AREA OF ENVIRONMENTAL CONCERN — Ocean Hazard AEC
Dear Mr. Flentje:
I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an
application for a minor development permit under the Coastal Area Management Act. Based on the information
provided, I have determined that the activity you propose is exempt from needing a minor development permit as
long as it remains consistent with your site drawing dated received by DCM on November 10, 2022, and meets the
conditions specified below. If your plans should change and your project will no longer meet these conditions,
please contact me before proceeding.
ACCESSORY STRUCTUREIUSE
1. The work authorized under this exemption specifically includes maintenance and repair of the existing front
and rear decking and beach access walkway.
2. The development must not involve removal, damage, or destruction of threatened or endangered animal or
plant species.
3. The development must not alter naturally or artificially created surface drainage channels.
4. The development must be consistent with all applicable use standards and local land use plans in effect at
the time the exemption is granted.
5. The proposed development shall remain consistent with the attached work plan drawings.
6. This permit does not authorize the removal of vegetation or sand from the frontal dune.
7. ALL work authorized under this exemption shall not exceed 50% of the replacement cost of the
structure(s). No new development is authorized including but not limited to expansions and/or
additions.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State,
Federal or Local authorization. This exemption expires 120 days from the date of the letter.

Please find attached.the sketch of the decking for my property located at 1043 Ocean Blvd, Topsail Beach, NC 28445. It is
essentially identical to that of my.next-door neighbor, Andy Law, who I am working with on this project (our homes were.
built in 2002 by the same builder using the same plans). My wife Debra and I are the owners of the property at 1043.
Our home address is 1401 Paper Birch Court, Raleigh, NC 27606 and my phone # is 443-831- 0983. Thank you for your
consideration and follow up.
We are fortunate that our home is situated a very comfortable distance from the vegetation and our excellent dune
structure. Please advise me of your determination and the next steps. The plan is to start work early in January.
