way (620 sf BUA with 1' Concrete
Curb) is in lieu of the 1100 sf Future Mixed Use Building Roofline.
DB 17 includes the existing Harbour Master Parking Lot, Turnaround "BHI Oval"
and Store. Drainage Area DB17 = 82,125 sf, with 60,487 sf Allowed BUA.
Entire Harbour Master Complex is not yet built. There is a 30t sf connection
piece from the parking lot to the oval. This is proposed as 8"-10" thick
concrete, with removable bollards, to allow boat trailer or emergency vehicle
drive thru access. Drawing shows the 30 sf as a "swap" from a (future)
building entrance walkway.
