Authorized Development 1) Unless specifically altered herein, this permit authorizes the construction of a t10,200 ftz retail building with a detached t1,792 ftz 5-bedroom house, a 56-space paved parking lot, a bulkhead, and a pier all as depicted in the attached permit application and workplan drawings. Holdings, LLC c/o Israel Golasa Permit # 83-13 Page 2 of 3 ADDITIONAL CONDITIONS Stormwater Management 2) The Division of Water Quality approval of this project under stormwater management Hiles of the Environmental Management Commission is covered by way of Stormwater Permit No. SW7130613, which was issued on 6/28/13. Any violation of the permit approved by the DWQ shall be considered a violation of this CAMA permit. Sedimentation and Erosion Control NOTE: The permittee has received a Sedimentation and Erosion Control Plan from the NC Division of Energy, Mineral, and Land Resources (Project No. DARE-2013-014). Should the permittee choose to modify/amend the existing Sedimentation and Erosion Control Permit, he or she should contact the Department of Environment and Natural Resources; Land Quality Section, at 943 Washington Square Mall, Washington, NC 27889. 3) In order to protect water quality, runoff from the construction shall not visibly increase the amount of suspended sediments in adjacent waters. 4) Appropriate sedimentation and erosion control devices, measures or structures (e.g. silt fence, diversion swales or berms, etc.) shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and/or properties. Bulkhead 5) The bulkhead shall be constructed at or landward of the normal water level at the time of construction. 6) The bulkhead shall. be constructed prior to any backfilling activities, and the bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The bulkhead shall be solid and constructed of treated wood, concrete slabs, vinyl or metal sheet piles or other suitable materials approved by Division personnel. 8) The backfill material shall be clean and free of any pollutants except in trace quantities. 9) All backfill material shall be obtained from a highground source and confined behind the permitted bulkhead. No other structure, whether floating or stationary, shall become a permanent part of the permitted project without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 12) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. RECEIVED 13) No formalized slips are authorized by this permit. The permittee is not relieved of this requirement if he/she abandons the permitted activity without having it transferred to a third party. 15) No vegetated wetlands or open water areas shall be excavated or filled, even temporarily, without permit modification. 16) The permittee and/or his/her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required including but not limited to a driveway connection permit from the NC Department of Transportation. NOTE: Future development of the pemuttee's property may require a modification of this permit. Contact a representative of the Division at (252) 948-3852, prior to commencement of any such activity for this determination. In addition, any development or land disturbing activity that is considered non -water dependent is not authorized within 30 feet of the normal water level unless specifically exempted by Coastal Resource Commission (CRC) regulations. NOTE: Engineers and Contractors should be aware of utility locations within the project area. Please contact the local water utility to assist with the location of existing water mains in or near the project area. NOTE: The N.C. Division of Water Quality has determined the project is in compliance with North Carolina's Water Quality Certification Program and has issued General 401 WQ Certification #3900 on 7/9/13 and it was assigned project #13-0644. NOTE: The U.S. Army Corps of Engineers has assigned the proposed project AID No. SAW-2013- 01154 and authorized the development via Regional General Permit 198000291. The subject site is approximately 1.45 acres in size and is owned by the Town of Aurora. Although the Town of Aurora owns the property the NC Wildlife Resources Commission (WRC) maintains an existing public boat ramp facility at this location. The property is located on the western side of South Creek with approximately 811 linear feet of shoreline. The existing boat ramp and parking is located on a peninsula that is bordered by man-made canals on both the northern and southern sides. Existing man-made features on the property include a boat ramp, launch pier with dock, gravel and asphalt parking area, bulkhead, riprap shoreline stabilization and a fishing pier. Based on borings by the WRC the entire peninsula consists of fill material comprising of gravel, shells in addition to the asphalt pavement. Vegetation on the property includes upland yard grass and ornamental shrubs. Both the southern (upstream) and northern (downstream) adjacent properties are vegetated with coastal wetlands. Water depths are approximately 6.0' below Normal Water Level (NWL) at the waterward end of the existing boat ramp. A cursory review of the near shore area did not reveal any submerged aquatic vegetation. The Environmental Management Commission classifies the waters of South Creek in this area as class C Sw NSW waters. South Creek is classified as inland fishing waters at this location, is not open to shell fishing and is not a primary nursery. Project description The applicant proposes to renovate the existing boating access area. The following is proposed: 1. The existing boat ramp will be removed. The applicant proposes to construct two 15' (38' total boat ramp width) wide concrete boat ramps with an 8' wide by 60' long floating dock separating the two ramps. The new ramps will be located in the same location as the existing boat ramp. The boat ramp will extend approximately 45' into South Creek. A concrete apron will extend approximately 45' landward of the NWL. 2. The property has three sections of bulkhead which measure 390 feet, 157 feet and 217 feet. The bulkheads will be replaced in each of these three sections. The alignment of the new bulkheads will be 2' waterward of the existing bulkheads. 3. The existing launch pier and associated dock on the downstream (northern) side of the boat ramp will be removed. A new floating pier with a concrete abutment will be installed approximately 40' downstream of the boat ramp. If the permit is issued staff suggest the following conditions: 1. The authorized structures and associated activity shall not cause an unacceptable interference with navigation. 2. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. 3. Disturbed areas will, within fifteen (15) working days or thirty (30) calendar days of completion of any phase of grading, whichever period is shorter, be planted or otherwise provided with ground cover sufficient to restrain erosion. 4. The bulkhead alignment shall be no farther waterward than 2' as measured from the outside of the existing sheet to the outside of the new sheeting. The bulkhead shall be constructed prior to any backfilling activities. The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6. No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing(s). The concrete boat ramp shall be poured on high ground and pushed or placed into the water once hardened, or the applicant shall provide information on other construction methodologies that will be considered for approval on a case -by -case basis by Division of Coastal Management personnel. The existing property consists of the Main Street public right-of-way and five parcels owned by the Town of Aurora. The site is contains an existing boat ramp, parking lot, and fishing pier. This project involves the renovation of the existing NCWRC boating access area. The existing ramp, parking lot, and dock will be removed. The existing bulkhead that surrounds the peninsula will also be replaced. The existing fixed wooden fishing pier will remain, however. The BAA will consist of two single lane launch ramps with a floating dock between the ramps. There will also be a floating courtesy T-dock installed. Uphill from the ramps, the existing parking lot will be renovated. Upon completion, it will consist of two single vehicle parking spaces and 22 trailer parking spaces. Impervious Surface Calculations: Based on soil borings, the material used to construct the peninsula consists of gravel and shell just below the ground surface. In addition, the majority of the unpaved area has been parked on at one point or another due to an insufficient number of paved parking spaces. As a result, the entire project area will be considered impervious. Because of these findings and interpretation, the project will not cause an increase in impervious surface despite the increase in the amount of asphalt pavement. Dredging: No dredging is proposed for this project. The only work required in the water will be the removal of the existing ramp and the installation of the new concrete ramp and stone base. RSCENED SEP 16 21113 Grading: The total amount of earthwork for this project will be approximately 700 cubic yards. This includes rough and fine grading, preparing the subgrade of the drive aisles and parking lots, and any fill that needs to be brought to the site as well as any excess that may need to be hauled off. Any spoil material that will be generated should consist primarily of the existing asphalt which will either be disposed of at the nearest landfill or recycled. If another site is found or needed, we will inform DCM and submit the necessary information or make the necessary revisions to obtain approval to use the site. The total disturbed area of this project is approximately 49,000 sf (1.12 acres). Upland Excavation and Earthwork: The upland excavation on this site will be to reach the proposed subgrade for the drive aisles and parking lots. Additional excavation may be necessary due to unsuitable soils. However, this will not be known until construction begins. Existing Stormwater Conditions: Currently, runoff from the site enters two existing storm drain inlets in the parking lot. These inlets drain directly into South Creek via 4" pipes. The portion of the site that does not enter the inlets drains into South Creek by overland flow down the existing ramp, to the existing rip rap lined shoreline, and toward the western end of the existing bulkhead on the north side of the peninsula. Proposed Stormwater Conditions: The proposed project will not alter the current drainage patterns. The existing inlets and 4" pipes will be replaced/upgraded to handle the runoff. Currently, the pipes are undersized. The new pipes will discharge in the same locations as the existing pipes, so no new discharge points will be created as a result of the proposed development. Following development, a portion of the site will still drain to the existing rip rap lined shore line and the western end of the bulkhead on the north side of the peninsula. The ramp will be graded to minimize the amount of area that drains directly into the creek to just the ramp itself No upland areas will drain down the ramp. Ramps/Docks: The proposed project includes the construction of two, single lane launch ramps. Each land will be 15' wide, for a total width of 30'. The will be an 8'x60' floating dock between the ramps. A floating courtesy T-dock with an 8'x52' walkway and 8'x48' tee will be provided at the end of the peninsula. Holdings, LLC, has requested the attached application be processed under the Express Permit Review Program, for construction of a commercial retail building under the name of I. G. Holdings, LLC. The project site is located at 24530 NC 12 in the Village of Rodanthe adjacent the Pamlico Sound in Dare County, North Carolina. The Pamlico Sound is classified as Public Trust Area and Estuarine Water Areas of Environmental Concern (AECs), with the corresponding designated Coastal Shoreline AEC (75' Estuarine Shoreline). The proposed project site is ±1.75 acres and was a commercial recreational vehicle storage lot. The site has ±160' of shoreline and it is armored with large broken concrete riprap along the entire length. A ±60' long riprap groin straddles the northern property line. Near the center of the lot is a large concrete pad on which a building previously existed that was destroyed in Hurricane Irene in 2011. A gravel drive enters the site from NC 12, loops around the building and has an expanded parking area along the south side of the old building site. The remainder of the site is vegetated with upland grasses. The property has a chain link fence along NC 12 and down both property lines that stops short of the water. The property is bordered to the north by commercial development (Kitty Hawk Kites), which has a bulkheaded shoreline and ±130' long pier. An old amusement park site (Water Fall Park) borders the site to the south. It has a shoreline stabilized with broken concrete similar to the project site but the structures on the upland portion of this site were damaged by Hurricane Irene and have not been repaired. The project site has an existing elevation of ±5'. Pamlico Sound at this location is classified as SA;HQW by the Environmental Management Commission. The area is open to the harvesting of shellfishing. Project description The applicant proposes to construct a ±10,200 ft2 (60' by 170') retail building on the site with a detached ±1,792 ft2 (28' by 64' footprint) 5-bedroom house for the employees. The existing elevation of the property at the building location will be raised ±6' for a finished floor elevation of ±10.7'. A 56-space concrete paved parking lot is also proposed as well as a driveway connection to NC 12. The applicant proposes to cor14truct a wastewater system utilizing a standard LPP system. The bulkhead alignment will be located at the normal water level along the shoreline. Along the southern property line the applicant proposes a 50' long return wall. A 6' wide by 130' long pier is proposed including a 16' by 25' L-Head platform. A 6' wide by 54' long wooden boardwalk access is proposed from the bulkhead to the proposed parking area. Existing water depth at the end of the proposed pier is 1.8' below normal water level. No impervious surface is proposed within 30' of the Pamlico Sound. The total amount of disturbance for the project site is t1.8 acres (t78,408 ft2), which is the entire site plus a portion of the NC DOT right of way for the driveway connection. The total impervious coverage for the site is ±37,634 ft2 or 49.4%. As proposed, ±840 ft2 of impervious surface will be located within the 75' Coastal Shoreline Area AEC associated with the concrete parking area. No impervious surface is proposed within the 30' Coastal Shoreline Buffer. Anticipated impacts The project as proposed will result in the disturbance of ±78,408 ft2 of uplands. Approximately 840 ft2 of impervious surface within the Coastal Shoreline AEC will result from the installation of the paved parking area. Croatan Hwy, Nags Head, NC, 27949 June 4, 2013 DCM-MHDCPPY Existing Conditions: IG Holdings, LLC has recently purchased a 1.73 acre site in the Village of Rodanthe on Hatteras Island in Dare County. Prior to the purchase, the site was operated (under previous ownership) as "Boyce Storage", serving as a storage facility for large vehicles, campers, etc. The site is adjacent to the Pamlico Sound (SA, HQW classification) and has approximately 160' of sound frontage. The Natural Resource Conservation Service Soil Survey for Dare County has mapped the soils on the site to consist primarily of Corolla Fine Sand, with a small portion Corolla — Duckston Complex along the southeast corner of the parcel. The majority of the site is between 3 and 6 feet above sea level (NAVD 1988). The west side of the site of the site slopes to sea level and the shoreline is lined with rip -rap consisting of large broken concrete for stabilization of the shoreline. Portions of the shoreline have a sandy beach in front of the rip -rap (above NWL). A large raised building foundation is located within the center of the site, with much of the surrounding areas containing gravel access roads previously used for the vehicle/trailer storage. The remainder of the site is sandy with areas of sparse vegetation consisting of native weedy ground cover. The property is within a flood zone of AE-8 & AE-9. Shoreline protection along the adjacent parcel to the north (Kitty Hawk Kites) consist of a wooden bulkhead, while the parcel to the south has rip -rap along the shoreline. Proposed Development: IG Holdings, LLC intends to redevelop the property to construct a new 10,200 sf retail building, a five -bedroom house and a parking lot. All the existing gravel and paved surfaces will be removed. An on -site septic system consisting of a septic tank, pump tank and LPP drainfield will serve both facilities, which will be permitted through the Dare County Health Department. Domestic water will be provided through a connection to the existing Dare County watermain along the west side of NC-12. Stormwater will be directed to an infiltration basin along the northern property line. A new bulkhead will be provided for shoreline protection. A pier with a platform at the end will also be provided. CAMA Permitting Items: The Pamlico Sound is jurisdictional waters that include an AEC of 75' from the shoreline. Development within the AEC includes the installation of a bulkhead (including grading to backfill the bulkhead) and pier as well as the construction of a portion of the parking lot and house. The bulkhead will be timber with anchor rods and deadmen, and will extend vertically to an elevation of 5' above msl.
