1) This permit authorizes only the dock extension that is expressly set forth in the permit application.
No other structures, whether floating or stationary, may become a permanent part of this docking
facility without permit modification. No non -water dependent uses of structures may be conducted
on, in, or over public trust waters without permit modification.
2) The docking facility will display a sign showing the location of the nearest pumpout facility, and
other appropriate waste disposal information, at the entrance and exit from the main pier.
3) No sewage, whether treated or untreated, shall be discharged at any time from boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the pemtittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

and cross -sectional drawings) drawn to scale in black

detailed description.)

only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by

Engineers regarding that agency's use of larger

I have reviewed the subject application in regards to 07H.0206, .0207 & .0208 and have
determined that the proposed project is consistent with those rules. I have no objection to the
permit being issued with the following conditions:

SUBJECT: Consistency Determination, Major Permit Application, Sea
Harbour Marina, Inc., Town of Oriental, Pamlico County
DATE: April 26, 1996
Sea Harbour Marina is located off Harbour Way, adjacent Dolphin
Creek and Bonito Channel, in Oriental, Pamlico County. The
applicant proposes to create a tenth boat slip by extending the
existing dock on Dolphin Creek an additional 471. In addition, the
applicant proposes to repair sections of two existing docks.
AECs impacted by the work include Estuarine Waters and Public Trust
Areas. Dolphin Creek is classified as SA NSW and is closed to the
harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 1994 Town of
Oriental Land Use Plan (LUP) Update and offer the following
comments.
The general area of the project is classified as Developed, while
the AECs impacted by the proposed work are classified as
Conservation.
The Oriental Land Use Plan supports state standards for development
in Conservation classified AECs. The only exception regards the
requirement for the provision of pump -out facilities for marinas
having eleven or more slips. This pump -out requirement also applies
to docks located in the Town Harbor (Raccoon Creek). Since this
proposal is not considered to be a marina, and is not located in
Raccoon Creek, these more stringent local requirements local
requirements do not appear to be applicable to this proposal.
Provided all 7H standards can be satisfied, this project appears to
be consistent with the 1994 Town of Oriental Land Use Plan.

Through coordination with the North Carolina Division of Coastal
Management, we have learned of your plans to add a commercial boat slip
to an existing dock, on property identified as the Sea Harbour Marina, Inc
located off Harbour Way, adjacent Dolphin Creek, in the Town of Oriental,
Pamlico County, North Carolina.
On January 1, 1994, we renewed general permit No. 197800056, (copy
enclosed) that authorizes the maintenance, repair, construction, and
installation of piers, docks, boathouses, boatshelters, mooring pilings,
dolphins and jetties in navigable waters of the United States in the State
of North Carolina.
Your proposed work is authorized if you can comply with all permit
conditions. Please read the enclosed permit to prevent an unintentional
violation of Federal law. As this Department of the Army general permit
does not relieve you of the responsibility to obtain any other required
approvals, you should contact appropriate State and local agencies before
beginning work.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign' both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions.appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

9. NARRATIVE DESCRIPTION:
Project Setting
The project site is located off Harbour Way adjacent Dolphin Creek and Bonito
Channel, both tributaries to Pierce Creek, in Oriental, Pamlico County. The applicant,
Sea Harbour Marina, Inc., owns approximately 2.3 acres of land on the western end of
a peninsula between Dolphin Creek and Bonito Channel. A 30' easement provides
access through the applicants' property to the point or eastern end of the property
adjacent Pierce Creek. The point is owned by Sea Harbour Condominium Yacht Club
Inc., an 80-slip marina complex. Currently, the applicants' property has nine
commercial boat slips, three on the northern boundary of the property on Dolphin
Creek and six on the southern boundary of the property on Bonito Channel. At the
site, Dolphin Creek is approximately 120' wide. A black needlerush marsh borders
both sides of the site. Private lots in Sea Vista Subdivision border the upstream side of
the property. Dolphin Creek is classified SA NSW, is not a PNA, and is closed to
shellfishing.
Project Description
The applicants propose to create a tenth boat slip by extending the existing 6'-
wide dock on Dolphin Creek an additional 47' along the shoreline. The dock would be
constructed at the waterward edge of the needlerush marsh, essentially creating a 15'-
wide X 40'-long boat slip. No freestanding mooring pilings are proposed. The
structure would abut within several feet of the riparian line, but the neighbor has
waived the 15' minimum setback. In addition, the applicants are proposing to repair
sections of the two existing docks.
Anticipated Impacts
The project as proposed would usurp 282 fO of the Estuarine Waters and Public
Trust Area within Dolphin Creek. However with a boat docked at the slip, an
additional 600 ft2 would be effectively removed from the public's use (the project
would have essentially created a 15' X 40' open water slip). The dock would fall well
within the established pierhead alignment along this section of creek. And only
minimal impact to the adjacent marsh and shallow bottom habitat should occur during
dock construction.

Mr. and Mrs. Thomas Kenworthy have asked that I write you
and try to explain the recent title history of Sea Harbour's
property on Pierce Creek. It is my understanding that the
corporation has applied for a permit to add an additional pier to
their existing nine, and you needed clarification on the
ownership of the adjoining slips.
Sea Harbour Marina acquired the entire peninsula from The
Dolphin Company of Oriental by deed dated March 31, 1983 and
recorded in Deed Book 220 at page 212, Pamlico County Registry.
The corporation then constructed the marina which consisted of
eighty-eight slips.
In 1990, Sea Harbour converted the eastern two-thirds of the
peninsula to a "boataminium" and in connection with that it
conveyed by deed dated July 16, 1990 to Sea Harbour Condominium
Yacht Club, Inc. the eastern two-thirds of the real estate along
with all improvements, including the wooden piers. I am
enclosing a copy of the Yacht Club's plat and I have highlighted
the dividing line. The effect of this 1990 deed (a copy is
attached) is to vest legal title of the land west of the line in

Way, adjacent Dolphin Creek, in the Town of Oriental, Pamlico County. It was received on
March 18, and appears to be adequate for processing at this time. The projected deadline for
making a decision is June 1. 1996. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be
contacted by the appropriate State or Federal agency. Please contact me if you have any
