It expires on 12/31/09. The action proposed in your submittal is to relocate two previously authorized sheds, measuring 12'in length by 12'in width (dripline dimensions), with an additional 60 square foot concrete pad between the two sheds, within Deep Point Marina, outside of the 30' buffer, adjacent to the Cape Fear River, in Southport, Brunswick County. Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit i191- 96, as described in your letter & plans dated and received March 11, 2009. Please note this refinement does not alleviate the need to obtain any other state of federal permits. By copy of this letter we are also notifying the U. S. Army Corps of Engineers of our action. Five copies of f 1" x 1T' color drawing CI are enclosed, signed and sealed on 3-11-09 showing present permitted locations of sheds B 1 & B2, as well as the new proposed locations. Also shown are the original proposed locations for the two sheds from my 7-9-07 initial DPM-3 submittal. Per your comments in August 2007, I moved the sheds outside of the 30' marina buffer, but within the 75' AEC. At that time I moved shed B2 to the south comer of the marina, from its position adjacent to shed BI. My new configuration has the start of shed Bl building pad at appx 45' from the marina side of the bulkhead cap. B2 is in line with Bl and the 10' building footprint is from 63' to 73' from the marina side of the bulkhead. There is 8' between the two 10'x10' shed structures. The slowed economy, along with the many construction needs for the opening of the new passenger ferry terminal have put start of construction of our larger, already permitted harbormaster building on hold until after this tourist season. We also want to avoid a large construction project occurring directly in the "view corridor" of passengers arriving at the new ferry terminal building for'4he first time. The two sheds will act as the temporary harbormaster office for this summer. Note that each shed has a 12'xl2' roof (10'x10' building footprint). Associated with each shed is an additional 30 sq ft of impervious not under the roofline (4'x10' each, with 1'X10' under the roof). These pads are combined at the center for the configuration shown on my 3-11-09 Cl drawing. Based on previous shed construction on Bald Head Island, I had planned for these small pads in front of the sheds in my permits. There is 7500 sf of impervious shown allotted for between the 30' buffer and the 75' AEC on the October 1, 2008 approved minor mod drawing. We do have a bit of a sense of urgency in this LOR request, in that we need a temporary location for our electronic fuel tank monitoring systems. This computer based system needs a home very soon. The action proposed in your submittal is to remove approximately 1500 cubic yards of material from the spoil basin at Deep Point Marina and to relocate the spillway/water control structure within the basin, adjacent to the Cape Fear River, in Southport, Brunswick County. Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit #91-96, as described in Plan Cl, dated and received March 13, 2009, and letter and Plan C3, dated and received March 27, 2009, which is subject to the following permit conditions: • Dike walls must be restored to their previous condition and stabilized prior to the addition of new dredged material to the spoil basin. • Flow from the diked retention area shall be contained by pipe, trough or similar device to a point at or below the mean low water (MLW) elevation contour to prevent gully erosion and siltation. • No vegetated wetlands shall be filled. • Material excavated from the basin shall be located on high ground, outside of the 30' buffer, and shall not extend outside of previously permitted areas of disturbance. All other conditions and stipulations of the active permit remain in force under this amendment. Please note this refinement does not alleviate the need to obtain any other state of federal permits. All work must be performed in compliance with Bald Head Island Limited, LLC's approved State Sedimentation and Erosion Control Plan. By copy of this letter we are also notifying the U. S. Request for sand removal from the spoil basin and maintenance to the spillway structure. Five copies of drawings C1 Rev 2, 11"x17", seal dated 3-18-09 and an 8.5" x 11" larger scale of the spillway replacement detail from Cl, also seal dated 3-18-09 detail are already in your possession. I am including today 5 copies of 11"x17" drawing C3 Rev 3 seal dated 3-27-09 showing the site location(s) on the Deep Point Marina site that we wish to move sand to. I have added notes to indicate that no sand/spoil to be placed within the 30' marina buffer or within the 404 wetlands on the site. I spoke with Carol Miller of Land Quality last week. The Deep Point Site and its many CAMA permitted buildings, roads and parking areas are already covered by Sediment and Erosion Control Permit Bruns-2005-254. Thus placing sand/spoil/fill on the site is already permitted. The spoil basin was constructed under our previous mining permit/original site S&E plans. Repair the berm after removal of sand is allowed. We would follow the planting schedule on my 3-18-09 8 ''/z"xl l" detail, which calls for using Curlex/Ecomat to stabilize the seeding, and the use of a fertilizer coated seed. This is a better procedure for the berm slopes than that specified when the spoil basin was constructed. Note that we are working on a time frame that is dependent and instrumental for the completion of the main ferry terminal and on the return of the dredge from the Sand By -Pass Dredging at Bald Head Island. Initial thought is to pull out approximately 1500 cu yds to 8000 cu yds of sand while the contractor is working on the spillway structure replacement and place it at the future restaurant, hotel or parking sites. However, depending on the weather, timing and economy, we may do the spillway repair/replacement first, then the dredging, and then look to remove the sand from the basin later in the season.
