Rd., Manns Harbor , as requested in the permittee's application dated 5/28/96, including
6/13/96.
This permit, issued on August 28, 2000 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Pier/Platform/Boatlift
1) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.
2) The alignment of the proposed pier must be approved by a representative of the Division of Coastal
Management prior to the start of construction.
3) No attempt will be made by the permittee to prevent the free and full use by the public of all navigable
waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the
public's right to free navigation on all navigable waters of the United States.

This permit action may be appealed by the permittee or Signed by the authority of the Secretary of DENR and the
other qualified persons within twenty (20) days of the issuing Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
NOTE: Permanent reflectors should be attached to the structure in order to make it more visible during
hours of darkness or inclement weather.
Bulkhead
NOTE: An adjacent property owner has given notice of a disputed property boundary claim relative to
your property. The Division of Coastal Management does not adjudicate property disputes.
Therefore, the permittee is advised that if it is determined in the future that a portion of the
permitted bulkhead encroaches on the adjacent property, the permittee may be required to
remove, at his own expense, the offending portion of the bulkhead.
The bulkhead shall not extend waterward more that 29 feet from the normal water level at any point
along its alignment at the time of construction.
5) The authorized alignment of the proposed bulkhead must be staked by a representative of the Division of
Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions will require the
alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of
construction.
6) The bulkhead must be constructed prior to any backfilling activities.
7) The bulkhead must be structurally tight so as to prevent seepage of backftll materials through the
structure.
8) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other
suitable materials approved by department personnel. No excavation is permitted except for that which
may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does
not authorize any excavation waterward of the approved alignment.
All back fill material will be obtained from a high ground source and confined behind the permitted
bulkhead.
10) The fill material will be clean and free of any pollutants except in trace quantities. Metal products,
organic materials, or unsightly debris will not be used.
11) No excavated or fill material shall be placed at any time, in any surrounding waters, outside of the
alignment of the fill area indicated on the workplans.
12) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized.

13) All disturbed areas will be properly graded and provided a ground cover sufficient to restrain erosion
within 30 working days of project completion.
General
NOTE: The N.C. Division of Water Quality has authorized the proposed project under General Water
Quality Certification No. 3025 (DWQ Project No. 960653), which was issued on 7/22/96.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project COE Action Id. No.
199604687.
This permit does not eliminate the need to obtain- any additional permits, approvals or
authorizations that may be required.
Future development of the permittee's property may require a modification of this permit.

such activity for this determination.

On August 1, 1996, CAMA Major Permit #116-96 was issued to Richard J. Spicer
for construction of a bulkhead, pier and boatlift on a lot located at the south end of Ferry
Dock Road, Manns Harbor in Dare County. On February 21, 2000 it was transferred to
Gaylord and Deborah Perry and renewed with an expiration date of December 31, 2001.
In accordance with NCAC T15A: 07J.0406, Mr. Edwin T. Coulbourn, P. O. Box
2450, Manteo, NC 27954 has submitted a request to have permit #116-96 transferred to his
name. The applicant has indicated that there are no substantial changes or modifications to
the development project as permitted or changes in conditions, circumstances or facts
affecting the project. The applicant has submitted $50.00 for the permit transfer fee and a
copy of his deed for the property. It is recommended that the transfer request be approved
with all existing conditions to remain in effect.

The enclosed permit constitutes authorization underthe Coastal Area ManagementAct, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
Ifyou object to the permit or any ofthe conditions, you may request ahearing pursuantto NCGS 113A-121.1
or 113-229. Your petition for a hearing mustbe filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days ofthis
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance ofthis permit within twenty (20) days, the matter mustbe resolved priorto work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The projectplan is subject to those conditions appearing on the permit form. Otherwise, all work mustbe
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request
that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concemingpermit conditions, environmental safeguards, orproblem areas, you may contact Department personnel at
any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.
