This permit, issued on May 1. 2013 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) Unless specifically sltered herein, this permit authorizes only the construction of the additional
docking facility with associated tie pilings, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over public
trust waters without permit modification.
2) All portions of the access pier/walkway located over Coastal Wetlands shall not exceed a width of 6
ft. and shall be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom
of the decking.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2016
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL. CONDITIONS
3) The authorized structure shall not extend more than '/< of the width of the waterbody, as measured from
the waterward edge of the marsh on both sides of the water body immediately in front of the project site.
4) No attempt shall be made by the. permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
6) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
8) This permit authorizes one additional boat slip for maximum of five formalized boat slips.
General
9) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States'or the state of North Carolina on account of any such
removal or alteration.
10) No Coastal Wetlands or open water areas shall be excavated or filled, even temporarily.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) The permittee and/or his contractor shall meet with a representative of the Division prior to project
initiation.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division,at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

Dear Ms. Styron:
Please find enclosed a CAMA permit application seeking authorization to construct a pier into
Taylors Creek at property located at 2570 Lennoxville Road, near the Town of Beaufort, Carteret
County. Also enclosed are mail receipts showing that the application has been sent to adjacent
riparian property owners, a copy of the deed to the property and a check of $250 for the
application fee.
The purpose of this project is to provide an adequate docking area for a large boat with reliable
water depths. That is not possible with the existing docking dock facility located in Cowpen
Creek because of the shoaling that occurs in the area.
The proposed pier will be approx. 96' in length by 55' wide. At its end, an "L' section will be
constructed on the east side of the pier which will be approx. 29' in length by 7' in width. Four
tie-up pilings are also proposed. Three will be approx. 18' waterward of the main pier/platform
structure and one will be appox. 15' east (and in line) of the proposed pier/platform. The pier
will be elevated at least 3' above coastal wetland substrate as measured from the bottom of the
decking.
The proposed pier and mooring pilings will be located near but behind the federal setback line
established for this section of Taylors Creek. This pier has been designed to be the mirror image
of the adjacent property owner's pier which is located west of this property.

If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, [phone] within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.

one slip along the Taylors Creek portion of the property.

9. Narrative Description:
The Stevenson Weeks project is located at 2570 Lennoxville Road within the Town of
Beaufort, Carteret County. The site is found by turning right off of Hwy 70 east (adjacent
to Gaskills general store) onto Lennoxville Road. Follow this road for approximately 1
mile. The site will be located on the right. It is not located within the Beaufort
Historic District or the National Historic District.
The residential property is .92 acres (40,075) in its entirety and 5' above nhw. Taylors Creek
runs along the south side of the property with Cow Pen Creek along the east side. The upland
vegetation mainly consists of lawn grasses, shrubs and oak trees. There is a 10' x 564'section
of coastal wetlands along the 564' of shoreline on Taylors and Cow Pen Creek. The waters of
Taylors Creek have an approximate -3' lunar tidal amplitude.
The Division of Water Quality classifies this area as SC Waters. Taylors Creek is not
designated as a Primary Nursery Area and is closed to the taking of shellfish. The Town of
Beaufort's Land Use Plan classifies this area as Residential with Conservation within the
AECs. There are no shellfish resources in the area. The Federal Channel Setback within this
area of Taylors Creek is 61'. Water depths within this project location range from-1'nlw/mlw
to-10'nlw/mlw, depending on location, with connecting water depths of -10' plus nlw/mlw.
The bottom substrate is silty sand with shell. Taylors Creek is approximately 400' wide at this
location.
10) Proposed Development:
The applicant wishes to add a private 1-slip docking facility with tie pilings to the Taylors
Creek portion of the property. There is an existing 4-slip docking facility along the Cow
Pen Creek portion of the property; however, due to the shallow water depths within Cow
Pen Creek, this is the reason the applicant is asking for a docking facility along Taylors
Creek. The Cow Pen Creek docking facility located on the eastern side would remain the
same. The applicant is proposing to construct a 5.5' x 96' pier that extends from nhw/mhw
along the existing riprap. The pier would intersect a 7' x 29' L-head platform that extends
to the east. A total of four tie pilings would also be utilized for the docking facility. Three
of the pilings would be located a maximum distance of 18' waterward of the proposed
platform with a final tie piling located in line with and 18' east of the proposed platform.
All parts of the docking facility would be landward of the USACOE channel setback
(approximately 1' to 5' depending on location), a maximum distance of 121' waterward of
nhw/mhw, and a distance of 60' from the western and eastern riparian corridors. There
would be a total of five slips (4 existing and 1 new).
11. Anticipated Impacts:
The proposed dock additions would shade 676 ft2 and incorporate 1,676 ft2 of shallow
bottom with an increase in the number of wet slips to a total of 5 (4 existing and 1 new).
The existing water depths are sufficient for this use. The setting of pilings has the potential to
cause a temporary increase in turbidity during construction activities as well as temporary

impacts to coastal wetlands during piling installation. The location of the proposed docking
facility with tie pilings should not be a hindrance to navigation due to the fact all portions
would be located landward of the USACOE channel setback. The addition should not cause
additional closures because Taylors Creek is a permanently closed area.

The following is my assessment and consequent recommendations of the above referenced
proposal:
There is currently a 4 slip docking facility along the Cow Pen Creek portion of this property.Per the
applicant due to the shallow water depths and frequent maintenance excavation they are proposing
the construction of a pier, platform, pilings and one additional boat slip along the Taylors Creek
portion of the property. The proposed docking facility (includes pier and platform) would extend a
maximum of 103' waterward of normal high/ mean high water with the outer tie pilings a
maximum of 121'. All portions of the development would be landward 2' to 4' of the USACOE
channel setback. The development conforms to the guidelines set forth under 15A NCAC 07H
.0208. Assuming that state and federal agencies concur with the proposal, the District recommends
the project be authorized as proposed, contingent upon the following conditions:
• The total # of wet slips shall not exceed a maximum of 5 (4 existing and 1 new).
• All parts of the docking facility shall be landward of the USACOE channel setback and not
exceed a maximum distance of 12 P from nhw/mhw.

LUP Consistency Determination: The proposal is Consistent With & not in Conflict with
the 2006 Town of Beaufort Core Land Use Plan certified, by the CRC on January 26,
2007.
Overview:
Areas of Environmental Concern (AECs) impacted by the proposal include Estuarine Water,
Public Trust Area, and Coastal Wetlands. The Waters at the project site are classified as SC and
are closed to the harvesting of shellfish. The area is not a primary nursery area.
The Beaufort Future Land Use Map designates the subject property as "Medium Density
Residential". Development within the designated AECs is limited by CAMA regulations and
development guidelines. Related policy includes the following:
"The Town of Beaufort supports state and federal law regarding land use and
development in AECs. " (Section 4.2.6, Policy 1, pg. 84)
"Beaufort supports the use standards for estuarine and public trust areas as specified
in 15A NCAC.0207. " (Section 4.2.6, Policy 3, pg. 84)
"Construction of boat ramps, piers, and bulkheads within conservation -designates
areas will be allowed if 15A NCAC 7H use standards and local ordinances are

development of your property located on Taylors Creek in Carteret County. The site is at 2570 Lennoxville Rd. in
Beaufort, Carteret County. The application was received as complete on 3/27/13, and appears to be adequate for
processing at this time. The projected deadline for making a decision is 6/10/13. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 3/27/13, you may request a meeting with the Director
of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held
within five working days from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property, or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State
or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of
my field report and/or comments from reviewing agencies.

Please find enclosed a CAMA permit application seeking authorization to construct a pier into
Taylors Creek at property located at 2570 Lennoxville Road, near the Town of Beaufort, Carteret
County. Also enclosed are mail receipts showing that the application has been sent to adjacent
riparian property owners, a copy of the deed to the property and a check of $250 for the
application fee.
The purpose of this project is to provide an adequate docking area for a large boat with reliable
water depths. That is not possible with the existing docking dock facility located in Cowpen
Creek because of the shoaling that occurs in the area.
The proposed pier will be approx. 96' in length by 5.5' wide. At its end, an "L" section will be
constructed on the east side of the pier which will be approx. 29' in length by 7' in width. Four
tie-up pilings are also proposed. Three will be approx. 18' waterward of the main pier/platform
structure and one will be appox. 15' east (and in line) of the proposed pier/platform. The pier
will be elevated at least 3' above coastal wetland substrate as measured from the bottom of the
decking.
The proposed pier and mooring pilings will be located near but behind the federal setback line
established for this section of Taylors Creek. This pier has been designed to be the mirror image
of the adjacent property owner's pier which is located west of this property.

NOW COMES Benjamin G. Hines, Jr. and wife, Dale Pate Hines, by and through their
undersigned counsel, and respectfully moves pursuant to Rule .0117 of the Rules of the Office of
Administrative Hearings and Rule 24(a) of the North Carolina Rules of Civil Procedure for leave to
intervene as of right as a Party Respondent in this action to represent their interests as the
Perrnittee of CAMA Major Pemut No. 53-13, issued on May 1, 2013 with minor modifications to
CAMA Major Permit No. 53-12, issued on December 10, 2013. That said CAMA Major Permit
No. 52-12 was transferred to Benjamin G. Hines, Jr. on February 21, 2014. That further, a letter
was issued dated March 6, 2014, authorizing refinement of CAMA Major Permit No. 53-12,
including correspondence and workplace drawings. That said Permits and modifications thereto
are subject to the Coastal Area Management Act ("CAMA") Permit Third Party Appeal. That
Petitioner filed the Petition for Contested Case Hearing with the Office of Administrative
Hearings. That said Petition was dated August 4, 2014. That final agency decision allowing
Petitioner to file a Contested Case Hearing and Final Decision dated July 15, 2014.

In the alternative, Benjamin G. Hines, Jr. and wife, Dale Pate Hines, move for permissive
intervention pursuant to Rule 24(b) of the North Carolina Rules of Civil Procedure to become a
Party Respondent on the ground that their claims or defenses in the pending action share common
questions of law and fact with those of the existing parties. Allowing Benjamin G. Hines, Jr. and
wife, Dale Pate, Hines to intervene as a Respondent will not unduly delay or prejudice the
adjudication of the rights of the original parties.
In support of this Motion, Benjamin G. Hines, Jr. and wife, Dale Pate Hines, would
respectfully show the Court as follows:
1. CAMA Major Permit 53-13, as modified and amended is for property adjacent to
the riparian area of the Petitioner.
2. Said pier as currently constructed by Benjamin G. Hines, Jr. is located to the east of
the Petitioner's dock and within their riparian access area. It did not go into the fifteen foot (15')
riparian setback as required by the CAMA rules and regulations.
3. With Benjamin G. Hines, Jr. and wife, Dale Pate Hines, being the Permittee and the
location of the existing pier is so situate that the disposition of this action could as a practical
matter impair or impede their ability to protect its interests.
4. The interests of Benjamin G. Hines, Jr. and wife, Dale Pate Hines, are not
adequately represented by the existing parties. The Petitioner's interests are adverse to those of
Benjamin G. Hines, Jr. and wife, Dale Pate Hines. The interests of the Division of Coastal
Management in upholding the issuance of its permit are different from those of Benjamin G.
Hines, Jr. and wife, Dale Pate Hines. The Division of Coastal Management has no financial or
monetary interest in the Permit and property in question and time is not of the essence to the
Division. It is necessary for Benjamin G. Hines, Jr. and wife, Dale Pate Hines, to be a pafMto this
proceeding in order to adequately represent its Permit and property interests in twwatter2014

5. Benjamin G. Hines, Jr. and wife, Dale Pate Hines', application to intervene is timely,
in that no proceedings have taken place in this case. The Petitioner's petition has only recently
been filed. Preheating Statements have not been filed and no discovery has been conducted.
Benjamin G. Hines, Jr. and wife, Dale Pate Hines, is interested in expediting the resolution of this
matter and will use all due diligence to see that this case is moved along as expeditiously as
possible.
6. Given its direct financial interest in the issuance of CAMA Major Permit No. 53-13
as modified and their ownership of the property that are the subject matter of this contested case
hearing, Benjamin G. Hines, Jr. and wife, Dale Pate Hines, should be allowed to intervene as of a
matter of right as a Respondent.
7. In the alternative, Benjamin G. Hines, Jr. and wife, Dale Pate Hines, should be
allowed permissive intervention under Rule 24(b) NCR Civ. P. Benjamin G. Hines, Jr. and wife,
Dale Pate Hines', claims and defenses have identical questions of law and fact in common with the
claims and defenses asserted by the existing parties in this action. Furthermore, because no
proceedings have been conducted in this case, allowing intervention by Benjamin G. Hines, Jr. and
wife, Dale Pate Hines, will not unduly delay or prejudice the adjudication of the rights of the
original parties. Benjamin G. Hines, Jr. and wife, Dale Pate Hines, should be allowed to be heard
on the substantive issues raised in the Petition for Contested Case Hearing. Therefore, Benjamin
G. Hines, Jr. and wife, Dale Pate Hines, should be allowed to intervene as a Respondent with all
the rights of a party.
8. The undersigned counsel has conferred with Elizabeth Weese of the Department of
Justice, and Counsel for Respondent and she has consented on behalf of Respondent to the
intervention of Benjamin G. Hines, Jr. and wife, Dale Pate Hines, in this acIp. Rremm

The Chairman of the Coastal Resources Commission, Frank Gorham, has received a request for an
administrative hearing to challenge CAMA Major Permit #53-13. The Third Party Hearing Request was filed
on behalf of petitioner Stephen Valentine on July 2, 2014. Under N.C.G.S. §113A-121.1 (the Coastal Area
Management Act), your permit is suspended upon receipt of a hearing request and will remain suspended until
either: (1) Chairman Gorham denies the hearing request (under standards set out in the statute); or (2) there is a
final Coastal Resources Commission decision on the permit appeal. You may not undertake any development
under the permit until further notice after Chairman Gorham issues his decision.
The Division of Coastal Management will prepare a recommendation for the Chairman on whether to grant or
deny the hearing request. The Chairman_must make a decision within 15 days after receipt of the hearing
request. Therefore his decision is due close of business on July 17, 2014. If you wish to submit any materials
for. the Chairman's consideration in ruling on the request for contested case hearing, please send them to me as

interest as we sold this property on or about December 2013 to Benjamin Hines and wife, Dale
Hines. It appears from the information that you provided that the permit was modified at the
request of the Hines on or about March 6, 2014 and the Hines constructed their dock.
Today I visited the property to advise Mr. Hines of the letter I received. On my visit to the
property I had occasion to observe and photograph the docks in question. I am very familiar with
riparian rights and CAMA regulations pertaining to zones of riparian access. I was appellee
counsel In re: Protest of Mason, 78 N.C. App. 16 (1985) in which for the first time the appellate
courts of North Carolina recognized and adopted the CAMA regulations to determine riparian
access zones. The Hines' dock is clearly constructed within their riparian access zone, as is
shown in the attached photographs. According to Mr. Valentine's complaint the dock interferes
with access to his riparian property. The only reason Mr. Valentine would have difficulty
docking his vessel at his dock is the placement of the pilings outboard of his dock, in particular
the center piling. Mr. Valentine, with the application of proper seamanship and the removal of
the center piling should easily be able to dock at his dock without entering the Hines' riparian
