Dear Sir:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully, prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

Recommendations for State Permit - Stevens Building Co.
The wetlands to be effected by this proposal have negligible interaction with the estuarine system.
There are no direct indications of this interaction (crab holes, wrack lines, etc.). The wetland species
present is probably due to the spoil substrate and the ponding situation created by the bulkhead
restricting runoff from the adjacent road. I recommend the project be authorized as proposed based on
the following conditions:
1) This permit does not authorize any ground disturbance or development of any kind waterward of
the bulkhead.
2) The fill material will be clean and free of any pollutants, except in trace quantities. Metal products,
organic materials, or unsightly debris will not be used.
3) All backfill material will be obtained from a highground source and confined behind the permitted
bulkhead.
4) No excavated or fill material will be placed at any time, in any marsh or surrounding waters, outside
of the alignment of the fill area indicated on the workplat.

This permit consistency opinion is based on my review of the Steven's Building Company permit
application, the Field Investigation Report (T. Barrett, 2/20/96), and my understanding and
interpretation of the policies presented in the Town of Carolina Beach Land Use Plan.
The applicant proposes to fill a lot containing coastal wetlands for improvement in the
marketability of the lot. The drainage is to be directed away from the bulkhead towards the
street. The location and complete description of the project are in the Field Investigation Report.
LAND USE CLASSIFICATION: Developed/Conservation
RELATED POLICIES AND IMPLEMENTATION MEASURES:
The policies of the Land Use Plan support the Town's desire to protect the waters of Myrtle
Grove Sound and to avoid further diminution of critical coastal wetlands and estuarine shoreline
vegetation where possible. The following policy addresses new bulkheads:

...It is also Carolina Beach policy to prohibit bulkheading and filling of the Town's shorefront forward of the areas of
environmental concern along the eastern edge of Myrtle Grove Sound ... Re-establishment of wetlands is to be strongly
encouraged. Any butkheading operations must comply with all local, state and federal regulations.
CONSISTENCY OPINION:
This consistency opinion is based on two assumptions:
Lthat the existing bulkhead is high enough to contain the proposed 4.1' fill elevation,
therefore eliminating the need to build a new bulkhead; and
2. that the coastal marsh which has encroached landward of the existing bulkhead is
insignificant in its value.
This project will be cetalsi:itent when all conditions placed on the permit by CAMA and other
review agencies are met. ANY fill or dredge activity which occurs waterward of the existing
bulkhead without a separate permit will be inconsistent with the land use plan.

Dear Ms. Wilson:
You have our approval to place fill material in 1150 square feet of wetlands or waters for the
purpose of installing at 1013 Canal Drive, Carolina Beach, N.C., as you described in your application
dated 23 February 1996. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section

9. PROJECT DESCRIPTION 2120/96
The project site is located adjacent to the Carolina Beach Yacht Basin on the east side, at 1013 Canal
Drive. This is a residential area, classified as Developed in the Carolina Beach Land Use Plan. This
is a vacant lot that was stabilized by a bulkhead in previous years. The lot was filled following
bulkhead construction, though not sufficiently to prevent the migration of wetlands. Very poor storm
drainage along Canal Drive has encouraged the encroachment of the wetland species by ponding behind
the bulkhead. The substrate is sandy fill material, possibly containing spoil from basin dredging.
The waters of the Carolina Beach Yacht Basin are classified SB; the area is not designated as Primary
Nursery by the Division of Marine Fisheries; the basin is closed to the taking of shellfish for
consumption.
The property is predominantly high ground on historic fill. Approximately 1150 square feet of
marginally active Spartina patens occur from the bulkhead to about halfway into the lot. On the
waterward side of the bulkhead, Bomchia frutescens Iya frutescens. and Spartina patens occur; these
give way to Juncus roemerianus and Snartina alterniflora. There is no development proposed waterward
of the bulkhead, and no structures proposed at this time. The lot is approximately 7950 square feet in
size.
The applicant proposes to fill the lot to raise the wetlands out of jurisdiction and direct stormwater to
the road. The intent is to sell the lot for residential construction. The present elevation of the lot is
approximately 3.7'. In order to sell the lot as a viable building lot, the applicant wishes to grade the
lot, filling the wetlands to 4.1' in elevation, sloping the lot toward the street to guide stormwater away
from the bulkhead. The size of the proposed graded area is approximately 3650 square feet. Of this,
approximately 2500 square feet is high ground, and approximately 1150 square feet is Spartina patens.
The fill material would raise the lot to the elevation of the existing bulkhead.
Carolina Beach has a building setback requirement in this area of 10' from the street.
10. ANTICIPATED EVIPACTS
The project as proposed would remove from jurisdiction approximately 1150 square feet of marginally
active Spartina en . Another 2500 square feet of high ground would be disturbed and graded. There
should be no sedimentatiori/erosion control issues because there is an existing bulkhead with filter cloth.

The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located at 1013 Canal Drive in Carolina Beach. It was
received completed on 2/19/96, and appears to be adequate for processing at this time. The projected
deadline for making a decision is 5104/96. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
