1) This minor modification authorizes the redesign of the eight previously authorized holding ponds
and the placement of two floating holding platforms adjacent to the previously authorized pier within
the man-made canal system. Both actions must take place in accordance with the attached workplan
drawings.
2) The floating holding platforms may only be utilized for the temporary and short term containment
of flounder.
3) The floating holding platforms may only be placed in the water from September ffim January of any
year, and shall be removed to an upland location for the rest of the year.

other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on

that your project is consistent with the North Carolina
Coastal Management Program.

Redesigned 30 foot ponds
New ponds will be octagon in shape with concrete floors and
block walls 48 inchs in height all intake and drainage remain
the same.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Attached is a request from Coastal USA Fish Co. to modify their permit which authorized the
construction of fish ponds on property located in Cedar Island, Carteret County. The pemrittee
now wishes to concrete the bottoms and block the sides of the S smaller ponds. He also wishes
to place 2 floating holding platforms (barges) in the canal adjacent to his dock. The floating
platforms will be used to temporary store the flounders before they are transferred to the holding
ponds. The platforms will be removed at the end of January and keep on shore until the flounder
season begins in September.
I have no objections to the issuance of a modified permit for this project. If you have any

RE: Modification of CAMA Permit 135-96
Dear Mr. Jones:
I wish to request the modification of CAMA Permit No.135-96 in order to make improvements at my
facility in Cedar Island, Carteret County. I would like to request the following:
1. 1 would like to modify the 8 small holding ponds by redesigning their shape and surface material.
In order to do this, the existing walls around the ponds would be lowered with the excess sand
being redistribute around the 60' ponds. The redesigned ponds would be constructed with a
poured concrete floor with block walls, six courses high, for a height of 48". The redesigned
ponds would provide better stability to side walls instead of shifting sand.
2. I would also like to place two floating barges adjacent to my pier which is located within the man-
made canal system. One barge would be 15' wide x 41' long x 2' deep while the other is 12' wide x
26' long x 2' deep. These barges would allow me to unload the boats faster and put the flounder in
oxygenated waters sooner. The barges would also allow me to sort flounder by size and condition
before transferring to the holding ponds. It would also allow for the fish to calm down for at least
24 hours after being taken from pond nets, thus causing less damage to the flounders. Both of the
barges would be kept in water from September thm January. They would be pulled out of the
water for the rest of the year.

Dear Sir:
Through coordination with the North Carolina Division of Coastal
Management, we have learned of your request to modify CAMA Permit No. 135-96.
Your proposed modification involves a proposal to concrete the bottoms and
block the sides of the 8 smaller ponds and place 2 floating holding platforms
(barges) in the canal adjacent to the 31-foot-long by 11-foot wide dock. The
Department of the Army permit issued on November 5, 1996, authorized the
dredging of 12 square feet of vegetated marsh and 30 feet of non vegetated
wetlands, and the placement of fill material in 60 square feet of non
vegetated wetlands for the purpose of constructing 12 holding ponds for a
commercial fish storage facility on an existing canal off of the Cedar Island
Harbor of Refuge, in Cedar Island, Carteret County, North Carolina.
Your proposal continues to be consistent with the provisions and
objectives of general permit No. 198000291. The permit is hereby modified to
include the work as shown on the enclosed plan. It is understood that all
conditions of the original permit remain applicable and that the expiration
date is unchanged.
