drawings 2 dated revised 5/31/96 and 1 dated 5/31/96.
This permit, issued on JULY 31, 1996 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Bulkhead Construction
1) The bulkhead shall not extend waterward more than 2 feet from the normal water level at any point
along its alignment at the time of construction.
2) The bulkhead must be constructed prior to any backfilling activities.
3) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by department personnel. No excavation is permitted except for
that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,1999
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
4) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.
5) All backfill material will be obtained from a highground source and confined behind the permitted
bulkhead.
6) The fill material will be clean and free of any pollutants except in trace quantities. Metal products,
organic materials, or unsightly debris will not be used.
7) No vegetated wetlands will be excavated or filled.
Boat Ramp Construction
8) In order to prevent wet concrete, which may be toxic to marine organisms, from coming into
contact with the aquatic environment, the concrete for the boat ramp shall be poured on an upland
site and pushed into place once hardened.
Sedimentation and Erosion Control
9) The disturbed areas will be properly graded and provided a ground cover sufficient to restrain
erosion within 30 working days of project completion.
General
10) This permit authorizes only the in water excavation needed to establish the boat ramp slope.
11) No fill material shall be placed at any time in any marsh or surrounding waters outside of the
alignment of the fill area indicated on the work plats.
NOTE: The N.C. Division of Environmental Management has authorized the proposed project
under General Water Quality Certification No. 3025 which was issued on 7/18/96.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id.

• A copy of the deed (with state application only) or
other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then
forward a copy of the deed or other instrument under
which the owner claims title, plus written permission
from the owner to carry out the project.
• An accurate, dated work plat (including plan view
and cross -sectional drawings) drawn to scale in black
ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality, copies are provided by
applicant. (Contact ' the U.S. Army "Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

• A list of the names and complete addresses of the

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

The proposed project appears to be consistent with the rules found in Subchapter 7H
concerning development in Estuarine Water, Public Trust Areas, and Estuarine Shoreline. The
shallow water sandy shoreline will require minimal excavation for the installation of the boat ramp
and the 2' alignment on the bulkhead is in keeping with the GP wording. If the permit is issued,
in addition to the standard conditions I recommend the following;
1. The bulkhead will not extend waterward more than 2 feet from the normal water level at
any point along its alignment at the time of construction.
2. The bulkhead must be constructed prior to any backfilling activities.
3. The bulkhead must be structurally tight so as to prevent seepage of backfill materials
through the structure.
4. The fill material will be clean and free of any pollutants except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.
5. No vegetated wetlands will be excavated or filled.
6. No fill material will be placed at any time in any marsh or surrounding waters outside of
the alignment of the fill area indicated on the work plat(s).
7. This permit only authorizes the in water excavation needed to establish the boat ramp
slope.

This proposal includes the construction of a boatramp and access pier on each side, an access
lot designed to serve a 7 lot subdivision. Public Trust Areas, Estuarine Water and Estuarine
Shoreline AECs are involved. The proposal comes under the auspices of the March 1993 CRC
certified Beaufort County Land Use Plan update.
The following limited guidance is noted in the 1993 plan:
County policy on AECs (page VIII-4) is to support development within only if such
development meets standards and objectives in 7H.
County policies on economic and community development (pages VIU-15 - VHI-20)
includes no specific policy guidance on site location for new subdivisions except to note
"employ the land classification map as a means of aiding in the selection and designing
appropriate areas of the county for future commercial, industrial and other economic
development land areas."
By definition all AECs are included in the Conservation land class where uses consistent
with AEC standards are permitted. The non -AEC portion of the proposal is in the
Transitional land class where intense development ultimately requiring urban type
services is expected.
My opinion is if this proposal can be accomplished in accordance with applicable AEC standards
it would not be inconsistent with the county plan.

SUBJECT: CAMA/Dredge and Fill Permit Application for George Rowd, off SR1102 at
Sparrows Bay near Blounts Creek Community, Beaufort County.
Biologists on the Wildlife Resources Commission staff have reviewed this permit
application and are familiar with habitat values of the project area. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-
128), as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16
U.S.C. 661 et seq.).
The applicant proposes to construct a concrete boat ramp with an access pier on each
side. The boat ramp will extend 40 ft. waterward of the NWL. The water depth at the end of the
ramp is 3 ft. so no excavation is proposed below the normal water level. Pamlico river is
classified as SB-NSW by the Environmental Management Commission.
The contact of wet cement with the aquatic environment has been shown to be toxic to �*
marine organisms in the immediate vicinity. We request that the cement for the boat ramp be
poured on an upland site and pushed into place once hardened. `r

1996. After reviewing your application, we have decided that this till is covered by General Water Quality
Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.

Project Setting
The project site is located off SR 1102 at Sparrows Bay on the Pamlico River near the
Blounts Creek Community in Beaufort County, North Carolina. The property is bordered on the
downstream (east) side by a developed lot which is vegetated with pines, mixed hardwoods,
shrubs and lawn grass. The property is bordered on the upstream (west) side by a developed lot
which is vegetated with pines, mixed hardwoods, shrubs,, lawn grass, and an area of Soartina
cvnosuroides and S. Patens adjacent the river. The majority of the ±6.14 acres in the project site
has been in agriculture production. The ±60' wide area adjacent the river is vegetated with pines
and mixed hardwoods which give way to vines and shrubs as you move down the ±5' high
embankment towards a ±12' wide sand beach. The remainder of the property is vegetated with
annual grasses. The tract is ±8' above mean sea level.
Pamlico River is classified as SB-NSW by the Environmental Management Commission.
Pamlico River at the project site is coastal water but is not open to shell fishing.
Project description
The applicant proposes to subdivide an ±6.14 acre tract to create a seven lot subdivision
and an access lot adjacent the Pamlico River. Four of the residential lots will be waterfront and
three will second row lots divided by the proposed access road. The proposed access road will
be ±30' wide and constructed of marl. A spur off the road will bisect the access lot down to the
proposed boat ramp. The boat ramp will be constructed of concrete and will be 12' wide and 150'
long (40' to be below the normal water level). The water depth at the 40' mark is ±3' deep so
no excavation is proposed below the normal water level. The existing ±5' high embankment will
be graded down to establish the ramp slope needed.
A 3' wide by 90' long access pier is proposed on each side of the boat ramp. The piers
will project 40' into the water past the normal water level with the remaining 50' over land. The
applicant proposes to bulkhead the access lot with ±55' of bulkhead along the shoreline with the
average and maximum alignment 2' waterward of the normal water level.
Anticipated impacts
The project as proposed will result in the filling of ±590 ftz of river bottom associated
with the construction of the boat ramp and backfill for the proposed bulkhead. Construction of
the access road and the section of boat ramp constructed on the high ground will result in the
excavation of ±1,320 ft2 and the filling of ±34,412.4 ftz. The project as proposed will result in
localized turbidity as a result of the construction activities.

We recommend that the following condition(s) be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans.
2. No vegetated wetlands will be excavated or filled.
3. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
4. The fill material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials, or unsightly debris will
not be used.
5. The authorized structure and associated activity will not cause an
unacceptable interference with navigation.

that receive authorization from the State of North Carolina.

the Army (DA) authorization to construct a boatramp and access piers, on
property located off State Road 1102, at Sparrows Bay on the Pamlico River,
near the Community of Blounts Creek, in Beaufort County, North Carolina,

be accomplished by the North Carolina Division of Coastal Management.

A Department of the Army permit will not be granted until the certification has
been obtained or waived.

F. Rowe and Violet M. Rowe, et parte" appearing in the Office of
the Clerk of Superior Court of Beaufort County in Special
Proceedings F-W p. 3935. This being the remainder of the
Second and Third Trac s as described in the petition therein,
The Grantors hereinabove designated represent the surviving
widow of Jacob F. Rowe and the sole surviving children of Jacob
F. Rowe who was one of seven surviving brothers and sisters of
Robert Rowe who died intestate in 1948,
TO HAVE AND TO HOLD said lands and premises unto
them, the parties of the second part, their heirs and assigns,
in fee simple, together with all privileges and appurtenances
thereunto belonging.
And the parties of the first part covenant with
the parties of the second part that they are seized in fee
simple of the land above described and have good right and
title to convey the same; that tire same is free and clear
from all liens and encumbrances. FXCFPT 1993 ad valorem
taxes, and that subject thereto, they will forever warrant
and defend the title to the same against all lawful claims
and demands of all persons whomsoever,
