It came to my attention on Saturday, December 6, 1997, lue Water �y}annaaoo
Brunswick County, North Carolina has applied for a 30 foot extension eir dock an
mooring facilities.
I have a house at 6318 Kings Lynn Drwe which is approximately 300 yards below the
Marina on the inlet. My access to the intercostal waterway is dependant upon me negotiating
between the reefs and the Marina. At best, with the current space between the reef and Marina
my approach and departure is risky and perilous because of the width and depth of the water
between the reefs and Marina.
If the Blue Water Point Marina is granted the extension., the number of boats and
decreased availability of suitable navigable water will cffectively restrict my capability of
coming in and out of my house to the water.
Please give this information careful consideration when reviewing the application for the
Blue Water Point Marina.

By copy of North Carolina Department of Environment and Natural
Resources letter to you of March 2, 1998, we have learned that State
authorization for you to extend and rearrange boat slips, finger piers, and
docks in the Blue Water Point Marina facility in the Eastern Channel, Long
Beach, Brunswick County, North Carolina, has been denied. Under the
administrative rules of our regulatory program, A—miazLal of required State
authorization precludes favorable consideration of ed4ral permit.
Accordingly, your Department of the Army application is hereby denied, and
your file has been retired.
If you wish to continue to pursue a DA permit, you must obtain the
required State authorization. In the event you obtain the authorization, we
will reopen your permit file, and continue to process your application. After
the file is reopened, any issues raised during the public review process must
be addressed before a permit can be issued.

Based on the joint state and Federal agency review, the Division of Coastal
Management has made the following findings:
1) The existing docking facility extends a maximum of 133 feet into the 400
foot wide water body.
2) The existing marina allows for adequate access to deep water.
3) Three individuals have objected to the pier extensions on the grounds that
the extensions would have an adverse impact on their navigational usage
of the public trust waters adjacent to the project site.
4) Because the proposed project would extend more than one-third of the way
across the water body, the proposed project has been determined to be
inconsistent with T15A:07H.0208(b)(6)(C)(iii), which states that "Piers
shall be designed to minimize adverse effects on navigation and public
trust use by not extending more than one-third the width of a natural water
body or man-made canal or basin."
5) The proposed project has been determined to be inconsistent with
T15A:07H.0208(b)(5)(H), which states that "Marinas shall be designed to
minimize adverse effects on navigation and public use of public trust areas
while allowing the applicant adequate access to deep waters."

6) In that the proposed development has been determined to be inconsistent with the rules of
the Coastal Resources Commission, the proposed project must also be found inconsistent
with the Town of Long Beach Land Use Plan.
Given the preceding findings, it is necessary that your request for a permit under the
Coastal Area Management Act be denied. This denial is made pursuant to N.C.G.S. 113A-
120(a)(8), which requires permit denial for projects inconsistent with the state guidelines for
Areas of Environmental Concern or the local land -use plan.
If you wish to appeal this denial, you are entitled to a hearing. The hearing will involve
appearing before an Administrative Law Judge who listens to evidence and arguments of both
parties and then makes a recommendation to the Coastal Resources Commission. Your request
for a hearing must be in the form of a written petition, complying with the requirements of
§ 150B of the General Statutes of North Carolina, and must be filed with the office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447, (919) 733-2698, within
twenty (20) days from the receipt of this letter. A copy of this petition should be filed with this
office.
Also, you should be advised that as long as this state permit denial stands, your project
must be deemed inconsistent with the N.C. Coastal Management Act Program, thereby
precluding the issuance of Federal permits for this project. The Federal Coastal Zone
Management Act (CZMA) gives the right to appeal this finding to the U.S. Secretary of
Commerce within thirty (30) days of receipt of this letter. Your appeal must be based on the
grounds that the proposed activity is (1) consistent with the objectives or purposes of the CZMA,
or (2) is necessary in the interest of national security, and thus, may be federally approved.

The proposed project is not consistent with theigam E (7H.0208b6C) for length of piers. The existing
marina docks extend 133.3 feet into the 400 feet wide water body. Given this inconsistency and the
number of objections submitted from area property owners and boaters, I recommend that the marina
dock expansion request be denied.

Carolina.
The North Carolina Wildlife Resources Commission has reviewed the project for impacts
to wildlife and fishery resources. A site visit was made on February 18, 1998. Our comments are
provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401,
as amended; 16 U.S.C. 661 et seq.) and the Coastal Area Management Act (G.S. 113A-100
through 113A-128).
The applicant is seeking a modification to his existing permit allowing extension of the
marina docks an additional 29 ft. into Eastern Channel, adjacent to the AIWW. Area waters are
classified SA and open shellfishing waters are adjacent to the site. Our primary concerns are
related to the project's encroachment on open shellfishing waters and the navigation channel. The
dock extensions could 'increase the area of shellfish closure and may also exceed the "1/3 rule" for
Eastern Channel. Based on these concerns, we recommend that any permit modification be
conditioned as follows.
1. Dock extensions do not result in additional shellfish closure.
2. Dock extensions conform to the "1/3 rule".

On February 11, 1991, we renewed general permit No. 19800'0'pv (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received January 23, 1998, for Department
of the Army authorization to extend previously permitted docks and finger
piers, and rearrange boat slips and finger piers for the purpose of
accomodating larger boats, in the Eastern Channel adjacent to the Intracoastal
Waterway, Long Beach, Brunswick County, North Carolina, indicates it to be a
candidate for Federal authorization under this general permit. Accordingly,
the administrative processing of your application will be accomplished by the
North Carolina Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act,
has been assigned Action ID No. 199800735. It will be coordinated by the

This permit consistency opinion is based on my review of the Mickey/Blue Water Point Marina
permit application, the Field Investigation Report (E.F.Brooks, 1/7/97), and my understanding and
interpretation of the policies presented in the Town of Long Beach Land Use Plan.
The applicant is requesting a permit to allow him to maintain adequate navigable water depths
within the Blue Water Point Marina basin and entrance channel which provides access to and from
the ICWW. The location and complete description of the project are in the Field Investigation
Report.

Estuarine Shoreline: (b) Long Beach will use all available means of law to restrict the use of
estuarine shoreline areas for purposes where there is a substantial chance of pollution

Residential Commercial. and Industrial Development Impacts on Resources:
(a) In recognition of the importance of estuarine and public trust waters for fisheries and related
industries as well as aesthetics, recreation and education, Long Beach shall promote the
conservation and quality of estuarine and public trust waters. Residential and commercial
development which meets 15A NCAC 7H minimum use standards, Long Beach zoning
requirements, and the policies contained in this plan will be allowed in estuarine shoreline,
estuarine water, and public trust areas ... (IV-9)
Assistance in Channel Maintenance: Long Beach will support efforts of the US Army Corps of
Engineers and state officials to provide proper channel maintenance. However, the town opposes
the establishment of any dredge spoil sites within its jurisdiction, with the exception of
useable spoil material for beach renourishment.(IV-15)
CONSISTENCY OPINION:
This project will be consistent with the Town of Long Beach Land Use Plan policies when all
comments submitted by the public and state review agencies have been considered and all permit
conditions met. The Town does have a prohibition against establishing permanent spoil sites within
its jurisdiction (see above). It is understood that this is a temporary spoil site and that, once de -
watered, the fill will be taken off site.

The project site is the existing Blue Water Point Marina and Motel facility, located at the end of West
57th Place Dr.,adjacent to Eastern Channel, in Long Beach, in Brunswick County, NC. The facility
consists of the marina docks (approximately 76 slips), with fuel service, and the adjacent motel,
restaurant, and associated parking. The 2.3 acre site is divided by West 57th Place Dr. which terminates
with a public boat ramp into Eastern Channel.The motel and restaurant are located on the east side of the
street and parking and above ground fuel storage tanks are located on the west side of the street.
The waters in the project area are classified as SA by the NC Division of Water Resources. The shellfish
closure line across the mouth of Davis Creek includes the marina basin and all waters of Davis Creek,
east of Blue Water Point Marina. The waters of Eastern Channel to the west of the marina, and north to
the Atlantic Intracoastal Waterway, are OPEN to the harvest of shellfish. The waters within the project
area are not designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The
width of the water body at the marina site varies from 320 to 400 feet across Eastern Channel, and
approximately 400 feet across Davis Creek.
The applicant is requesting authorization to relocate the marina's system of floating docks 29 feet
waterward (north) of their present location, to allow for larger boat slips on the south side of the floating
docks. The applicant proposes to lengthen the two access docks, perpendicular to the shoreline, an
additional 29 feet. The extension to the dock east of the boat ramp would be 29 feet long and 10 feet
wide, and the western dock extension would be 29 feet long and 8 feet wide. The applicant proposes to
widen the boat slips of the eastern docking system from 12.5 feet and 14 feet, to 16 feet. This would
require an expansion of 20 feet in the total width of the dock and the rearrangement of existing finger
piers. The finger piers on the south side of the dock would also be lengthened to 32 feet. The boat slips
and finger piers associated with the floating dock adjacent to the bulkhead would also be rearranged from
varied widths to a uniform width of 19 feet.

The proposed expansion of the footprint of the marina would incorporate an additional 12,420 square feet
of estuarine waters and public trust area. There is the potential that the project would impact navigation
for smaller craft using the shallow water channels adjacent to the marina area. There are sand shoals along
the opposite side Eastern Channel northeast of the western docks, and mud flats and oyster rock east of
the marina in Davis Creek. The project would provide safer ingress and egress to docking space for larger
vessels utilizing the marina.

Enclosed is our application for changes to our docks at Blue Water Point
Marina, including our fee check of $250.00.
With the present dock layout we can accommodiate the larger 36' + boats
on the outside, but we have no place for the 20' to 32' boat which is a very
popular size in this area. Our inside docks do not have enough room to
maneuver the boats into the slips. We need about 29 more feet between the two
docks. On the outside docks, the 36' boats have trouble docking because of the
width of the slip. They need to be about 2' wider.
The west docks also need to be moved out. As you know, the grass has
grown out considerably which makes the inside almost unusable. Three or four
very small boats can tie up lengthwise but they are on the ground at low tide.
Basically, on the east dock, we are changing the distance between the
docks 29 feet and adding 2 feet in width of each slip. On the west dock, we are
moving the dock out 29 feet to allow inside docking. The increase is within the
15' riparian setback, based on the survey done by McHenry Survey, Inc. on
January 3, 1995.

It came to my attention on Saturday, December 6, 1997, that Blue Water Point Marina of
Brunswick County, North Carolina has applied for a 30 foot extension from their dock and
mooring facilities.
I have a house at 6318 Kings Lynn Drive Whi6 is approximately 300 yards below the
Marina on the inlet. My access to the intercostal waterway is dependant upon me negotiating
between the reefs and the Marina. At best, with the current space between the reef and Marina
my approach and departure is risky and perilous because of the width and depth of the water
between the reefs and Marina.
If the Blue Water Point Marina is granted the extension, thf, number of boats and
decreased availability of suitable navigable water wiel effective}y restrict my capability of
coming in and out of my house to the water.

FIRST, THE RIPERIAN RIGHTS
CORRECT FOR TWO REASONS:

LAND. THE DRAWING IS VERY
SECOND: TO MOVE THE DOCKS OUT 29 ADDITIONAL FEET INTO
DEEPER WATER WILL PUT THE DOCK OVER THE CENTER OF THE
CHANNEL WHICH IS ILLEGAL AND WILL INTERFERE WITH THE
NATURAL CREEK FLOW.
THIRD, BUT OF UTMOST IMPORTANCE, THE EASTERN CHANNEL
OF LOCKWOOD FOLLY INLET (WEST OF THE BLUE POINT
MARINA DOCKS), WILL BE CLOSED DOWN TO BELOW MINIMUM
SAFE VESSEL TRAVEL LANES. NOT ONLY WILL THIS CREATE A
BOATING HAZARD FOR THE MARINA USERS, BUT WILL IMPEDE
AND ENDANGER NEIGHBORHOOD BOATERS AND PIER OWNERS TO
ACCESS OPEN WATERS.
IN SUMMARY, THE BAD PROBLEM THAT WILL BE CREATED HERE
FOR THE CITIZENS AND COMMUNITY BY FAR OUTWEIGH THE

97) to extend the marina docks waterward to allow the mooring of larger boats inside the basin.
No new boat slips are proposed.

The project site is the existing Blue Water Point Marina and Motel facility, located at the end of West
57th Place Dr.,adjacent to Eastern Channel, in Long Beach, in Brunswick County, NC. The facility
consists of the marina docks (approximately 76 slips), with fuel service, and the adjacent motel,
restaurant, and associated parking. The 2.3 acre site is divided by West 57th Place Dr. which terminates
with a public boat ramp into Eastern Channel.The motel and restaurant are located on the east side of the
street and parking and above ground fuel storage tanks are located on the west side of the street.
The waters in the project area are classified as SA by the NC Division of Water Resources. The shellfish
closure line across the mouth of Davis Creek includes the marina basin and all waters of Davis Creek,
east of Blue Water Point Marina. The waters of Eastern Channel to the west of the marina, and north to
the Atlantic Intracoastal Waterway, are OPEN to the harvest of shellfish. The waters within the project
area are not designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The
width of the water body at the marina site varies from 320 to 400 feet across Eastern Channel, and
approximately 400 feet across Davis Creek.
The applicant is requesting authorization to relocate the marina's system of floating docks 29 feet
waterward (north) of their present location, to allow for larger boat slips on the south side, of the floating
docks. The applicant proposes to lengthen the two access docks, perpendicular to the shoreline, an
additional 29 feet. The extension to the dock east of the boat ramp would be 29 feet long and 10 feet
wide, and the western dock extension would be 29 feet long and 8 feet wide. The applicant proposes to
widen the boat slips of the eastern docking system from 12.5 feet and 14 feet, to 16 feet. This would
require an expansion of 20 feet in the total width of the dock and the rearrangement of existing finger
piers. The finger piers on the south side of the dock would also be lengthened to 32 feet. The boat slips
and finger piers associated with the floating dock adjacent to the bulkhead would also be rearranged from
varied widths to a uniform width of 19 feet.

The proposed expansion of the footprint of the marina would incorporate an additional 12,420 square feet
of estuarine waters and public trust area. There is the potential that the project would impact navigation
for smaller craft using the shallow water channels adjacent to the marina area. There are sand shoals along
the opposite side Eastern Channel northeast of the western docks, and mud flats and oyster rock east of
the marina in Davis Creek. The project would provide safer ingress and egress to docking space for larger
vessels utilizing the marina.

Enclosed is our application for changes to our docks at Blue Water Point
Marina, including our fee check of $250.00.
With the present dock layout we can accommodiate the larger 36' + boats
on the outside, but we have no place for the 20' to 32' boat which is a very
popular size in this area. Our inside docks do not have enough room to
maneuver the boats into the slips. We need about 29 more feet between the two
docks. On the outside docks, the 36' boats have trouble docking because of the
width of the slip. They need to be about 2' wider.
The west docks also need to be moved out. As you know, the grass has
grown out considerably which makes the inside almost unusable. Three or four
very small boats can tie up lengthwise but they are on the ground at low tide.
Basically, on the east dock, we are changing the distance between the
docks 29 feet and adding 2 feet in width of each slip. On the west dock, we are
moving the dock out 29 feet to allow inside docking. The increase is within the
15' riparian setback, based on the survey done by McHenry Survey, Inc. on
January 3, 1995.

The project site is the existing Blue Water Point Marina and Motel facility, located at the end of West
57th Place Dr.,adjacent to Eastern Channel, in Long Beach, in Brunswick County, NC. The facility
consists of the marina docks (approximately 76 slips), with fuel service, and the adjacent motel,
restaurant, and associated parking. The 2.3 acre site is divided by West 57th Place Dr. which terminates
with a public boat ramp into Eastern Channel.Tlte motel and restaurant are located on the east side of the
street and parking and above ground fuel storage tanks are located on the west side of the street.
The waters in the project area are classified as SA by the NC Division of Water Resources. The shellfish
closure line across the mouth of Davis Creek includes the marina basin and all waters of Davis Creek,
east of Blue Water Point Marina. The waters of Eastern Channel to the west of the marina, and north to
the Atlantic Intracoastal Waterway, are OPEN to the harvest of shellfish. The waters within the project
area are not designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The
width of the water body at the marina site varies from 320 to 400 feet across Eastern Channel, and
approximately 400 feet across Davis Creek.
The applicant is requesting authorization to relocate the marina's system of floating docks 29 feet
waterward (north) of their present location, to allow for larger boat slips on the south side of the floating
docks. The applicant proposes to lengthen the two access docks, perpendicular to the shoreline, an
additional 29 feet. The extension to the dock east of the boat ramp would be 29 feet long and 10 feet
wide, and the western dock extension would be 29 feet long and 8 feet wide. The applicant proposes to
widen the boat slips of the eastern docking system from 12.5 feet and 14 feet, to 16 feet. This would
require an expansion of 20 feet in the total width of the dock and the rearrangement of existing fmger
piers. The finger piers on the south side of the dock would also be lengthened to 32 feet. The boat slips
and finger piers associated with the floating dock adjacent to the bulkhead would also be rearranged from
varied widths to a uniforni width of 19 feet.

The proposed expansion of the footprint of the marina would incorporate an additional 12,420 square feet
of estuarine waters and public trust area. There is the potential that the project would impact navigation
for smaller craft using the shallow water channels adjacent to the marina area. There are sand shoals along
the opposite side Eastern Channel northeast of the western docks, and mud flats and oyster rock east of
the marina in Davis Creek. The project would provide safer ingress and egress to docking space for larger
vessels utilizing the marina.

Enclosed is our application for changes to our docks at Blue Water Point
Marina, including our fee check of $250.00.
With the present dock layout we can accommodiate the larger 36' + boats
on the outside, but we have no place for the 20' to 32' boat which is a very
popular size in this area. Our inside docks do not have enough room to
maneuver the boats into the slips. We need about 29 more feet between the two
docks. On the outside docks, the 36' boats have trouble docking because of the
width of the slip. They need to be about 2' wider.
The west docks also need to be moved out. As you know, the grass has
grown out considerably which makes the inside almost unusable. Three or four
very small boats can tie up lengthwise but they are on the ground at low tide.
Basically, on the east dock, we are changing the distance between the
docks 29 feet and adding 2 feet in width of each slip. On the west dock, we are
moving the dock out 29 feet to allow inside docking. The increase is within the
15' riparian setback, based on the survey done by McHenry Survey, Inc. on
January 3, 1995.

97) to extend the marina docks waterward to allow the mooring of larger boats inside the basin.

The project site is the existing Blue Water Point Marina and Motel facility, located at the end of West
57th Place Dr.,adjacent to Eastern Channel, in Long Beach, in Brunswick County, NC. The facility
consists of the marina docks (approximately 76 slips), with file] service, and the adjacent motel,
restaurant, and associated parking. The 2.3 acre site is divided by West 57th Place Dr. which terminates
with a public boat ramp into Eastern Channe].The motel and restaurant are located on the east side of the
street and parking and above ground fuel storage tanks are located on the west side of the street.
The waters in the project area are classified as SA by the NC Division of Water Resources. The shellfish
closure line across the mouth of Davis Creek includes the marina basin and all waters of Davis Creek,
east of Blue Water Point Marina. The waters of Eastern Channel to the west of the marina, and north to
the Atlantic Intracoastal Waterway, are OPEN to the harvest of shellfish. The waters within the project
area are not designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The
width of the water body at the marina site varies from 320 to 400 feet across Eastern Channel, and
approximately 400 feet across Davis Creek.
The applicant is requesting authorization to relocate the marina's system of floating docks 29 feet
waterward (north) of their present location, to allow for larger boat slips on the south side of the floating
docks. The applicant proposes to lengthen the two access docks, perpendicular to the shoreline, an
additional 29 feet. The extension to the dock east of the boat ramp would be 29 feet long and 10 feet
wide, and the western dock extension would be 29 feet long and 8 feet wide. The applicant proposes to
widen the boat slips of the eastern docking system from 12.5 feet and 14 feet, to 16 feet. This would
require an expansion of 20 feet in the total width of the dock and the rearrangement of existing finger
piers. The forger piers on the south side of the dock would also be lengthened to 32 feet. The boat slips
and finger piers associated with the floating dock adjacent to the bulkhead would also be rearranged from
varied widths to a unifonn width of 19 feet.
The proposed expansion of the footprint of the marina would incorporate an additional 12,420 square feet
of estuarine waters and public trust area. There is the potential that the project would impact navigation
for smaller craft using the shallow water channels adjacent to the marina area. There are sand shoals along
the opposite side Eastern Channel northeast of the western docks, and mud flats and oyster rock east of
the marina in Davis Creek. The project would provide safer ingress and egress to docking space for larger
vessels utilizing the marina.

Enclosed is our application for changes to our docks at Blue Water Point
Marina, including our fee check of $250.00.
With the present dock layout we can accommodiate the larger 36' + boats
on the outside, but we have no place for the 20' to 32' boat which is a very
popular size in this area. Our inside docks do not have enough room to
maneuver the boats into the slips. We need about 29 more feet between the two
docks. On the outside docks, the 36' boats have trouble docking because of the
width of the slip. They need to be about 2' wider.
The west docks also need to be moved out. As you know, the grass has
grown out considerably which makes the inside almost unusable. Three or four
very small boats can tie up lengthwise but they are on the ground at low tide.
Basically, on the east dock, we are changing the distance between the
docks 29 feet and adding 2 feet in width of each slip. On the west dock, we are
moving the dock out 29 feet to allow inside docking. The increase is within the
15' riparian setback, based on the survey done by McHenry Survey, Inc. on
January 3, 1995.

8. PROJECT SUMMARY: The applicant is requesting a modification of his existing permit (#25-
97) to extend the marina docks waterward to allow the mooring of larger boats inside the basin.
No new boat slips are proposed.

9. PROJECT DESCRIPTION
The project site is the existing Blue Water Point Marina and Motel facility, located at the end of West
57th Place Dr.,adjacent to Eastern Channel, in Long Beach, in Brunswick County, NC. The facility
consists of the marina docks (approximately 76 slips), with fuel service, and the adjacent motel,
restaurant, and associated parking. The 2.3 acre site is divided by West 57th Place Dr. which terminates
with a public boat ramp into Eastern Channel.The motel and restaurant are located on the east side of the
street and parking and above ground fuel storage tanks are located on the west side of the street.
The waters in the project area are classified as SA by the NC Division of Water Resources. The shellfish
closure line across the mouth of Davis Creek includes the marina basin and all waters of Davis Creek,
east of Blue Water Point Marina. The waters of Eastern Channel to the west of the marina, and north to
the Atlantic Intracoastal Waterway, are OPEN to the harvest of shellfish. The waters within the project
area are not designated as Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. The
width of the water body at the marina site varies from 320 to 400 feet across Eastern Channel, and
approximately 400 feet across Davis Creek.
The applicant is requesting authorization to relocate the marina's system of floating docks 29 feet
waterward (north) of their present location, to allow for larger boat slips on the south side of the floating
docks. The applicant proposes to lengthen the two access docks, perpendicular to the shoreline, an
additional 29 feet. The extension to the dock east of, the boat ramp would be 29 feet long and 10 feet
wide, and the western dock extension would be 29 feet' long and 8 feet wide. The applicant proposes to
widen the boat slips of the eastern docking system from 12.5 feet and 14 feet, to 16 feet. This would
require an expansion of 20 feet in the total width of the dock and the rearrangement of existing finger
piers. The forger piers on the south side of the dock would also be lengthened to 32 feet. The boat slips
and finger piers associated with the floating dock adjacent'to'the bulkhead would also be rearranged from
varied widths to a uniform width of 19 feet.
10. AN_T_LCIPATED IMPACTS
The proposed expansion of the footprint of the marina would incorporate an additional 12,420 square feet
of estuarine waters and public trust area. There is the potential that the project would impact navigation
for smaller craft using the shallow water channels adjacent to.the marina area. There are sand shoals along
the opposite side Eastern Channel northeast of the western docks, and mud flats and oyster rock east of
the marina in Davis Creek. The project would provide safer ingress and egress to docking space for larger
vessels utilizing the marina.

Enclosed is our application for changes to our docks at Blue Water Point
Marina, including our fee check of $250.00.
With the present dock layout we can accommodiate the larger 36' + boats
on the outside, but we have no place for the 20' to 32' boat which is a very
popular size in this area. Our inside docks do not have enough room to
maneuver the boats into the slips. We need about 29 more feet between the two
docks. On the outside docks, the 36' boats have trouble docking because of the
width of the slip. They need to be about 2' wider.
The west docks also need to be moved out. As you know, the grass has
grown out considerably which makes the inside almost unusable. Three or four
very small boats can tie up lengthwise but they are on the ground at low tide.
Basically, on the east dock, we are changing the distance between the
docks 29 feet and adding 2 feet in width of each slip. On the west dock, we are
moving the dock out 29 feet to allow inside docking. The increase is within the
15' riparian setback, based on the survey done by McHenry Survey, Inc. on
January 3, 1995.

The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located at the end of 57th Place West, in Long Beach, in
Brunswick County. It was received on November 19, 1997, and appears to be adequate for processing
at this time. The projected deadline for making a decision is February 2, 1998. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing' postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your,
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could
result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and
federal review agencies for their comments. If additional information is required based on this review,
the agencies may contact you directly.

Enclosed for your information is our application for changes to our docks
at Blue Water Point Marina.
With the present dock layout we can accommodiate the larger 36' + boats
on the outside, but we have no place for the 20' to 32' boat which is a very
popular size in this area. Our inside docks do not have enough room to
maneuver the boats into the slips. We need about 29 more feet between the two
docks. On the outside docks, the 36' boats have trouble docking because of the
width of the slip. They need to be about 2' wider.
The west docks also need to be moved out. As you know, the grass has
grown out considerably which makes the inside almost unusable. Three or four
very small boats can tie up lengthwise but they are on the ground at low tide.
Basically, on the east dock, we are changing the distance between the
docks 29 feet and adding 2 feet in width of each slip. On the west dock, we are
moving the dock out 29 feet to allow inside docking. The increase is within the
15' riparian setback, based on the survey done by McHenry Survey, Inc. on
January 3, 1995.
