This permit, issued on Janua4 14, 2013 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Upland Development
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the retaining
wall and single family residence, all as expressly and specifically set forth in the attached permit
application and workplan drawings. Any additional land disturbing activities and/or construction
may require a modification of this permit. Contact a Division of Coastal Management representative
at (252) 264-3901 for this determination.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2016
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
Retaining Wall
The alignment of the retaining wall shall be staked by the permittee and approved on site by a Division
of Coastal Management representative prior to initiation of construction.
The authorized retaining wall shall adhere to the alignment depicted on the attached workplan drawings.
The retaining wall shall be constructed prior to any backfilling activities.
The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.
The retaining wall shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
The retaining wall shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet
piles, or other suitable materials approved by Division personnel.
All backfill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
10) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the top of the retaining wall immediately following completion of backfilling
activities.
General
11) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused
thereby, without expense to the United States or the state of North Carolina. No claim shall be made
against the United States or the state of North Carolina on account of any such removal or alteration.
12) No wetlands shall be excavated or filled, even temporarily, outside of the areas indicated on the attached
workplan drawings.
13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to a stormwater
management permit from the Division of Water Quality.
NOTE: Future development of the permittee's property may require a modification of this permit.

In accordance with your application to be covered under the State Stormwater General Permit
for Single Family Residences, received on January 17, 2013, we are forwarding herewith the
subject Certificate of Coverage Number SWG010014 to construct and maintain Impervious
areas, and stormwater control measures, associated with a single family residence under the
subject General Permit. This permit is issued pursuant to the requirements of North Carolina
General Statute 143-215.1 and Title 15A NCAC 2H .1000, the stormwater management rules.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division of Water Quality (DWQ . The DWQ may require modification or revocation and
reissuance of the Certificate of Coverage.
This permit does not affect the legal requirement to obtain other permits which may be required
by the Division of Water Quality, the Division of Land Resources, Coastal Area Management
Act, or any other Federal, State, or Local agency, law, rule, or ordinance.

LOT 8 — ALBEMARLE PLANTATION
SECTION L-3 * PHASE 2
Lot 8 of Sound View at Albemarle Plantation, Section L-3, Phase 2 is a long, narrow lot at the end of
Country Club Drive. This lot is constrained in its development envelope by a long, bulkheaded shoreline on the
Albemarle Sound and two areas ofwetlands subject to Section 404 of the Clean Water Act on the north and east sides of �2
the property. A SO -foot stonnwater buffer extends landward from the Albemarle Sound side of the property and a 30-foot
building setback from the road side.
The applicant designed a house that was commensurate with the other homes in the area before discovering the
stormwater buffer. A redesign ofthe house allowed for alignment outside ofthe buffer, extending only five feet into the
building setback (allowed by the County) but resulted in the need to fill wetlands in order to provide a foundation for the
house with adequate access to the deadmen for figure repair.
The plan represents the third iteration to avoid wetland impacts however, due to the storrnwater buffer, the budding must
encroach into wetlands. The area of fill in wetlands has been minhnized by reducing the size of the residential structure
and by employing retaining walls to confine the fill.
Mitigation for the wetland fill is proposed by purchase ofavdits on a ratio of2:1 from the North Carolina Ecosystem
Enhancement Program.
The construction will begin with the installation of a vinyl wall supported by tiebacks to deadmen. Fill will be brought to
the site and placed behind the retaining wall, compacted, and prepared for construction. The house will be constructed
and the yard stabilized with turf and landscaping.

you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate.this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit

8. PROJECT SUMMARY: The applicant is proposing to construct a single family residence that
will fill 4,362 SF of wetlands regulated by the U.S. Army Corps of Engineers.
Proiect Settine
The subject property is located at the southern -most end of Country Club Drive in the Albemarle
Plantation subdivision in Hertford, Perquimans County. It is bordered by the Albemarle Sound to the
south, single family residences to the northeast, an undeveloped lot comprised primarily of wetlands
regulated by the U.S. Army Corps of Engineers to the north, and portions of the Albemarle Plantation
golf course to the east and west that also contain Corps regulated wetlands. The Albemarle Sound is
classified as SB (Recreation) and is closed to shellfish harvesting in this area.
The subject property is comprised of an uplands section located in the center of the lot that extends
toward the southwest comer of the property. The eastern and western portions of the lot are
comprised of U.S. Army Corps of Engineers regulated wetlands containing mature Cypress trees and
a few Sweetgum. Approximately 45% of the lot is uplands, with the western wetlands area
comprising 35% of the lot and the eastern wetlands area covering the remaining 20%. The western
portion of the lot contains a small, shallow stream that meanders through, and eventually dissipates
into, the wetlands.
The 697 feet of sound front located on the subject property is hardened with 283 feet of bulkhead and
25 feet of riprap. Neither of the adjacent riparian properties' shorelines has been hardened. No pier
structures have been constructed on the subject property or the adjacent riparian properties.
The uplands portion of the tract has been cleared and is vegetated with manicured lawn grasses with
several medium size cypress trees growing on the water ward side of the property's bulkhead.
Several medium size pine trees separate the uplands area from the Corps regulated wetlands located
on the western portion of the property.
The lot has elevations ranging from normal water level (NWL) along the on -site wetlands to 5 feet
above NWL across the uplands portion of the lot.
Development Proposal
The applicant is proposing to construct a single family residence in the Estuarine Shoreline AEC that will
result in the fill of 4,362 SF of wetlands regulated by the U.S. Army Corps of Engineers. The applicant
proposes to construct a 105-foot long retaining wall on the east side of the proposed single family
residence and a 150-foot long retaining wall on the west side of the house. Construction and backfill of
the east side structure will fill 1,954 SF of wetlands while the construction and backfill of the west side
structure will fill 2,408 SF. None of the proposed fill will impact wetlands regulated by the Division of
Coastal Management.

It is anticipated that the proposed project will have the following impacts:
• Construction of the single family residence will disturb - 10,650 SF of Estuarine Shoreline
AEC.
Construction of the single family residence will fill 3,362 SF of wetlands regulated by the U.S.
Army Corps of Engineers located within the Estuarine Shoreline AEC and another 1,000 SF
located beyond the Division of Coastal Management's AECs.

LOT 8 — ALBEMARLE PLANTATION
SECTION L-3 * PHASE 2
Lot 8 of Sound View at Albemarle Plantation, Section L-3, Phase 2 is a long, narrow lot at the end of _
Country Club Drive. This lot is constrained in its development envelope by a long, bulkheaded shoreline on the �Z
Albemarle Sound and two areas ofwetlands subject to Section 404 ofthe Clean Water Act on the north and east sides of
the property. A 50-foot stommwater buffer extends landward from the Albemarle Sound side ofthe property and a 30-foot
budding setback from the mad side.
The applicant designed a house that was commensurate with the other homes in the area before discovering the
stormwater buffer. A redesign ofthe house allowed for alignment outside ofthe buffer, extending only five feet into the
building setback (allowed by the Coumy) but resulted in the need to fill wetlands in order to provide a foundation for the
house with adequate access to the dead men for future repair.
The plan represents the third iteration to avoid wetland impacts; however, dare to the storrnwater buffer, the building must
encroach into wetlands. The area of fill in wetlands has been minimized by reducing the sire ofthe residential structure
and by employing retaining walls to confine the fill.
Mitigation for the wetland fill is proposed by purchase of credits on a ratio of2:1 from the North Carolina Ecosystem
Enhancement Program.
The construction will begin with the installation ofa vinyl wall supported by tiebacks to deadmen. Fill will be brought to

PROPOSED
DEVELOPMENT: The applicants are proposing to construct a single family residence that
will fill 4,362 SF of wetlands regulated by the U.S. Army Corps of
Engineers; 3,362 SF of which are located in the Estuarine Shoreline AEC.
The following is a review of the applicable portions of 15 NCAC Subchapter 7H, "State
Guidelines for Areas of Environmental Concern," as they apply to the permit request.
15A NCAC 07H .0203 MANAGEMENT OBJECTIVE OF THE ESTUARINE AND
OCEAN SYSTEM
It is the objective of the Coastal Resources Commission to conserve and manage estuarine
waters, coastal wetlands, public trust areas, and estuarine and public trust shorelines, as an
interrelated group of ABCs, so as to safeguard and perpetuate their biological, social, economic,
and aesthetic values and to ensure that development occurring within these AECs is compatible
with natural characteristics so as to minimize the likelihood of significant loss of private property
and public resources. Furthermore, it is the objective of the Coastal Resources Commission to
protect present common-law and statutory public rights of access to the lands and waters of the
coastal area.
Consistent: In my opinion, the proposed development is consistent with the intent of this rule.

15A NCAC 07H .0208 USE STANDARDS
(a) General Use Standards
(1) Uses which are not water dependent shall not be permitted in coastal wetlands,
estuarine waters, and public trust areas. Restaurants, residences, apartments,
motels, hotels, trailer parks, private roads, factories, and parking lots are examples
of uses that are not water dependent. Uses that are water dependent include:
utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging,
bridges and bridge approaches, revetments, bulkheads, culverts, groins,
navigational aids, mooring pilings, navigational channels, access channels and
drainage ditches;
Consistent: In my opinion, the proposed development is consistent with the intent
of this rule.
(2) Before being granted a permit, the CRC or local permitting authority shall find
that the applicant has complied with the following standards:
(A) The location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective
of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall
be sited and designed to avoid significant adverse impacts upon the productivity
and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic
vegetation as defined by the Marine Fisheries Commission, and spawning and
nursery areas;
Consistent: Subject to recommended conditions.
(B) Development shall comply with state and federal water and air quality

(C) Development shall not cause irreversible damage to documented
archaeological or historic resources as identified by the N.C. Department of
Cultural resources;

of this rule.
(D) Development shall not increase siltation;

of this rule.
(E) Development shall not create stagnant water bodies;

(F) Development shall be timed to avoid significant adverse impacts on life
cycles of estuarine and ocean resources; and

15A NCAC 07H .0209 COASTAL SHORELINES
(c) Management Objective. The management objective is to ensure that shoreline development
is compatible with the dynamic nature of coastal shorelines as well as the values and the
management objectives of the estuarine and ocean system. Other objectives are to conserve and
manage the important natural features of the estuarine and ocean system so as to safeguard and
perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a
management system capable of conserving and utilizing these shorelines so as to maximize their
benefits to the estuarine and ocean system and the people of North Carolina.
Consistent: In my opinion, the proposed development is consistent with the intent of this rule.
(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph (c) of this Rule. These uses shall be limited to those types of development activities
that will not be detrimental to the public trust rights and the biological and physical functions of
the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid,
mitigate or reduce adverse impacts of development to estuarine and coastal systems through the
planning and design of the development project. In every instance, the particular location, use,
and design characteristics shall comply with the general use and specific use standards for
coastal shorelines, and where applicable, the general use and specific use standards for coastal
wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section.
Development shall be compatible with the following standards:
(1) All development projects, proposals, and designs shall preserve and not weaken
or eliminate natural barriers to erosion including peat marshland, resistant clay
shorelines, and cypress -gum protective fringe areas adjacent to vulnerable
shorelines.
Consistent: In my opinion, the proposed development is consistent with the intent
of this rule.
(2) All development projects, proposals, and designs shall limit the construction of
impervious surfaces and areas not allowing natural drainage to only so much as is
necessary to adequately service the major purpose or use for which the lot is to be
developed. Impervious surfaces shall not exceed 30 percent of the AEC area of
the lot, unless the applicant can effectively demonstrate, through innovative
design, that the protection provided by the design would be equal to or exceed the
protection by the 30 percent limitation. Redevelopment of areas exceeding the 30
percent impervious surface limitation may be permitted if impervious areas are
not increased and the applicant designs the project to comply with the intent of the
rule to the maximum extent feasible.
Consistent: In my opinion, the proposed development is consistent with the intent
of this rule.

(3) All development projects, proposals, and designs shall comply with the following
mandatory standards of the North Carolina Sedimentation Pollution Control Act
of 1973:
(A) All development projects, proposals, and designs shall provide for a buffer
zone along the margin of the estuarine water which is sufficient to confine
visible siltation within 25 percent of the buffer zone nearest the land
disturbing development.
Consistent: In my opinion, the proposed development is consistent with
the intent of this rule.
(B) No development project proposal or design shall permit an angle for
graded slopes or fill which is greater than an angle which can be retained
by vegetative cover or other erosion -control devices or structures.
Consistent: In my opinion, the proposed development is consistent with
the intent of this rule.
(4) Development shall not have a significant adverse impact on estuarine and ocean
resources. Significant adverse impacts include development that would directly
or indirectly impair water quality standards, increase shoreline erosion, alter
coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils
waterward of normal water level or normal high water, or cause degradation of
shellfish beds.
Consistent: In my opinion, the proposed development is consistent with the intent
of this rule.
(5) Development shall not interfere with existing public rights of access to, or use of,
navigable waters or public resources.
Consistent: In my opinion, the proposed development is consistent with the intent
of this rule.
(7) Development . shall not cause irreversible damage to valuable, historic
architectural or archaeological resources as documented by the local historic
commission or the North Carolina Department of Cultural Resources.
Consistent: In my opinion, the proposed development is consistent with the intent
of this rule.
(8) Established common-law and statutory public rights of access to the public trust
lands and waters in estuarine areas shall not be eliminated or restricted.
Development shall not encroach upon public accessways nor shall it limit the
intended use of the accessways.

the development takes place.

15A NCAC 07H .0602 POLLUTION OF WATERS
No development shall be allowed in any AEC which would have a substantial likelihood of
causing pollution of the waters of the state in which shellfishing is an existing use to the extent
that such waters would be officially closed to the taking of shellfish. This rule shall also apply to
development adjacent to or within closed shellfish waters when a use attainability study of those
waters documents the presence of a significant shellfish resource in an area that could be
expected to be opened for shellfishing given reasonable efforts to control the existing sources of
pollution.
Consistent: In my opinion, the proposed development is consistent with the intent of this rule.
Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application, and plans, I recommend a Major Permit be issued to the Barbara and John
Hendricksen, provided the applicants obtain the necessary permit from the U.S. Army Corps of
Engineers and provide a copy of that permit to DCM staff in Elizabeth City prior to beginning
construction.

8. PROJECT SUMMARY: The applicant is proposing to construct a single family residence that
will fill 4,362 SF of wetlands regulated by the U.S. Army Corps of Engineers.
Protect Setting
The subject property is located at the southem-most end of Country Club Drive in the Albemarle
Plantation subdivision in Hertford, Perquimans County. It is bordered by the Albemarle Sound to the
south, single family residences to the northeast, an undeveloped lot comprised primarily of wetlands
regulated by the U.S. Army Corps of Engineers to the north, and portions of the Albemarle Plantation
golf course to the east and west that also contain Corps regulated wetlands. The Albemarle Sound is
classified as SB (Recreation) and is closed to shellfish harvesting in this area.
The subject property is comprised of an uplands section located in the center of the lot that extends
toward the southwest corner of the property. The eastern and western portions of the lot are
comprised of U.S. Army Corps of Engineers regulated wetlands containing mature Cypress trees and
a few Sweetgum. Approximately 45% of the lot is uplands, with the western wetlands area
comprising 35% of the lot and the eastern wetlands area covering the remaining 20%. The western
portion of the lot contains a small, shallow stream that meanders through, and eventually dissipates
into, the wetlands.
The 697 feet of sound front located on the subject property is hardened with 283 feet of bulkhead and
25 feet of riprap. Neither of the adjacent riparian properties' shorelines has been hardened. No pier
structures have been constructed on the subject property or the adjacent riparian properties.
The uplands portion of the tract has been cleared and is vegetated with manicured lawn grasses with
several medium size cypress trees growing on the water ward side of the property's bulkhead.
Several medium size pine trees separate the uplands area from the Corps regulated wetlands located
on the western portion of the property.
The lot has elevations ranging from normal water level (NWL) along the on -site wetlands to 5 feet
above NWL across the uplands portion of the lot.
Development Proposal
The applicant is proposing to construct a single family residence in the Estuarine Shoreline AEC that will
result in the fill of 4,362 SF of wetlands regulated by the U.S. Army Corps of Engineers. The applicant
proposes to construct a 105-foot long retaining wall on the east side of the proposed single family
residence and a 150-foot long retaining wall on the west side of the house. Construction and backfill of
the east side structure will fill 1,954 SF of wetlands while the construction and backfill of the west side
structure will fill 2,408 SF. None of the proposed fill will impact wetlands regulated by the Division of
Coastal Management.

It is anticipated that the proposed project will have the following impacts:
Construction of the single family residence will disturb — 10,650 SF of Estuarine Shoreline
AEC.
Construction of the single family residence will fill 3,362 SF of wetlands regulated by the U.S.
Army Corps of Engineers located within the Estuarine Shoreline AEC and another 1,000 SF
located beyond the Division of Coastal Management's AECs.
Available maps indicate there are no archeological sites near the subject property.

Lot 8 of Sound View at Albemarle Plantation, Section L-3, Phase 2 is a long, narrow lot at the end of
Country Club Drive. This lot is constrained in its development envelope by a long, bulkheaded shoreline on the
Albemarle Sound and two areas ofwetlands subject to Section 404 ofthe Clean Water Ad on the north and east sides of
the property. A 50-foot stormwater buffer extends landward from the Albemarle Sound side ofthe pmpeny and a 30-foot
building setback from the road side.
The applicant designed a house that was commensurate with the other homes in the area before discovering the
stormwater buffer. A redesign ofthe house allowed for alignment outside ofthe buffer, extending only five feet into the
building setback (allowed by the County) but resulted in the need to fill wetlands in order to provide a foundation for the
house with adequate access to the deadmen for future repair.
The plan represents the thud iteration to avoid wetland impacts; however, due to the stonnwater buffer, the building must
encroach into wetlands. The area of fill in wetlands has been minimized by reducing the size of the residential structure
and by employing retaining walls to confine the fill.
Mitigation for the wetland fill is proposed by purchase ofcredits on a ratio of2:1 from the North Carolina Ecosystem
Enhancement Program.
The construction will begin with the installation ofa vinyl wall supported by tiebacks to deadmen. Fill will be brought to
the site and placed behind the retaining wall, compacted, and prepared for construction. The house will be constructed
and the yard stabilized with turf and landscaping.

terminus cul-de-sac of Country Club Drive, in Albemarle Plantation, Perquimans
County.

Consistency Determination: The request is consistent with/not in conflict with the 1998
Perquimans County Land Use Plan certified by the CRC on
October 24, 2002.
Overview: The subject property is a 1.25 acre lot with approximately 697 feet of shoreline along
the Albemarle Sound. The property is comprised of uplands in the center of the lot and Section
404 wetlands to the east and west. The site is undeveloped except for 283 linear feet of
bulkhead and 25 feet of riprap along the shoreline. The property is within the AE floodzone.
Elevations range from Normal Water Level (NWL) along the on -site wetlands to 5 feet above
NWL across the upland portion of the lot.
Construction of a single-family house, a 105 foot long retaining wall and a 150 foot long
retaining wall, within 75 feet of the shoreline is proposed. Construction of the house and
construction and backfill of the retaining walls will result in impacts to Section 404 wetlands. A
driveway will also be constructed. The house has been situated outside of a 50 foot stormwater
buffer along the sound.
The waters of the Albemarle Sound are classified as SB in this area and are closed to shellfish
harvesting. There are no known archaeological sites associated with the property.
Anticipated Impacts resulting from this project are expected to include: the disturbance of
10,650 sq. ft. of Estuarine Shoreline Area of Environmental Concern (AEC), and; the filling of
3,362 sq. ft. of Section 404 Wetlands within the Estuarine Shoreline AEC and 1,000 sq. ft. of
Section 404 Wetlands outside of the Estuarine Shoreline AEC.
Mitigation for wetland fill is proposed by purchase of credits on a ratio of 2:1 from the North
Carolina Ecosystem Enhancement Program.

Basis for Determination:
The Perquimans County Land Classification Map identifies the site area as "Developed". As
noted on Page 49 of the Land Use Plan (LUP), all areas within an AEC also qualify for the
designation of "Conservation". The following are LUP policies that may be applicable to this
request:

"Perquimans County will continue to support and enforce, through its CAMA Minor
Permitting capacity the State policies and permitted uses in Areas of Environmental

Chapter 15A, Subchapter 7H of the North Carolina General Statutes.".

The following comments by the North Carolina Division of Marine Fisheries (NCDMF) on the subject project
are offered pursuant to G.S. 113-131. The applicant is proposing to construct a single family residence in the
Estuarine Shoreline AEC that will result in the fill of 4,362fe of U.S. Army Corps of Engineers' wetlands
(1,954f to the west of the house and 2,408f to the east of the house) at the mouth of the Yeopim River on a
lot that currently has a bulkhead. The applicant proposes to construct a 105 foot long retaining wall on the east
side of the residence and a 150 foot long retaining wall on the west side of the house. The applicant states that
they designed a house to be similar in size to other houses in the development but they have minimized wetland
impacts by reducing the footprint of the structure. The applicant has proposed purchasing EEP credits (2:1) for
the wetland impacts, but no documentation from EEP has been provided.
The NCDMF is concerned regarding the wetland impacts from the project as this project is located near a golf
course and there are limited wetlands at the location. Mallin and Wheeler (2000) studied the effect of golf
courses in New Hanover and Brunswick counties on water quality in adjacent water bodies. Although this
study found that ammonium and orthophosphate was tightly bound to the soils, nitrate levels in the streams
increased as they flowed through the courses and in some places caused increases in phytoplankton biomass and
algal blooms. The authors concluded that waters adjacent to golf courses having vegetated buffer zones, wet
detention ponds, and wooded wetland areas had considerably lower nutrient levels than sites without these
landscape features and management tools (Mallin and Wheeler 2000 and Deaton et al. 2010). The NCDMF
looks for avoidance, minimization, and if avoidance and minimization is demonstrated that the applicant can
explore mitigation options. The NCDMF requests that the applicant redesign the proposal to minimize the
wetland impacts from the project. Options for minimizing the fill include redesigning the structure to make the
structure smaller to bring the retaining wall out of the wetlands, changing the orientation of the house to keep
the garage and driveway out of the wetland to reduce the fill, moving the deck of the north side of the house to
the west can minimize the fill to the west of the house. Once avoidance and minimization has been
demonstrated an accepted EEP mitigation letter should be provided with the project application.

Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is located at the
south end of Country Club Drive within Albemarle Plantation near Hertford, NC. Our continents are
provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through
113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and
Wildlife Coordination Act (48 Stat 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to construct a single family residence and retaining wall structure that will
fill approximately 4,362 SF of Section 404 wetlands. A 105' long retaining wall on the east side of the
residence and a 150' long retaining wall on the west side compose the wetland impacts. The Albemarle
Sound at this location is classified SB by the Environmental Management Commission.
The NCWRC has reviewed the permit application and requests avoidance and minimization of
wetland impacts be demonstrated. Minimization could occur with residence realignment or changes in
either the construction or dimensions of the retaining wall.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts. - It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved. You must also comoly with all other state federal or local government permits regulations or authorizations associated
with the proposed activity including SL 2009-337: An Act to Promote the Use of Compensatory Mitigation Banks as amended by
S.L.2011-343.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit1401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation are
summarized in the following table. The amount of mitigation required for this impact is determined by permitting agencies.

The NC Division of Coastal Management hereby acknowledges receipt of your application on
August 30, 2012 for State approval for the development of the referenced project. An initial
screening of the submittal package has been conducted. This revealed certain deficiencies, which
must be corrected before the application package can be accepted as complete. To assist you in
expediting the permitting process as much as possible, I am notifying you of these deficiencies
immediately so that they can be quickly corrected to facilitate my detailed review.
Because the deficiencies are easily correctable, I am not returning the original application
package. Please make the needed changes, and submit the appropriate documentation. With the
retained copy of the application, I can commence the detailed review. Please understand that the
subsequent detailed review may reveal additional areas where further information or
documentation is required to demonstrate compliance with the rules directly applicable to the
proposed development. If this occurs, you will be notified of such issues separately.
Our initial screening has identified the following deficiencies:
1. Adequate Work Plans or Drawings have not been submitted. Please address the following
items:
■ When drawings are larger than 11 inches by 17 inches, 26 copies must be
provided (after the minor corrections listed below are made).

Indicates the full extent of the creek located to the west of the proposed

2. Additional detailed information must be provided to reflect all development within, or
impacting, Areas of Environmental Concern. Please provide the area of wetland fill and
the area of disturbance that will occur within the Estuarine Shoreline AEC.

3. Documentation of Notification of Riparian Property Owners must be provided. Please
submit Certified Return -Mail Receipts for this notification, along with a copy of the
notification provided to these owners and any comments received in reply.
To expedite our response to your permitting request, we will commence the detailed review of
your application for a permit pending the receipt of the additional information requested above.
However, the statutorily provided 75/150 days allowed for review cannot commence until such
time as we have received a complete application package. Once your application has been
accepted as complete, you will receive a separate notification letter.
If it is not possible to render a permit decision within 70 days of the date when your application
is received complete, you may request a meeting with the Director of the Division of Coastal
Management and permit staff to discuss the status of your project. Such a meeting will be held

development of their property located at Country Club Drive in the Albemarle Plantation

to be adequate for processing at this time. The projected deadline for making a
decision is December 5, 2012. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th

associated Regional Supplement and is part of a broad continuum of wetlands connected to the Albemarle
Sound, a TNW.
