Upland Development
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the 4 single-
family homes with associated driveways, parking and wastewater treatment systems, all as expressly
and specifically set forth in the attached permit application and workplan drawings. Any additional
land disturbing activities and/or construction may require a modification of this permit. Contact a
Division of Coastal Management representative at (252) 946-9481 for this determination.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
(late. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2016
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

2) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
3) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.

4) No wetlands shall be excavated or filled, even temporarily.
5) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to a stormwater
management permit from the Division of Water Quality.
NOTE: The permittee is advised that many development or land disturbing activities are not allowed
within the Environmental Management Commission's Tar/Pamlico River basin. Contact a
representative of the Division of Water Quality at (252) 946-6481 for more information
concerning allowable uses within the Tar/Pamlico River Buffer.
NOTE: The N.C. Division of Water Quality has authorized the proposed project under DWQ Project No.
12-0968, and Buffer Authorization dated 10/29/12.

The 3.01 acre project site is located off SR 1357 (John Gaskins Drive) on the east side of
Ocracoke Village adjacent the Pamlico Sound near Horse Pen Point in Hyde County, North
Carolina. The site is a sandy berm/upland area bordered on the northeast side by the Pamlico
Sound and the southwest by a coastal wetland marsh vegetated primarily with Juncus
roemeranus (Black Needlerush). Access to the sandy upland is by a ±20' wide x ±200' long
filled road across the marsh from SR 1357. The sandy upland berm ranges in width from t70' to
±200' and has an elevation of approximately 4' above the normal water level (NWL). The
upland berm is subdivided into 5 lots and the largest containing the most upland located on the
northern end (Lot 4, Section 1 of Issac and John O'Neal Heirs). This lot has served as a spoil
area in the past for dredging projects authorized by Major CAMA/Dredge and Fill Permits 132-
87 and 78-01. This lot has considerably more elevation as a result of the spoil deposition
activities as much as 9' above the NWL. The spoil material (sand) has and continues to be
redistributed as part of development activities undertaken by the property owner, across the other
remaining 4 lots. Vegetation on the sandy upland berm consists of salt meadow hay (Spartina
pat ens , american beach grass (Ammophila breviligulata), pennywort (Hvdrocoty_le bonariensis)
and sea oats viola Raniculata.. The upland/wetland transition on the southwest side of the
upland berm is vegetated with wax myrtle (Mydca cerifera and red cedar J( unipems vir ' 'ana .
The last lot on the south side of the upland berm is developed with a single family residence and
associated biofiltration wastewater treatment system. There is also a 6' x 150' long pier with a
20' x 20' L-head platform built into the Pamlico Sound offshore of this lot.
The shoreline adjacent the Pamlico Sound is stabilized with the combination of a vinyl
bulkhead and riprap revetment for a distance of ±750'. An existing 4' wide walkway/boardwalk
runs the entire length immediately adjacent the existing bulkhead. There is a t800'long dredged
access channel, originally authorized by CAMA/Dredge and Fill Permit No. 132-87, that
connects to two dredged basins, authorized by CAMA/Dredge and Fill Permit No. 78-01, located
offshore the aforementioned lots. Each dredged basin has a pier constructed to it with a total of
six slips between the two piers. This dredging and pier construction was conducted as part of the
development of the property.
The Pamlico Sound at this location is designated as Coastal Waters by the Marine
Fisheries Commission as well as SA by the Environmental Management Commission. The
offshore waters adjacent to this site are open to shellfishing.
Project Description
The applicant is proposing to further develop each of the four remaining unoccupied lots
with a single family residence each with associated wastewater system, driveway and parking.
Three of the four proposed wastewater systems will be biofiltration and one will be a
conventional system. Each wastewater system has been authorized by the Hyde County Health

Department. The conventional system is proposed to be constructed on the largest lot on the
north end of the upland berm. This lot will also be used to support two of the biofiltration
wastewater systems for adjoining lots lacking space to support both a residence and wastewater
system. These two lots will have a lift station to pump the wastewater from the residence to the
biofiltration system on the northern lot. The driveway and parking areas are to be constructed
with gravel. Each residence will have a wooden boardwalk constructed from the residence to the
existing boardwalk adjacent the bulkhead.
Anticipated Impacts
The project as proposed will disturb 16,695 ft' of uplands. There are no proposed
wetland or open water impacts proposed in this application package. Impervious surface
coverage for the entire upland area will be 14,223 ft' or 10.8%. Impervious coverage within the
Estuarine Shoreline is 9,133 ft' or 18.8%. Home construction will result in 2,296 ft' of
impervious surface coverage in Zone 2 of the Tar/Pamlico River Basin Buffer. There will be
466 ft' of Zone 2 shaded by open wooden decks elevated 8' above the existing ground level. The
project will result in an increase of surface runoff from the developed areas.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by
you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS I I3A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.

Thank you for your letter dated November 13, 2012, concerning the Coastal Area Management
Act (CAMA) major permit request submitted by John Geewax, in which authorization was
requested to construct four single family residences with associated driveways, parking areas,
and wastewater treatment systems at O'neal Drive, on Ocracoke Island. The Division
appreciates your concerns about the proposed project.
The Coastal Area Management Act permit review process involves a coordinated state and
federal review of each permit application, with all review agency comments considered by the
Division before final action is taken on a permit application. In this case, no inconsistencies with
the Coastal Area Management Act were identified as a result of this review. Consequently, the
Division has issued a Major Permit, No. 3-13 for the proposed activity. A copy of the permit is
being provided to you for your information.
If you wish to object to the actions taken on this permit application, you may request an appeal
of this decision within twenty (20) days of the permit decision. If you would like copies of the

Mr. Moye,
I spoke with Mr. Troxier today about the Geewax property. Mr. Troxler asked If 1 would put my
concerns in writing and send them to you. First, I would like to express that I have never been
upset with Mr. Geewax about developing his property and he has always appeared to be a good
neighbor. He has put a lot of time and money into bulkheading and laying down riprap to
stabilize that beachhead. My concerns about the granting the Coma permit as applied for is the
number of homes. It was my understanding that there are three lots adjacent to each other
(Newell property, Cockren property and the one in the middle were the house sits now). I also
was told that he had water meters with some of the lots and septic permits. When he built the
first home, it was my understanding that there would be two more (one for each lot). The
following concerns come from my understanding of what CAMA is tasked to protect and
observations of his property during hurricanes.
During hurricane Sandy and other hurricanes, I have watched the storm surge go over
his bulkhead and waves break on his property. Granting 4 more homes for those lots is
irresponsible to the other people who live near his property who may be impacted by
damage to his property.
• The storm surge is significant enough on that property and down his road that it is very
likely that the septic fields will be compromised or even destroyed during storms. All
the debris and nutrients associated with the homes and the septic will be spread into
the adjacent marsh. In order to clean up the marsh, significant damage to the marsh
will occur and the nutrient pollution will cause other damage.
• In my opinion, that property will sustain erosion damage overtime so development
should be done in a conservative manner.
believe that the LAMA permit that is being applied for does not meet that the new standards
of the NC CHIP plan. Good and responsible development is one thing, the addition of 4 more
homes in such a narrow strip of land surrounded by important marsh is irresponsible and
greedy. Please do not grant the permit. Thank you for your time.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules and Regulations
PERMISSION IS HEREBY GRANTED TO

construction, operation and maintenance of a 12% low density subdivision in compliance
with the provisions of Session Law 2008-211 and 15A NCAC 2H .1000 (hereafter referred
to as the "stormwater rules') and the approved stormwater' management plans and
specifications, and other supporting data as attached and on filewith and approved by the
Division of Water Quality and considered a part of this permit.
The Permit shall be effective from the date of issuance until rescinded and shall be subject
to the following specific conditions and limitations:
I. DESIGN STANDARDS
Each of the 4 lots is limited to a maximum of 13,758 square feet of built -upon area,
as indicated in the application and as shown on the approved plans. The
stormwater management plan shall utilize a roof water runoff system that will
include individual cisterns for each residence that will collect and store runoff to be
used for Irrigation and gray water use on the properties. CAMA regulations may
reduce the allowable built -upon area for those lots within the AEC.
2. The overall tract built -upon area percentage for the project must be maintained at
12% per the requirements of Session Law 2008-211 and Section .1005 of the
stormwater rules.
3. The built -upon' areas associated with this project shall be located at least 50 feet
landward of all perennial and intermittent surface waters.
4. The only runoff conveyance systems allowed will be vegetated conveyances such
as swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules
and approved by the Division.
5. All roof drains must terminate at least 50 foot from the mean high water mark.
6. Level spreaders shall be provided at the ends of all swales that discharge into a
regulated wetland or any surface water.
7. No direct discharges to class SA Waters are allowed. Diffuse flow of stormwater at
a nonerosive velocity to a vegetated buffer or other natural area capable of
providing effective infiltration of the runoff from the 1 year24-hour storm shall not be
considered a direct point of stormwater discharge.

II. SCHEDULE OF COMPLIANCE
Swales and other vegetated conveyances shall be constructed in their entirety;
vegetated, and be operational for their intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the swales or other vegetated conveyances will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to
operate the permitted stormwater management systems at optimum efficiency to
include:
a. Inspections
b. Sediment removal.
C. Mowing, and re -vegetating of the side slopes.
d. Immediate repair of eroded areas.
B. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Maintenance of level spreaders and infiltration areas in accordance with
approved plans and O&M documents.
4. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed below:
a. Any revision to any of the items shown on the approved plans, including the
stormwater management system, design concept, built -upon area, details,
etc.
b. Project name change.
c. Transfer of ownership,
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, or selling of the project area.
f. Filling in, altering or piping' any vegetative conveyance shown on the
approved plan.
5. The permittee shall submit all information requested by the Director or his
representative within the time frame specified in the written information request.
6. No piping shall be allowed except that minimum amount necessary to direct runoff
beneath an impervious surface such as a road and that minimum amount needed
under driveways to provide access to lots.
7. Within 30 days of completion of the project, the permittee must certify in writing that
the project's stormwater controls, and impervious surfaces have been constructed
within substantial intent of the approved plans and specifications. Any deviation
from the approved plans must be noted on the Certification.
The permittee is responsible for verifying that the proposed built -upon area does not
exceed the allowable built -upon area. Once the lot transfer is complete, the built -
upon area may not be revised without approval from the Division of Water Quality,
and responsibility for meeting the built -upon area limit is transferred to the individual
property owner, provided that the permittee complies with the requirements of
Section II.11 and 11.12 of this permit.

9. Deed restrictions are incorporated into this permit by reference and must be
recorded with the Office of the Register of Deeds prior to the sale of any lot.
Recorded deed restrictions must include, as a minimum, the following statements
related to stormwater management:
a. The following covenants are Intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW7130404, as issued by
the Division of Water Quality under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit.
C. These covenants are to run with the land and be binding on all persons and
parties claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division of
Water Quality.
e. Alteration of the drainage as shown on the approved plans may nottake
place without the concurrence of the Division of Water Quality.
f. The maximum built -upon area per lot is 854 square feet for Lot 3, 1,421
square feet for Lot 4, 2,522 square feet for Lot 5 and 8,960 square feet for
Lot 4, Section I. This allotted amount includes any built -upon area
constructed within the lot propperty boundaries, and that portion of the
right-of-way between the front fot line and the edge of the pavement. Built
upon area includes, but is not limited to, structures, asphalt, concrete, gravel,
brick, stone, slate, and coquina, but does not include raised, open wood
decking, or the water surface of swimming pools.
g. Filling in or piping of any vegetative conveyances (ditches, swales, etc.)
associated with the development except for average driveway crossings, is
strictly prohibited by any persons.
h. For those lots within CAMA's Area of Environmental Concern, where DCM
calculates a different maximum lot built -upon area, the governing lot BUA
shall be the most restrictive of the two amounts.
I. Each lot will'maintain a 50 foot wide vegetated buffer between all impervious
areas and surface waters.
j. All roof drains shall terminate at least 50 foot from the mean high water
mark.
k. If permeable pavement credit is desired, the property owner must submit a
request, with supporting documentation, to the permittee and receive
approval prior to construction of the permeable pavement.
10. The permittee shall submit a copy of the recorded deed restrictions within 30 days
of the date of recording.
11. If the permittee sets up an Architectural Review Committee or Board (ARC orARB)
to review plans for compliance with the restrictions, the plans reviewed must include
all proposed built -upon area (BUA). Any approvals given by the ARC orARB do not
relieve the lot owner of the responsibility to maintain compliance with the permitted
BUA limit.
12. All stormwater conveyances will be located in either dedicated right-of-way (public
or private), recorded common areas or recorded drainage easements. The final
plats for the project will be recorded showing all such required easements, in
accordance with the approved plans.
13. The Director may notify the permittee when thepermitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a.written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide
copies of revised plans and certification in writing to the Director that the changes
have been made.

14. If permeable pavement credit is desired, the permittee must submit a request to
modify the permit to Incorporate such language as required by the Division of Water
Quality. The request to modify must include a soils report identifying the type of soil,
the Seasonal High Water Table elevation and the infiltration rate. Upon the
successful completion of a permit modification, the individual lot owners that request
to utilize permeable pavements must submit the necessary forms and
documentation to the permittee and receive approval prior to construction of the
permeable pavement.
Ill. GENERAL. CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director. The Director may require.modification or revocation and
re -issuance of the permit to change the name and incorporate such other
requirements as maybe necessary. In the event of a name or ownership change, a
completed Name/Ownership Change form, signed by both parties, must be
submitted to the Division of Water Quality accompanied by the supporting
documentation as listed on page 2 of the form. The approval of this request will be
considered on its merits, and may or may not be approved.
2. The permittee is responsible for compliance with all permit conditions until the
Director approves a transfer of ownership. Neither the sale of the project nor the
transfer of common areas to a third party, such as a homeowner's association,
constitutes an approved transfer of the stormwater permit.
3. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to an enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statutes 143-215.6A to 143-215.6C.
4. The issuance of this permit does not prohibit the Director from reopening and
modifying the permit, revoking and reissuing the permit, orterminating the permit as
allowed by the laws, rules, and regulations contained in Session Law 2008-211,
Title 15A of the North Carolina Administrative Code, Subchapter 2H.1000; and
North Carolina General Statute 143-215.1 et. al.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by the Division, such as the construction of additional or
replacement stormwater management systems.
B. The permittee grants permission to DENR Staff to enter the property during normal
business hours, for the purpose of inspecting all components of the stormwater
management facility.
7. The permit issued shall continue in force and effect until revoked orterminated. The
permit may be modified, revoked and reissued orterminated for cause. The filing of
a requestfor a permit modification, revocation and re -issuance, or termination does
not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the swales must
follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.

10. The issuance of this permit does not preclude the Permittee from complying with
Any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state and federal), which have jurisdiction.
11. The permittee shall notify the Division in writing of any name, ownership or mailing
address changes at least 30 days prior to making such changes.

Subject: Major Permit Application Request by John Geewax to construct 4- single family

LUP Determination: The proposal is consistent with and not in conflict with the 2008 Hyde
County Land Use Plan (LUP) that was certified by the CRC on March
28, 2008.
LUP Considerations: The proposal is within an area designated as "Agricultural Low Density
Residential", within Ocracoke Villiage, on the Hyde County 'Future Land Use Plan Map'
(FLUPM).
Overview: The project is located and fronting on the west side of John Gaskins Drive. The
request involves Four (4) properties that will share a common driveway. Though the County's
policy limits the request area ("Agricultural Low Density Residential"), 'to a very low density
designation that calls for an average of one unit per five (5) acres, The request involves an
existing subdivision and as such there is not an issue.

Dear Mr. Geewax:
You have our authorization, in accordance with 15 A NCAC 02B .0259 and
Session Law 2011-394 any conditions listed below, to impact approximately
2,762 ft2 of Zone 2 of the protected riparian buffer for the purpose of
constructing a driveway, parking area and single-family dwelling with open
slatted decks on the subject property as described in your application dated
October 17, 2012. In addition, you should obtain or otherwise comply with any
other required federal, state or local permit before you go ahead with your
project including (but not limited to) Erosion and Sediment Control, Non -
Discharge, 404 and CAMA regulations.
This approval is for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be
required to send us a new application. If the property is sold, the new owner
must be given a copy of this Certification and approval letter and is thereby
responsible for complying with all conditions. If total fills for this project (now
or in the future) exceed one acre of wetland or 150 linear feet of stream,
compensatory mitigation may be required as described in 15A NCAC 2H
.0506 (h). This approval requires you to follow the conditions listed in the
attached certification and any additional conditions listed below.

specific and general conditions of this Certification (or Isolated Wetland
Permit) are met. No other impacts are approved including incidental

2: Stormwater Management
Stormwater generated off the residential dwelling must be collected and
treated. This may be accomplished through the use of gutters and rain
barrels or by collecting and directing to a residential rain
garden/biotention area. An Operation and Maintenance Agreement (0&M
Agreement) will be required when utilizing the above -mentioned Best
Management Practices (BMPs). A bioretention cell consists of a
depression in the ground that supports various types of water -tolerant
vegetation. The surface of the BMP is depressed in bioretention cell to
allow for ponding of runoff that filters through the soil. Ponding depth
shall be 12 inches or less. No dimension (width, length, or radius) can be
less than 10 feet,. This is to provide sufficient space for plants. A final
plan for stormwater treatment must be provided and approved by the
Division, including an 0&M Agreement.

Upon completion of all work approved within the 401 Water Quality
Certification or applicable Buffer Rules, and any subsequent modifications,
the applicant is required to return the attached certificate of completion to
the 401 Oversight/Express Review Permitting Unit, North Carolina Division
of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Any disputes over determination regarding this Authorization Certificate
(associated with the approved buffer impacts) shall be referred in writing to
the Director for a decision. The Director's decision is subject to review as
provided in Article 3 and 3 of G.S. 150B. This Authorization Certificate shall
expire five (5) years from the date of this letter.

This letter completes the review of the "No Practical Alternatives"
determination under 15A NCAC 2B .0259 and Session Law 2011-394. This
letter does not authorize any impacts to either Waters of.the United States or
Waters of the State. Please contact the US Army Corps of`Engineers (USACE),
Division of Coastal Management (DCM) or Division of Water`Quality'(DWQ) if
any impacts are proposed to either of these waters. If you have any

This memo is in reference to the Major CAMA permit application submitted by Doug
Doorman with Atlantic Environmental Consultants on behalf of John Geewax for the
development of four consecutive single family residential lots located off SR 1357 (John Gaskins
Drive) on the east side of Ocracoke Village adjacent the Pamlico Sound near Horse Pen Point in
Hyde County, North Carolina. The property owner proposes to construct a single family
residence on each of the four lots. The home construction will impact Zone 2 of the Tar/Pamlico
River Basin Buffer on each lot with part of the house and deck tripping the Major CAMA Permit
process. This phase of the development of these four lots does not impact any open water or
wetland areas.
Staff has reviewed the project per the development standards as found in North Carolina
Administrative Code 7H.0209 and have determined the project to be consistent with the
applicable development standards. Staff recommends that the permit be issued with the standard
conditions for upland development addressing erosion and sedimentation control and impervious
surface limits.

County Health Department, and the owner or owners representative.
During this conference the wastewater system shall be staked out on the krt.

LOCATION OF PROJECT:
The project consists of four lots. Lots 3, 4, & 5 of the Trent Woods 2 Subdivision and lot
4, Sec I located off Oneal Drive (S.R. 1357), on Ocracoke, Hyde County, adjacent to the
Pamlico Sound (35006'59"N 75058'09"W).
PURPOSE and PROPOSED CONSTRUCTION:
John Geewax is proposing to do improvements his property on four separate lots. The
proposed project includes the construction of four single family residences with
associated wastewater systems, driveway and parking. The total project site consists of
3.1 acres of highground and a mixture of "404" and coastal wetlands. Currently the
manmade improvements on this property are an asphalt/gravel driveway, a bulkhead
and rip -rap shoreline, and two piers with 6 boat slips and one gazebo. Construction of
the houses, drainfields, driveways and parking will take place using a dump truck, bull
dozier, frontend loader with a box blade. Silt fence will be placed along areas of land
disturbance for erosion control.

Gaskins Drive on the East Side of Ocracoke Village adjacent the Pamlico Sound near Horsepen
Point in Hyde County, North Carolina. It was received on 8 October 2012, and appears to be
adequate for processing at this time. The projected deadline for making a decision is 22
December 2012. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from the 8 October 2012,
you may request a meeting with the Director of the Division of Coastal Management and permit
staff to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.

The 3.01 acre project site is located off SR 1357 (John Gaskins Drive) on the east side of
Ocracoke Village adjacent the Pamlico Sound near Horse Pen Point in Hyde County, North
Carolina. The site is a sandy berm/upland area bordered on the northeast side by the Pamlico
Sound and the southwest by a coastal wetland marsh vegetated primarily with Juncus
roemeranus (Black Needlerush). Access to the sandy upland is by a t20' wide x ±200' long
filled road across the marsh from SR 1357. The sandy upland berm ranges in width from f70' to
±200' and has an elevation of approximately 4' above the normal water level (NWL). The
upland berm is subdivided into 5 lots and the largest containing the most upland located on the
northern end (Lot 4, Section 1 of Issac and John O'Neal Heirs). This lot has served as a spoil
area in the past for dredging projects authorized by Major CAMA/Dredge and Fill Permits 132-
87 and 78-01. This lot has considerably more elevation as a result of the spoil deposition
activities as much as 9' above the NWL. The spoil material (sand) has and continues to be
redistributed as part of development activities undertaken by the property owner, across the other
remaining 4 lots. Vegetation on the sandy upland bens consists of salt meadow hay (Soartina
ap tens), american beach grass (Ammophila breviligulatal, pennywort (Hydrocotyle bonariensis
and sea oats niola aniculata . The upland/wetland transition on the southwest side of the
upland berm is vegetated with wax myrtle (Myrica cerifera and red cedar Quniperus virginiana).
The last lot on the south side of the upland berm is developed with a single family residence and
associated biofiltration wastewater treatment system. There is also a 6' x 150' long pier with a
20' x 20' L-head platform built into the Pamlico Sound offshore of this lot.
The shoreline adjacent the Pamlico Sound is stabilized with the combination of a vinyl
bulkhead and riprap revetment for a distance of±750'. An existing 4' wide walkway/boardwalk
runs the entire length immediately adjacent the existing bulkhead. There is a t800'long dredged
access channel, originally authorized by CAMA/Dredge and Fill Permit No. 132-87, that
connects to two dredged basins, authorized by CAMA/Dredge and Fill Permit No. 78-01, located
offshore the aforementioned lots. Each dredged basin has a pier constructed to it with a total of
six slips between the two piers. This dredging and pier construction was conducted as part of the
development of the property.
The Pamlico Sound at this location is designated as Coastal Waters by the Marine
Fisheries Commission as well as SA by the Environmental Management Commission. The
offshore waters adjacent to this site are open to shellfishing.
Project Description
The applicant is proposing to further develop each of the four remaining unoccupied lots
with a single family residence each with associated wastewater system, driveway and parking.
Three of the four proposed wastewater systems will be biofrltration and one will be a
conventional system. Each wastewater system has been authorized by the Hyde County Health

Department. The conventional system is proposed to be constructed on the largest lot on the
north end of the upland berm. This lot will also be used to support two of the biofiltration
wastewater systems for adjoining lots lacking space to support both a residence and wastewater
system. These two lots will have a lift station to pump the wastewater from the residence to the
bioftltration system on the northern lot. The driveway and parking areas are to be constructed
with gravel. Each residence will have a wooden boardwalk constructed from the residence to the
existing boardwalk adjacent the bulkhead.
Anticipated Impacts
The project as proposed will disturb 16,695 ft' of uplands. There are no proposed
wetland or open water impacts proposed in this application package. Impervious surface
coverage for the entire upland area will be 14,223 ft' or 10.8%. Impervious coverage within the
Estuarine Shoreline is 9,133 ft' or 18.8%. Home construction will result in 2,296 ft' of
impervious surface coverage in Zone 2 of the Tar/Pamlico River Basin Buffer. There will be
466 ft' of Zone 2 shaded by open wooden decks elevated 8' above the existing ground level. The
project will result in an increase of surface runoff from the developed areas.

The project consists of four lots. Lots 3, 4, & 5 of the Trent Woods 2 Subdivision and lot
4, Sec I located off Oneal Drive (S.R. 1357), on Ocracoke, Hyde County, .adjacent to the
Pamlico Sound (35006'59"N 75058'09"W).
PURPOSE and PROPOSED CONSTRUCTION:
John Geewax is proposing to do improvements his property on four separate lots. The
proposed project includes the construction of four single family residences with
associated wastewater systems, driveway and parking. The total project site consists of
3.1 acres of highground and a mixture of "404" and coastal wetlands. Currently the
manmade improvements on this property are an asphalt/gravel driveway, a bulkhead
and rip -rap shoreline, and two piers with 6 boat slips and one gazebo. Construction of
the houses, drainfields, driveways and parking will take place using a dump truck, bull
dozier, frontend loader with a box blade. Silt fence will be placed along areas of land
disturbance for erosion control.

The 3.01 acre project site is located off SR 1357 (John Gaskins Drive) on f
Ocracoke Village adjacent the Pamlico Sound near Horse Pen Point in Hyde County, No
Carolina. The site is a sandy berm/upland area bordered on the northeast side by the Pamlico
Sound and the southwest by a coastal wetland marsh vegetated primarily with Juncus
roemeranus (Black Needlerush). Access to the sandy upland is by a ±20' wide x ±200' long
filled road across the marsh from SR 1357. The sandy upland berm ranges in width from f70' to
±200' and has an elevation of approximately 4' above the normal water level (NWL). The
upland berm is subdivided into 5 lots and the largest containing the most upland located on the
northern end (Lot 4, Section 1 of Issac and John O'Neal Heirs). This lot has served as a spoil
area in the past for dredging projects authorized by Major CAMA/Dredge and Fill Permits 132-
87 and 78-01. This lot has considerably more elevation as a result of the spoil deposition
activities as much as 9' above the NWL. The spoil material (sand) has and continues to be
redistributed as part of development activities undertaken by the property owner, across the other
remaining 4 lots. Vegetation on the sandy upland berm consists of salt meadow hay (Snartma
ap tens), american beach grass (Ammophila brevili ug latal, pennywort I(_3yt _le bonariensis)
and sea oats niola paniculata). The upland/wetland transition on the southwest side of the
upland berm is vegetated with wax myrtle (,MMyrica cerifera and red cedar (Junipems virginiana).
The last lot on the south side of the upland berm is developed with a single family residence and
associated biofiltration wastewater treatment system. There is also a 6' x 150' long pier with a
20' x 20' L-head platform built into the Pamlico Sound offshore of this lot.
The shoreline adjacent the Pamlico Sound is stabilized with the combination of a vinyl
bulkhead and riprap revetment for a distance of ±750'. An existing 4' wide walkway/boardwalk
runs the entire length immediately adjacent the existing bulkhead. There is a t800'long dredged
access channel, originally authorized by CAMA/Dredge and Fill Permit No. 132-87, that
connects to two dredged basins, authorized by CAMA/Dredge and Fill Permit No. 78-01, located
offshore the aforementioned lots. Each dredged basin has a pier constructed to it with a total of
six•slips between the two piers. This dredging and pier construction was conducted as part of the
development of the property.
The Pamlico Sound at this location is designated as Coastal Waters by the Marine
Fisheries Commission as well as SA by the Environmental Management Commission. The
offshore waters adjacent to this site are open to shellfishing.
Project Description
The applicant is proposing to further develop each of the four remaining unoccupied lots
with a single family residence each with associated wastewater system, driveway and parking.
Three of the four proposed wastewater systems will be biofiltration and one will be a
conventional system. Each wastewater system has been authorized by the Hyde County Health

Department. The conventional system is proposed to be constructed on the larg�ot on the
north end of the upland berm. This lot will also be used to support two of the biofiltratiib"Cz v
wastewater systems for adjoining lots lacking space to support both a residence and wastewater
system. These two lots will have a lift station to pump the wastewater from the residence to the
biofiltration system on the northern lot. The driveway and parking areas are to be constructed
with gravel. Each residence will have a wooden boardwalk constructed from the residence to the
existing boardwalk adjacent the bulkhead.
Anticipated Impacts
The project as proposed will disturb 16,695 ft' of uplands. There are no proposed
wetland or open water impacts proposed in this application package. Impervious surface
coverage for the entire upland area will be 14,223 ft' or 10.8%. Impervious coverage within the
Estuarine Shoreline is 9,133 ft' or 18.8%. Home construction will result in 2,296 ft' of
impervious surface coverage in Zone 2 of the Tar/Pamlico River Basin Buffer. There will be
466 ft' of Zone 2 shaded by open wooden decks elevated 8' above the existing ground level. The
project will result in an increase of surface runoff from the developed areas.

The project consists of four lots. Lots 3, 4, & 5 of the Trent Woods 2 Subdivision and lot
4, Sec I located off Oneal Drive (S.R. 1357), on Ocracoke, Hyde County, adjacent to the
Pamlico Sound (35006'59"N 75058'09"W).
PURPOSE and PROPOSED CONSTRUCTION:
John Geewax is proposing to do improvements his property on four separate lots. The
proposed project includes the construction of four single family residences with
associated wastewater systems, driveway and parking. The total project site consists of
3.1 acres of highground and a mixture of "404" and coastal wetlands. Currently the
manmade improvements on this property are an asphalt/gravel driveway, a bulkhead
and rip -rap shoreline, and two piers with 6 boat slips and one gazebo. Construction of
the houses, drainfieids, driveways and parking will take place using a dump truck, bull
dozier, frontend loader with a box blade. Silt fence will be placed along areas of land
