BULI(EA.D CONSTRUCTION
The bulkhead alignment will approximate the mean high water level to the greatest extent possible at the
time of construction.
The authorized alignment of the proposed bulkhead must be staked by a representative of the Division of
Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of construction. Failure
to initiate construction within thirty (30) days, or erosion of the shoreline by adverse weather conditions, will
require the alignment to be re -staked by DCM within a maximum of thirty (30) days prior to the new
expected start of construction.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDMONAL CONDITIONS
-3. The bulkhead must be constructed prior to any backfilling activities.
4. The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.
5. The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles, or
other suitable materials approved by Department personnel. No excavation is permitted, except
for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables,
etc. This permit does not authorize any excavation waterward of the approved alignment.
6. The fill material will be clean and free of any pollutants, except in trace quantities. Metal products,
organic materials, or unsightly debris will not be used.
7. All backfill material will be obtained from a highground source and confined behind the permitted
bulkhead.
8. All fill material to be placed below mean high water level will be confined behind the permitted
bulkhead.
NOTE: The Division of Environmental Management authorized this project on January 26, 1996 under
General Water Quality Certification No. 3025.
NOTE: The U.S. Army Corps of Engineers authorized this project on December 19, 1995 under

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved; If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

9. PROJECT DESCRIPTION
The project is located near the northern end of a man-made canal which connects to the AIWW. It
consists of a 60'x 70' residential lot on which a bulkhead has been built in the past. The existing
bulkhead was authorized by the exemption process and is landward of the wetland fringe along the
shoreline of the project. There is a severe erosion gully which is located along the southern property
line. This was apparently formed prior to the construction of the existing bulkhead due to the affects
of surface runoff and not erosion. Prior to the bulkhead, coastal wetlands invaded this gully and the
existing bulkhead was built landward of these species. This construction created a trash trap as well
as eliminating part of the formerly usable portion of the applicant's property. This gully is
approximately 30' deep x 15' wide. It is filled with medium dense mixed wetland vegetation including
a total of approximately 40 sf of scattered Suartina alterniflora (smooth cordgrass). A small amount
of Salicomia Up. is also present as well as Spartina an tens and Borrichia Up.. The remainder of the
shoreline is predominately vegetated with Borrichia with scattered stems of S. Alterniflora and other
species. The mean high water (mhw) contour is located along the proposed bulkhead alignment except
that at present a thread of mhw extends into the eroded area along the southern property line. The mhw
contour may also extend toward the bank at the northern property corner. On the waterward side of
the mhw contour there is a border of S. alterniflora marsh approximately 6' to 8' in width. There are
existing bulkheads to either side of the applicants property. The bulkhead to the south was aligned
initially without a permit and was allowed to remain apparently due to the fact that it was determined
that a major permit would have been available for the action. The other bulkhead was just recently
built and it was aligned along an exempt alignment. The adjacent waters are classified as SA and are
closed to shellfishing. They are not a designated primary nursery area.
The applicant proposes to align a new bulkhead between the two adjacent bulkheads and to build a new
pier and dock. The bulkhead will be approximately 60 feet in total length. It will be aligned
landward of the mean high water (mhw) contour except for the areas noted above. The proposed pier
and dock will be situated in the middle of the 60' wide lot. A walkway approximately 4' wide and 6'
long will cross the S. alterniflora fringe waterward of the new bulkhead alignment. A 10'x 6' floating
dock will be install at the end of the pier.
10. ANTICIPATED EMPACTS
At present the existing bulkhead has created a significant trash trap along the southern property line and
has severely limited the applicants use and enjoyment of that comer of her property. The construction
of the southern bulkhead at a more waterward location that the applicants structure has created other
legitimate concerns for the applicant. The adjacent neighbor to the north chose to accept an exempt
alignment rather than to go through the major process. The consumption of approximately 350 sf of
mixed wetland species including approximately 50 sf of S. alt. is not considered to be a significant
adverse impact. There will remain in place approximately 400 sf of S. AltemMora waterward of the
proposed bulkhead. The structure will meet the two existing structures to either side of her property.
The gully appears to have been created by surface mn off but now is affected by sheet erosion from the
canal. It is unique to this lot now that the lot to the south has been bulkheaded at a more waterward
location than the applicant. The proposed bulkhead will also extend below the mhw contour only to
the extent necessary to eliminate the remains of the gully and to extend to the adjacent bulkhead at the
northern property line. The pier/dock is basically absent of any adverse impact.

Recommendations for State Permit -Suzanne L. Sewell
I have no objections to the proposed project subject to the following conditions.
[1] The bulkhead alignment will approximate the mean high water level to the greatest extent
possible a the time of construction.
[2] The, alignment of the proposed bulkhead must be staked by a representative of the Division of
Coastal Management (DCM) within a maximum of thirty (30) days prior to the start of
construction. Failure to initiate construction within thirty (30) days, or erosion of the shoreline
by adverse weather conditions, will require the alignment to be re -staked by DCM within a
maximum of thirty (30) days prior to the new expected start of construction.
[3] The bulkhead must be constructed prior to any backfilling activities.
[4] The bulkhead must be structurally tight so as to prevent seepage of backfill materials through
the structure.
[5] The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles,
or other suitable materials approved by Department personnel. No excavation is permitted,
except for that which may be required for the construction of the bulkhead wall, riprap, deadmen
cables, etc. This permit does not authorize any excavation waterward of the approved
alignment.
[6] The fill material will be clean and free of any pollutants, except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
[7] All backfill material will be obtained from a highground source and confined behind the
permitted bulkhead.
[8] All fill material to be placed below mean high water level will be confined behind the permitted
bulkhead.

This permit consistency opinion is based on my review of the Sewell permit application, the
Field Investigation Report (CR Stroud,Jr., 12/18/95), and my understanding and interpretation
of the policies presented in the Town of Ocean Isle Beach 1990 Land Use Plan.
The applicant proposes to relocate an existing bulkhead which was originally constructed to meet
an exempt alignment as it was above mean high water and landward of all wetlands. The new
alignment will match with the two bulkheads to either side of the applicant's property. Also
proposed is the construction of a pier and dock. The location and complete description of the
project are in the Field Investigation Report.
LAND USE CLASSIFICATION:
Urban Transition; Conservation
CLASSIFICATION DESCRIPTION:
The Conservation classification includes estuarine shorelines, estuarine waters, coastal wetlands
and public trust areas. Water dependent uses are permitted, provided such uses comply with
Town ordinances or regulations, and applicable CAMA permitting requirements.(p.75)
RELATED POLICIES AND IMPLEMENTATION MEASURES:
14. The Damaging of Existing Marshes by Bulkhead Installation
Policy: The Town opposes the damaging of existing marshlands improperly constructed bulkheads.
Implementation: CAMA major and minor permitting processes.
CONSISTENCY OPINION:
This project is consistent with the Town of Ocean Isle Beach Land Use Plan provided it meets
all local and state regulations, and that all conditions placed on the permit by DCM and other
review agencies are met.

The Wildlife Resources Commission has reviewed the
project for impacts to wildlife and fishery resources. A
site visit was made on January 24, 1996. Our comments are
provided in accordance with provisions of the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et. seq.) and the Coastal Area Management Act
(G.S. 113A-100 through 113A-128).
The applicant proposes to relocate an existing bulkhead
waterward into coastal wetlands bordering an excavated
channel connected to the AIWW. A particular concern of the
applicant is a v-shaped embayment in the southern end of the
existing bulkhead containing wetlands that reportedly
collects trash. As proposed, the bulkhead alignment appears
to extend 4-20 ft. waterward of its current location and
would fill approximately 350 sq. ft. of coastal wetlands.

its filtering capabilities, and area water quality will
consequently suffer. Cumulative impacts of this sort have
great potential for impairing estuarine water quality

proposed bulkhead alignment not be used. Rather, we
recommend retaining the existing bulkhead alignment except
where the v-shaped embayment occurs. At the embayment, the
f 6 alignment can be brought waterward to a point even with the
C` existing bulkhead alignment on the applicant's property.

Reference your application of November 6, 1995, for Department of the
Army (DA) authorization to discharge fill material into approximately
2400 square feet of wetlands adjacent to the Atlantic Intracoastal Waterway,
to backfill a bulkhead on your lot located at 35 Isle Plaza, Ocean Isle Beach,
Brunswick County, North Carolina.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization,
pursuant to Section 10 of the Rivers and Harb6rs Act and Section 404 of the
Clean Water Act, was provided by Nationwide Permit No. 18 for discharges of
dredged or fill material into all waters of the United States provided:
The discharge does not exceed 25 cubic yards in open water areas;
b. The discharge will not cause the loss of more than 1/10 acre of a
special aquatic site, including wetlands. For the purposes of this nationwide
permit, the acreage limitation includes the filled area plus special aquatic
sites that are adversely affected by flooding and special aquatic sites that
are drained so that they would no longer be a water of the United States as a
result of the project;
Your work, sited in the coastal area, is authorized by this nationwide
permit provided it is accomplished in strict accordance with the enclosed
conditions and any required State authorization. A consistency determination
is required from the North Carolina Division of Coastal Management (NCDCM).
Contact Mr. Steve Benton, telephone (919) 733-2293 for this consistency
determination. A Section 401 water quality certification is required from the
North Carolina Division of Environmental Management. Contact Mr. John Dorney,
telephone (919) 733-1786 for this certification. This nationwide permit does
not relieve you of the responsibility to obtain other required State or local
approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked, which will occur prior to January 21, 1997. It is
incumbent upon you to remain informed of changes to the nationwide permits,
which will be announced by public notice when they occur. If you commence, or
are under contract to commence, this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation, to complete the activity under the present
terms and conditions of this nationwide permit.

For activities that may be authorized by the above listed nationwide permits that require notification, the
applicant shall not begin work
a. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by
the District Engineer, or
b. If notified that an individual permit may be required, or
c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer
and no notice has-been received from the District Engineer, and 'required state approvals have been obtained.
Required state approvals include: 1) a Section 401 water quality certification if authorization is requested for a
discharge of dredged or fill material, and 2) an approved coastal zone management consistency determination if
the activity will affect the coastal area.
Use of NWP 12 also requires notification to the District Engineer, but work may not begin until written
concurrence is received from the District Engineer. The time periods described above do not apply.
Furthermore, requirements to notify the U.S. Fish and Wildlife Service (USFWS), the National Marine
Fisheries Service (NMFS), and the State Historic Preservation Office (SHPO), as indicated below and on the
notification form, do not apply.
B. APPLICATION TO DEM FOR NATIONWIDE PERMIT SECTION 401 CERTIFICATION.
Certain nationwide permits require an application to DEM in order to obtain Section 401 water quality certification.
They are NWP 6, NWP 12, NAT 15, NWP 16, NWP 17, NWP 21, NWP 33, NWP 34, NWP 38, and NWP 40.
Certain nationwide permits were issued general certifications and require no application. They are NWP 3, NWP 4,
NWP 5, NWP 7, NWP 20, NWP 22, NWP 23 (requires notification to DEM), NWP 25, NWP 27, NWP 32. NWP 36,
and NWP 37.
The following nationwide permits were issued general certifications for only limited activities: NWP 13 (for projects
less than 500 feet in length), NWT 14 (for projects that impact waters only), NWP 18 (for projects with less than 10
cubic yards of fill in waters only), and NWP 26 (for projects with less than or equal to one-third acre fill of waters or
wetlands). Projects that do not meet these criteria require application for Section 401 water quality certifications.
C. NOTIFICATION/APPLICATION PROCEDURES.
The attached form should be used to obtain approval. from the Corps of Engineers and/or the N.C. Division of
Environmental Management as specified above. The permittee should make sure that all necessary information is
provided in order to avoid delays. One copy of the completed form is required by the Corps of Engineers and seven
copies are required by DEM. Plans and maps must be on 8 112 x 11 inch paper.
Endangered species requirement For Corps of Engineers notifications only, applicants must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the presence of endangered species that may
be affected by the proposed project.

For activities that may be authorized by the above listed nationwide permits that require notification, the
applicant shall not begin work
a. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by
the District Engineer, or
b. If notified that an individual permit may be required, or
c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer
and no notice has been received from the District Engineer, and required state approvals have been obtained.
Required state approvals include: 1) a Section 401 water quality certification if authorization is requested for a
discharge of dredged or fill material, and 2) an approved coastal zone management consistency determination if
the activity will affect the coastal area.
Use of NWP 12 also requires notification to the District Engineer, but work may not begin until written
concurrence is received from the District Engineer. The time periods described above do not apply.
Furthermore, requirements to notify the U.S. Fish and Wildlife Service (USFWS), the National Marine
Fisheries Service (NMFS), and the State Historic Preservation Office (SHPO), as indicated below and on the
notification form, do not apply.
B. APPLICATION TO DEM FOR NATIONWIDE PERMIT SECTION 401 CERTIFICATION.
Certain nationwide permits require an application to DEM in order to obtain Section 401 water quality certification.
They are NWP 6, NWP 12, NWP 15, NWP 16, NWP 17, NWP 21, NWP 33, NWP 34, NWP 38, and NWP 40.
Certain nationwide permits were issued general certifications and require no application. They are NWP 3, NWP 4,
NWP 5, NWP 7, NWP 20, NWP 22, NWP 23 (requires notification to DEM), NWP 25, NWP 27, NWP 32, NWP 36,
and NWP 37.
The following nationwide permits were issued general certifications for only limited activities: NWP 13 (for projects
less than 500 feet in length), NWP 14 (for projects that impact waters only), NWP 18 (for projects with less than 10
cubic yards of fill in waters only), and NWP 26 (for projects with less than or equal to one-third acre fill of waters or
wetlands). Projects that do not meet these criteria require application for Section 401 water quality certifications.
C. NOTIFICATION/APPLICATION PROCEDURES.
The attached form should be used to obtain approval from the Corps of Engineers and/or the N.C. Division of
Environmental Management as specified above. The permittee should make sure that all necessary information is
provided in order to avoid delays. One copy of the completed form is required by the Corps of Engineers and seven
copies are required by DEM. Plans and maps must be on 8 1/2 x 11 inch paper.
Endangered species requirement: For Corps of Engineers notifications only, applicants must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the presence of endangered species that may
be affected by the proposed project.

The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your property located at 35 Isle Plaza, Ocean Isle Beach, Brunswick
County. It was received on November 13, 1995 and was considered to be complete following the field
visit on November 28, 1995 and appears to be adequate for processing at this time. The projected
deadline for making a decision is February 11, 1996. An additional 75-day review period is provided
by law when such time is necessary to complete the review. If you have not been notified of a final
action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing' postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;
or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and
federal review agencies for their comments. If additional information is required based on this review,
the agencies may contact you directly.
