This letter is in response to your application request for permits under the Coastal Area
Management Act (LAMA) and the state dredge and fill law to excavate an area surrounding your pier
and adjacent your property on Greenville Sound at 6600 Towles Road in Wilmington. Processing
of the application, which was accepted on October 20, 1995 and for which notice of extended review
was given on January 4, 1996, is now complete.
Based on the joint state and Federal agency review, the Division of Coastal Management has
made the following findings:
1) The project has been determined to be new development and does not constitute
maintenance of an existing channel;
2) The proposed dredging will alter approximately 3000 square feet of shallow water
fisheries habitat of Greenville Sound;
3) The project alignment is located in a Primary Nursery Area, so designated by the
Marine Fisheries Commission to afford such areas special protection;
4) Dredging the project alignment reduces the important nursery function of the area for
fish, shrimp, crabs, oysters, and clams which, in turn supports commercial and
recreational fishing;
5) During the course of the permit review, three state agencies recommended denial of
the requested permit;
6) The proposed project is determined to be inconsistent with T15A:07H.0208(b)(1),
which states that 'Navigation channels, canals, and boat basins must be aligned or
located so as to avoid primary nursery areas, highly productive shellfish structures may
cause significant adverse impacts on the value and enjoyment of adjacent properties
or public access to and use of the ocean beach, and, therefore, are prohibited. Such

7) Inasmuch as the proposal is inconsistent with a state standard, the proposal has been
determined to be inconsistent with the New Hanover County Land Use Plan.
Given the preceding findings, it is necessary that your request for a permit under the Coastal
Area Management Act be denied. This denial is made under N.C.G.S. 113A-120(a)(8), which
requires denial of projects inconsistent with the Local Land Use Plan or State Guidelines for Areas
of Environmental Concern.
If you wish to appeal this denial, you are entitled to a hearing. The hearing will involve
appearing before an Administrative Law Judge who listens to the evidence and arguments of both
parties and then makes a recommendation to the Coastal Resources Commission. Your request for
a hearing must be in the form of written petition, complying with the requirements of Chapter 150B
of the General Statues of North Carolina, and must be filed with the Office of Administrative
Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447, (919) 733-2698, within 20 days of this
decision on your permit application. A copy of the petition should be filed with this office.
Also, you should be advised that as long as this state permit denial stands, your project must
be deemed inconsistent with the N.C. Coastal Management Act Program, thereby precluding issuance

this letter. Your appeal must be based on the grounds that the proposed activity is (1) consistent with
the objectives or purposes of CZMA, or (2) is necessary in the interest of national security, and thus,
may be federally approved.

determined to be inconsistent with the New Hanover County Land Use Plan.

9. PROJECT DESCRIPPION 10/20/95
The project site lies south of Bradley .Creek between the Shandy and Turtle Hall developments in New
Hanover County. The property address is 6600 Towles Rd, and is approximately 3/4 acre is size.
Towles Rd. is residential with the exception of the old Westsail property at the northeast terminus of
the road. The project site is the southeast terminus of Towles Rd., and supports a'residence, a pool,
a bulkhead, and a pier. The lot is landscaped with high ground grasses and shrubs to the bulkhead.
Snartina alterniflora marsh appears to abut the bulkhead on aerial photography, but in reality is offset
from the bulkhead by 6' to 8'. This is probably due to recent accretion of sand against the bulkhead
face. The existing pier spans the marsh for approximately 80'. The bottom in the project area is sandy.
The waters of Greeneville Sound are classified SA by the Division of Environmental Management. The
area is designated as Primary Nursery by the Division of Marine Fisheries, and is open to the taking
of shellfish for consumption. New Hanover County classifies the area as Conservation in their Land
Use Plan.
There was a CAMA permit, #55-79, issued for dredging in the adjacent area, from the Westsail Plant
south for 220'. This project was realized. In addition, a permit was issued in 1974 for excavation to
within 52' of the bulkhead on this project site, in the name of Charles Ellington. At that point in time,
the excavation would have led to and around the T-head at the end of the pier. The pier has since been
extended beyond that T-head. There is no indication that this excavation was ever accomplished.
Evidence on the aerial photography does not show any dredged or maintained channel extending into
this project area. The regulatory staff and marine contractors that worked in this area during that period
in time do not recall that the area was ever dredged. Soundings in the area currently average -1' mean
low water to -3' mean low water.
The applicant is proposing to excavate a 40' x 60' basin around the northeast end of his pier to a depth
of -4' mean low water. He is also proposing to continue an access channel to the point reaching -4'
mean low water, which would be for 30' eastward. This channel would also be excavated to a depth
of -4' mean low water, and would be 20' in width. The applicant expects to remove 445 cubic yards
of material from the system with this project; however, based on the submitted soundings, which have
been field verified, this amount should be closer to 300 cubic yards.
The spoil is to be placed on an existing US Army Corp of Engineers spoil island at channel marker 125.
This island is presently diked, and permission is on file to use it. The diked portion of this spoil area
that the applicant is using is approximately 300' x 500', but the applicant plans to utilize a 150' x 100'
area in the southwest corner. Excavation will be accomplished by hydraulic clam bucket to barge, and
off loaded at the spoil site partially de -watered.
10. ANTICIPATED IlVIPACTS
This project would excavate material from an area previously untouched. The excavation would remove
approximately 300 cubic yards of sand from the system. It will disturb approximately 3000 square feet
of shallow bottom area, and cause temporary turbidity increases. The spoil will cause the fill of
approximately 15,000 square feet of high ground within an existing diked spoil area.

The CAMA/Dredge and Fill Permit Application has been reviewed the following comments
is provided for your consideration. Dredging in PNA's is contrary to the protection afforded by
the designation assigned by the North Carolina Marine Fisheries Commission. Maintenance
dredging in a PNA will result in the loss of regularly harvested shellfish for human consumption.
The natural resources in the state are protected from destructive activities by the public trust
policies imbedded in the constitution and the laws of our state. Once PNA's are designated by
the Marine Fisheries Commission they are afforded special protection, this protection should not
be violated. Therefore, I recommend that the permit for dredging in a PNA be denied.

As per your request, Resource Enhancement staff examined
jW existing shellfish data in the area of Mr. William Mingin's
application to dredge 3,000 sf of shallow estuarine bottom. A
substantial portion of the proposed site falls in stratum S
(intertidal firm non -vegetated with shell) in area 5-095.
Shellfish samples indicate a shellfish density of 75.3 oysters
per square meter and 2.5 clams per square meter in this stratum
in this area. Both of these values are above the minimum
established by the Marine Fisheries Commission for a natural
shellfish bed. The remainder of the site falls within a stratum
that produced no shellfish during sampling.
f' Although the intertidal portion of the 3,000 sf site
proposed by Mr. Mingin may or may not currently contain a
standing crop of 56 bushels of oysters and 25 bushels of clams
per acre as indicated by these density estimates, this bottom
type in this area has been established as good shellfish
production habitat and loss of this habitat should not occur.

SUBJECT: CAMA/Dredge and Fill Permit Application for William Edward Mingin, adj. the
AIWW in Greenville Sound, New Hanover County, North Carolina.
Staff biologists with the Wildlife Resources Commission have reviewed the project and
associated impacts on wildlife and fishery resources in the area. A site visit was made November
8, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Coastal Area
Management Act (G.S. 113A-100 through 113A-128).
The applicant is proposing to excavate 40' x 60' area around his existing dock and dredge
a 20' x 30' access channel. This will impact about 3,000 square feet of shallow bottom area in
Greenville Sound. Material is to be removed by a hydraulic clam bucket and placed on a barge to
be off loaded on a previously used spoil site. The spoil will cause the fill of about 15,000 square
feet of high ground within an existing diked spoil area. This area of Greenville Sound is classified
as `SA' waters, designated as a Primary Nursery Area (PNA) and open to the harvest of shellfish.
Our major concern is the potential adverse impacts to marine fauna resulting from
turbidity associated with the proposed activities, particularly in a PNA. Elevated turbidity could
reduce water quality in these areas and stress marine organisms, particularly during warm
weather. Excessive turbidity is particularly damaging to egg and larval life stages of marine
organisms. Therefore, we recommend that dredging activities be prohibited from April 1 through
September 30.

Reference the application of William Edward Mingin for a Department of
the Army permit to excavate approximately 3,000 square feet of nonvegetated
shallow bottom for a boat basin, located in Greenville Sound, at 6600 Towles
Road in Wilmington, New Hanover County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
All work authorized by this permit must be performed in strict
compliance with the permit plans.
All excavated materials will be confined landward of the mean high water
(MHW) elevation contour within adequate dikes or other retaining structures to
prevent spillover of solids into any vegetated wetlands or surrounding waters.
Flow from the diked retention area will be confined by pipe, trough, or
similar device to a point at or below the mean low water (MLW) elevation
contour to prevent gully erosion and siltation.
The existing dike berm of the disposal area will be maintained in its
present condition. Any damage to the berm resulting from the deposition of
spoil material or associated activity will be corrected to the satisfaction of
the U.S. Army Corps of Engineers.
No excavated or fill materials will be placed at any time in any
vegetated wetlands or waters.
Excavation will not exceed 4 feet below the elevation of mean low water
(MLW) and will not occur in any vegetated wetlands or waters.
The permittee's scheme of development, of which the authorized work is a
part, contemplates the presence of structures and their attendant utilities on
lands subject to an easement in favor of the United States for the operation,
maintenance, improvement, and enlargement of the Atlantic Intracoastal
Waterway (AIWW). Accordingly, the permittee will be required to remove such
structures and improvements at his own expense in the event that, in the
judgment of the U.S. Army Corps of Engineers acting on behalf of the United
States, the lands are needed at any time for any purpose within the scope of

the easement. Permanent buildings will not be constructed within the
easement.
No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized
work. Use of the permitted activity must not interfere with the public's
right to free navigation on all navigable waters of the United States.
The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
The authorized structure and associated activity will not cause an
unacceptable interference with navigation.
The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction -related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU'e or
less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or
less in trout waters, are not considered significant.
If the permittee discovers any previously unknown historic or
archeological remains while accomplishing the authorized work, he will
immediately notify the Wilmington District Engineer who will initiate the
required State/Federal coordination.
If possible, under applicable law, the permittee will incorporate this
permit as part of the documents reflecting title to or interest in the real
property affected.
This Department of the Army permit does not obviate the need to obtain
other Federal, State, or local authorizations required by law.
This permit does not grant any property rights or exclusive privileges.
This permit does not authorize interference with any existing or
proposed Federal project.
In issuing this permit, the Federal Government does not assume any
liability for:
a. Damages to the permitted project or uses thereof as a result of
other permitted or unpermitted activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of
current or future Federal activities initiated on behalf of the general
public.
c. Damages to other permitted or unpermitted activities or structures
caused by the authorized activity.
d. Design and construction deficiencies associated with the permitted

work.
e. Damage claims associated with any future modification, suspension,
or revocation of this permit.
DREDGING•
The work authorized herein includes periodic maintenance which may be
performed for ten years from the date of issuance of this permit provided:
a. The permittee will advise the District Engineer in writing at least
two weeks before he intends to undertake any maintenance dredging.
b. The proposed area to be dredged, method of dredging and disposal of
dredged material will be in strict accordance with that authorized by this
permit.

existing pier estimated 315 feet long with floating dock located at 6600 Towles road in Greenville
Sound, Wilmington, N.C. 1n Fcbruaty of 1974 a permit was issuedto Mr. Charles Ellihngton to Dredge

We are asking to redredge this same aria that has net been dredge. in may years to allow, us to dock our
boat in this basin.
Tn response to the request for additional information: Question a) at this time I do not know of
any other way to remove this sand. The system t(lat we propose (slain shell) to use will due less damage
then the suction type dredge ,where a 1)t of sand is loosen up and is nut removed thus canting tide to
have it fill someone else basin. b) the lire only to--ing out the sand that has washed over the years into our
basin: ci the sand that we are rcmovin:� is to be put on and island that corps has given us permi.cion to

Major Development and State Dredge and Fill permit to carry out development on property
located adjacent the AIWW, in New Hanover County. Although processing of the application
is nearing completion, additional time is needed for this office to complete the review and make
a decision on your request. Therefore, it is necessary that the standard review time be extended.
An additional 75 days is provided by G.S. 113A-122(c) which would make March 18, 1996 the
new deadline for reaching a decision on your request. However, we expect to take action prior
to that time and will do so as soon as possible. In the interim, if you have any question on the

The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located at 6600 Towles Rd. in New Hanover County. It was
received completed on 10/20/95, and appears to be adequate for processing at this time. The projected
deadline for making a decision is 1/3/96. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right -of --way fronting your property;
or at a point along the road right -of --way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and
federal review agencies for their comments. If additional information is required based on this review,

The project site lies south of Bradley Creek between the Shandy and Turtle Hall developments in New
Hanover County. The property address is 6600 Towles Rd, and is approximately 3/4 acre is size.
Towles Rd. is residential with the exception of the old Westsail property at the northeast terminus of
the road. The project site is the southeast terminus of Towles Rd., and supports a residence, a pool,
a bulkhead, and a pier. The lot is landscaped with high ground grasses and shrubs to the bulkhead.
Spartina alterniflora marsh appears to abut the bulkhead on aerial photography, but in reality is offset
from the bulkhead by 6' to 8'. This is probably due to recent accretion of sand against the bulkhead
face. The existing pier spans the marsh for approximately 90'. The bottom in the project area is sandy.
The waters of Greeneville Sound are classified SA by the Division of Environmental Management. The
area is designated as Primary Nursery by the Division of Marine Fisheries, and is open to the taking
of shellfish for consumption. New Hanover County classifies the area as Conservation in their Land
Use Plan.
There was a CAMA permit, #55-79, issued for dredging in the adjacent area, from the Westsail Plant
south for 220'. This project was realized. In addition, a permit was issued in 1974 for excavation to
within 52' of the bulkhead on this project site, in the name of. Charles Ellington. At that point in time,
the excavation would have led to and around the T-head at the end of the pier. The pier has since been
extended beyond that T-head. There is no indication that this excavation was ever accomplished.
,Evidence on the aerial photography does not show any dredged or maintained channel extending into
this project area. The regulatory staff and marine contractors that worked in this area during that period
in time do not recall that the area was ever dredged. Soundings in the area currently average -1' mean
low water to -3' mean low water.
The applicant is proposing to excavate a 40' x 60' basin around the northeast end of his pier to a depth
of -4' mean low water. He is also proposing to continue an access channel to the point reaching -4'
mean low water, which would be for 30' eastward. This channel would also be excavated to a depth
of -4' mean low water, and would be 20' in width. The applicant expects to remove 445 cubic yards
of material from the system with this project; however, based on the submitted soundings, which have
been field verified, this amount should be closer to 300 cubic yards.
The spoil is to be placed on an existing US Army Corp of Engineers spoil island at channel marker 125.
This island is presently diked, and permission is on file to use it. The diked portion of this spoil area
that the applicant is using is approximately 300' x 500', but the applicant plans to utilize a 150' x 100'
area in the southwest corner. Excavation will be accomplished by hydraulic clam bucket to barge, and
off loaded at the spoil site partially de -watered.
10. ANTICIPATED EMPACTS
This project would excavate material from an area previously untouched. The excavation would remove
approximately 300 cubic yards of sand from the system. It will disturb approximately 3000 square feet
of shallow bottom area, and cause temporary turbidity increases. The spoil will cause the fill of
approximately 15,000 square feet of high ground within an existing diked spoil area.
