Any violation of these terms may oe suoiecr to lines, impnsumncin ur Civil acuuiI; ut 111Sy l.auac Iuc ticluul Iv uc uual aUU Y Vl 1) This amendment authorizes a name change for this permit from Bald Head Island Limited., to Bald Head Island Limited, LLC. 2) This amendment shall be attached to the original of Permit No. 91-96, which was issued on 6/3/96, renewed on 12/8/99, 2/14/02, 2/23/04, and 12/22/05, and modified on 8/19/99, 5/22/00, and 7/16/04, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 3) All conditions and stipulations of the active permit remain in force under this amendment. This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2007 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. State Permit No. 91-96 was issued to Bald Head Island, Ltd, on June 3, 1996 for the excavation of an access channel and boat basin, marina facility with barge and ferry landings, a marine maintenance building, office and storage buildings, and parking. A minor modification was issued on August 19, 1999 for the addition of riprap and the permit was renewed on December 8, 1999. The permit was again modified on May 22, 2000 for the expansion of the marina basin and then renewed on February 14, 2002 and February 23, 2004. On July 16, 2004, it was modified for the addition of additional parking spaces. An amendment was issued on April 27, 2006 to authorize a name change to Bald Head Island Limited and amended again on September 18, 2006 to change the permit holder's name to Bald Head Island Limited, LLC. The permit will expire on December 31, 2007. Mr. Marek is requesting that the permit be modified to increase the excavation depth from -8' to a maximum of -12' MLW within the marina basin and from -10' to -12' MLW within the entrance channel. The depth of the basin would taper from -11' MLW at the southern end to a depth of -12' MLW at the basin's northern end. The taper is designed promote flushing. The dimensions of the excavation will not change, with the exception of depth; as a 4:1 slope would be maintained and the -12' depth would occur 40' off the marina's bulkhead (per Mr. Marek's calculations). The applicant has submitted a check (ck. X 1250) in the amount of $100.00 for the modification request. Mr. Marek has withdrawn his request to increase the permitted dredge depth of the channel and basin in this request This Office has no objection to the permit modification request. Box 3069 Bald Head Island, NC 28461 910-457-7517 July 20, 2007 Ms. Heather Coats NCDENR Division of Coastal Management 127 Cardinal Drive Extension Wilmington, NC 28405 Re: CAMA Permit #91-96 Minor Modification Request to Increase Depth in Deep Point Marina, Southport, NC, Dear Ms. Coats: Please use the previously submitted five copies of drawing DPM-1 dated & sealed 7-9-07, for the Bald Head Island Limited, LLC owned Deep Point Marina plus check #1250 for $100 that you already are holding for return to the Bald Head Island Limited, LLC Planning Department in order to split the marina deepening out from the 22 item minor mod that I submitted on July 9. This is a request to change the excavated (dredged) depth of the Deep Point Marina Entrance Channel from -10' MLW to -12' MLW, and the excavated (dredged) depth of the Deep Point Marina Basin from -B' MLW to -1 V MLW at the southern end, sloping to an excavated (dredged) depth of -12' at the south end of the Fuel Dock. See Drawing. The Cape Fear River Shipping Channel, which has a purported dredged depth of -42', is only 200 to 300 yards from the jetty entrance. This request is similar to my CAMA#41-85 Minor Modification approved March 19, 2007 for the Indigo Plantation Marina. Over the years, the Bald Head Island ferries have increased in size, and they now have a pair of 82' x 28' catamaran passenger ferries, which draw approximately 7' in draft to the propeller tips when fully loaded at their current 149 passenger capacities. In the future, when the Deep Point shoreside ferry terminals are upgraded to meet U.S. Coast Guard port security requirements, these vessels will have a passenger capacity of as many as 277 passengers and added draft of .3' to .4'. The requested deeper channel and marina depth is for passenger safety for the passenger ferries, as well as operational safety for the barge service and larger vessels berthing or fueling at the Deep Point Marina. This marina is just off of the Cape Fear River Shipping Channel, which has a dredged depth of 42'. Larger yachts may find this as a convenient place for safe haven in a storm. Our ferries and barge have sat out a few of the minor hurricanes and tropical storms here without incident. Note that per engineering standards, bottom profile from the marina bulkheads is usually designated at a 4H:1V slope or shallower. Assuming a mudline elevation of approximate 0' to-3'MLW, the requested depth of -12' occurs at about 40' from the marina walls. My drawing uses 0' MLW. This in essence, puts the max permitted depth at the fairways and in the ferry docking areas. However, because of propwash from the ferries, the 12' draft near the ferry docks will occur closer to the bulkhead.
