ADDITIONAL CONDITIONS -8) Shoreline Stabilization Permit #90-13 Page 2 of 3 Unless specifically altered herein, this permit authorizes the installation of the geotextile and aggregate socks and the grading and other land disturbing activities associated with the construction of the shoreline stabilization project, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910) 796-7215 for this determination. The alignment of the authorized geotextile and aggregate socks shall adhere to the alignment depicted on the attached workplan drawings. The geotextile and aggregate socks shall not extend more farther waterward of the normal high water line than depicted on the attached workplan drawings. The geotextile and aggregate socks shall be free from loose dirt or any pollutant. They shall be of a size and design sufficient to prevent their movement from the approved alignment by wave or current action. Sedimentation and Erosion Control In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. General The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. The outlet ditch for the freshwater lagoon system on Bald Head Island has some erosion on some of the steep banks between lots 103 N. Bald Head Drive and 113 Lighthouse Landing. We are proposing to stabilize some of the slopes with vegetation and some of the steeper slopes with staked geotextile media and aggregate socks. c. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and where it is to be stored. The site has very limited access so no heavy equipment would be used. Other than the possible use of small skid -steer type equipment, most of the work would be done by hand. d. List all development activities you propose. The only proposed activities are the stabilization of the outlet ditch. e. Skvarla, III Secretary The Wilmington Regional Office of the Division of Water Quality received a copy of the CAMA Major Permit Application for the subject project on June 6, 2013. Staff review of the plans and specifications has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 21-1.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the oonstrucfion of the project must be removed within 30 days of completion of the project, or when it is no longer needed, whichever occurs first. PROJECT DESCRIPTION The project is located off of North Bald Head Wynd, adjacent to Bald Head Creek, on Bald Head Island, in Brunswick County. To find the project site from the Bald Head Island ferry terminal, travel south on Marina Wynd to North Bald Head Wynd. Continue approximately 0.25 miles on North Bald Head Wynd. The project site will be located on the left. The subject property consists of a outfall ditch running along the property line of two lots, 103 N. Bald Head Wynd to the south and 113 Lighthouse Landing to the north. The ditch is connected to the island's freshwater lagoon system by means of a culvert under North Bald Head Wynd with a water control structure located on the south side of North Bald Head Wynd. Water is typically discharged from the lagoon through the ditch only during times of high rainfall. The banks of the ditch vary from approximately 3'- 6' in height and are sparsely vegetated due to the steep slope of the banks. Several areas are notably eroding. There is a single-family residence located at 103 N. Bald Head Wynd, owned by Shirley and David Everhart. A short retaining wall has been installed along a short section of the bank at the end of the driveway. The lot at 113 Lighthouse Landing is undeveloped and owned by Bald Head Island, Ltd. Both lots are primarily vegetated with Yaupon (Ilex vomitoria), Wax Myrtle (Myrica cerifera), Live Oak (Quercus virginiana) and Catbrier (Smilax spp). Vegetation along the ditch is comprised primarily of Yaupon and Catbrier. Coastal wetland vegetation is absent from the banks of the ditch and the project area, but Salt Marsh Cordgrass (Spartina alterniflora) is present at the mouth of the ditch adjacent to Bald Head Creek. Due to the changes in elevation along the ditch, it appears normal high water may only extend mid -way up the ditch, but surveyed elevations show mean high water extending up to the culvert at road. The waters of the Bald Head Creek are classified as SA by the North Carolina Division of Water Quality. The waters are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to install geotextile socks filled with aggregate and media as shoreline stabilization to allow re -vegetation of the steep ditch banks that are currently eroding. The socks would measure 12" and 18" in approximate diameter and would be stacked to a varying height between 3.5 and 6 feet. The aggregate/ media socks should allow for permanent re -vegetation of the affected areas. As proposed, the socks would be installed along 100 linear feet of bank along the east side of the ditch and along 175 linear feet of bank to the west. The larger 18" socks would be installed at or slightly below the mean high water line and would be filled with an aggregate mix and secured with wooden stakes. The 12" socks would be located above mean high water filled with a media mix and secured with live stakes as needed. The applicant has stated the socks can be staked at a maximum slope of 0.5:1. Geotextile fabric would be installed under the socks for additional stabilization. As proposed, a distance of 60 linear feet would also be re -graded to a 3:1 slope and then seeded in order to reduce scouring of the bank during times of water discharge. This historical outlet is the only outlet for the entire lagoon system. With freshwater a commodity on BHI, most rainwater runoff is stored in the lagoon system for golf course irrigation. Because of this, the outlet pipe and ditch only discharge in very large storm events. Recent inspections on the outlet ditch revealed erosion on some of the steep banks. These areas are highlighted on the plan for stabilization. Some simple grading and seeding will return approximately 601f of ditch bank to an appropriate 3:1 slope. The remaining 275 linear feet of ditch bank (1001f on the east side and 1751f on the west side) requires stabilization as shown on the drawing. Filtrexx type tubular socks are proposed in 18" and 12" sizes. The18" socks will be filled with an aggregate mix and placed below and above the High Water Line (HWL) to provide a solid base for the 12" socks filled with growth media. The 18" socks subject to tidal fluctuations will be staked with wooden stakes and the 12" socks can be staked with live stakes if found to be appropriate. The socks can be staked at a maximum slope of 0.5:1 and the stack height varies between 3.5 feet and 6 feet. A geotextile fabric will be used behind the socks to provide additional stability. The use of geotextile with staked media and aggregate socks provide the sturdy base and structure needed for vegetation to permanently take hold and prevent further erosion. The regraded areas of the ditch will be immediately seeded and the outlet ditch control valve will be kept closed while the banks stabilize. This site has very limited access, so the aggregate and media socks provide a solution without the use of heavy equipment. No impervious is proposed from this stabilization. PROJECT DESCRIPTION The project is located off of North Bald Head Wynd, adjacent to Bald Head Creek, on Bald Head Island, in Brunswick County. To find the project site from the Bald Head Island ferry terminal, travel south on Marina Wynd to North Bald Head Wynd. Continue approximately 0.25 miles on North Bald Head Wynd. The project site will be located on the left. The subject property consists of a outfall ditch running along the property line of two lots, 103 N. Bald Head Wynd to the south and 113 Lighthouse Landing to the north. The ditch is connected to the island's freshwater lagoon system by means of a culvert under North Bald Head Wynd with a water control structure located on the south side of North Bald Head Wynd. Water is typically discharged from the lagoon through the ditch only during times of high rainfall. The banks of the ditch vary from approximately 3% 6' in height and are sparsely vegetated due to the steep slope of the banks. Several areas are notably eroding. There is a single-family residence located at 103 N. Bald Head Wynd, owned by Shirley and David Everhart. A short retaining wall has been installed along a short section of the bank at the end of the driveway. The lot at 113 Lighthouse Landing is undeveloped and owned by Bald Head Island, Ltd. Both lots are primarily vegetated with Yaupon (Ilex vomitoria), Wax Myrtle (Myrica cerifera), Live Oak (Quercus virginiana) and Catbrier (Smilax spp). Vegetation along the ditch is comprised primarily of Yaupon and Catbrier. Coastal wetland vegetation is absent from the banks of the ditch and the project area, but Salt Marsh Cordgrass (Spartina alternii fora) is present at the mouth of the ditch adjacent to Bald Head Creek. Due to the changes in elevation along the ditch, it appears normal high water may only extend mid -way up the ditch, but surveyed elevations show mean high water extending up to the culvert at road. The waters of the Bald Head Creek are classified as SA by the North Carolina Division of Water Quality. The waters are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to install geotextile socks filled with aggregate and media as shoreline stabilization to allow re -vegetation of the steep ditch banks that are currently eroding. The socks would measure 12" and 18" in approximate diameter and would be stacked to a varying height between 3.5 and 6 feet. The aggregate/ media socks should allow for permanent re -vegetation of the affected areas. As proposed, the socks would be installed along 100 linear feet of bank along the east side of the ditch and along 175 linear feet of bank to the west. The larger 18" socks would be installed at or slightly below the mean high water line and would be filled with an aggregate mix and secured with wooden stakes. The 12" socks would be located above mean high water filled with a media mix and secured with live stakes as needed. The applicant has stated the socks can be staked at a maximum slope of 0.5:1. Geotextile fabric would be installed under the socks for additional stabilization. As proposed, a distance of 60 linear feet would also be re -graded to a 3:1 slope and then seeded in order to reduce scouring of the bank during times of water discharge. ANTICIPATED IMPACTS: The proposed development would fill up to 685 square feet of high ground, and would also fill approximately 415 square feet of public trust area and estuarine waters. The project would also result in the temporary disturbance of approximately 1,000 square feet of high ground along the bank. The work would likely result in a temporary increase in turbidity. Submitted by: Heather Coats Date: June 5, 2013 Office: Wilmington JUN 14 2013 Narrative The interconnected freshwater lagoon system on Bald Head Island (Brunswick County, NC) has a piped 36" outlet that drains via ditch to the BHI Creek. This historical outlet is the only outlet for the entire lagoon system. With freshwater a commodity on BHI, most rainwater runoff is stored in the lagoon system for golf course irrigation. Because of this, the outlet pipe and ditch only discharge in very large storm events. Recent inspections on the outlet ditch revealed erosion on some of the steep banks. These areas are highlighted on the plan for stabilization. Some simple grading and seeding will return approximately 6O1f of ditch bank to an appropriate 3:1 slope. The remaining 275 linear feet of ditch bank (1001f on the east side and 1751f on the west side) requires stabilization as shown on the drawing. Filtrexx type tubular socks are proposed in 18" and 12" sizes. The18" socks will be filled with an aggregate mix and placed below and above the High Water Line (HWL) to provide a solid base for the 12" socks filled with growth media. The 18" socks subject to tidal fluctuations will be staked with wooden stakes and the 12" socks can be staked with live stakes if found to be appropriate. The socks can be staked at a maximum slope of 0.5:1 and the stack height varies between 3.5 feet and 6 feet. A geotextile fabric will be used behind the socks to provide additional stability. The use of geotextile with staked media and aggregate socks provide the sturdy base and structure needed for vegetation to permanently take hold and prevent further erosion. The regraded areas of the ditch will be immediately seeded and the outlet ditch control valve will be kept closed while the banks stabilize. This site has very limited access, so the aggregate and media socks provide a solution without the use of heavy equipment. No impervious is proposed from this stabilization.
