Permit Class, NEW Permit Number 53-13 STATE OF NORTH CAROLINA Department of Environment and Natural Resources and Coastal Resources Commission V elrmit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Stevenson and Rebecca Weeks, PO Box 360, Beaufort, NC 28516 Authorizing development in Carteret County at adi. to Taylors Creek, at 2570 Lennoxville Road, in Beaufort , as requested in the permittee's application dated 3/18/13including the attached workplan drawings (3) all dated 3/4/13 This permit, issued on May 1. 2013 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically sltered herein, this permit authorizes only the construction of the additional docking facility with associated tie pilings, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) All portions of the access pier/walkway located over Coastal Wetlands shall not exceed a width of 6 ft. and shall be elevated a minimum of 3 feet above the marsh substrate as measured from the bottom of the decking. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. CONDITIONS 3) The authorized structure shall not extend more than '/< of the width of the waterbody, as measured from the waterward edge of the marsh on both sides of the water body immediately in front of the project site. 4) No attempt shall be made by the. permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 6) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) This permit authorizes one additional boat slip for maximum of five formalized boat slips. General 9) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States'or the state of North Carolina on account of any such removal or alteration. 10) No Coastal Wetlands or open water areas shall be excavated or filled, even temporarily. 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: Future development of the permittee's property may require a modification of this permit. March 18, 2013 Heather Styron NC Division of Coastal Management 400 Commerce Avenue Morehead City, NC 28557 Dear Ms. Styron: Please find enclosed a CAMA permit application seeking authorization to construct a pier into Taylors Creek at property located at 2570 Lennoxville Road, near the Town of Beaufort, Carteret County. Also enclosed are mail receipts showing that the application has been sent to adjacent riparian property owners, a copy of the deed to the property and a check of $250 for the application fee. The purpose of this project is to provide an adequate docking area for a large boat with reliable water depths. That is not possible with the existing docking dock facility located in Cowpen Creek because of the shoaling that occurs in the area. The proposed pier will be approx. 96' in length by 55' wide. At its end, an "L' section will be constructed on the east side of the pier which will be approx. 29' in length by 7' in width. Four tie-up pilings are also proposed. Three will be approx. 18' waterward of the main pier/platform structure and one will be appox. 15' east (and in line) of the proposed pier/platform. The pier will be elevated at least 3' above coastal wetland substrate as measured from the bottom of the decking. The proposed pier and mooring pilings will be located near but behind the federal setback line established for this section of Taylors Creek. This pier has been designed to be the mirror image of the adjacent property owner's pier which is located west of this property. Thank you for your assistance in this request. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. Narrative Description: The Stevenson Weeks project is located at 2570 Lennoxville Road within the Town of Beaufort, Carteret County. The site is found by turning right off of Hwy 70 east (adjacent to Gaskills general store) onto Lennoxville Road. Follow this road for approximately 1 mile. The site will be located on the right. It is not located within the Beaufort Historic District or the National Historic District. The residential property is .92 acres (40,075) in its entirety and 5' above nhw. Taylors Creek runs along the south side of the property with Cow Pen Creek along the east side. The upland vegetation mainly consists of lawn grasses, shrubs and oak trees. There is a 10' x 564'section of coastal wetlands along the 564' of shoreline on Taylors and Cow Pen Creek. The waters of Taylors Creek have an approximate -3' lunar tidal amplitude. The Division of Water Quality classifies this area as SC Waters. Taylors Creek is not designated as a Primary Nursery Area and is closed to the taking of shellfish. The Town of Beaufort's Land Use Plan classifies this area as Residential with Conservation within the AECs. There are no shellfish resources in the area. The Federal Channel Setback within this area of Taylors Creek is 61'. Water depths within this project location range from-1'nlw/mlw to-10'nlw/mlw, depending on location, with connecting water depths of -10' plus nlw/mlw. The bottom substrate is silty sand with shell. Taylors Creek is approximately 400' wide at this location. 10) Proposed Development: The applicant wishes to add a private 1-slip docking facility with tie pilings to the Taylors Creek portion of the property. There is an existing 4-slip docking facility along the Cow Pen Creek portion of the property; however, due to the shallow water depths within Cow Pen Creek, this is the reason the applicant is asking for a docking facility along Taylors Creek. The Cow Pen Creek docking facility located on the eastern side would remain the same. The applicant is proposing to construct a 5.5' x 96' pier that extends from nhw/mhw along the existing riprap. The pier would intersect a 7' x 29' L-head platform that extends to the east. A total of four tie pilings would also be utilized for the docking facility. Three of the pilings would be located a maximum distance of 18' waterward of the proposed platform with a final tie piling located in line with and 18' east of the proposed platform. All parts of the docking facility would be landward of the USACOE channel setback (approximately 1' to 5' depending on location), a maximum distance of 121' waterward of nhw/mhw, and a distance of 60' from the western and eastern riparian corridors. There would be a total of five slips (4 existing and 1 new). 11. Anticipated Impacts: The proposed dock additions would shade 676 ft2 and incorporate 1,676 ft2 of shallow bottom with an increase in the number of wet slips to a total of 5 (4 existing and 1 new). The existing water depths are sufficient for this use. The setting of pilings has the potential to cause a temporary increase in turbidity during construction activities as well as temporary impacts to coastal wetlands during piling installation. The location of the proposed docking facility with tie pilings should not be a hindrance to navigation due to the fact all portions would be located landward of the USACOE channel setback. The purpose of this project is to provide an adequate docking area for a large boat with reliable water depths. At its end, an "L" section will be constructed on the east side of the pier which will be approx. 29' in length by 7' in width. Four tie-up pilings are also proposed. The only reason Mr. Valentine would have difficulty docking his vessel at his dock is the placement of the pilings outboard of his dock, in particular the center piling.
