This permit, issued on APRIL 15, 1996 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
1) The alignment of the proposed bulkhead must be staked by a representative of the Division of
Coastal Management (DCM) within a maximum of 30 days prior to the start of construction.
Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather
conditions, will require the alignment to be restaked by DCM within a maximum of 30 days
prior to the new expected start of construction.
2) Priot to any work beginning on the proposed project; a pre -construction meeting must be held
between the permittee and a representative of the DCM.
3) The bulkhead must be constructed prior to any backfilling activities.
4) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through
the structure.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

or other suitable materials approved by department personnel. No excavation is permitted,
except for that whicy may be required for the construction of the bulkhead wall, riprap, deadmen
cables, etc. This permit does not authorize any excavation waterward of the approved
alignment.
6) ° All backfill material will be obtained from a highground source and confined behind the
permitted bulkhead.

• A copy of the deed '(with'state application only) or
other instrument under which the applicant claims title
to.the affected properties. If,the.applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or otherinstrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and -cross -sectional drawings) drawn to scale in black
ink on an 8 1/2 by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

site. Include highway or secondary road (SR)
numbers, landmarks, and the like.
• A Stormwater Certification, if one is necessary.
• A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners and
signed return receipts as proof that such owners
have received a copy of the application and plats
by certified mail. Such landowners must be advised
that they have 30 days in which to submit comments
on the proposed project to the Division of Coastal
Management. Upon signing this form, the applicant
further certifies that such notice has been provided.

Dear Sir:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -
colored form) is retained by you and it must be available on site when the project is inspected for compliance.
Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing
the permit and proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the
Office of Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20)
days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work
initiation. The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must
be carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

8. PROJECT SUMMARY: The applicant is proposing to construct a boatramp, bulkhead and finger
piers at Tuscarora Beach.

Environmental setting
The applicant owns a 7.5 acre tract of land off of SR 1401 adjacent to the Chowan River
in Hertford County. The property is known as Tuscarora Beach. Located on the property is
a series of piers, boat house, and boat slips. The large enclosed boat house structure is used to
moor power vessels. Open slips are present at its east end. A pier which is used for
recreational purposes, e.g. swimming, diving, etc., is located to the east of the boat house. This
pier is located within a designated swimming area. Much of the shoreline landward of the NWL
is maintained as a sandy beach which is utilized by swimmers. Upland development consist of
a restaurant, storage buildings and campsites. Areas which are not covered with sand is
vegetated with various upland grasses and trees. No wetland vegetation is present at the site.
Project pro osal
The applicant is proposing the following:
(1) The construction of a 40' long by 12' wide concrete boatramp of which 15' will
extend beyond the NWL. The ramp will be located adjacent to and to the west
of an existing pier. Some small amount of bottom sloping will be required for
proper ramp placement.
(2) The construction of 275' of bulkhead between the boat house and the swimming
pier. The bulkhead will average 2' beyond the NWL and will be 4' at the
furthest point. Once completed the bulkhead will be backfilled with materials
from an upland source.
(3) The construction of four, 10' long by 2' wide fier piers. These will be attached
to the west side of the existing swimming pier. These piers will be utilized as
temporary moorings for patrons to the restaurant.
Environmental impact
The project as proposed should have a minimal environmental impact. Approximately
550 sq. ft. of open water area will be filled landward of the proposed bulkhead. Approximately
180 sq. ft. of area will be disturbed in regards to sloping the boatramp.

Request for CAMA Major Development Permit

I have reviewed the subject application in regards to NCAC 7H, specifically the use
standards, and have determined that the applicant's proposal is consistent with those guidelines.
I recommend the permit be issued with the following conditions:
(1) The alignment of the proposed bulkhead must be staked by a representative of the
Division of Coastal Management (DCM) within a maximum of 30 days prior to
the start of construction. Failure to initiate construction within 30 days, or
erosion of the shoreline by adverse weather conditions, will require the alignment
to be restaked by DCM within a maximum of 30 days prior to the new expected
start of construction.
(2) Prior to any work beginning on the proposed project, a pre -construction meeting
must be held between the permittee and a representative of the DCM.
(3) The bulkhead must be constructed prior to any backfiliing activities.
(4) The bulkhead must be structurally tight so as to prevent seepage of backfill
materials through the structure.
(5) The bulkhead must be solid and constructed of treated wood, concrete slabs,
metal sheet piles or other suitable materials approved by department personnel.
No excavation is permitted except for that which may be required for the
construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.
(6) All back fill material will be obtained from a highground source and confined
behind the permitted bulkhead.

SRF, Inc. proposes the above development activity off SR 1401 at Tuscarora Beach. Public Trust
Areas, Estuarine Water, and Estuarine Shoreline AECs are involved and the proposal comes under the
auspices of the July 1991 CRC certified Hertford County Land Use Plan update.
The plan offers the following limited guidance on proposals of this type:
• County policy on AECs (page 40) notes "The policy shall be to support protective measures in
AECs but to encourage resource development activities which can meet state and federal and
local standards." Further, the county proposes to implement this policy through enforcement
of the county AEC overlay standards in the zoning ordinances which also requires a local EIS
for development disturbing more than one acre of land.
• By definition (page 64) AECs are included in the Conservation land classification and note that
the State's Coastal Management program regulates development within AECs, and the county
has not developed use and performance standards for AECs that are more restrictive.
My opinion if this proposal can be accomplished in accordance with applicable AEC standards it is not
inconsistent with the July 1991 certified Hertford County Land Use Plan update.

In addition to the comments made by Sara Winslow in her memo dated 19 February
1996 this Division makes the following comments for your consideration. The Division
sees no justification for the placement of a bulkhead or the loss of public trust lands. The
use of 550 square feet t of public trust lands for additional restaurant parking is a non -
water dependant use of public trust lands and is inconsistent with CAMA rules. There is
no indication of erosion or any other adverse effects to the high ground at this location.
The installation of a bulkhead can only disrupt the natural flow of the water along the
beach area. Therefore, this Division recommends that the bulkhead portion of this
application be denied.

The following comments by the North Carolina. Division of Marine Fisheries are
provided pursuant to General Statute 113-131.
Chowan River functions as a spawning and nursery area for biueback herring,
alewife, American shad, hickory shad and other commercially and recreationally important
species. The area to be bulkheaded is the location of one of DMF anadromous seine
stations. NCDMF has sampled this area since 1972, and has documented the shallow waters
along the beach to function as a nursery area for various species.
---s This agency is concerned with the bulkheading aspect of this project. The Chowan
River in the area of Tuscarora Beach is a rather low energy area. The placement of this
bulkhead will probably result in additional losses of beach along the property. It has been
well documented that along bulkheads the water depth will increase. When the Chowan
River is at unusually high levels and the water level drops it will probably take out the fill
from behind the bulkhead. The nursery area along this stretch of river may be impacted.

your application dated 14 February 1996. Alter reviewing your application, we have decided that this
fill is covered by General Water Quality Certification Number 302i.
This approval is only valid for die purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send u> a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicalory
hearing. You must act within 60 days of the date that you receive this letter. To ask for it hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Adminisrative Hearings, P.U. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a heaving.

Management, we have learned of your plans to construct a boatramp, bulkhead,
and finger piers at Tuscarora Beach, located off State Road 1401, adjacent the
Chowan River, Hertford County, North Carolina.
On January 1, 1994, we renewed General Permit No. 197800125, (copy
enclosed) that authorizes the maintenance, repair, and construction of boat
ramp facilities in navigable waters and waters of the United States in the
State of North Carolina.
On January 1, 1994, we renewed General Permit No. 197800080, (copy
enclosed) that authorizes the maintenance, repair, construction, and backfill
of bulkheads and riprap material structures along eroding shorelines in
navigable waters and waters of the United States in the State of North
Carolina.
On January 1, 1994, we renewed General Permit No. 197800056, (copy
enclosed) that authorizes the maintenance, repair, construction, and
installation of piers, docks, boathouses, boatshelters, mooring pilings,
dolphins and jetties in navigable waters of the United States in the State
of North Carolina.
Your proposed work is authorized if you can comply with all permit
conditions. Please read the enclosed permits to prevent an unintentional
violation of Federal law. As this Department of the Army general permit does
not relieve you of the responsibility to obtain any other required approvals,

SR 1401 at Tuscarora Beach, adjacent to the Chowan River in Hertford County,
North Carolina. It was received on 31 January 1996 and appears to be adequate
for processing at this time. The projected deadline for making a decision is
15 April 1996. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will also serve as your
notice of an extended review. However, an additional letter will be provided on
or about the 75th day. Should there be any questions on this procedural change,
do not hesitate to contact me.
N.C.G.S. 113A-119(b) requires that notice of an application be posted at
the location of the proposed development. Enclosed you will find a "Notice of
Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be:
nailing the notice card to a telephone pole or tree along the road right-of-way
