This letter of refinement is in reference to the February 25, 2014 correspondence letter requesting a refinement
of Major CAMA Permit No. 53-13 issued you on February 21, 2014. This permit is set to expire on 12/31/16.
Your request to reconfigure the previously permitted L-head platform to a T-head design and relocate the
dolphin style mooring pilings per the attached plan dated received by DCM on 2/25/14, is hereby authorized as
requested. All permit conditions including the December 31, 2016 expiration date still apply and remain
unchanged.,

RE: Refinement of State Permit #53-13, Benjamin Gerald Hines Jr.
A written request was made by the agent Mr. Earl Weeks for a minor modification to allow the reconfiguration
of the previously permitted pier and dolphin mooring pilings. After speaking with Major Permit Coordinator
Daniel Govoni on March 6, 2014, it was detemiined that a refinement could be issued for this request. The
permit was issued on 5/1/13 and is set to expire on 12/31/16.
The applicant has requested to redesign the platform as a T-head configuration instead of the previously
permitted L-head design. The pier would increase to a 6' width and the four previously permitted dolphin style
mooring pilings would be relocated. The mooring pilings along the east and west side of the T-head platform.
would be a distance of 25'. The final two dolphin pilings to the south of the platform would be a distance of 20'
and would not extend farther than 121' from nhw as previously permitted. The dolphin pilings would be located
40' from the eastern riparian corridor, 25' from the western riparian corridor, 25' from the east and west sides
of the platform and 20 from the south side. All development as proposed would meet the USACOE channel
setback as well as the minimum 15' distance from the riparian corridors. The proposal is still consistent with the
specific guidelines found in 15A NCAC 07H.0208. This district recommends the refinement be authorized as
proposed, contingent all original conditions apply as well as the following specific conditions.
All work shall be consistent with request dated received 2/25/14 and shall not extend farther than 121'
from nhw in order to meet the USACOE channel setback requirements.

Thank you for coming in yesterday to discuss your concerns about the refinement to the Coastal
Area Management Act (CAMA) Major Development Permit No. 53-13 made by DCM staff on
March 6, 2014. This permit was originally issued to Stevenson Weeks on May 1, 2013, and then
a minor modification was approved and issued on December 10, 2103. The permit was
transferred from StevensonWeeks to Benjamin Hines Jr. on February 21, 2014, and finally was
refined on March 6, 2014.
If you wish to formally contest these actions by DCM staff, you may request an appeal of these
actions pursuant to the procedure set forth in N.C.G.S. § 113A-121.1(b). If you would like
