This permit, issued on Februar3� 27, 2013 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Shoreline Stabilization
1) Unless specifically altered herein, this permit authorizes the construction of the bulkhead that is
expressly and specifically set forth in the permit application and workplan drawings.
2) The alignment of the permitted bulkhead shall be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of any construction.
3) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawings.
4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2016
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation landward of the authorized
alignment is permitted except for that which may be required for the construction of the bulkhead wall
and deadmen cables, etc.
6) All backfrll material shall be clean and free of any pollutants except in trace quantities.
7) All backfill material shall be obtained from a high ground source and confined behind the .permitted
bulkhead.
Upland' Development
8) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the above referenced property including the removal of the concrete approach, all as
expressly and specifically set forth in.the attached permit application and workplan drawing. Any
additional land disturbing activities and/or construction may require a modification of this permit.

Sedimentation and Erosion Control
9) In order to ,protect, water quality, runoff from construction shall not visibly increase the amount of
suspended sediments 'in adjacent'waters.
10) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g.. silt fence,
diversion swales or berms, etc.). At a minimum, a silt fence. shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfrlling activities.
11) All disturbed areas shall be properly graded and provided a ground cover sufficient to restrain erosion
within thirty days of project completion.
General
12) Unless specifically altered herein, this permit authorizes the removal the pier and floating dock located
to the north of the existing boat ramp that is expressly and specifically set forth in the permit application
and workplan drawings.
13) The permittee and/or his contractor shall meet with a representative of the Division prior to project
initiation in order to discuss the conditions set forth in this permit.
14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No. SAW -
SAW 2013-00115.

In addition to this completed application form, (MP-1) the following items below, if applicable, must be submitted in order for the application
package to be complete. Items (a) - (1) are always applicable to any major development application. Please consult the application
instruction booklet on how to properly prepare the required items below.

b. An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale. Please give the present status of the
proposed project. Is any portion already complete? If previously authorized work, clearly indicate on maps, plats, drawings to distinguish
between work completed and proposed.
c. A site or location map that is sufficiently detailed to guide agency personnel unfamiliar with the area to the she.
d. A copy of the deed (with state application only) or other instrument under which the applicant claims title to the affected properties.
e. The appropriate application fee. Check or money order made payable to DENR.
f. A list of the names and complete addresses of the adjacent waterfront (riparian) landowners and signed return receipts as proof that such

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by
you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

The project is located within the Marsh Creek Subdivision at the end of Captain Adkins Drive, adjacent to
Dutchman Creek, in Southport, Brunswick County. To find the project site, travel south on NC Highway 133
to Southport. Travel straight through the intersection of N. Howe Street, where Hwy 133 becomes Robert
Roark Drive. Travel approximately 1.25 miles to Captain Adkins Drive. Make a left on Captain Adkins Drive
and travel to the end. Turn left, which continues as Captain Adkins Drive and travel again to the end of the
street. The site will be located on the right.
The project site consists of a single lot measuring approximately''/2 acre in size. The site is bordered by two
residential lots to the east and west, by Dutchman Creek to the north and by Captain Adkins Drive to the south.
Manmade features on the tract include a bulkheaded shoreline, a private concrete boatramp and two docks, one
located on each side of the boat ramp. The southern dock has an 8' in length by 5' in width fixed pier leading
to a L-shaped floating dock. The floating measures 16' in length by 8' in width, extending towards the channel
and terminates in a 30' in length by 8' in width floating dock aligned parallel to the channel. The northern dock
is in disrepair and inaccessible at this time. A short fixed platform remains and a disconnected L-shaped
floating dock runs approximately 16' towards the channel. The floating dock then turns parallel to the channel,
where it measures approximately 25' in length and 8' in width. The lot is elevated approximately 5-8' above
normal high water and is vegetated primarily with lawn grasses and pine trees. There are no coastal wetlands at
the project site. The normal high water line is located at the bulkhead and extends approximately 15' landward
of the bulkhead in the location of the existingboat ramp. A general permit for the boat ramp (Permit # D2615)
was issued to Mr. Herring on March 21, 1988. There is a small area of oysters growing on either side of the
ramp, covering a combined area of approximately 7 square feet.
The waters of Dutchman Creek are classified as SC by the North Carolina Division of Water Quality. They
ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are
closed to the harvest of shellfish.
The applicant is proposing to bulkhead across the existing boat ramp and backfill the ramp landward of the
new bulkhead. After backfilling to the top of the ramp slope, the applicant would also remove the existing
concrete approach to the ramp. The concrete rump located waterward of the bulkhead would remain in
place to reduce bottom disturbance associated with the project. Mr. Herring would also remove the pier
and floating dock located to the north of the existing ramp. The southern dock would remain in place.
10. ANTICIPATED IMPACTS
The proposed project would result in the fill of approximately 255 square feet of Estuarine Waters and Public
Trust Area. The work would result in the backfill and temporary disturbance of approximately 680 square feet
of high ground and the removal of approximately 1,392 square feet of impervious surface. It can be
anticipated that the project will result in temporary increases in turbidity. The project could also result in the
filling of approximately 7 square feet of oyster habitat, located in an area closed to the harvest of shellfishing.

The Wilmington Regional Office of the Division of Water Quality received a copy of the CAMA Major Permit
Application for the subject project on December 20, 2012. Staff review of the plans and specifications has determined
that the development activities proposed at this time will not pose a threat to surface water quality from stormwater
runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a
water quality threat from stormwater runoff should not be subject to the stormwater management permitting
requirements of 15A NCAC 21-1.1000, the stormwater rules. By copy of this letter, we are informing you that this
project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

Recommendations for State Permit — Davis Herring

It is the opinion of this office that the proposed project is consistent with the management objectives and use standards
for the Filling of Canals, Basins and Ditches, as set forth in NCAC 07H .0208(b)(11) and the management objective
and use standards for Coastal Shorelines (NCAC 07H .0209).
This office recommends that should there be no objections from the commenting agencies, a permit be issued including
the following conditions:
1. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters
at or adjacent to the authorized work.
2. In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
3. This permit does not authorize the interference with any existing or proposed Federal project, and, the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which
may be caused from existing or future operations undertaken by the United States in the public interest.
4. The permittee will maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without
having the permit transferred to a third -party.
5. The permitted activity will be conducted in such a manner as to prevent a significant increase in turbidity
outside of the area of construction or construction -related discharge. Increases such that the turbidity in the
waterbody is 25 NTU's or less in all saltwater classes are not considered significant.
6. Appropriate sedimentation and erosion control devices, measures or structures must be implemented to ensure
that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion
swales or berms, sand fence, etc.).
7. The disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion within
30 working days of project completion.
8. Any development or land disturbing activity that is considered non -water dependent is not authorized within 30
feet of the normal high water level unless specifically exempted by Coastal Resource Commission (CRC)
regulations in place at the time of such development.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals
or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit. Contact a
representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this
determination.

Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine
Shoreline, Estuarine Waters, and Public Trust areas. Waters at the project site are
classified as SC and are not open to the harvesting of shellfish. The area is a Primary
Nursery Area.
I have reviewed this proposal for consistency with the Town of Southport Land Use Plan
and offer the following comments.
The general area of the project is classified as Medium Density Residential.
In general, Southport allows development in Medium Density Residential classified
AECs, which is consistent with the State's minimum use standards. The Southport Land
Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these standards appear to be applicable to this proposal.

decision is 2/27/13. An additional 75-day review period is provided by law when such time is necessary to complete the review. If
you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended.
Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 12/12/12 you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held
within five working days from the receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing' postcard which must be posted at the property of your proposed development.
You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a
point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in
an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State

To whom it may concern:
We are proposing to eliminate the existing boat ramp located on lot #18, Capt. Adkins Drive SE in
Smithville Woods subdivision. We propose to construct a bulkhead that connects the existing bulkhead
which is parallel to Dutchman Creek, then backfill the old boat ramp to the height of the undisturbed
natural surrounding soil. The boat ramp is 17'wide by 15' landward of normal high water. The bulkhead
to be installed is IS'water ward of normal high water. The boat ramp approach concrete will be
removed to bring land up to the adjacent grade. The west dock will be removed also.
The purpose of this project is to eliminate the existing boat ramp, enhance the site, and bring it back to
a standard residential lot. The entire project consists of backfilling; there will be no excavating on the
existing site of the boat ramp.

1. Please submit a copy of your deed for the property.

During the pre -application or application submittal meeting, a DCM representative will sit
down with you and review the application package for completeness. The Division
representative will refer to this checklist to determine whether or not an application is
deemed to be complete or to be insufficient. If an application package is deemed incomplete,
the speck deficiencies will be noted on the application checklist. A copy of the checklist will
be provided to the applicant, or applicant's agent, at the end of the meeting. Once the items
have been addressed, the applicant or agent should contact the local field representative to
schedule a final meeting.
PERMIT APPLICATION FORMS
All applicants must completely fill out all three pages of the DCM MP-1 form. Depending on
the scope of the proposed development, you will also need to fill out some or all of the
additional form(s) listed below. A checkmark beside the applicable form(s) indicates that the
forms are required for the proposed development.

submitted workplan drawings.
WORKPLAN DRAWINGS
All drawings must be neat, clear, and of standard size to permit photographic reproduction. If
blue prints or sheets larger than II" x 17" are used, 27 copies must be submitted (it is
advisable to request that a Division representative inspect a final copy of the workplan
drawings) prior to making the required 27 copies). Drawings larger than 1 I" x 17" should
be folded to legal size or smaller. If color coded drawings are submitted, regardless of paper
size, then 27 (preapproved) copies will be required.
The workplan drawings must be accurately drawn to an engineers scale (1"-200' or less)
(example 1"=30'), 1"=50', 1"=60', 1"=100', etc.). The scale must be indicated on the
drawings.
The following list of items must be indicated on the workplan drawings. No application or
workplan drawings will be accepted as complete until all of the applicable items on the
checklist have been approved by the DCM.
A DCM representative will review the permit application and workplan drawing(s) and
mark off each item(s) listed on the checklist that is deemed to be complete. An item that has
not been "checked off' indicates that additional information is needed in order to accept the
application as complete, or that the item is "Not Applicable" to the proposed project. A copy
of the checklist will be provided to you at the end of the pre -application meeting, or
submission meeting, once the entire permit application package has been reviewed.
