Good morning Ashley,
DMF has reviewed the moratorium relief request submitted in regards to the Moss East permit (CAMA Major
Permit # 115-21). The permit included a 15 February through 30 September moratorium on all in -water work.
Inclusion of this permit condition is intended to minimize impacts to resources of interest to the Division of
Marine Fisheries and Wildlife Resources Commission, including a variety of fish species. Due to the need for
different constnuction materials than what was expected, delays in construction have occurred.
DMF is amenable to granting moratorium relief through 28 February. Based on the information submitted with
the request, DMF believes that this is sufficient time to complete construction of the bulkhead portion of the
project, including removal of any water -based construction equipment.

NCWRC has reviewed the request to continue work on bulkhead installation for the Moss East project. The majority of
the work has been completed outside of the moratorium, but due to the need of different marine materials, a delay has
occurred.
The NCWRC requested the February 15 — September 30 in -water work moratorium as a permit condition to protect
primary nursery area (PNA) resources, including Atlantic sturgeon. We believe minimizing certain disturbances during
this period is a very important fishery management tool. However, due to the description of work provided, the
proposed schedule, and reported activity in the river, an allowance to work through February 28 would not cause
significant impacts. This two -week extension should provide adequate time if the project progresses as proposed.
Extended time into March would be problematic.
Thank you for the opportunity to provide comment on this request. Please continue to inform NCWRC of the project's
progression or complications if they arise.

Mr. James Stephenson Development Manager at Moss East has requested a 2-week relief from the moratorium placed
on CAMA Major Permit 115-21 for all in water work from February 15`b —September 301 of every year. They have
currently have set 940' of their permitted 1,140' of permitted bulkhead to date. They had a problem this week that will
delay the completion date of the project. They found their vinyl bulkhead sheets to be an inadequate length and have
had to order additional materials to complete the project correctly. The contractor on site said the delivery date for the
additional materials is 11-February-2022 and he would be able to complete all in water work for the bulkhead project
within the requested two -week relief window which would be March 1, 2022. Please let me know if you have any
additional questions or concerns involving this request.

I hope you are doing well. I just spoke with our Marine Contractor, TJ's Marine -Toby Tetterton. We are on the last 200
feet of bulkhead at Moss East and have hit a snag. In the last section, 16' sheets are proving to be inadequate in
length. Until now the 16' sheets have worked well. Mr. Tetterton is trying to get 20' vinyl sheets to finish up and achieve
the required resistance when driving the sheets. The delivery date of the vinyl sheet pile is scheduled for next Friday 2/11.
We would like to ask for 2 week relief in the moratorium to be able to complete the job and get out of the water. Does
your office handle this request or do I need to direct the question to someone else? Thank you for your direction with this.
