After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept -any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Highest priority shall be allocated to the conservation of estuarine waters and its vital components." 8) The proposed project is determined to be inconsistent with T15A.07H.0208(a)(2)(B), which states "Before receiving approval for location of a use or development within these AECs, the permit -letting authority shall find that no suitable alternative site or location outside of the AEC exists for the use or development and, further, that the applicant has selected a combination of sites and design that will have a minimum adverse impact upon the productivity and biological integrity of coastal marshland, shellfish beds, beds of submerged aquatic vegetation, spawning and nursery areas, important nesting and wintering sites for waterfowl and wildlife, and important natural erosion barriers (cypress fringes, marshes, clay soils)." 9) Inasmuch as the proposal is inconsistent with a state standard or standards, the proposal has been determined to be inconsistent with the Elizabeth City Land Use Plan. Given the preceding findings, it is necessary that your request for a permit under the Coastal Area Management Act be denied. This denial is made pursuant to N.C.G.S. 113A- 120(a)(8), which requires permit denial for projects inconsistent with the state guidelines for Areas of Environmental Concern or the local land -use plan. If you wish to appeal this denial, you are entitled to a hearing. The hearing will involve appearing before an Administrative Law Judge who listens to evidence and arguments of both parties and then makes a recommendation to the Coastal Resources Commission. Elizabeth City is unique in that it has shoreline areas that are located within the estuarine shoreline AEC and shoreline areas that, although they appear identical are not considered estuarine shoreline. Elizabeth City has allowed extensive filling along the non -estuarine shorelines of Charles Creek and Knobbs Creek. The area the applicant wishes to fill is located along a small drainage ditch that empties into the Pasquotank River and the area to be filled is less than A acre. In the Natural Resources section of its plan on page 75 of the 1992 update it states: "The City believes that any development permitted must conform to State, Local and Federal environmental regulations and not cause a degradation or irreversible damage to the sensitive estuarine system." Wetlands are of great importance to fisheries resources, serving as sources of basic biological productivity, providing food directly and indirectly, and serving as nursery areas in some cases. The proposed project consists of placing 180 cubic yards of fill material in wetlands to construct a 160-foot-long by 20-foot-wide stone surface driveway through wetlands. The fill material would be from an upland source. The project area consists of 1.13 acres of upland and 0.63 acre of wetland located adjacent to the Pasquotank River. The wetland area is directly connected to the river and is primarily vegetated with bald cypress (Taxodium distichum). During periods of high water, wooded swamp forests export organic material that is an important component of the detrital based aquatic food chain. They also serve to remove sediments, nutrients, and pollutants from upland run-off before it reaches surface waters.' Foreman, Jr. Bio Report Page Two Site Description The applicant owns a 1.76 acre residential lot in the Winslow Acres subdivision located at 1808 Rivershore Road, Elizabeth City, Pasquotank County, North Carolina. The lot is bounded by the Pasquotank River on a side, a residential lot with a home on a side, Rivershore Road on a side and a small natural canal with a wetland buffer area on a side. The lot has 1.13 acres of highground and .63. acres of wetlands. The highground has been developed with a single family residence, a driveway and a lawn and has an elevation of approximately four feet. Other improvements include a boatlift (Certification of Exemption - October 2, 1995) and a bulkhead and dock (previous owner). The wetland area is vegetated with a thick canopy of bald cypress (Taxodium distichum): DEM classifies the waters of the Pasquotank River at this location as SC. Development Proposal In order to construct a driveway for his home, the applicant proposes to fill approximately 3,200 square feet of Estuarine Shoreline wetlands. The dimensions of the fill area are approximately 160' x 20'. The proposal calls for the driveway surface to be approximately two feet above the existing surface and will require approximately 180 cubic yards of fill. The applicant proposes to stabilize the driveway shoulders by installing temporary silt fencing, planting grass and, if needed, rip rap. Two 15 inch culverts are planned to prevent any blockage of water transfer the proposed causeway would produce. The driveway surface is to be stone. CAMA Review/Anticipated Impacts The proposed project involves the Estuarine Shoreline Area of Environmental Concern. The proposed project will result in .073 acres of Section 404 wetlands being filled. No historical/archeological significance is associated with this lot. Foreman, Jr. Bio Report Page Two Site Description The applicant owns a 1.76 acre residential lot in the Winslow Acres subdivision located at 1808 Rivershore Road, Elizabeth City, Pasquotank County, North Carolina. The th a home on a side, Riverlot re lot is is bounded by the Pasquotank River on a side, a residential lot wi Road on a side and a small natural canal with a wetland buffer area on a side. The lot has 1.13 acres of highground and .63 acres of wetlands. The highground has been developed with a single family residence, a driveway and a lawn and has an elevation of approximately four feet. Other improvements include a boatlift (Certification of Exemption - October 2, 1995) and a bulkhead and dock (previous owner). The wetland area is vegetated with a thick canopy of bald cypress (Taxodium distichum). DEM classifies the waters of the Pasquotank River at this location as SC. Development Proposal In order to construct a driveway for his home, the applicant proposes to fill approximately 3,200 square feet of Estuarine Shoreline wetlands. The dimensions of the fill area are approximately 160' x 20'. The proposal calls for the driveway surface to be approximately two feet above the existing surface and will require approximately 180 cubic yards of till. The applicant proposes to stabilize the driveway shoulders by installing temporary silt fencing, planting grass and, if needed, rip rap. Two 15 .inch culverts are planned to prevent any blockage of water transfer the proposed causeway would produce. The driveway surface is to be stone. CAMA Review/Anticipated Impacts The proposed project involves the Estuarine Shoreline Area of Environmental Concern. The proposed project will result in .073 acres of Section 404 wetlands being filled. No historical/archeological significance is associated with this lot.
