RE: Refinement of CAMA Major Permit #73-96
Dear Ms. Rosell:
I have reviewed your request to modify CAMA Major Permit #73-96 to allow you to
substitute the construction of a modified low water bulkhead for the 52' of riprap breakwater.
I hereby refine your permit to allow you to construct 52 feet of wooden breakwater,
aligned no more than 2 feet waterward of the wetland fringe except in the eroded pocket just
north of the salt marsh cordgrass where the breakwater may not exceed 7 feet and having 2
return walls not to exceed 2 feet in length and not to encroach on the coastal wetlands. This
authorization goes into effect immediately and does not allow you to use any backfill material
nor the use of tie backs and dead men for this structure. These changes will replace permit
conditions 1 through 4. All other terms and conditions of permit #73-96 remain in effect.

MEMORANDUM

SUBJECT: Request to Refine Major Permit #73-96 For Marjean Rosell
DATE: July 15, 1996
On July 5, 1996, the Elizabeth City Office received a request to,modify the above permit.
Subsequent to that request the property owner revised the plans and now would like to refine the
permit. The original permit (as shown on the attached plat noted as page 2 of 2) approved the
installation of a shoreline stabilization system including a 72' low water bulkhead in front of a
high Juncus Marsh (Juncus roemerianus) and a 52' long riprap breakwater system.in front of
a wetland fringe composed of Salt Meadow Cordgrass (Spartina patens) and Smooth Cordgrass
(Spartina alterniflora). The permit holder, Marjean Rosell, has been advised by her contractor
that there is no practicable way to access the shoreline for the placement, of riprap without
causing severe damage to existing vegetation a septic system located in the front of the property.
The refinement would allow a low water bulkhead to be installed in place of the approved riprap
system in the same location. The bulkhead will be of a modified design with openings equaling
one inch per one linear foot of bulkhead. According to the applicant a short 2'- 0" return wall
on the bulkhead will terminate approximately at mean high water to afford stability to the
structure. The alignment of the bulkhead will be along the waterward edge of the coastal fringe,
an average of two feet waterward of mean high water and not exceed a maximum of seven feet
at any point .
Site review of the property has verified that access to the shoreline would require crossing the
applicants septic tank and field lines. Due to the low overhang of the canopy of existing Live
Oak it also appears and the position of the septic system it is not practicable to riprap the
shoreline as originally requested. I would like to recommend that the permit refinement be
approved.
