BISER Secretary BRAXTON DAVIS Director Dare County c/o Dustin Peele Email: dustin.peele@darenc.com NORTH CAROLINA Environmental Quality October 26, 2022 RE: EXEMPTED PROJECT - REDISTRIBUTION OF SAND CONSISTENT WITH CURRENT RULES [15A NCAC 07K .0103(c)] PROJECT ADDRESS - Buxton Village beachfront, between Cottage Ave. and Oramar Dr. AREA OF ENVIRONMENTAL CONCERN - Ocean Erodible Dear Mr. Peele: I have reviewed the information submitted to this office by CSE concerning the proposed engineered dune repairs in response to recent erosion and have determined that the proposed activity is exempt from needing permit approval as long as it remains consistent with your site drawings dated October 25, 2022, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. MAINTENANCE AND REPAIR- [15A NCAC 7K .0103(c)]: Redistribution of sand that results from storm overwash or aeolian transport around buildings, pools, roads, parking areas and associated structures is considered maintenance so long as the sand remains within the Ocean Hazard AEC. 1. The project consists of removing excess sand from the three areas between Cottage Avenue and Oramar Drive, as indicated on the plans; 2. This exemption allows for relocated sand to be used in the repair of the storm damaged (recently constructed) engineered dune; 3. The dune shall be repaired in alignment with the remaining dune and shall not be broadened or extended in an oceanward direction beyond pre -storm dimensions; 4. Redistribution of sand shall be accomplished in such a manner that damage to existing vegetation is minimized; 5. Accumulated sand containing storm debris shall be sifted or have all debris removed prior to redistribution within an Area of Environmental Concern; 6. Work shall be conducted from the landward side of the dune; and 7. No work shall be conducted on private property without the property owner's written consent. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date of the letter.
