Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be Hutt ana vota. 1) In accordance with the permittee's letter dated 10/18/13, the original proposal to park 2 semi van trailers on the southern end of dock and the proposed construction of a 7' x 36' deck, is hereby removed from this project. Any reference to these proposals in the attached workplan drawings is hereby null and void. 2) Unless specifically altered herein, this minor modification authorizes the extension of the boardwalk south of the existing boat ramp, 12' x 12' roof over the 8' wide dock located overland, 7' x 42' access deck situated perpendicular to the existing overland dock, and the 7' x 36' deck for a future building, all as indicated on the attached workplan drawings. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or ,other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered -hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Mr. E. Floyd Foster has requested that the permit by modified as follows: 1. Extend the existing 8' wide boardwalk 24' to the southern side of the existing boat ramp. 2. Cover the proposed and existing 8' wide overland dock with a roof measuring 12' wide by 42' long. 3. Construct a 7' wide by 42' long access deck situated perpendicular to existing overland dock. 4. Park 2 semi van trailers (8' by 46') on southern end of dock for holding crabs as well as storage. 5. Construct a 7' by 36' deck next to van trailers for access. 6. We vehemently oppose any further building. We ask that the current permit be enforced before any modifications be approved. We opposed the original permit request based on several factors. Three of which were 1). Interference with current navigational channels 2). Use of a private road and boat ramp for commercial purpose. 31. No septic system. These have all proven to be valid concerns. 1. Navigational channels are being blocked by the loading and unloading of crab pots on the Southside. 2. Our private road has significantly eroded, as evidenced by Mr Foster continuing to bring in sand to replenish. Our access to the boat ramp is routinely blocked. (we have deeded access to boat ramp) 3. An individual lived on site in a camper hooked up to water without proper facilities Now Mr. Foster is asking for modifications. We are much more concerned with "what he is not requesting" Parking. Where are all the cars, trailers, boats, etc to park. The integrity of the land is already in question. s Septic. He references a "future building". Based on history and fact, Mr Foster does not wait for approval, he simply builds first. o An appropriate designated area for loading and unloading, not the current navigational channel. We are also concerned that several of the modifications have afready been built He is asking for a Permit after the fact. As riparian owners we oppose these modifications. And hold valid the adverse impact without proper infrastructure. This Office received a request from Mr. Ernest F. Foster of Forests Seafood to modification the 401 Certification and Buffer Authorization as follows: 1. Extend the existing 8' wide boardwalk 24' to the southern side of the existing boat ramp. 2. Cover the proposed and existing 8' wide overland dock with a roof measuring 12' wide by 42, tong. 3. Construct a 7' wide by 42' long access deck situated perpendicular to the existing overland dock: 4. Park 2 semi van trailers (8' by 46') on the southem•end of the dock for holdings crabs as well as storage. S. Construct a 7' by 36' deck next to the van trailers for access. 6. Construct a 7' by 36' deck for future building. Upon review of the request, Items #1, •2, and 3 could be approved via the existing buffer authorization. 11tein #6Is not subject to the Tar -Pamlico Riparian Buffer because the man-made canal does not appear on either the most recent published USDA NRCS Solt Survey or the most recent version of the 1:24000 scale quadrangle topographic maps prepared by the USGS. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that if another qualified parry submits a valid objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal Resources Commission makes the final decision on any appeal. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements.
