This permit, issued on January 31, 1992 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The low water bulkhead/breakwater will not extend waterward more than 2
feet from the edge of the marsh and will be aligned in strict accordance
with the attached plats. This alignment shall be approved by DCM staff
prior to construction. Failure to initiate construction within thirty
(30) days, or significant erosion of the shoreline by adverse weather
conditions, will require the alignment to be re-examined by DCM staff
within thirty (30) days prior to the new expected start of construction.
2) The height of the structure shall not be greater than the height of the
adjacent marsh substrate. It is recommended that this height be
established by DCM staff.
3) No deadmen or other tie back structures shall be placed in the marsh
without prior DCM approval.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.

ADDITIONAL CONDITIONS
4) The breakwater structure will be constructed so that a one -foot -wide
opening is provided for every 5 linear feet of breakwater.
5) Any secondary wooden breakwater structure will be no closer than one foot
from the primary breakwater, and will be no greater than 24 inches in
length behind each opening in the primary breakwater. Division personnel
are available to assist you with the design and placement of these
structures. You may contact this Division at [phone].
6) The permittee will maintain the authorized work in good condition and in
conformance with the terms and conditions of this permit. The permittee
is not relieved of this requirement if he abandons the permitted activity
without having the permit transferred to a third party. .
7) No backfill is authorized by this permit.
NOTE: Care should be taken during construction to
minimize the disturbance and impacts to
the wetland areas.
8) ' No marsh or wetland areas will be excavated or filled.
9) The authorized structure and associated activity will not cause an
unacceptable interference with navigation.
10) The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction -related discharge. Increases such that the turbidity in the
waterbody is 25 NTUs or less are not considered significant.
