as authorized by the State of North Carolina, Department of Environmental Quality
and the Coastal Resources Commission for development in an area of environmental
concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area Management"
Issued to Eddie Hyler, C & R LaVecchia, LLC, et al, authorizing development in the Ocean Hazard (AEC) at 321 Fort
Fisher Blvd, S. in Kure Beach, New Hanover County, as requested in the permittee's application, dated July 22, 2016, and
received complete July 22, 2016. This permit, issued on August 1, 2016, is subject to compliance with the application and
site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below.
Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be
null and void.
This permit authorizes: the reconstruction of a new home with pool.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on July 22, 2016.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal
regulations, applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-
evaluation and modification of this permit.
(4) A copy of this permit shall be posted or available on site, Contact this office at (910) 796-7215 for a final
inspection at completion of work.

This permit must be on the project site and accessible to the permit officer when
the project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on;
December 31, 2019

(5) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred; sold or otherwise
disposed of to a third -party.
(6) Dune disturbances will be allowed only to the extent necessary for development and if the dune's protective value is
not weakened or reduced. Disturbed dune areas will be immediately stabilized.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Disturbed areas shall be vegetatatively stabilized (planted and
mulched) within 14 days of construction completion.
(8) Pursuant to 15A NCAC Subchapter 7H .0308(c) the accessway over the dunes must not exceed eight feet in width
and shall provide only pedestrian access to the ocean beach. The accessway must be constructed so as to make
negligible alterations to the frontal dunes. That portion of the accessway crossing the frontal dune must be
constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings
touch the frontal dunes without any alteration to the dunes. In no case shall the dune be altered so as to
significantly diminish its capacity as a protective barrier against flooding and erosion.
(9) Dune disturbances and land disturbing activity shall be restricted to the applicant's property and no work is
authorized outside of the lateral bounds of the applicant's property.
