,This permit, issued on September 17, 2013 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) In accordance with commitments made by the permittee, and in order to be found consistent with the
rules of the Coastal Resources Commission, the alignment of the authorized 10'. x 16' stationary dock
shall be moved landward so that the dock extends no more than 6 feet over Coastal Wetlands.
Docking Facility
2) Unless specifically altered herein, this permit authorizes the construction of stationary platform, the
floating platform and the ramp and other structures and uses that are expressly and specifically set
forth in the permit application. No other structure, whether floating or stationary, shall become a
permanent part of this docking facility without permit modification. No non -water dependent uses of
structures shall be conducted on, in or over public trust waters without permit modification.

3) . Any portion of the docking facility built over Coastal Wetlands shall not exceed six feet in width and
shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the
decking.
The piers and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor.
No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
7) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
8) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
.,9) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
10) This permit authorizes 1 new formalized boatslip associated with this docking facility.
Bulkhead
;11) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings.
12) The bulkhead shall be constructed prior to any backfilling activities.
13) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
,14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
-1 15)' ` The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
16) All backfill material shall be clean and free of any pollutants except in trace quantities.

17) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the bulkhead cap immediately following completion of backfilling activities.
General
19) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused
thereby, without expense to the United States or the state of North Carolina. No claim shall be made
against the United States or the state of North Carolina on account of any such removal or alteration.
20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
21) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, outside of the
areas as indicated on the attached workplan drawings
22) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No.
13-0725.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No.
SAW-2013-01270 which was issued on 7/17/13.

you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113429. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

The project site consists of a canal front lot located at 134 Dolphin Drive, in the Town of Holden Beach,
Brunswick County. To get to the site from Wilmington take US Hwy 17 S to Mt. Pisgah Road. Turn left onto Mt.
Pisgah Road, Mt. Pisgah Road merges with NC Hwy 130, and continue on NC Hwy 130. Cross the high rise bridge
to Ocean Boulevard. Turn right onto Ocean Boulevard West and travel approximately 3.75 miles to Dolphin
Drive. Turn right onto Dolphin Drive and travel approximately 0.16 miles. The project site will be located on the
right.
The project site is a canal front lot that measures approximately 50 feet in width by approximately 87 feet in
depth. The elevation of the high ground area of the lot averages approximately 3.4 feet above normal high water
(NHW). High ground vegetation consists primarily of lawn grasses, woody shrubs, cedar trees, native vines, and
transitions to marsh adjacent to the shoreline. The shoreline of the property is somewhat stabilized with
vegetation, consisting of mostly woody shrubs. An identifiable erosion scarp is present along the shoreline and
is evident by an elevation change of approximately 2.5 feet. Coastal Wetlands are present water ward of the
erosion scarp and consist primarily of Smooth Cord Grass (Spartina alternaflora) along with Sea Lavender
(Limonium spp.) sparsely intermixed. The Coastal Wetlands are, on average, 20feet in width as measured from
the erosion scarp.
The adjacent shorelines have been stabilized with bulkheads. The property to the south has a bulkhead aligned
approximately 14feet water ward of the existing Normal High Water (NHW) boundary of the project site. The
adjacent shoreline to the north has been stabilized with a bulkhead that is aligned approximately 3 feet water
ward of the NHW boundary of the project site. The NHW boundary on the adjacent properties is located along
the bulkheads with approximately 10 feet of Smooth Cord Grass present water ward of the bulkhead.
The project site is currently undeveloped and not serviced by any utilities. -The Holden Beach Land Use Plan
classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as
Residential. There are no known archaeological sites within the project vicinity. The waters of the AIW W are
classified SA by the Division of Water quality and are NOT designated as a Primary Nursery Area (PNA) by the
N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to construct a private docking facility, install approximately 50 linear feetof bulkhead
and fill approximately 100 sq. ft. of coastal wetlands. The bulkhead backfill would consist of approximately 100
square feet of coastal wetlands, primarily Smooth Cord Grass (Spartina alterniflora), located below Normal High
Water and approximately 220 square feet of tidal flat. As proposed, the bulkhead would be installed, on
average, 2 feet water ward of the NHW boundary. The bulkhead would have a maximum alignmentof
approximately 7 feet water ward of the erosion scarp. As proposed, the bulkhead alignment would connect to
the existing bulkhead of the adjacent riparian property to the north and would be located 14' landward of the
bulkhead of the adjacent riparian property to the south. As proposed, the bulkhead would measure
approximately 50 feet in length. The limits of disturbance would be located approximately 30 feet landward of
the proposed bulkhead alignment The applicant is also proposing to construct a docking facility originating from
the center of the lot along the proposed bulkhead. The proposed docking facility would have a fixed platform
measuring approximately 16 feet wide by 10 feet long and would be located over Coastal Wetlands. The access
pier would connect, by ramp to a floating dock that would measure approximately 8 feet in width by 16 feet in
length. As proposed, the docking facility would be in alignment with the adjacent docking facilities, would not
exceed the established pier head line and would maintain the 15 foot riparian corridor setback from both the
adjacent properties.

10. ANTICIPATED IMPACTS
The proposed new bulkhead construction with associated backfill and tie back/anchor system would result in the
filling of approximately 100 square feet of coastal wetlands and estuarine waters. The bulkhead backfill would
consist of approximately 100 square feet of coastal wetlands, primarily Smooth Cord Grass (Spartina
alterniflora), located below Normal High Water and approximately 220 square feet of tidal flat located above
NHW. The proposed, bulkhead construction would result in the disturbance of approximately 1,500 square feet
of high ground. As proposed the docking facility would result in the shading of approximately 160 square feet of
coastal wetlands and the incorporation of approximately 128 square feet of Estuarine Waters AEC. As proposed
the docking facility would provide mooring for two (2) vessels. Minor increases in turbidity should be expected
during construction. The proposed docking facility would not encroach into either adjacent riparian property
setback nor would it exceed the established pier head line.

threshold for written authorization as long as all conditions of General Water Quality Certification
Number 3885 (GC3885) are met. This certification may also be viewed on our website at

Nationwide 13 Permit when issued by the US Army Corps of Engineers.
This approval is only valid for the purpose and design that is described in your application. If
you change your project, you must notify us and you may be required to send us a new
application. If the property is sold, the new owner must be given a copy of this Certification and
approval letter and is thereby responsible for complying with all conditions. If total wetland fills
for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h) (6) and (7). This approval shall expire when the
corresponding Regional General or Nationwide Permit expires or as otherwise provided in the

Application for the subject project on July 11, 2013. Staff review of the plans and specifications has
determined that the development activities proposed at this time will not pose a threat to surface water

Otecommendations for State Permit— Carl and Lisa Kellis
It is the staffs recommendation that the proposal to construct a bulkhead with coastal wetland fill is CONS] STENTwith
the Rules of 15A NCAC 07H.0208 (7) Bulkheads which requires that bulkhead alignment shall approximate mean high
water or normal water level and shall be landward of significant marshland or marsh grass fringes. It also states that
bulkheads shall be permitted below approximate mean high water or normal water level only when the following
standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results
from natural causes or adjacent bulkheads, or it has unusual geographic or geologic
features, e.g. steep grade bank, which will cause the applicant unreasonable hardship RECEPRD
under the other provisions of this Rule;
(ii) the bulkhead alignment extends no further below approximate mean high water or JUL 1 6 2l))3
normal water level than necessary to allow recovery of the area eroded in the year prior
to the date of application, to align with adjacent bulkheads, or to mitigate the
unreasonable hardship resulting from the unusual geographic or geologic features; DCMMBDCITY
(iii) the bulkhead alignment will not result in significant adverse impacts to public trust
rights or to the property of adjacent riparian owners;
(iv) the need for a bulkhead below approximate mean high water or normal water level is documented
in the Field Investigation Report or other reports prepared by the Division of
Coastal Management; and
(v) the property to be bulkheaded is in a nonoceanfront area.
The applicants property does have an identifiable erosion problem, probably caused from storm water runoff and/or the
effects of the adjacent bulkheads. The proposed bulkhead will extend no further below NHW than necessary to align
with the adjacent bulkhead to the north. The alignment should not result in significant adverse impacts to public trust
rights or to the property of the adjacent riparian property owners because the bulkhead will not extend beyond the
adjacent bulkheads and because both adjacent properties are already bulkheaded. The bulkhead would need to be
located below NHW in order to connect to the adjacent bulkhead to the north. This is a nonoceanfront area.
Based on these factors, it is recommended that a permit be issued to authorize the construction of bulkhead as proposed
in the applicant's submittal. It is our opinion that the wetlands present in the eroded area adjacent to the existing
bulkhead and along the remainder of the bulkhead alignment are not considered a significant marsh grass fringe and are
in this area as a result of recent shoreline erosion.
The Town of Holden Beach has adopted ordinances found in the Land Usage Section of the Code of Ordinances 157.025
(D) which states "bulkheads are required on all canal lots. Every property located in Holden Beach must be brought into
compliance with this requirement by February 10, 2012." The applicants proposal to construct a bulkhead would bring
to lot into compliance with the local ordinance.
It is the staffs recommendation that the proposal to construct a private docking facility is INCONSISTENT with the Rules
of 15A NCAC 07H.0208(6)(C) Pier and Docking facilities which states piers and docking facilities over coastal wetlands
shall be no wide than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured
from the bottom of the decking. As proposed the docking facility platform would exceed the six foot width requirement.
It is therefore recommended that the platform be reduced insize or the permit conditioned so that the facility not
exceeds six feet in width over coastal wetlands.
It is staffs recommendation that the proposal to construct a private docking facility and bulkhead are CONSISTENT with
the Rules of 15 NCAC 7H.0205 (d) Use Standards for Coastal Wetlands, Rules of 15 NCAC 7H.0206 (d) Use Standards for
Estuarine Waters, Rules of 15 NCAC 71-1.0207 (d) Use Standards for Public Trust Areas.

Any permit issued should include the following conditions: e
1. The bulkhead alignment will approximate the mean high/norrm"al waterlevel at the time of
construction
2. The alignment of the authorized bulkhead must be staked by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction
within 30 days, or erosion of the shoreline by adverse weather conditions will require the alignment to be
restaked by DCM within a maximum of 30 days prior to the new expected start of construction.
3. The bulkhead must be constructed prior to any backfilling activities
4. The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure
S. The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation is permitted except for that which may
be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not
authorize any excavation waterward of the approved alignment.
6. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic
materials, or unsightly debris will not be used.
7. All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead.
8. No backfill material is to be placed within 30 feet of the normal high water line, except that which will be
used to backfill the area behind the permitted bulkhead.
9. In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
10. This permit does not authorize the interference with any existing or proposed Federal project, and, the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
12. Future development on the permittee's property may require a modification of this permit. Contact a
representative of this Division at (910) 796-7215 prior to commencement of any such activity for this
determination.
13. The construction of the proposed project shall be in compliance with all local, State and Federal
regulations and associated permit conditions.
14. This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structures, whether
floating or stationary, may become a permanent part of the structure without permit modification. No
non -water dependent uses of structures may be conducted on, in, or over public trust waters without
permit modification.
15. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

16. The authorized structure and associated activity must not cause an unacceptable interference with
navigation and shall not exceed the established pier head line.
17. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the
U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
18. The pier/boathouse and associated structures shall have a minimum setback distance of 15 feet between
any parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the waters edge.
19. This permit does not authorize the interference with any existing or proposed Federal project, and, the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
20. The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
project without having the permit transferred to a third -party.
21. This permit authorizes a maximum of two (2) boat slips. At no time shall more than two (2) vessels be
moored or docked at the facility. The restriction of the number of vessels shall apply to all marine
vessel types, including but not limited to motorboats, sailing vessels and personal watercraft.
22. The pier/docking facility shall not exceed six feet in width over any portion of coastal wetlands.

Consistency: This project isnconsistent,with the Town, of Holden4Beach Land Use
Plan update.
The applicant proposes to construct a private docking facility and install approximately
50 linear feet of bulkhead and fill approximately 100 sq. ft. area of coastal wetlands. The
project is located at 134 Dolphin Drive in the Town of Holden Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine
Shoreline and Coastal Wetlands.
Waters at the project site are classified as SA and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Holden Beach Land Use
Plan and offer the following comments.
The general area of the project is classified Residential, while the AECs impacted are
classified as Conservation.
In general, the Town of Holden Beach allows development in Conservation classified
AECs, which is consistent with the State's minimum use standards. The Town of Holden
Beach Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
This project appears to be consistent with the Town of Holden Beach Land Use Plan.

The enclosed Major CAMA Permit application is for the proposed
construction of a bulkhead to facilitate shoreline stabilization.
The proposed alignment will utilize existing bulkheads located on each side

Per our discussion can you please include the proposed docking facility in the narrative and on the MP-4 Structure form
indicating the dimensions. Please clarify the nearest waterbody as a man-made canal which is closest to the major
waterbody -AIWW (MP-1 No.1 b and d). Also would you please clarify the total land disturbed area MP-1 No. 5.f this
usually includes the tie back system and the in water fill. My approximate measurements show more than 100 square
feet of fill below high water (MP-2 No. 3.g) it is also very helpful to have those dimensions of the in water and high
ground fill associated with the bulkhead on the plan view drawing itself. You can include those dimensions in a note to
me so that you don't have to modify the drawing and send that in. The other forms should be simple to correct and

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required by NCGS
113A-119(b) that an application for development permit in an Area of Environmental Concern as designated
under the CAMA was received complete on June 25, 2013.
According to said application, Carl & Lisa Kellis propose to construct a docking facility and
bulkhead at 134 Dolphin Dr., adjacent to a canal off the AIWW, in Holden Beach, Brunswick County. A
copy of this entire application may be examined or copied at the office of Holley Snider, N.C. Dept. of
Environment and Natural Resources, Division of Coastal Management, 127 Cardinal Drive Extension,
Wilmington, North Carolina 28405, (910-796-74215) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to August 3, 2013, will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice of
the permit decision in this matter will be provided upon written request.
