Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) Unless specifically altered herein, this minor modification authorizes the following: a. Three future retail buildings (labeled as Structures 10-12 on the attached workplan drawing), b. A restaurant (labeled as Structure 8 on the attached workplan drawing), c. A hotel, located outside of the 75' AEC (labeled as Structure 9 on the attached workplan drawing, d. A future building, located at the existing spoil basin (labeled as Structure 13 on the attached workplan drawing), e. A 6' wide wooden boardwalk adjacent to the existing bulkhead, f. Underground storage tanks located outside the 75' AEC, g. A truck wash facility located adjacent to the spoil basin, all as expressly and specifically set forth in the attached letter and workplan drawing. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910) 769-7215 for this determination. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2007 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required, including but not limited to a revised Stormwater Permit.
