Dear Mr. Coulbourn:
This letter is in regard to your request under the Coastal Area Management Act (CAMA)
to renew CAMA Major Permit No. 116-96 for an additional two years. Permit No. 116-96,
which was transferred to you on August 28, 2000, authorized construction of a bulkhead, dock,
and boatlift adjacent to Croatan Sound, 6035 Highway 64, Manns Harbor, .Dare County.
Processing of the renewal request, which was received by the Division of Coastal Management
on February 16, 2004, is now complete. Based on the State's review, the Division of Coastal
Management has made the following findings:
1) On August 1, 1996, CAMA Major Permit No. 116-96 was issued to Richard J. Spicer,
authorizing the. construction of a bulkhead, dock, and boatlift adjacent to Croatan Sound,
6035 Highway 64, Maims Harbor, Dare County.
2) The permit was renewed and transferred to Gaylor and Deborah Perry on February 21,
2000.
3) The permit was transferred to Edwin T. Coulbourn, Jr. on August28, 2000.
4) The second permit renewal was issued on January 22, 2004.
5) Under the rules of the Coastal Resources Commission (CRC), a CAMA permit may only
be' renewed when substantial development has occurred and is continuing on a permitted
project. According to CRC Rule NCAC T15A:07J.0404(b)(5), "substantial development
shall be deemed to have occurred on a project if the pemuttee can show that development
has progressed beyond basic site preparation, such as land clearing and grading, and
construction has begun and is continuing under normal construction practices on the
primary structure or structures authorized under the permit."

In the applicant's renewal request and subsequent review by DCM staff, no evidence was
presented that indicated that substantial development has been undertaken on the permitted
project since the last renewal. Based upon the findings outlined above, the proposed renewal has
been determined to be inconsistent with 15A NCAC 07S .0404,, which requires that in
circumstances such as this, the Division of Coastal Management may only renew a permit upon
finding that substantial development has begun and is continuing on the permitted project.
Given the preceding findings, it is necessary that your request for the renewal of CAMA
Major Permit No. 152-96 be denied. This denial is made pursuant to N.C.G.S. 113A-120 (a)(8),
which requires denial for projects inconsistent with state guidelines or local land use plans.
- Ifyouwish to appeal this denial, you are entitled to a hearing. -The hearing will -involve
appearing before an Administrative Iaw Judge who listens to evidence'and arguments of both
parties and then makes a recommendation to the Coastal Resources Commission.Your request
for a hearing must be in the form of a written petition, complying with the requirements of
§150B of the General Statutes of North Carolina, and must be filed with the office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714, (919) 733-2698,
within twenty (20) days from the date of this letter. A copy of this petition should be filed with
this office.
Also, you should be advised that as long as this state permit renewal denial stands, your
project must be deemed inconsistent with the N.C. Coastal Management Program, thereby
precluding the issuance of federal permits for this project. The Federal Coastal Zone
Management Act (CZMA) gives you the right to appeal this finding to the .U.S. Secretary of
Commerce within thirty (30) days of receipt of this letter. Your appeal must be on the grounds
that the proposed activity is (1) consistent with the objectives or purposes of the CZMA, or (2) is
necessary in the interest of national security, and thus, may be federally approved.

Dear Mr. Coulboum:
I have received your request to extend CAMA Major Permit that was issued to your
father for the construction of a bulkhead, pier, and boatlift on a o cated at the south end of
Ferry Dock Road (SR 1110), Manns Harbor, in Dare County, and adjacent to the Croatan Sound.
I have also received your check number 1035 for $100 with a notation "Permit #116-96
Extension." Your request to extend the CAMA Permit has been forwarded to the Division's
Coordinator for disposition.
In your letter, you indicated that you bought the property from your father on October 30, 2003.
It is recommended that you submit a request to our office to have the permit transferred to your
name. A copy of the deed, or sales agreement, and a check for $100 payable to the Department
of Environment and Natural Resources (DENR) should be submitted along with a transfer
request indicating that you will use the permit for which it was issued; that there are no
substantial changes in the conditions, circumstances, or facts affecting the project; and that there
is not substantial change or modification of the project as proposed in the original application.

SUBJECT: CAMA Major Permit #116-96, Edwin T. Coulbourn, Jr.,
Renewal Request
CAMA. Major Permit #116-96 was transferred to the applicant on August 28, 2000, with a
December 31, 2001, expiration date. On January 22, 2002, Permit 9116-96 was renewed with an
expiration date of December 31, 2003. The permit authorized the construction of a bulkhead,
pier, and boatlift on a lot located at the south end of Ferry Dock (SR 1110), Manns Harbor, in
Dare County, and adjacent to the Croatan Sound.
To date, the applicant has constructed the bulkhead; however, neither the pier nor the boatlift
have been constructed. The applicant has submitted a renewal request as well as check number
1035 for $100 for the renewal fee.
It is recommended that the permit be renewed with no change in the conditions.

Dear Mr. Jennings,
This letter is to request that a two year extension be granted to complete the work on the
above referenced permit. What has to be finished is the construction of the
pier/platform/boatlift portion of the original permit.
The property has just recently changed ownership. I bought the property from my dad on
October 30, 2004. I will begin and finish construction on the pier/platform/boatlift
portion of the permit before the end of two years (before Jan 1, 2006). The weather has
held me up as it has been a wet winter. I recently changed careers and it takes time to
establish legitimacy with financial lenders, but I do have house plans, survey and
improvement permit in place as soon as I am able to secure a mortgage.
Enclosed is a check written in the amount of $100.00 for the purposes of an extension on
permit number 116-96. Thank you for you assistance and understanding in this process.
