This permit, issued on APRIL 11, 1996 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
NOTE: This permit authorization applies only to roadway construction and utility installation
associated with the proposed development. The seven single-family homes must each
receive separate Coastal Area Management Act permit authorization.
Stormwater Management
1) The Division of Environmental Management approved this project under stormwater
management rules of the Environmental Management Commission on 11/8/95. Any violation
of or deviation from the plan approved by the DEM will be considered a violation of this
CAMA permit.
(See attached sheet for Additional Conditions)
This permit_action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the ermit expires on
December 31, 19$9
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

NOTE: Revegetation of any bare sand areas around the disturbed areas should be initiated during
the next growing season to reduce erosion.
2) No vegetated wetlands may be excavated or filled.
3) The temporary placement or double -handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
NOTE: The permittee is encouraged to contact the Pender County Mosquito Control Office to
discuss mosquito control measures.

on the site of the former "Seafood World" fish house. .

9. PRONCT DESCRIPTION
The proposed Sunward Cove Subdivision is a 2.4 acre tract of land located off of Highway 50, in the
town of Surf City, Pender County. The property is bordered by Highway 50, Banks Channel, and
residential lots to the North and South of the tract. The tract is sandy, high -ground property with some
remaining maritime thickets and native vegetative. The site was previously used as a commercial
seafood house with a sand driveway and small sandy parking area. The seafood house was located over
the water with surrounding piers. Those structures have been removed. The entire waterfront along
Banks Channel is bulkheaded. Approximately 195 linear feet of the property borders the water.
Currently one residential structure is under construction and was permitted by a CAMA Minor
Development Permit issued by the Town Of Surf City. The structure is located on lot #2 on Highway
50. General Permits were issued authorizing the bulkhead work (existing) and a private pier on lot #3.
The applicants plan to construct one entrance road off of Highway 50 and provide utilities to serve 7
lots. The individual houses will be permitted by CAMA Minor Permits. The proposed project has
undergone stormwater review by the Division of Environmental Management and has an approved
Stormwater Plan geared toward low -density development. Approximately 1.6 acres will be disturbed
during the proposed development. The plans have been reviewed by the Land Quality Section and the
proposal has an approved Sedimentation/Erosion Control Plan.
The waters of Banks Channel are classified as SA by the Division of Environmental Management.
Banks Channel has not been designated as primary nursery area by the Division of Marine Fisheries.
The area is open to the taking of shellfish. The property is designated as Developed Maritime Forest
by the Town of Surf City Land Use Plan. There are no known federal or coastal wetlands landward
of the existing bulkhead on this tract.
The 4 lots bordering Highway 50 and the entrance road are within the Ocean Hazard Area of
Environmental Concern. However, they are not oceanfront. They are "second" row, across the street
from the ocean. All proposed activity is well landward of the 60' erosion setback required in this area.
Little or none of the utility and road work will fall within the Estuarine Shoreline Area of
Environmental Concern. The single-family houses will have to apply for CAMA Minor Development
Permits prior to commencement of construction. Any of the residential houses that fall with the
Estuarine Shoreline AEC must meet the 30 % impervious surface limitation as required under Coastal
Management Rules.
10. ANTICIPATED EMPACTS
The proposed Sunward Cove Subdivision has been designed to comply with the low -density option of
the Stormwater rules. A positive effect has been the removal of the fish house building that was located
over public trust waters. Since, this site was previously used for a commercial business. Therefore,
human traffic and noise may actually decrease. Adverse impacts include decreased open space and
removal of natural vegetation.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2 by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners

that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal

NARRATIVE DESCRIPTION
Sunward Cove is the proposed subdivision of a tract of land
previously known as Sea Food World, a fish retail business,
containing 3 separate parcels of land totaling 1.5 acres now
owned jointly by Jim E. Ward and Gary E. Sunderland to be
combined with an adjoining tract of land on its north east border
containing 2 separate parcels of land totaling 0.94 acres now
owned by Michael L. Compton. The total tract contains 2.46 acres.
The Tract is all high ground with no 404 or Coastal Wet Lands
on or adjoining this site.
A low density development was desired by the respective Owners
to preserve the Maritime Vegetation on this tract of land and
to minimize the impact on the adjoining Coastal waters of Topsail
Sound.
Toward this objective The property was down zoned by the Owners
from R-10, High Density Residential and Commercial to R-5, Low
Density Residential,
Only 7 Lots are proposed within this Subdivision. The resulting
density is 3 lots per acre and impervious coverage will be
restricted to the 25% limit requested by DEHNR for low density
development. Both Water Quality Certification and Soil Erosion
Control Permits are issued and attached to this Application.
A Central paved Cul-de-sac will serve the 7 Lots and all
Utilities including City Water and Sewer will be underground.
All City and State Permits are issued and attached to this
application.
The shore line of the entire tract was previously bulkheaded.
The deterioating Asbestos and Wood Bulkhead was replaced with
a Precast Concrete Sea Wall under earlier CAMA Permits. The
12" Concrete Cap of the Sea Wall isolates the entire tract from
the Waters of Topsail Sound. No surface run off will occur.

The Wilmington Regional Office received the modification to the Stormwater Management Permit Application
for Sunward Cove Subdivision on July 10, 1996. Staff review of the plans and specifications has determined
that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC
2H.1000. We are forwarding Permit No. SW8 950908, dated August 2, 1996, for the construction of the
project Sunward Cove Subdivision. The modification covers the redistribution of the allowable built -upon area
on the lots.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the conditions
and limitations as specified therein, and does not supercede any other agency permit that may be required.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit.
This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC
27611-7447. Unless such demands are made this permit shall be final and binding.

the Division of Water Quality and considered a part of this permit for Sunward Cove Subdivision.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the following
specific conditions and limitations:
I. DESIGN STANDARDS
1. There are 7 lots in the project. The maximum built -upon area in square feet is: Lot 1 @1,945; Lot 2
@1,933; Lots 3 and 5 @3,747; Lot 4 @3,874; Lot 6 and 7 @2,075 square feet, as indicated in the
approved plans. CAMA regulations may reduce the allowable built -upon area for those lots within the
AEC.
2. The overall tract built -upon area percentage or lot sizes for the project must be maintained at 25 %, per
the requirements of Section 1005 of the stormwater rules.
3. Approved plans and specifications for projects covered by this permit are incorporated by reference and
are enforceable parts of the permit.
4. The only runoff conveyance systems allowed will be vegetated conveyances such as swales with
minimum side slopes of 3:1 (H:V) or curb outlet systems as defined in the stormwater rules and
approved by the Division.

5. No piping shall be allowed except:
a. That minimum amount necessary to direct runoff beneath an impervious surface such as a road.
b. That minimum amount needed under driveways to provide access to lots.
6. Projects covered by this permit will maintain a minimum 30 foot wide vegetative buffer between all
impervious areas and surface waters.
7. The permittee is responsible for verifying that the proposed built -upon area does not exceed the
allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised
without approval from the permittee, and responsibility for meeting the built -upon area limit is
transferred to the individual property owner.
8. Deed restrictions are incorporated into this permit by reference and must be recorded with the Office
of the Register of Deeds prior to the sale of any lot. A copy of the recorded restrictions must be
received by this Office within 30 days of the date of recording. Recorded deed restrictions must
include, as a minimum, the following statements related to stormwater management:
a. "The allowable built -upon area in square feet is Lot 1 @1,945; Lot 2 @1,933; Lots 3 and 5
@3,747; Lot 4 @3,874; Lot 6 and 7 @2,075, inclusive of that portion of the right-of-way
between the front lot line and the edge of the pavement, structures, pavement, walkways of
brick, stone, slate, but not including wood decking."
b. "The covenants pertaining to stormwater regulations may not be changed or deleted without
concurrence of the Division of Water Quality."
C. "Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the
development except for average driveway crossings, is strictly prohibited by any persons."
d. "Lots within CAMA's Area of Environmental Concern may have the permitted built -upon area
reduced due to CAMA jurisdiction within the AEC."
9. The Engineer/Owner/Developer/Permittee must certify in writing that the project's stormwater controls,
and impervious surfaces have been constructed within substantial intent of the approved plans and
specifications. Any deviation from the approved plans must be noted on the Certification.
10. The following items will require a modification to the permit. Revised plans, specifications and
calculations must be permitted prior to the permittee beginning construction on the modification:
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering or piping any vegetative conveyance shown on the approved plan.
In addition, the Director may determine that other revisions to the project should require a modification
to the permit.

11. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall
submit a written time schedule to the Director for modifying the site to meet minimum requirements.
The permittee shall provide copies of revised plans and certification in writing to the Director that the
changes have been made.
II. SCHEDULE OF COMPLIANCE
1. The permittee shall comply with the following schedule for construction and maintenance of the Low
Density Option stormwater systems:
a. Swales and other vegetated conveyances shall be constructed in their entirety, vegetated, and be
operational for their intended use prior to the construction of any built -upon surface except
roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the swales or
other vegetated conveyances will be repaired immediately.
2. The permittee shall at all times provide the operation and maintenance necessary to operate the
permitted stormwater management systems at optimum efficiency to include:
a. Inspections
b. Sediment removal.
C. Mowing, and revegetating of the side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
3. The permittee shall submit a copy of the recorded deed restrictions which indicates the approved built -
upon area per lot within 30 days of the date of recording.
4. The permittee shall submit the Engineer/Owner/Designer/Permittee Certification within 30 days of
completion of the project.
5. The permittee shall submit all information requested by the Director or his representative within the
time frame specified in the written information request.
III. GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
an enforcement action by the Division of Water Quality, in accordance with North Carolina General
Statutes 143-215.6A to 143-215.6C.
2. The permit issued shall continue in force and effect until revoked or terminated.
3. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for
a permit modification, revocation and reissuance, or termination does not stay any permit condition.

4. The issuance of this permit does not prohibit the Director from reopening and modifying the permit,
revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules, and
regulations contained in Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000;
and North Carolina General Statute 143-215.1 et. al.
5. The permit is not transferable to any person except after notice to and approval by the Director. The
Director may require modification or revocation and reissuance of the permit to change the name and
incorporate such other requirements as may be necessary. A formal permit request must be submitted
to the Division of Water Quality accompanied by the appropriate fee, documentation from both parties
involved, and other supporting materials as may be appropriate. The approval of this request will be
considered on its merits, and may or may not be approved.
6. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances which may be imposed by other government agencies (local, state and
federal) which have jurisdiction.
7. The permittee grants permission to DEHNR Staff to enter the property during business hours for the
purposes of inspecting the stormwater control system and it's components.

Recommendations for State Permit - NPTff7=8UBWV1SION
The Wilmington Staff's recommendation is that the permit be issued with the following conditions:
1. The seven single-family homes must be permitted separately under individual CAMA Minor Permits.
2. High priority should be placed on the preservation of as much natural vegetation as possible within
the project area. Incorporation of at least 50% of the native trees, shrubs, vines and grasses into
"islands" of natural vegetation as part of the landscape design would continue to provide habitat for
some wildlife species.
3. Re -vegetation of any bare sand areas around the proposed road and utility easements should be
initiated during the next growing season to reduce erosion.
4. The Division of Environmental Management approved this project under stormwater management
rules of the Environmental Management Commission. Any violation of or deviation from the plan
approved by DEM will be considered a violation of this Major CAMA Permit.
5. No work except for street and utility installation are authorized by this permit.

This permit consistency opinion is based on my review of the Sunderland permit application, the
Field Investigation Report QM Russell, 2/15/96), and my understanding and interpretation of
the policies presented in the Town of Surf City Land Use Plan.
The applicant requests permission to build a 7-lot residential subdivision on the site of the
former "Seafood World" fish house. The location and complete description of the project are
in the Field Investigation Report.
LAND USE CLASSIFICATION: Conservation (those lots located within Areas of
Environmental Concern such as Ocean Hazard or Estuarine Shoreline); Developed Maritime
Forest.
CLASSIFICATION DESCRIPTION:
Developed Maritime Forest (subclass of Developed Class):
This subclass is identical t the previously described Developed class with one exception. This subclass takes into
account the valuable natural resource ... the maritime forest (or shrub thicket), a rare and highly threatened
coastal natural ecosystem, possessing significant cultural, scientific and aesthetic values.
The same development criteria apply to this subclass with one exception — development should be done in a
manner that will cause the least harm to the forested area. This means clearing only as much forest vegetation
as is needed for the actual construction of a building, drive or roadway.
RELATED POLICIES AND IMPLEMENTATION MEASURES:

To permit development within flood prone areas only if done in a manner that will minimize the loss
of human life and damage to property
Development in flood prone areas is controlled by .. Zoning Ordinance, CAMA Regulations, Flood

To the maximum extent feasible, and consistent with a property owner's rights to reasonable use of
his property, use of land in ocean hazard areas shall be located, designed, and constructed so as to
maximize a structure's protection from wind and water and to minimize damage to the protective land
forms of dunes and beaches in accordance with: CAMA regulations.

The Town supports and encourages redevelopment, upgrading and adaptive reuse of properties. The
re -subdivision or in -filling of existing platted properties is preferred over the development of areas
requiring new streets and utilities.
CONSISTENCY OPINION
The proposed subdivision and construction of roads and installation of utilities will be consistent
when all conditions placed on this permit and all local ordinance requirements are met. It should

This office has reviewed the subject sedimentation and erosion control plan. We find the plan to be
acceptable and hereby issue this letter of approval with comments as attached.
Please be advised that Title 15A, of the North Carolina Administrative Code, 4B.0017(a) requires that
a copy of the approved plan be on file at the job site. Also, you should consider this letter to give the Notice
required by GS 1 13A-61(d) approved plan. The last Dage(s) which lists aDDroval comments should be copied
and attached to the sedimentation and erosion control plan that is maintained on site.
North Carolina's Sedimentation Pollution Control Program is performance oriented, requiring protection
of the natural resources and adjoining properties. If, following the commencement of this project, it is
determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 thru 66), this office
may require revisions to the plan and its implementation to insure compliance with the Act.
Recognizing the desirability of early coordination of sedimentation control, we believe that it would
be beneficial if a pre -construction conference could be arranged to discuss the approved plan for this project.

on the site of the former "Seafood World" fish house.

9. PROJECT DESCRIPTION
The proposed Sunward Cove Subdivision is a 2.4 acre tract of land located off of Highway 50, in the
town of Surf City, Pender County. The property is bordered by Highway 50, Banks Channel, and
residential lots to the North and South of the tract. The tract is sandy, high -ground property with some
remaining maritime thickets and native vegetative. The site was previously used as a commercial
seafood house with a sand driveway and small sandy parking area.. The seafood house was located over
the water with surrounding piers. Those structures have been removed. The entire waterfront along
Banks Channel is bulkheaded. Approximately 195 linear feet of the property borders the water.
Currently one residential structure is under construction and was permitted by a CAMA Minor
Development Permit issued by the Town Of Surf City. The structure is located on lot #2 on Highway
50. General Permits were issued authorizing the bulkhead work (existing) and a private pier on lot #3.
The applicants plan to construct one entrance road off of Highway 50 and provide utilities to serve 7
lots. The individual houses will be permitted by CAMA Minor Permits. The proposed project has
undergone stormwater review by the Division of Environmental Management and has an approved
Stormwater Plan geared toward low -density development. Approximately 1.6 acres will be disturbed
during the proposed development. The plans have been reviewed by the Land Quality Section and the
proposal has an approved Sedimentation/Erosion Control Plan.
The waters of Banks Channel are classified as SA by the Division of Environmental Management.
Banks Channel has not been designated as primary nursery area by the Division of Marine Fisheries.
The area is open to the taking of shellfish. The property is designated as Developed Maritime Forest
by the Town of Surf City Land Use Plan. There are no known federal or coastal wetlands landward
of the existing bulkhead on this tract.
The 4 lots bordering Highway 50 and the entrance road are within the Ocean Hazard Area of
Environmental Concern. However, they are not oceanfront. They are "second" row, across the street
from the ocean. All proposed activity is well landward of the 60' erosion setback required in this area.
Little or none of the utility and road work will fall within the Estuarine Shoreline Area of
Environmental Concern. The single-family houses will have to apply for CAMA Minor Development
Permits prior to commencement of construction. Any of the residential houses that fall with the
Estuarine Shoreline AEC must meet the 30% impervious surface limitation as required under Coastal
Management Rules.
10. ANTICIPATED IMPACTS
The proposed Sunward Cove Subdivision has been designed to comply with the low -density option of
the Stormwater rules. A positive effect has been the removal of the fish house building that was located
over public trust waters. Since, this site was previously used for a commercial business. Therefore,
human traffic and noise may actually decrease. Adverse impacts include decreased open space and
removal of natural vegetation.

NARRATIVE DESCRIPTION
Sunward Cove is the proposed subdivision of a tract of land
previously known as Sea -Food World, a fish retail business,
containing 3 separate parcels of land totaling 1.5 acres now
owned jointly by Jim E. Ward and Gary E. Sunderland to be
combined with an adjoining tract of land on its north east border
containing 2 separate parcels of land totaling 0.94 acres now
owned by Michael L. Compton. The total tract contains 2.46 acres.
The Tract is all high ground with no 404 or Coastal Wet Lands
on or adjoining this site.
A low density development was desired by the respective Owners
to preserve the Maritime Vegetation on this tract of land and
to minimize the impact on the adjoining Coastal waters of Topsail
Sound.
Toward this objective The property was down zoned by the Owners
from R-10, High Density Residential and Commercial to R-5, Low
Density Residential,
Only 7 Lots are proposed within this Subdivision. The resulting
density is 3 lots per acre and impervious coverage will be
restricted to the 25% limit requested by DEHNR for low density
development. Both Water Quality Certification and Soil Erosion
Control Permits are issued and attached to this Application.
A Central paved Cul-de-sac will serve the 7 Lots and all
Utilities including City Water and Sewer will be underground.
All City and State Permits are issued and attached to this
application.
The shore line of the entire tract was previously bulkheaded.
The deterioating Asbestos and Wood Bulkhead was replaced with
a Precast Concrete Sea Wall under earlier CAMA Permits. The
12" Concrete Cap of the Sea Wall isolates the entire tract from
the Waters of Topsail Sound. No surface run off will occur.
