This permit, issued on a�7., /C V is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Pier/Platform/Boatlift
1) The pier and associated structures shall have a minimum setback distance of 15 feet between any
parts of the structure and the adjacent property owner's riparian access corridor, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the
-channel line that intersects with the shore at the point where the upland property line meets the
water's edge.
2) The alignment of the proposed pier must be approved by a representative of the Division of
Coastal Management prior to the start of construction.
(See attached sheet for Additional Conditions)
This permiCaction may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessfole on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the rmit expires on
01 December 31, 20
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
=?: 3): No attempt will be made by the permittee to prevent the free and full use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
'interfere with the public's right to free navigation on all navigable waters of the United States.
NOTE:' Permanent reflectors should be attached to the structure in order to make it more visible
during hours of darkness or inclement weather.
NOTE:
Bulkhead
An adjacent property owner has given notice of a disputed property boundary claim
relative to your property. The Division of Coastal Management does not adjudicate
property disputes. Therefore, the permittee is advised that if it is determined in the future
that a portion of the permitted bulkhead encroaches on the adjacen property, the permittee
may be required to remove, at his. own expense, the offending portion of the bulkhead.
4) The bulkhead shall not extend waterward more that 29 feet from the normal water level at any
point -along its alignment at the time of construction.
5) The authorized alignment of the proposed bulkhead must be staked by a representative of the
Division of Coastal Management within a maximum of 30 days prior to the. start of construction.
Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather
conditions, will require the alignment to be restaked by DCM within a maximum of 30 days prior
to the new expected start of construction.
6) The bulkhead must be constructed prior to any backfrlling activities.
7) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.
8) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by department personnel. No excavation is permitted except
for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables,
etc. This permit does not authorize any excavation water -ward of the approved alignment.
9) All back fill material will be obtained from a highground source and confined behind the
permitted bulkhead.
10) The fill material will be clean and free of any pollutants except in trace quantities. Metal
products, organic materials, or unsightly debris will not be used.

The enclosed pemtitconstitutes authorimtionunderthe CoasW AreaManagementAct, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
Ifyou objectto the permit or any ofthe conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days ofthis
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at
any time for assistance. By wo7king-in accordance with the permit, you will be helping to protect oirr vitally
important coastal resources.

On August 1, 1996, CAMA Major Permit #116-96 was issued to Richard J.
Spicer for construction of a bulkhead, pier and boatlift on a lot located at the
south end of Ferry Dock Road, Manns Harbor in Dare County. The permit has
an expiration date of December 31, 1999 and Mr. Gaylord Perry is listed as the
authorized agent by the permit application.
In accordance with NCAC T15A: 07J .0406, Mr. and Mrs. Gaylord Perry
have submitted a request to have permit #116-96 transferred to their names. Mr.
and Mrs. Perry have also requested, in accordance with 07J .0404 to have permit
#116-96 extended. The applicants have indicated that there are no substantial
changes or modifications to the development project as permitted or changes in
conditions, circumstances or facts affecting the project. The applicants have
submitted $100.00 for the permit transfer fee and the permit extension fee. It is
recommended that both the transfer request and extension request be approved.

I have reviewed your letter requesting that Major CAMA Permit #116-96 for construction of a
bulkhead, pier and boatlifi on a lot located at the south end of Ferry Dock Road, Matins Harbor in Dare
County be extended Our records indicate that Richard J. Spicer, P. O. Box 2020, Manteo, NC 27954 is
the permittee.
In order for you to be able to extend this permit, you must fast have it transferred to your name.
A permit may be transferred to you at the discretion of the Director of the Division of Coastal Management
upon finding each of the following:
1) A written request from you,
2) A deed, a sale, lease, or option to you showing that you have sole legal right to develop the project:
3) That you will use the permit for the purposes for which it was issued;
41) No substantial change in conditions, circumstances, or facts affecting the project; and
5) No substantial change or modification of the project as proposed in the original application.
6) You must submit with the request a check or money order payable to the Department of
Environment and Natural Resources (DENR) in the sum of fifty dollars ($50.00).
Once I have received your request, it will be submitted to the Director for her decision. Your
permit renewal request will also be submitted to the Director after I have received your permit transfer
