Reef Road, Washington , as requested in the permittee's application dated 2/12/13, including the attached workplan drawings (2), both dated 2/13/13 This permit, issued on Ma"h IS, 21113 is subject to compliance with the, application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes the installation of a single -pole jet ski lift to the existing docking facility, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee David Howdy Permit 07-13 Page 2 of 3 ADDITIONAL CONDITIONS 3) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 4) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury Which may be caused from existing or future operations undertaken by. the United States in the public interest. '5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise; on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure'in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes I new formalized boatslip for a total of 3 formalized boatslips at this docking facility. General 7) The permittee understands and agrees that, if future operations by the United States requires. the removal, relocation, or other alteration of the structure or work authorized' by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work 'shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due. notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the •Division at (9,10) 796-7215 prior to the commencement of any such activity for this determination. NOTE: The permittee is advised that many development or land disturbing activities are not allowed within the Environmental Management Commission's "Tar/Pamlico River basin. The project site is a single-family residential lot with a natural shoreline located off SR 1322 at 943 Swan Point Reef Road on the Pamlico River near the City of Washington in Beaufort County, North Carolina. The lot, which is actually located on Swan Point, is approximately 0.5 acres (22,000 ftz) in size and has approximately 150 linear feet of shoreline. Man-made features on the lot include a single-family residence, 116' long pier with a f16' by ±16' L-head platform, two uncovered boatlifts and three groins. Water depth at the terminal end of the pier structure is approximately -6.0' below Normal Water Level (NWL). The existing number of slips is two. Landward of the NWL the elevation gradually slopes upward to an approximate elevation of t4' above the NWL. The lot is mostly vegetated with lawn grasses and ornamental shrubs. Both adjacent properties on the upstream (northwest) side and downstream (northeast) side are developed lots with natural shorelines and single family dwellings which have piers. Both the adjacent properties are similarly vegetated lawn grasses and ornamental shrubs with the exception of the downstream property containing a stand of Spartina Cynosuroides. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River at this location is designated Coastal Waters and is not open to shell fishing. Project description The applicant proposes to attach an uncovered±10' by t6' Personal Watercraft (PWC) lift to an existing piling beside the pier approximately 50' waterward of NWL. The addition of the PWC lift will bring the total number of slips to three. The water depth at the proposed location of the PWC lift is approximately -3.5' below NWL. Anticipated impacts The project will not result in localized turbidity because the lift will be attached to an existing piling. The PWC lift will result in a total shading impact of ±60 ft2. The lot, which is actually located on Swan Point, is approximately 0.5 acres (22,000 ftz) in size and has approximately 150 linear feet of shoreline. Man-made features on the lot include a single-family residence, 116' long pier with a f16' by f16' L-head platform, two uncovered boatlifts and three groins. Water depth at the terminal end of the pier structure is approximately -6.0' below Normal Water Level (NWL). The existing number of slips is two. Landward of the NWL the elevation gradually slopes upward to an approximate elevation of t4' above the NWL. The lot is mostly vegetated with lawn grasses and ornamental shrubs. Both adjacent properties on the upstream (northwest) side and downstream (northeast) side are developed lots with natural shorelines and single family dwellings which have piers. Both the adjacent properties are similarly vegetated lawn grasses and ornamental shrubs with the exception of the downstream property containing a stand of Sparrina Cynosuroides. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River at this location is designated Coastal Waters and is not open to shell fishing. The project site is a single-family residential lot with a natural shoreline located off SR 1322 at 943 Swan Point Reef Road on the Pamlico River near the City of Washington in Beaufort County, North Carolina. The lot, which is actually located on Swan Point, is approximately 0.5 acres (22,000 ftz) in size and has approximately 150 linear feet of shoreline. Man-made features on the lot include a single-family residence, 116' long pier with a ±16' by f16' L-head platform, two uncovered boatlifts and three groins. Water depth at the terminal end of the pier structure is approximately -6.0' below Normal Water Level (NWL). The existing number of slips is two. Landward of the NWL the elevation gradually slopes upward to an approximate elevation of t4' above the NWL. The lot is mostly vegetated with lawn grasses and ornamental shrubs. Both adjacent properties on the upstream (northwest) side and downstream (northeast) side are developed lots with natural shorelines and single family dwellings which have piers. Both the adjacent properties are similarly vegetated lawn grasses and ornamental shrubs with the exception of the downstream property containing a stand of Spartina Cynosuroides. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the proj ect site. The Pamlico River at this location is designated Coastal Waters and is not open to shell fishing. Proiect description The applicant proposes to attach an uncovered f 10' by f6' Personal Watercraft (PWC) lift to an existing piling beside the pier approximately 50' waterward of NWL.
