with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Fill Area
1) All fill material will be obtained from a highground source.
2) The fill material will be clean and free of any pollutants, except in trace quantities.
3) Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales, or
burlap must be installed between the land -disturbing activity and the adjacent marsh or water areas,
until such time as the area has been properly stabilized with a vegetated cover.
4) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.

This permiLaction may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
5) The activity will be conducted in a way that prevents a significant increase in turbidity outside the
area of construction or construction -related discharge. Increases such that the turbidity in the water
body is 25 NTUs or less are not considered significant.
Other Facilities
6) As per the permittee's request dated received 2/5/96, all reference to pond excavation and boat
ramp construction is hereby deleted.
7) This permit authorizes only the docks, piers, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other
structures, whether floating or stationary, may become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures may be conducted on,
in or over public trust waters without permit modification.
8) The docks and associated structures shall have a minimum setback distance of 15' between any
parts of the structure and the adjacent property lines as extended perpendicular to the channel
into the water at the points where they intersect the shoreline.
9) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
10) The authorized structure and associated activity must not cause an unacceptable interference
with navigation.
11) No sewage, whether treated or untreated, shall be discharged at any time from boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
NOTE: Plans and specifications of all water system improvements must be approved
by the Division of Environmental Health prior to the award of a contract or
the initiation of construction (as required by 10 NCAC, 10D.0900, et. seq).

quirements for septic tank installations (as required under 10 NCAC, 10A
.1900, et. seq). For information concerning septic tank and other onsite

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 112" by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

site. Include highway or secondary road (SR)
numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy of the application and plats
by certified mail. Such landowners must be advised
that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.

Fill Area
1) All fill material will be obtained from a highground source.
2) The fill material will be clean and free of any pollutants, except in trace quantities.
3) Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales, or
burlap must be installed between the land -disturbing activity and the adjacent marsh or water areas,
until such time as the area has been properly stabilized with a vegetated cover.
4) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.

other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999

ADDITIONAL CONDITIONS
5) The activity will be conducted in a way that prevents a significant increase in turbidity outside the
area of construction or construction -related discharge. Increases such that the turbidity in the water
body is 25 NTUs or less are not considered significant.
Other Facilities
6) As per the permittee's request dated received 2/5/96, all reference to pond excavation and boat
ramp construction is hereby deleted.
7) This permit authorizes only the docks, piers, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other
structures, whether floating or stationary, may become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures may be conducted on,
in or over public trust waters without permit modification.
8) The docks and associated structures shall have a minimum setback distance of 15' between any
parts of the structure and the adjacent property lines as extended perpendicular to the channel
into the water at the points where they intersect the shoreline.
9) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
10) The authorized structure and associated activity must not cause an unacceptable interference
with navigation.
11) No sewage, whether treated or untreated, shall be discharged at any time from boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation
of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
NOTE: Plans and specifications of all water system improvements must be approved
by the Division of Environmental Health prior to the award of a contract or
the initiation of construction (as required by 10 NCAC, 10D.0900, et. seq).

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Reference your application for a Department of the Army permit to place
fill material in approximately 13,000 square feet of vegetated wetlands and to
construct an elevated walkway, floating docks, and a boat ramp, resulting in
impacts to approximately 2,500 square feet of non -vegetated wetlands and water
of Town Creek, west of US 17 at Winnabow, in Brunswick County, North Carolina.
Your proposal has been reviewed and found to be consistent with the
provisions and objectives of general permit No. 198000291. Therefore, you may
commence construction activity in strict accordance with applicable State
authorization and the enclosed plan. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action is
necessary as revised plans must be reviewed and the authorization modified.

means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS I I3A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans,, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for

Recommendations for State Permit - Steve Thompson
Since Town Creek is classified as inland waters and there are no coastal wetland species present, the area
comes under CAMA jurisdiction by way of Public Trust waters and consistency with local, state and federal
programs. The floating docks are consistent with the management objectives and use standards for Public Trust
Areas (7H.0207). The proposed boat ramp and four foot wide walkways, though technically are not within
coastal wetlands, are still consistent with use standards set forth for Coastal Wetlands (7H.0209). The pottery
studio, which is proposed to be located on the upland portion of the lot with an attached deck on pilings is outside
of CAMA's jurisdiction but is consistent with federal regulations. It was disclosed during conversation with a
Corps of Engineers (COE) representative that the filling of 0.3 acres of federal wetlands is not consistent with
COE regulations and such action would require a separate review and an individual permit. There are also
concerns from CAMA that the filling of wetlands adjacent to Public Trust waters may result in water quality
degradation (7H.0208). The COE representative also disclosed that 0.1 acres or less of fill in federal wetlands
may be authorized under a Nationwide Permit #18, which would not require separate review and could be
conditioned on the CAMA major permit. If strategically placed along the marginal fringe of wetlands adjacent
to the upland, 0.1 acres of fill could possibly increase the parking area while maintaining most of the filtering
capacity of the wetlands. Effective sedimentation and erosion control measures should further lessen the impact.
Based on the above, I recommend allowing the applicant to fill only 0.1 acres of federal wetlands according to
aitd under the guidance of a DCM field representative and US Corps of Engineers concurrence. If the applicant
insists on filling 0.3 acres of wetlands, I recommend the applicant obtain a separate review and an individual
permit from the Corps of Engineers.
I have no objections to the proposed project subject to the following conditions:
1) All proposed development and associated construction must be done in accordance with the permitted
work plat drawings submitted on February 21, 1996, except, proposed fill in wetlands shall be reduced
from 0.3 acres to 0.1 acres.
2) No excavated or fill material will be placed at any time, in any marsh or surrounding waters, outside of
the alignment of the fill area indicated during an onsite meeting with a DCM representative prior to
initiation of work.
3) This permit authorizes only 0.1 acres of fill and requires a Nationwide # 18 Permit from the U.S. Army
Corps of Engineers.
4; The fill material will be clean and free of any pollutants, except in trace quantities. 1 ftff-products„
organic-materialf,—or uaslghtiy debris wtt��used.
5) Prior to initiating any land -disturbing activities, a barrier line of filter cloth, staked hay bales, or burlap
must be installed between the land -disturbing activity and the adjacent marsh or water areas, until such
time as the area has been properly stabilized with a vegetated cover.
\ 6) \-) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
�j that are expressly and specifically set forth in the permit application. No other structures, whether
floating or stationary, may become a permanent part of this docking facility without permit modification.
No non -water dependent uses od structures may be conducted on, in or over public trust waters without
permit modification.

7) The docks and associated structures shall have a minimum setback distance of 15' between any parts of
the structure and the adjacent property lines as extended perpendicular to the channel into the water at
Pe points where they intersect the shoreline.
8) q No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
9) I The authorized structure and associated activity must not cause an unacceptable interference with
navigation.
10) Q No sewage, whether treated or untreated, shall be discharged at any time from boats using the docking
facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for
which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
NOTE: Plans and specifications of all water system improvements must be approved by the
Division of Environmental Health prior to the award of a contract or the initiation of
construction (as required by 10 NCAC, lOD.0900, et. seq). For information, contact the
Public Water Supply Section at (919) 733-2460.
NOTE: The applicant should contact the local Health Department regarding their requirements
for septic tank installations (as required under 10 NCAC, 10A.1900, et. seq). For
information concerning septic tank and other onsite waste disposal methods, contact the
Onsite Sewage Branch at (919) 733-6407.

This permit consistency opinion is based on my review of Stephen Thompson's permit
application, the Field investigation Report (JA Parker, 2/29/96), and my understanding and
interpretation of the policies presented in the Brunswick Count�I.and Use Plan.
The applicant proposes to relocate a building to the site to be used as a pottery studio and small
boatteanoe rental, construction and attachment of deck to waterward side of relocated building,
floating docks, elevated walkways and 6'xl2' deck over federal wetlands and boat ramp. he
location and complete description of the project are in the Field Investigation Report.
LAND USE CLASSIFICATION: Conservation ("For Brunswick County, the Conservation class
includes:... all wetland areas under the jurisdiction of the US Army Corps of Engineers' 404
wetlands Permit Program..."
CLASSIFICATION DESCRUMON: In Brunswick County, the Conservation class, "...should
be either not developed at all (preserved), or if developed, done so in an extremely limited and
cautious fashion...; the primary intent of the Conservation class is to provide protection for the
resources it contains." Uses within the land use classifications are described in the Plan's
policies.

The federally -endangered Greenfield ramshorn snail, Helisoma
eucosmium, thought to be extinct, was recently discovered in Town
Creek, Brunswick County. It occurs on submerged vegetation along
the shore. It is known from the vicinity of the US 17 bridge.
This project has the potential to affect this protected species.
Docks and other structures would shade the waters and impact the
submerged vegetation. I recommend that a survey be conducted for
this snail and/or submerged vegetation in the project area and if
present, the project be redesigned to avoid impacts. Suggested
contact is Dr. Courtney Hackney of UNCW (910)-395-3759. He had a
graduate student that did her thesis on Town Creek mollusks.

Stephen Thompson, on north side of US HWY 17 next
to Town Creek, near Winnabow, Brunswick County,

The Wildlife Resources Commission has reviewed the
project for impacts to wildlife and fishery resources. A
site visit was made on March 26, 1996. Our comments are
provided in accordance with provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et. seq.) and the Coastal Area Management Act
(G.S. 113A-100 through 113A-128).
The applicant proposes to open a small boat\canoe
rental business and pottery studio on a virtual island of
highground next to Town Creek. Two floating boat docks have
already been installed. Plans call for construction of a
small oyster shell boat ramp and a deck with a 240 ft. long
by 5 ft. wide walkway elevated over wooded wetlands along
the creek. Also proposed is the filling of 0.3 acre of
wetlands between the island and highway right-of-way for a
parking area." Town Creek is classified as Class C swamp
waters.
At present, the wetlands between the island and US 17
provide a stormwater buffer between the highway and Town
Creek. Therefore, these wetlands provide a water quality
'protection function that benefits the stream's fisheries
resources. In our opinion, filling the wetlands would
reduce stormwater filtration capacity in a critical area.
Wetland loss would also represent a loss of habitat for
raccoon, muskrat, mink, opossum, and a variety of songbirds.
Based on these concerns, we recommend that the project be
modified to reduc least half.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended,
and other applicable Laws, Rules and Regulations

construction, operation and maintenance of a 30 % low density development in compliance with the provisions
of .15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules") and the approved stormwater
management plans and specifications, and other supporting data as attached and on file with and approved by
the Division of Water Quality and considered a part of this permit for Town Creek Pottery.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following
specific conditions and limitations: 11
I. DESIGN STANDARDS
1. The total allowable built -upon area for the tract is 10,716 square feet, based on .82 acres of uplands.
This permit covers the construction of 10,025 square feet of built -upon area.
2. The overall tract built -upon area percentage for the project must be maintained at 30%, as required by
Section 1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are incorporated by reference and
are enforceable parts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with
minimum side slopes of 3:1 (H:V) or curb outlet systems as defined in the stormwater rules and
approved by the Division.

No piping shall be allowed except:
a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road.
b. That minimum amount needed under driveways to provide access to lots.
6. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all
impervious areas and surface waters.
7. The tract will be limited to the amount of built -upon area indicated in the approved plans.
The permittee is responsible for verifying that the proposed built -upon area does not exceed the
allowable built -upon area.
The Engineer/Owner/Developer/Permittee must certify in writing that the project's stormwater controls,
and impervious surfaces have been constructed within substantial intent of the approved plans and
specifications. Any deviation from the approved plans must be noted on the Certification.
10. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall
submit a written time schedule to the Director for modifying the site to meet minimum requirements.
The permittee shall provide copies of revised plans and certification in writing to the Director that the
changes have been made.
11. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office
of the Register of Deeds prior to construction. A copy of the recorded restrictions must be received by
this Office within 30 days of the date of recording. Recorded deed restrictions must include, as a
minimum, the following statements related to stormwater management:
"The maximum built -upon area is 10,716 square feet, inclusive of that portion of the
right-of-way between the front lot line and the edge of the pavement, structures, pavement,
walkways of brick, stone, slate, but not including wood decking."
"Construction of additional impervious area will require a permit modification."
"The covenants pertaining to stormwater regulations may not be changed or deleted without
concurrence of the State."
"Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the
development except for average driveway crossings, is strictly prohibited by any persons."
"Projects within CAMA's Area of Environmental Concern (AEC) are subject to a reduction of
the permitted amount of built -upon area due to CAMA jurisdiction within the AEC."

12. The following items will require a modification to the permit. Revised plans, specifications and
calculations must be permitted prior to the permittee beginning construction on the modification:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification
to the permit.
II. SCHEDULE OF COMPLIANCE
1. The permittee shall comply with the following schedule for construction and maintenance of the Low
Density Option stormwater systems:
a. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be
operational for their intended use prior to the construction of any built -upon surface except
roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or
other vegetated conveyances will be repaired immediately.
2. The permittee shall at all times provide the operation and maintenance necessary to operate the
permitted stormwater management systems at optimum efficiency to include:
a. Inspections
b Sediment removal.
G. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
3. The permittee shall submit recorded deed restrictions limiting built -upon area within 30 days of the date
of recording.
4. The permittee shall submit the Engineer/Owner/Designer/Permittee Certification within 30 days of
completion of the project.
5. The permittee shall submit all information requested by the Director or his representative within the
time frame specified in the written information request.

M. GENERAL CONDITIONS
Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
an enforcement action by the Division of Environmental Management, in accordance with North
Carolina General Statutes 143-215.6A to 143-215.6C.
2. ' The permit issued shall continue in force and effect until revoked or terminated.
The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for
a permit modification, revocation and reissuance, or termination does not stay any permit condition.
4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit,
revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and
regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000;
and North Carolina General Statute 143-215.1 et. al.
5. The permit is not transferable to any person except after notice to and approval by the Director. The
Director may require modification or revocation and reissuance of the permit to change the name and
incorporate such other requirements as may be necessary. A formal permit request must be submitted
to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties
involved, and other supporting materials as may be appropriate. The approval of this request will be
considered on its merits, and may or may not be approved.
6. The penmittee grants permission to DEEINR Staff to enter the property for the purpose of inspecting
all components of the stormwater management facility.
7. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state and
federal) which have jurisdiction.

Reference the application of Mr. Stephen Thompson for a Department of the
Army (DA) permit to place fill material in 13,000 square feet of vegetated

Town Creek, Winnabow, Brunswick County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
��(( a. All work authorized by this permit must be done in strict compliance

-' L b. All fill material will be obtained from a highground source.
C. The fill material will be clean and free of any pollutants except in

d. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
e. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or next to the authorized work.
Use of the permitted activity must not interfere with the public's right to
free navigation on all navigable waters of the United States.
f. The permittee will maintain the authorized work in good condition and
in concordance with the terms and conditions of this permit. The permittee is
not relieved of this requirement if he abandons the permitted activity without
having it transferred to a third party.
o V g. The activity will be conducted in a way that prevents a significant
increase in turbidity outside the area of construction or construction -related
discharge. Increases such that the turbidity in the waterbody is rAPV23

Enclosed is the application of Stephen Thompson for Department of the
Army authorization and a State Water Quality Certification to place fill
material in approximately 13,000 square feet of vegetated wetlands and
construct an elevated walkway, floating docks, and a boat ramp, resulting in
impacts to approximately 2,500 square feet of non -vegetated wetlands and water
of Town Creek, west of US 17 at Winnabow, in Brunswick County, North Carolina.
Your receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by May 10, 1996, the District Engineer will deem that
waiver has occurred.

On February 11, 1991, we renewed general permit No. 19-9 UM91 (copy
enclosed), which provides Federal authorization for construction activities
that receive authorization from the State of North Carolina.
A review of your application received March 11, 1996, for Department of
the Army authorization to place fill material in approximately 13,000 square
feet of vegetated wetlands and construct an elevated walkway, floating docks,
and a boat ramp, resulting in impacts to approximately 2,500 square feet of
non -vegetated wetlands and water of Town Creek, west of US 17 at Winnabow, in
Brunswick County, North Carolina, indicates it to be a candidate for Federal
authorization under this general permit. Accordingly, the administrative
processing of your application will be accomplished by the North Carolina
Division of Coastal Management. Comments from Federal review agencies will be
furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State -Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should You begin work.
On February 6, 1990, the DA and the U.S. Environmental Protection Agency
(EPA) signed a memorandum of agreement (MOA) establishing procedures to
determine the type and level of mitigation necessary to comply with the Clean
Water Act Section 404(b)(1) Guidelines. This MOA provides for first, avoiding
impacts to waters and wetlands through the selection of the least damaging,
practical alternative; second, taking appropriate and practical steps to
minimize impacts on waters and wetlands; and finally, compensating for any
remaining unavoidable impacts to the extent appropriate and practical. To
enable us to process your application in full compliance with this MOA, we
request that you provide the following additional information:
a. Permits for work within wetlands or other special aquatic sites are
available only if the proposed work is the least environmentally damaging,
practicable alternative. Please furnish information regarding any other
alternatives, including upland alternatives, to the work for which you have
applied and provide justification that your selected plan is the least
damaging to water or wetland areas.

b. It is necessary for you to have taken all appropriate and practical
steps to reduce wetland losses. Please show all that you have done,
especially regarding development and modification of plans and proposed
construction techniques, to reduce adverse impacts.
c. The MOA requires that appropriate and practical mitigation will be
required for all unavoidable adverse impacts remaining after all appropriate
and practical minimization has been employed. Please show your plan to
mitigate for the projected, unavoidable loss of waters or wetlands or provide
information as to the absence of any such appropriate and practical measures.
This information is essential to our expeditious processing of your
application and it should be forwarded to us by April 2, 1996. Also, a copy
of this information must be sent to the North Carolina Division of
Environmental Management to enable them to adequately evaluate your
application for a Water Quality Certification pursuant to Section 401 of the
Clean Water Act.
Your application, pursuant to Section 10 of the River and Harbor Act and
Section 404 of the Clean Water Act, has been assigned Action ID No. 199603078.

for Town Creek Pottery. The North Carolina Administrative Code requires any project that must receive either a
Sedimentation and Erosion Control Plan permit and/or a CAMA major permit to apply for and receive a Stormwater
Management Permit by the Division of Environmental Management. Any construction on the subject site, prior to
receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate
enforcement action by this Office.
Enclosed is a copy of the NCAC 2H.1000 regulations and a permit application. Either a Stormwater Permit
Application Package including 2 sets of plans, completed application form, fee, and supporting documentation, or
a written response regarding the status of this project and the expected submittal date must be received in this Office

This letter is in response to your letter July I2
saying that you, need more information. I think perhaps
what you are unclear on is the following.
This is a pottery studio and art gallery together
with a canoe rental. This project will benefit the
community in many ways. The people who stop will be ex-
posed to the beauty of nature and art on a North Carolina
river ana swamp. We are trying to bring culture and an
appreciation of nature to an area now overrun by hog farms
and mobile homes..
The area we want to fill is not swampland. It is a
trench excavated by the Highway Dept. to construct Hwy. 17.
We are returning It to its natural condition - an island
in the swamp, now traversed by a freeway.
As far as the Stormwater Management permit goes, L
have sent them the additional information requested. We
are being required to fill in this amount of trench in
order to satiate the Health Dept's wetland setbacks for
a septic field. Also, please refer to your last correspond-
ance enclosed wherein you approved this fill activity.
I might also suggest that the Stormwater Management
permit become part of the CAMA permitting process, rJJUL31
required with a CAMA permit. I was not made aware needed a stormwater permit until a year after I fir

establishing a canoe and boat rental business with docks, boat ramp and walkways at Hwy. 17 on the
northern side of Towns Creek Bridge, as you described in your application dated 5 March 1996. After
reviewing your application, we have decided that this fill is covered by General Water Quality
Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section

building to site to use as Pottery Studio and to fill 0.3 acres of federal wetlands to use for parking area.

9. PROJECT DESCRIPTION
The project site is located off Hwy 17 South on the northern side of Town Creek bridge near Winnabow
in Brunswick County, NC. It is approximately 11 miles south of Wilmington. The site is a 3.12 acre
lot previously used as a fish camp in the early 1900's as exemplified by the concrete remnants of pits
which were used for cooking fish. The lot consists mostly of mesophytic forest type vegetation with an
upland area of approximately 0.82 acres surrounded almost entirely by 2.30 acres of federal wetlands.
The lot borders Town Creek on it's southern and western boundaries, Hwy 17 on it's eastern boundary
and the property of D. Lewis on it's northern boundary. No coastal wetland vegetation was observed
on the lot.
The waters of Town Creek are inland waters classified as Class C swamp waters by the Division of
Environmental Management. It is not a primary nursery area and there are no commercial shellfish
resources. The width of the section of Town Creek adjacent to the lot ranges from 70 ft. to 150 ft.
The applicant proposes to relocate an already purchased 14' X 40' building on the upland portion of the
lot which will be used as a pottery studio and canoe and small boat rental pending septic approval. Two
toilets are proposed for the relocated building. He then plans to attach a permeable, elevated deck to the
waterward side of the structure. The attached deck will extend over federal wetlands. The applicant has
also already purchased two floating docks (6' X 107' and 6' X 58') which he plans to place in Town
Creek by anchoring to existing shoreline trees along the southern and western boundaries of the lot. The
applicant then plans to bridge the floating docks to the upland with two 4' wide ramps. Twelve docking
slips along the floating docks for small boats (20 ft. or less) and\or canoes are proposed with no
intentions for fuel handling facilities nor overboard discharge of sewage. In an unvegetated area between
the two floating docks the applicant proposes a 12 ft wide oyster shell boat ramp.
Along the northwest boundary of the lot, the applicant proposes to construct a 5 ft wide elevated walkway
to be used as a nature trail beginning on the upland portion of the lot and extending approximately 240
ft, running parallel to the creek over federal wetlands, ending in a 6' X 12' deck also over federal
wetlands where Town Creek and Dead Creek intersect. The applicant proposes to avoid the destruction
of all trees during and after the construction of the walkway and deck.
All other wetlands on the lot are proposed to be left undisturbed except an eastern stretch between Hwy
17 and the upland area of the lot. The applicant proposes to fill this 13,050 sq.ft.(0.3 acre) area to an
elevation equal to the upland area which he then plans to use for parking. The applicant contends that
this stretch of wetlands are manmade, created by a depression resulting from construction of adjacent
Hwy 17 by the Division of Highways.
10. ANTICIPATED IMPACTS
The floating docks will incorporate 990 sq. ft. of public trust waters. There should be little turbidity
associated with the installation of the floating docks since they will be anchored to existing trees and will
not involve the placement of pilings. Based on the width and depth of Town Creek adjacent to the project
site, the floating docks would appear to present minimal navigational concerns. The relocated building
will be located entirely on the upland and should have minimal impact on wetlands, but the attached deck

for development of the property located off Hwy 17 South at Town Creek in Brunswick County, NC. It was
received on February 21, 1996 and appears to be adequate for processing at this time. The projected deadline for
making a decision is May 13, 1996. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property
of your proposed development. You should post this notice at a conspicuous point along your property where
it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or
tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal

1) NARRATIVE
a) Need to clarify contradictory statements between narrative and DCM forms.

certified mail (In your case that would appear to be the Division of Highways and the
neighbor upereek (north) of your property).
b) The CAMA Land Use Plan classification (Question 4g) is Limited Transition and should
be answered as such.
3) EXCAVATION AND FILL (DCM-MP-2)
a) Answer to Question lc appears contradictory.
b) Need more specific answers to question 2a and 2d. Since plat showing all development
is not scaled, I can not determine if disposal site is large enough to accommodate 220 cu.

a) Plats should be prepared according to the enclosed 710200. I would especially like a
scaled drawing of plat with all proposed development (piers, docks, boat ramp, etc.)

CONI&EENTS: For your information, if a major permit is issued, it will be good for three years. You
mentioned a restaurant to be built at a later date in your narrative and on some of the
DCM forms. If you plan to apply for the restaurant construction on this application, I
will need you to address it on all applicable forms and I will also need more information
(dimensions, exact location, documentation for septic system approval, etc.).
Also, your plan to provide 30 boat slips as indicated on form DCM-MP-6 may very
likely result in your requirement to submit an environmental assessment to determine if
the impact of the planned project will require the preparation of an environmental impact
statement.
Finally, if you will fill out the enclosed appropriate forms and provide the necessary
additional information, I would be willing to set up an appointment with you in our field
office to discuss and assist you with any questions you may have pertaining to the filling
out of the applications.

✓ impact some federal wetlands due to shading and placement of pilings. As proposed the project will cause
the filling of approximately 13,050 sq. ft.(0.3 acres) of federal wetlands. If allowed, the wetland area
between Hwy 17 and Town Creek will be reduced which will result in a smaller area to filter sediments
and runoff from the highway. More runoff may also result from the adjacent area being converted to
parking area. It could not be clearly determined if the applicant's contention that the wetlands that he
is proposing to fill are manmade was accurate. Regardless, the wetlands appeared to be functional and
serving as a buffer to improve water quality.
