Owen, Jr. Harbour Point Associates Raleigh, NC 27612 Dear Sir: This letter is in response to your application for a Coastal Area Management Act (CAMA) Permit to install two pile -supported markers to protect a waste water treatment plant outfall line and diffuser. The outfall provides services for your Harbour Pointe subdivision and marina development on the Pungo River and Upper Dowry Creek in Beaufort County. The pile structures would replace buoys which were required under CAMA Permit No. 163-87 as modified on February 8, 1993. Processing of your application, which was received on April 25, 1996 and for which notice of extended review was provided June 12, 1996, is now complete. Based on a coordinated state agency review, the Division of Coastal Management has made the following findings: 1) The proposed pile -supported markers would be located in a heavily traveled corridor for sport and commercial fishermen; 2) The markers would be located 1150' offshore, approximating the 6 foot contour; 3) Boats attempting to avoid crab pots which are required to be placed inshore of the six foot contour would be traveling a line just outside the 6 foot contour, or in line with the markers; 4) There is no proposal for lighting the markers; 5) A boat colliding with a 12" piling would sustain greater damage than one colliding plastic buoy; 19 6) The proposed structures are determined to pose a threat to navigational safety; P.O. Owen, Jr. Page 2 July 17, 1996 7) The proposal to install unlighted 12" pile structures 1 f 50 feet offshore in the Pungo River has been determined to be inconsistent with the following partial listing of the Rules of the Coastal Resources Commission: a) T154A:07H.0207(e) which states that the Management Objective for Public Trust Waters is to provide the public right of navigation; .0208(a)(2)(H) which states that development shall not impede navigation or create undue interference with use of public trust or estuarine waters; .0208(a)(2)(A) which requires that the design and need of development shall be consistent with the management objective. Based on the foregoing finding, it is necessary that your application request be denied under N.C.G.S. 113A-120(a)(8) which requires permit denial when a proposal is determined to be inconsistent with the state standards or guidelines. It is recommended that the Harbour Pointe outfall continue to be marked with buoys that are anchored sufficiently to keep the units on station during adverse weather. Additionally, the two buoys should contain signage information required in the NPDES permit, but utilize the color scheme specified in your recent application. This is also correct under the State Uniform Waterway Marker System. If you wish to appeal this denial, you are entitled to a hearing. The hearing will involve appearing before an Administrative Law Judge who listens to the evidence and arguments of both parties and then makes a recommendation to the Coastal Resources Commission. Your request for a hearing must be in the form of written petition, complying with the requirements of Chapter 150B of the General Statutes of North Carolina, and must be filed with the Office of Administrative Hearings, P. O. Drawer 27447, Raleigh, NC 27611-7447 (919) 733-2698 within 20 days from the receipt of this letter. A copy of the petition should be filed with this office. Also, you should be advised that as long as this state permit denial stands, your project must be deemed inconsistent with the N. C. Coastal Management Program, thereby precluding issuance of Federal permits for this project. The Federal Coastal Zone Management Act of 1972 (CZMA) gives the right to appeal this finding to the U. S. Secretary of Commerce, within 30 days of receipt of this letter. Your appeal must be based on the grounds that the proposed activity is (1) consistent with with the objectives or purposes of the CZMA, or (2) is necessary in the interest of national security, and thus, may be federally approved. This project was developed under an existing CAMA permit no. 163-87 .The development provides 99 single family lots of approximately 0.5 acres in size. Of the 99 lots 31 have been sold. These lots include lot 3 thru 6 , 10 thru 13, 17, 19 thru 30, 32 thru 36, 39, 41, 42, 54 and 55. There are 54 lots that front either the Upper Dowry Creek or the Pungo River. The remaining lots are situated in order to provide a view of these bodies of water. The permitted development includes a 72 slip marina , a marina store , a clubhouse, tennis courts , and a swimming pool. Construction of these facilities began in 1992. The roads are constructed and paved with asphalt. The marina and the marina building are completed. There are future plans for multifamily development on lot 100 in the area of the tennis courts and clubhouse. Lots have been sold throughout the subdivision and the construction of residential homes have begun. It is expected that the lots will be sold out in five to seven years and the construction will be built out in approximately 15 years. Dowry Creek is currently served by a dual path 50,OOOgpd extended aeration wastewater treatment plant to treat an estimated 44,000 gallons per day of wastewater from the development. These facilities are currently in place and operating and is permitted under an NPDES permit no. NC006946. Each dwelling or other facility in the development will be equipped with an individual pump station used to pump wastewater into the pressure sewer system. Each pump station was sized to pump peak flow while operating simultaneously with others in the system. After the wastewater is treated the effluent is discharged into an existing force main . The treated effluent is discharged into the Pungo River at a minimum depth of 6 feet below the water surface. The location of the diffuser will be marked by 2 - 3 x3' signs "Effluent discharge, submerged effluent diffuser, boaters take caution not to anchor in this area" . The signs will be located at each end of the 50 foot diffuser. These signs are a part of this new permit application. PROJECT SUMMARY: The applicant is proposing to replace two buoys which mark the waterward end of a wastewater diffuser with two pilings. HARBOUR POINTS ASSOCIATES Beaufort County Environmental setting On 10 August 1987 the DCM issued a CAMA Major Development permit to Harbour Pointe Associates for the development of an approximately 105 acre subdivision adjacent to Upper Dowry Creek and the Pungo River off of SR 1718 in Beaufort County. The permit allowed for several amenities including a marina and a wastewater treatment facility which had a discharge to the Pungo River. The discharge line is a 1,100' long, 3" forcemain which is located on a 20' wide easement lot. The line which was buried in 1993 has a 50' long diffuser at its waterward end. The diffuser is not buried but instead lies on the bottom of the Pungo River. When Permit #163-87 was issued the diffuser was required to be marked by a buoy at each end. Also prior to the discharge line placement, the NC DEM issued NPDES No. 006946 which required, among other things, that each end of the diffuser be marked with a piling. Monitoring of the placement of the discharge line on 31 August 1993 indicated that the line was placed according to the conditions set out in Permit #163-87. Project proposal The applicant is proposing to replace the two existing buoys with two 12" pilings. Attached to the pilings will be a danger sign as described on plat no. 4 dated 8 March 1996. The applicant has consulted with the U.S. Coast Guard and the sign that is being proposed is based on guidelines furnished by that agency. Environmental impact The project as proposed should have a minimum environmental impact. Other impacts are those that are associated with the placement of pilings 1,150' beyond the NWL in the Pungo River in a heavily used recreational boating area and a commercial fishing trawling area. MEMORANDUM TO: n J David Gossett John Crew DATE: I ) 8 April 1996 Harbour Pointe Associates Proposal for Warning/Marking Pilings, Pungo River/Upper Dowry Creek, Beaufort County, North Carolina This proposal by Harbour Pointe Associates is to replace two existing buoys marking the waterward end of a submerged wastewater treatment system diffuser located offshore of Dowry Creek Subdivision in eastern Beaufort County near Belhaven. The proposal to replace the buoys with a piling and warning sign is a condition of CAMA Permit #163-87 issued in 1987. The proposal involves Public Trust Areas and Estuarine Water AECs and comes under the auspices of the March 1993 CRC certified Beaufort County Land Use Plan update. The plan offers the following limited guidance on proposals of this type: County policy on AECs is to support development within only if proposals meet use and performance standards in 15 NCAC 7H .0203, .0208 and .0209 (page VIII-4). County policy on use of sewer treatment package plants (page VIII-6-7) notes that these facilities may be appropriate in certain areas and they must be permitted by either state or county health departments. By definition all AECs are included in the county's Conservation land classification (page IX-9-10). The wastewater diffuser used by Harbour Pointe Associates is located just waterward of the six foot depth contour in Pungo River. That fact places the marking buoys in a heavily used travel corridor for sport and commercial fishermen. By NCDMF proclamation, crab pots are required to be placed inside the six foot depth contour from May 1 to October 31 every year. Boat traffic wanting to avoid the concentration of crab pots inside the six foot depth contour will travel just outside the area utilized by crab potting. The chances of serious injury resulting from a boat colliding with a twelve inch diameter piling are much greater than if the same boat were to collide with a floating buoy. PROJECT SUMMARY: The applicant is proposing to replace two buoys which mark the waterward end of a wastewater diffuser with two pilings. HARBOUR POINTE ASSOCIATES Beaufort County Environmental setting On 10 August 1987 the DCM issued a CAMA Major Development permit to Harbour Pointe Associates for the development of an approximately 105 acre subdivision adjacent to Upper Dowry Creek and the Pungo River off of SR 1718 in Beaufort County. The permit allowed for several amenities including a marina and a wastewater treatment facility which had a discharge to the Pungo River. The discharge line is a 1,100' long, 3" forcemain which is located on a 20' wide easement lot. The line which was buried in 1993 has a 50' long diffuser at its waterward end. The diffuser is not buried but instead lies on the bottom of the Pungo River. When Permit #163-87 was issued the diffuser was required to be marked by a buoy at each end. Also prior to the discharge line placement, the NC DEM issued NPDES No. 006946 which required, among other things, that each end of the diffuser be marked with a piling. Monitoring of the placement of the discharge line on 31 August 1993 indicated that the line was placed according to the conditions set out in Permit #163-87. Project proposal The applicant is proposing to replace the two existing buoys with two 12" pilings. Attached to the pilings will be a danger sign as described on plat no. 4 dated 8 March 1996. The applicant has consulted with the U.S. Coast Guard and the sign that is being proposed is based on guidelines furnished by that agency. Environmental impact The project as proposed should have a minimum environmental impact. Other impacts are those that are associated with the placement of pilings 1,150' beyond the NWL in the Pungo River in a heavily used recreational boating area and a commercial fishing trawling area. This project was developed under an existing CAMA permit no. 163-87 .The development provides 99 single family lots of approximately 0.5 acres in size. Of the 99 lots 31 have been sold. These lots include lot 3 thru 6 , 10 thru 13, 17, 19 thru 30, 32 thru 36, 39, 41, 42, 54 and 55. There are 54 lots that front either the Upper Dowry Creek or the Pungo River. The remaining lots are situated in order to provide a view of these bodies of water. The permitted development includes a 72 slip marina , a marina store , a clubhouse, tennis courts , and a swimming pool. Construction of these facilities began in 1992. The roads are constructed and paved with asphalt. The marina and the marina building are completed . There are future plans for multifamily development on lot 100 in the area of the tennis courts and clubhouse. Lots have been sold throughout the subdivision and the construction of residential homes have begun. It is expected that the lots will be sold out in five to seven years and the construction will be built out in approximately 15 years. Dowry Creek is currently served by a dual path 50,000gpd extended aeration wastewater treatment plant to treat an estimated 44,000 gallons per day of wastewater from the development. These facilities are currently in place and operating and is permitted under an NPDES permit no. NC006946. Each dwelling or other facility in the development will be equipped with an individual pump station used to pump wastewater into the pressure sewer system. Each pump station was sized to pump peak flow while operating simultaneously with others in the system. After the wastewater is treated the effluent is discharged into an existing force main . The treated effluent is discharged into the Pungo River at a minimum depth of 6 feet below the water surface. HARBOUR POINTE ASSOCIATES Beaufort County Environmental setting On 10 August 1987 the DCM issued a CAMA Major Development permit to Harbour Pointe Associates for the development of an approximately 105 acre subdivision adjacent to Upper Dowry Creek and the Pungo River off of SR 1718 in Beaufort County. The permit allowed for several amenities including a marina and a wastewater treatment facility which had a discharge to the Pungo River. The discharge line is a 1,100' long, 3" forcemain which is located on a 20' wide easement lot. The line which was buried in 1993 has a 50' long diffuser at its waterward end. The diffuser is not buried but instead lies on the bottom of the Pungo River. When Permit #163-87 was issued the diffuser was required to be marked by a buoy at each end. Also prior to the discharge line placement, the NC DEM issued NPDES No. 006946 which required, among other things, that each end of the diffuser be marked with a piling. Monitoring of the placement of the discharge line on 31 August 1993 indicated that the line was placed according to the conditions set out in Permit #163-87. Project proposal The applicant is proposing to replace the two existing buoys with two 12" pilings. Attached to the pilings will be a danger sign as described on plat no. 4 dated 8 March 1996. The applicant has consulted with the U.S. Coast Guard and the sign that is being proposed is based on guidelines furnished by that agency. Environmental impact The project as proposed should have a minimum environmental impact. HARBOUR POINTE ASSOCIATES Beaufort County Environmental settine On 10 August 1987 the DCM issued a CAMA Major Development permit to Harbour Pointe Associates for the development of an approximately 105 acre subdivision adjacent to Upper Dowry Creek and the Pungo River off of SR 1718 in Beaufort County. The permit allowed for several amenities including a marina and a wastewater treatment facility which had a discharge to the Pungo River. The discharge line is a 1,100' long, 3" forcemain which is located on a 20' wide easement lot. The line which was buried in 1993 has a 50' long diffuser at its waterward end. The diffuser is not buried but instead lies on the bottom of the Pungo River. When Permit #163-87 was issued the diffuser was required to be marked by a buoy at each end. Also prior to the discharge line placement, the NC DEM issued NPDES No. 006946 which required, among other things, that each end of the diffuser be marked with a piling. Monitoring of the placement of the discharge line on 31 August 1993 indicated that the line was placed according to the conditions set out in Permit #163-87. Project proposal The applicant is proposing to replace the two existing buoys with two 12" pilings. Attached to the pilings will be a danger sign as described on plat no. 4 dated 8 March 1996. This project was developed under an existing CAMA permit no. 163-87 .The development provides 99 single family lots of approximately 0.5 acres in size. Of the 99 lots 31 have been sold. These lots include lot 3 thru 6 , 10 thru 13, 17, 19 thru 30, 32 thru 36, 39, 41, 42, 54 and 55. There are 54 lots that front either the Upper Dowry Creek or the Pungo River. The remaining lots are situated in order to provide a view of these bodies of water. The permitted development includes a 72 slip marina , a marina store , a clubhouse, tennis courts , and a swimming pool. Construction of these facilities began in 1992. The roads are constructed and paved with asphalt. The marina and the marina building are completed. There are future plans for multifamily development on lot 100 in the area of the tennis courts and clubhouse. Lots have been sold throughout the subdivision and the construction of residential homes have begun. It is expected that the lots will be sold out in five to seven years and the construction will be built out in approximately 15 years. Dowry Creek is currently served by a dual path 50,OOOgpd extended aeration wastewater treatment plant to treat an estimated 44,000 gallons per day of wastewater from the development. These facilities are currently in place and operating and is permitted under an NPDES permit no. NC006946. Each dwelling or other facility in the development will be equipped with an individual pump station used to pump wastewater into the pressure sewer system. Each pump station was sized to pump peak flow while operating simultaneously with others in the system. After the wastewater is treated the effluent is discharged into an existing force main . The treated effluent is discharged into the Pungo River at a minimum depth of 6 feet below the water surface. The location of the diffuser will be marked by 2 - YxT signs "Effluent discharge, submerged effluent diffuser, boaters take caution not to anchor in this area" . The signs will be located at each end of the 50 foot diffuser. This project was developed under an existing CAMA permit no. 163-87 .The development provides 99 single family lots of approximately 0.5 acres in size. Of the 99 lots 31 have been sold. These lots include lot 3 thru 6 , 10 thru 13, 17, 19 thru 30, 32 thru 36, 39, 41, 42, 54 and 55. There are 54 lots that front either the Upper Dowry Creek or the Pungo River. The remaining lots are situated in order to provide a view of these bodies of water. The permitted development includes a 72 slip marina , a marina store , a clubhouse, tennis courts , and a swimming pool. Construction of these facilities began in 1992. The roads are constructed and paved with asphalt. The marina and the marina building are completed. There are future plans for multifamily development on lot 100 in the area of the tennis courts and clubhouse. Lots have been sold throughout the subdivision and the construction of residential homes have begun. It is expected that the lots will be sold out in five to seven years and the construction will be built out in approximately 15 years. Dowry Creek is currently served by a dual path 50,OOOgpd extended aeration wastewater treatment plant to treat an estimated 44,000 gallons per day of wastewater from the development. These facilities are currently in place and operating and is permitted under an NPDES permit no. NC006946. Each dwelling or other facility in the development will be equipped with an individual pump station used to pump wastewater into the pressure sewer system. Each pump station was sized to pump peak flow while operating simultaneously with others in the system. After the wastewater is treated the effluent is discharged into an existing force main . The treated effluent is discharged into the Pungo River at a minimum depth of 6 feet below the water surface. The location of the diffuser will be marked by 2 - Tx3' signs "Effluent discharge, submerged effluent diffuser, boaters take caution not to anchor in this area" . The signs will be located at each end of the 50 foot diffuser. These signs are a part of this new permit application.
