DAVIS Direcaar Bald Head Island Limited, LLC c/o Bruce Marek 5489 Eastwind Road Wilmington, NC 28403 marekyd@ec.rr.com Dear Mr. Marek, NORTH CAROLINA Environmental Quality January 17, 2019 This is with reference to the request received by Tara MacPherson, Field Specialist, to refine State Permit No. 91-96, which was issued to Bald Head Island Limited, LLC on 6/3/96 for the construction of Deep Point Marina located adjacent to the Cape Fear River/AIW W, in Southport, Brunswick County. State Permit No. 91-96 has been modified, refined, and renewed several times since issuance. State Permit No. 91-96 is due to expire on December 31, 2020. The action proposed in your submittal is to install one (1) 2'x3'x7.25" thick concrete footing adjacent to the bulkhead cap, which will be located within the 30' coastal shoreline buffer. The stated purpose of the footing is to anchor a tug for the Bald Head Island barge. Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent of the permit. This Letter of Refinement authorizes the modification of State Permit No. 91-96 as described in your letter, dated January 15, 2019 and one (1) workplan drawing dated January 15, 2019. Please note this refinement does not alleviate the need to obtain any other local, state or federal permits. The existing shore power pedestal for the Tug at the barge landing is not sufficiently structurally anchored at its present location at the waterward end of the appx 6' x 90 If wood walkway. I am proposing a 2'x3'x7.25" thick concrete footing adjacent to the bulkhead cap, then with a series of 8"x8"xl6" nominal CMU Blocks to raise the pedestal to an appropriate height for use by the tug. Bald Head Island Limited, LLC's licensed electrician will assist in siting and designation of number of block courses. It is a water dependent item with the 30' marina buffer and 75' marina AEC. Wilson v District Manager, Wilmington DATE: January 15, 2019 SUBJECT: Modification Request State Permit No. 91-96 Deep Point Marina Bald Head Island Ltd, LLC Brunswick County Mr. Bruce Marek has submitted a request to modify State Permit No. 91-96, which was originally issued to Bald Head Island Limited on June 3,1996 for excavation and marina construction at Deep Point Marina adjacent to the Cape Fear River. This permit has been continually renewed and modified. The most recent refinement was issued on June 6, 2017 for the installation of dolphin and timber pilings within the manna. The most recent renewal was issued on December 6, 2018 and is due to expire on December 31, 2020. The permittee is requesting authorization to repair and support the existing failing bulkhead between slips A-1 and B- 2 by installing a 64 ft. long by 5'8" wide concrete pier with piling support watenvard of the existing wall (see Sheet Cl and C2). A 647" long by 8 ft. wide wooden deck is proposed over the concrete supporting pier that would connect to the existing boardwalk via 5 ft. long by 6 ft. wide walkways on either side of the wooden deck. The applicant states that the entire 180 linear ft. long by 6 f.t wide wooden walkway would also need to replaced between A dock and B dock. The permittee has submitted a check (#1681) in the amount of $100.00 for the modification. This office has no objection to this modification request, provided all other local, State and federal regulations are adhered to. By copy of this memo, DCM is requesting that the USACE, DWR, NC DMF and NC WRC provide any comment that your agency may have on the proposed project to Courtney Spears of DCM's Wilmington office within 14 days of receipt of this memo. Wth the record 100+ inches of rain to southeast North Carolina in 2018, we have noticed an outward migration of a section of the marina bulkhead cap/wall, i.e. a bulge. At this time it is minor but picked up during a site visit. Likewise, the 6' wide wood boardwalk, with edges at 5' and 1 1' landward of the water side of the bulkhead cap has developed an observable list. i.e. it is no longer level/horizontal. This segment of the marina wall is near to the harbormaster swimming bool and multiple retaining wall segments. Marina fuel (diesel and gas) lines, water, lighting and electric all run in the 30' marina buffer. There is no easy access to the marina roads for operation of necessary equipment to effect a landside repair. Thus internal discussion with my client has led us to a waterside repair approach of a 64' long by 5'8" wide x appx 2' thick (to match existing cap thickness) concrete pier, with 6 two pile bents spaced at 12' on center. The waterward most 6 piles are shown battered at 3:12 = 14 degrees. The closer to the bulkhead piles are shown vertical, but the pile cont4ractor has indicated that he feels that he can get some batter to them, and to try to wedge the wall/bulkhead cap back to vertical. I am submitting/have submitted 5 color originals, 11"xi7", with aseal date of 1-14-19 of drawings Cl and C2. Additionally, I am submitting/have submitted my check #1681 for $100 the minor mod fee. I have indicated that the 12 piles be coal tar epoxy coated steel piles, 14" o.d. x 0.50" i.d. with a minimum length of 30', and maximum purchased length of 40'. The contractor is looking at oil line piping out of Texas/Louisiana, so it will be a price/availability decision by my client with my input. These are similar piles to the Bennett Brother Travel Lift Pier in Wilmington, although theirs are 45' long for a future Travel Lift rated at 100 tons. Concrete piles would also be acceptable. My note #7 on sheet C 1 also indicates a possible use of helical earth anchors (Ram Jack or similar), in case a water side installation is deemed to be effective You are well aware of the aesthetic requirements of Bald Head Island Limited, LLC. My submitted engineer rectangles don't do justice to the more creative efforts of the Planning Department. I feel that the best method of making this wall reinforcement not noticeable is to turn it into a preservative treated wood quasi -observation deck. Which then leads to having rails per the NC building code. Drawing C1 shows the overview/location, while C2 indicates my proposed details. The wood deck is shown as appx 64'-7" x 8', 1 also show two 6' wide connector boardwalks at 90 degrees to the existing walkway. This may be sloped at 1: 12 max (handicap slope) to better connect to standard lumber sizes.
