Yes, Paul has been given verbal permission to use our slip. Paul and I will enter into a
written lease agreement for the slip.
The HOA recommendation was he utilize our slip since it has never been unused. Paul
has been given verbal permission to utilize the first slip on the left side, as looking
towards the end of the pier, and as shown on his installation submittals.

Hi Heather,
Just keeping you up to date. As of tracking today, the letter has still not been delivered. USPS indicates
that they only do one delivery attempt and it is up to the recipient to request a re -delivery attempt
online. Given that Bob has no intention of cooperating, it's very unlikely that he will request a re-
delivery or go to the post office to pick it up. USPS indicates that if it is not picked up or requested for
redelivery by February 8, it will be returned to me.
Is there any value in me sending via FeclEx or non -certified mail (just tracking)? If it will help I don't mind
doing it, but if it doesn't make a difference given that he has already responded to you in writing I
won't.
Thanks again for helping through all of this and I'm hoping this can all be resolved soon. If there is
anything else you need from me, please let me know.

saying you cant have two slips and you have not received authorization from the HOA or

and please get them to send me an email stating as such.

Ok - thank you for the advice.
I will keep tracking it. I know he is aware of the certified mail delivery being attempted because he
commented to the HOA President about it. I have a string of text messages documenting my notification
of him as well as emails sent with the documents and his confirmation of receipt of the documents - but
I think the issue is that the form specifically calls out certified mail as being the only trigger for the 10-
day deadline. If it's just a matter of it being delivered I could use Fed Ex to have it delivered. Would that
be good enough or does it have to be a certified mail delivery?

On January 10 he sent a message saying he had met with the HOA to discuss my proposal which means
he had obviously read and understood it:

intention of signing the document at this time, hence prompting me to send the letter via certified mail.
On Jan 23, 1 sent the letter via certified mail.

Fed ex would be another option for delivery and documentation. The 10 day
requirement usually is for the cert. mail. If it cant be delivered this is where all the
documentation comes in you sent below and any new you may receive. Normally the
USPS will try to deliver a couple of times, so you will need to check with them to see
their current policies on that. I have received written objections today as well and
wanted to make you aware.

Sorry - after looking through the forms I have a couple of questions:
I'm assuming I'm to put my home address even though the shared dock
is technically not on my property - it is between the 145 and 147 lots,
correct?
Does the adjacent property waiver form need to be filled out in paper or
can it be done electronically (e.g. I email to them, they print and sign,
then email back to me)? Related question - can I send these to you
electronically or do I need to send them via paper (or do they need to
mail them directly to you)?

Hello Heather,
I'm looking to install a Wave Armor
SLX6 Floating PWC port adjacent to our
existing pier which is maintained by our
homeowners association (the
association is just the 5 homes that are
adjacent to the pier). The floating PWC
port will not be attached to the existing
pier in any way and will just be free-
floating with 2 or 4 pipes that will allow
it to float up and down as needed.
I'm attaching a document that provides
additional details on what I would like
to do and the location. In conversations
with Curt he was trying to determine
what type of permit I would need for
this and what I need to provide for such
a permit. Since this technically does not
attach to any part of the existing pier, I
was hoping I could get a permit just for

this one piece, as the records for the
existing pier were all burned in a fire of
the home of the homeowners
association president a few years ago,
so anything that would require full
plans of the entire pier would be a huge
effort for me.

I am requesting to add a Wave Armor SLX6 Floating PWC port adjacent to our existing pier located
between 145 Azalea Ct and 147 Azalea Ct, Swansboro, NC 28584.

The installation will be similar to what is shown in this photo. This photo shows two SLX6 connected to
each other. The proposed installation will be for just one:

2" Galvanized Steel pipes will be driven 9 ft into the ground and then sleeved with 4" PVC pipes as
shown in the above photo. The dock will not be physically attached to the existing pier and will be free-
standing within the confines of the existing pier.
A ladder may be attached to the existing dock to facilitate being able to step down to the floating dock,
similar to what is shown in the above photo.

Yes, Paul has been given verbal permission to use our slip. Paul and I will enter into a written lease
agreement for the slip.
The HOA recommendation was he utilize our slip since it has never been unused. Paul has been given
verbal permission to utilize the first slip on the left side, as looking towards the end of the pier, and as
shown on his installation submittals.

Hi Heather,
Just keeping you up to date. As of tracking today, the letter has still not been delivered. USPS indicates
that they only do one delivery attempt and it is up to the recipient to request a re -delivery attempt
online. Given that Bob has no intention of cooperating, it's very unlikely that he will request a re-
delivery or go to the post office to pick it up. USPS indicates that if it is not picked up or requested for
redelivery by February 8, it will be returned to me.
Is there any value in me sending via FedEx or non -certified mail (just tracking)? If it will help I don't mind
doing it, but if it doesn't make a difference given that he has already responded to you in writing I
won't.
Thanks again for helping through all of this and I'm hoping this can all be resolved soon. If there is
anything else you need from me, please let me know.

I have to wait for the green card to be attempted to be delivered a couple of times. I
would say that sending in objections does mean they are aware of the project and can
be part of the notification documentation list I discussed previously. Their objections are
saying you cant have two slips and you have not received authorization from the HOA or
the slip owner to do so. I would check back with the HOA/slip owner to make sure
nothing has changed since you obtained the signed agent form and riparian signature
and please get them to send me an email stating as such.

Resources Commission (71-1. 2000), and as such, a permit has been issued to authorize the
development. I have enclosed a copy of the permit, as well as the relevant statutes.
If you wish to contest our decision to issue this permit, you may file a request for a Third
Party Hearing. The request for a hearing will be considered by the Chairman of the Coastal
Resources Commission. The hearing request must be filed with the Director, Division of
Coastal Management, in writing and must be received within twenty (20) days after the

is making an application to build a jet ski dock on a pier owned jointly by the Walnut Creek HOA.
We are members of the Walnut Creek HOA and adjacent waterfront property owners to the pier
and Mr. Girault's property. Mr. Girault already has a boat in place in the boat slip on this pier
which is appurtenant to his lot. He has no claim to the use of any other slip.
Mr. Girault has not received permission from the Walnut Creek HOA to make this application.
Therefore, any such application must be immediately be denied by DCM and withdrawn. Any such
application is based on a false premise that Mr. Girault has permission to proceed, even though
said permission has never even been raised for discussion. This matter is quite disturbing and there
is no legal way for it to go forward.
It is particularly disturbing that's it has been said that Mr. Giralt is urgently pursuing this matter,
making false representations and disregarding legal procedure, because of a belief that an
individual staff member at DCM, who is changing positions at the end of January 2023, will assist
him. DCM is a government agency and clearly operates on policies, and procedures.

2" Galvanized Steel pipes will be driven 9 ft into the ground and then sleeved with 4" PVC pipes as
shown in the above photo. The dock will not be physically attached to the existing pier and will be free-
standing within the confines of the existing pier.
A ladder may be attached to the existing dock to facilitate being able to step down to the floating dock,
similar to what is shown in the above photo.
