conditions and stipulations of the active permit remain in force under this modification unless altered
herein.
3) This minor modification does not authorize any increase in the number of permitted boat slips.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 2001
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

Dear Sir:
Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request for modification of your permit to expand the marina basin by 23.25 feet
along the western end of the basin. The Department of the Army permit issued on July 2, 1996
authorized dredging of vegetated and non -vegetated wetlands and shallow bottom in the Cape
Fear River, adjacent to the Prices Creek Southport/Fort Fisher ferry on NC 210, east of
Southport in Brunswick County, North Carolina.
Your proposal continues to be consistent with the provisions and objectives of general
permii No. 198000291. The permit is hereby modified to include the proposed work. It is
understood that all other conditions of your permit remain applicable and that the expiration date
is April 3, 2003.

Dear Sir:
Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request for modification of your permit to construct a 10-foot extension to the
previously authorized community docking facility. The facility should not extend closer.than
140 feet from the near shore edge of the federally maintained Atlantic Intracoastal Waterway
channel. The Department of the Army (DA) permit issued on November 15, 1.999 authorized
construction of a 26-slip community marina for Register Place Estates subdivision including piers,
finger piers and a gazebo adjacent to Middle Sound near Wilmington, New Hanover County,
North Carolina.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 198000291. The permit is hereby modified to include the requested work. It is
understood that all other conditions of your permit remain applicable and that the expiration date
is December 31, 2002.
Please be advised that, pursuant to recent Wilmington District Corps of Engineers policy,
the following is a condition of your modified DA permit:
The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or
alter the structural work or obstructions caused thereby, without expense to the United States.
No claim shall be made against the United States on account of any such removal or alteration.

SUBJECT: Request for modification of State Permit #91-96 (Deep Point Marina)
Bald Head Island Management, Inc.
The applicant has submitted the enclosed plans for the expansion of the marina basin at the Deep
Point Marina project. The request is to accommodate the turning radius of the passenger ferry.
The proposed expansion calls for an increase in basin length from 721.75 feet to 745 feet. The
expansion would be at the west end of the basin.
I have no objection to the proposed modification and recommend a minor modification be issued
to authorize the change, provided their are no required changes to the approved stormwater plan.

Enclosed are five (5) copies of a new plat layout for our new mainland base in Southport
(Deep Point Marina). We are requesting a minor modification to permit # 91-96 to expand the
size of the marina basin approximately 23' to the west. The size increase is necessary to allow
adequate operating room for the passenger ferry. The comparison dimensions are shown in the
upper right hand corner of the drawing. The increase in basin size will not result in an increase
in the number of boat slips.
A check for $50.00 is enclosed as permit processing fee. Call me at 457-7326 if you need
additional information.
