This permit, issued on October 22 2013 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
4) Unless specifically altered herein, this permit authorizes only the reconfiguration and expansion of the
existing docking facility, as well as the associated uses located in or over the water that are expressly
and specifically set forth in the permit application. No other structure, whether floating or stationary,
may become a permanent part of this docking facility without permit modification. No non -water
dependent uses of structures maybe conducted on, in or over public trust waters without permit
modification.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or
':other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
%continuance as the case may be.
-This permit must be accessible on -site to Department
'personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires farther Division approval.
All work must cease when the permit expires on
December 31, 2016
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL. CONDITIONS
Should adjacent property to the west be sold prior to the initiation of construction, the permittee shall be
` required to obtain a signed riparian corridor waiver from the new property owner prior to the placement
of any structure within the 15 foot riparian corridor.
3), The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct
r . view and must be permeable to air and water. Screen or wire on the sides along with benches and knee
i walls are permitted. Lattice is specifically excluded from being used under this authorization.
The roof of the covered gazebo shall not be designed for second story use.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
7)-,• This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
.8) ' This permit authorizes a maximum of three additional boat slips, resulting in a total of four formalized
boat slips at the authorized facility.
Excavation
9) In order to protect juvenile shrimp and finfish populations, no excavation shall be permitted between
April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management..
Excavation shall not exceed —5.0 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
No Coastal Wetlands shall be excavated or filled, even temporarily.
; j2 The temporary placement or double handling of excavated materials within waters or vegetated wetlands
is not authorized.
Spoil Disposal
13), ' All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.

f '16), . The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
i unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
1 . caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
= made against the United States or the state of North Carolina on account of any such removal or
° alteration.
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

approvals or authorizations that may be required.

dependent activities are not authorized within 30 feet of the normal high water,level.

This project is -consistent with the 2010 Sunset BeachLand Use Plan Update.
The applicant proposes to expand an existing docking facility and excavate a new boat
basin connecting to a man-made canal. The project is located at 1525 N. Shore Drive in
Sunset Beach, Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are PT and EW.
Waters at the project site are classified as SA and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2010 Sunset Beach Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Residential, BR2.
In general, Sunset Beach allows development in Residential, BR2 classified AECs, which
is consistent with the State's minimum use standards. The Sunset Beach Land Use Plan
contains some policies, which exceed the State's minimum use standards; however none
of these policies appear to be applicable to this project.
This project is consistent with the 2010 Sunset Beach Land Use Plan.

If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, [phone] within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit

9. PROJECT DESCRIPTION:
The project site is located at 1525 North Shore Drive, adjacent to a man-made canal, in the Town of Sunset
Beach, Brunswick County. To locate the property site take Highway 17 south from Wilmington towards
Sunset Beach. Turn left at Grissettown on N.C. Highway 904 and travel approximately 3.6 miles to the
intersection with N.C. Highway 179 (Sunset Blvd). Travel west approximately 2.0 miles and turn right to
cross the bridge to Sunset Beach. Travel approximately 1.25 wiles and turn left onto Main Street East and
travel approximately 0.50 miles to 12`h Street. Turn left onto 12`h Street, at the stop sign turn right onto
Canal Drive and make an immediate left onto Cobia Street. Follow Cobia Street approximately 0.15 miles
and turn right onto North Shore Drive. The subject property will be located approximately 0.35 miles to
the east on the left side of the road.
The lot is approximately 0.25 acres with approximately 135 feet of shoreline frontage. The lot averages
2.95 feet above mean sea level and the shoreline has been stabilized with a vinyl bulkhead. The applicant
maintains a single-family residence with a swimming. pool and pier. The highground vegetation consists
primarily of lawn grass and ornamental landscaping. The bulkhead curves from east to west along the
shoreline and an area of coastal wetlands exists waterward of the existing bulkhead on the east side of the
property. The area of coastal wetlands is vegetated with primarily with Smooth Cord Grass (Spartina
alterniflora).
On June 26, 2013 CAMA General Permit #59285D was issued authorizing the construction of an
approximately 35 feet long by 6 feet wide pier with a floating dock connected via ramp to the east side of
the pier. The existing floating dock measures approximately 8 feet wide by 16 feet long. The existing pier
is located approximately 14 feet from the edge of the existing dredged channel. The dredge channel in
this location is approximately 40 feet wide and is maintained to a final depth of -5 feet at MLW. No
dredging has been previously authorized in association with the existing docking facility. The adjacent
riparian property to the west is a vacant lot and to the east is a developed single-family residence with a
private docking facility. There are no known archaeological resources within the project vicinity.
The Town of Sunset Beach Land Use Plan classifies the adjacent high ground portion of the project area as
Residential. The waters of the man-made feeder canal are classified SA by the Division of Water Quality.
They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are
CLOSED to the harvest of shellfish. The width of the man-made canal in this location is approximately 120
feet wide at this location. # BECEWM
10. PROPOSED PROJECT: AUG 0 1 2013
The applicant proposes to expand an existing docking facility and excavate a new boatCITY
connecting to a man-made canal. The dimensions of the proposed boat basin would be approximately
109 feet in length by 40 feet in width and a final project depth of -5 feet at normal low water (NLW) is
requested. As proposed, the applicant would maintain a 10 foot buffer from the existing bulkhead and
marsh grass. Excavation of the basin would be accomplished by barge mounted mechanical
excavator. Excavated material would be placed on the barge for dewatering and then shipped to an
approved offsite location. The proposed spoil disposal area is located on the high ground property
located on the north side of the canal. The work plan drawing states that the disposal area would be

maintained 30 + feet from the mean high water line. A letter of from the property owner of record
has been provided authorizing the spoil disposal location. The applicant is proposing to expand the
existing docking facility by installing a boatlift, floating jet ski dock, a floating dock, and gazebo. As
proposed the gazebo would be constructed on the terminal end and as an extension of the existing
fixed pier and would measure 14 feet long by 14 feet wide as measured from the drip line. The
proposed boat lift would be located on the west side of the proposed gazebo and would measure
approximately 12 feet wide by 12 feet long. The proposed floating platforms would replace the
existing floating dock and would be accessed via ramp originating from the east side of the fixed pier.
The ramp would be connected to a proposed floating dock measuring 12 feet wide by 22 feet long that
would be oriented perpendicular to the shoreline. The proposed floating jet -dock would be anchored
on the west side of the proposed floating dock and would measure approximately 10 feet wide by 14
feet long. The proposed jet -dock would be located between the proposed floating dock and gazebo.
As proposed the docking facility would provide docking space for four (4) vessels.
11. ANTICIPATED IMPACTS:
The proposed boat basin excavation would result in the disturbance of approximately 4,360 square
feet of shallow bottom. Approximately 280 cubic yards of spoils material would be excavated from
below MHW. The final project depth would be -5 feet at MLW and would connect to the existing
depths of the dredge channel. The spoil disposal area would result in approximately 3600 square feet
of high ground fill at an approved offsite location. Short term increases in turbidity can be expected
during dredging activity. The excavation of the basin by mechanical means will create steep side slopes
and subsequent sloughing, thereby increasing the top width dimensions of the proposed project. As
proposed the applicant would maintain a 10 foot buffer from the existing bulkhead and marsh grass to
prevent disturbance to the areas resulting from sloughing. The proposed docking facility would
incorporate approximately 744 square feet, of which 600 square feet is shading impact. The
proposed boatlift would encroach into the 15-foot adjacent riparian property owner setback. The
structures would exceed the X width limitation however; the Town of Sunset Beach has an established
pier head alignment which conforms to the third width rule. The proposed docking facility would be
located approximately 5 feet from the edge of the dredge channel footprint and would comply with
the Town of Sunset Beach pier head alignment. As proposed the docking facility would provide
mooring for four (4) vessels.

Areas of Environmental Concern (AEC's) impacted by the proposal are PT and EW.

I have reviewed this proposal for consistency with the 2010 Sunset Beach Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Residential. BR2.
In general, Sunset Beach allows development in Residential, BR2 classified AECs, which
is consistent with the State's minimum use standards. The Sunset Beach Land Use Plan
contains some policies, which exceed the State's minimum use standards; however none
of these policies appear to be applicable to this project.
This project is consistent with the 2010 Sunset Beach Land Use Plan.

It is staffs recommendation that the boat basin excavation is CONSISTENT with the Rules of 15A NCAC 7H
.0208 (b) Specific Use Standards (1) which states Navigation channels, canals and boat basins shall be aligned
or located so as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as
defined by the MFC, or areas of coastal wetlands except as otherwise allowed in this Subchapter.
It is staffs recommendation that the expansion of the existing docking facility is CONSISTENT with the Rules
of 15 NCAC 7H.0208 (b)(6) Specific Use Standards for Piers and Docking Facilities.
I have no objections to the proposed project. Any permit issued should include the following conditions:
1. This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structures,
whether floating or stationary, may become a permanent part of the structure without permit
modification. No non -water dependent uses of structures may be conducted on; in, or over public
trust waters without permit modification.
2. No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
3. The authorized structure and associated activity must not cause an unacceptable interference with
navigation and shall not exceed the established pier head line.
4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the
U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
5. In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
6. This permit does not authorize the interference with any existing or proposed Federal project, and,
the permittee will not be entitled to compensation for damage to the authorized structure or work, or
injury, which may be caused from existing or future operations undertaken by the United States in the
public interest.

Recommendations for State Permit-DeBell 07/26/13
The permittee will maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
project without having the permit transferred to a third -party.
8. This permit authorizes a maximum of four (4) boat slips. At no time shall more than four (4) vessels be
moored or docked at the facility. The restriction of the number of vessels shall apply to all marine
vessel types, including but not limited to motorboats, sailing vessels and personal watercraft.
9. All excavated materials will be confined above mean high water and landward of regularly or irregularly
flooded marsh behind adequate dikes or other retaining structures to prevent spill -over of solids into any
marsh or surrounding waters.
10. The spoil material will be properly graded and provided a ground cover sufficient to restrain erosion
within thirty (30) working days of project completion.
11. Excavation will not exceed -5.0 feet below the mean high water level. In no case shall the depth of
excavation exceed the depth of connecting waters of the existing dredge channel.
12. The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.

The North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has
reviewed the subject permit application for proposed actions that impact fisheries and fisheries
habitats. The CAMA Major permit application from John and Pamela DeBell proposes to
expand an existing docking facility and excavate a new boat basin near Tubbs Inlet in Sunset
Beach, NC. Water depths in the proposed slips at this location are zero at MLW.
Shallow areas adjacent to coastal wetlands, such as this site, serve as fish habitat for a variety
of fish species. In order to minimize the impact to shallow habitat, it is recommended that the
dredge footprint be reduced to include only the areas necessary to serve the proposed docking
facility, instead of the entire allowable dredge area.

9. PROJECT DESCRIPTION:
The project site is located at 1525 North Shore Drive, adjacent to a man-made canal, in the Town of Sunset
Beach, Brunswick County. To locate the property site take Highway 17 south from Wilmington towards
Sunset Beach. Turn left at Grissettown on N.C. Highway 904 and travel approximately 3.6 miles to the
intersection with N.C. Highway 179 (Sunset Blvd). Travel west approximately 2.0 miles and turn right to
cross the bridge to Sunset Beach. Travel approximately 1.25 wiles and turn left onto Main Street East and
travel approximately 0.50 miles to 12`h Street. Turn left onto 12th Street, at the stop sign turn right onto
Canal Drive and make an immediate left onto Cobia Street. Follow Cobia Street approximately 0.15 miles
and turn right onto North Shore Drive. The subject property will be located approximately 0.35 miles to
the east on the left side of the road.
The lot is approximately 0.25 acres with approximately 135 feet of shoreline frontage. The lot averages
2.95 feet above mean sea level and the shoreline has been stabilized with a vinyl bulkhead. The applicant
maintains a single-family residence with a swimming. pool and pier. The highground vegetation consists
primarily of lawn grass and ornamental landscaping. The bulkhead curves from east to west along the
shoreline and an area of coastal wetlands exists waterward of the existing bulkhead on the east side of the
property. The area of coastal wetlands is vegetated with primarily with Smooth Cord Grass (Spartina
alterniflora).
On June 26, 2013 CAMA General Permit #59285D was issued authorizing the construction of an
approximately 35 feet long by 6 feet wide pier with a floating dock connected via ramp to the east side of
the pier. The existing floating dock measures approximately 8 feet wide by 16 feet long. The existing pier
is located approximately 14 feet from the edge of the existing dredged channel. The dredge channel in
this location is approximately 40 feet wide and is maintained to a final depth of -5 feet at MLW. No
dredging has been previously authorized in association with the existing docking facility. The adjacent
riparian property to the west is a vacant lot and to the east is a developed single-family residence with a
private docking facility. There are no known archaeological resources within the project vicinity.
The Town of Sunset Beach Land Use Plan classifies the adjacent high ground portion of the project area as
Residential. The waters of the man-made feeder canal are classified SA by the Division of Water Quality.
They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are
CLOSED to the harvest of shellfish. The width of the man-made canal in this location is approximately 120
feet wide at this location.
10. PROPOSED PROJECT:
The applicant proposes to expand an existing docking facility and excavate a new boat basin
connecting to a man-made canal. The dimensions of the proposed boat basin would be approximately
109 feet in length by 40 feet in width and a final project depth of -5 feet at normal low water (NLW) is
requested. As proposed, the applicant would maintain a 10 foot buffer from the existing bulkhead and
marsh grass. Excavation of the basin would be accomplished by barge mounted mechanical
excavator. Excavated material would be placed on the barge for dewatering and then shipped to an
approved offsite location. The proposed spoil disposal area is located on the high ground property
located on the north side of the canal. The work plan drawing states that the disposal area would be

maintained 30 + feet from the mean high water line. A letter of from the property owner of record
has been provided authorizing the spoil disposal location. The applicant is proposing to expand the
existing docking facility by installing a boatlift, floating jet ski dock, a floating dock, and gazebo. As
proposed the gazebo would be constructed on the terminal end and as an extension of the existing
fixed pier and would measure 14 feet long by 14 feet wide as measured from the drip line. The
proposed boat lift would be located on the west side of the proposed gazebo and would measure
approximately 12 feet wide by 12 feet long. The proposed floating platforms would replace the
existing floating dock and would be accessed via ramp originating from the east side of the fixed pier.
The ramp would be connected to a proposed floating dock measuring 12 feet wide by 22 feet long that
would be oriented perpendicular to the shoreline. The proposed floating jet -dock would be anchored
on the west side of the proposed floating dock and would measure approximately 10 feet wide by 14
feet long. The proposed jet -dock would be located between the proposed floating dock and gazebo.
As proposed the docking facility would provide docking space for four (4) vessels.
11. ANTICIPATED IMPACTS:
The proposed boat basin excavation would result in the disturbance of approximately 4,360 square
feet of shallow bottom. Approximately 280 cubic yards of spoils material would be excavated from
below MHW. The final project depth would be -5 feet at MLW and would connect to the existing
depths of the dredge channel. The spoil disposal area would result in approximately 3600 square feet
of high ground fill at an approved offsite location. Short term increases in turbidity can be expected
during dredging activity. The excavation of the basin by mechanical means will create steep side slopes
and subsequent sloughing, thereby increasing the top width dimensions of the proposed project. As
proposed the applicant would maintain a 10 foot buffer from the existing bulkhead and marsh grass to
prevent disturbance to the areas resulting from sloughing. The proposed docking facility would
incorporate approximately 744 square feet, of which 600 square feet is shading impact. The
proposed boatlift would encroach into the 15-foot adjacent riparian property owner setback. The
structures would exceed the % width limitation however; the Town of Sunset Beach has an established
pier head alignment which conforms to the third width rule. The proposed docking facility would be
located approximately 5 feet from the edge of the dredge channel footprint and would comply with
the Town of Sunset Beach pier head alignment. As proposed the docking facility would provide
mooring for four (4) vessels.

Proposed Development.•
The project consists of dredging around an existing dock located on North Shore Drive in Sunset
Beach. The proposed dredge area is approximately 280.4 cubic feet of sand and mud material. All
dredging activities will be limited within the subject riparian area. A ten foot (I O� buffet will remain
undisturbed around all existing vegetation, dock pilings and bulkheads. Materials removed from the
site will be shipped by barge to an approved disposal area located just north of the site on the lands
of Big Pine Holdings, LLC (see Letter of Permission). No dredge spoil material shall be disposed of
within 30 feet of the mean high water line of any coastal waters. Proposal for dock improvements
are shown on plan and consist of a 12' X 12' boat lift, a 12' X 12" T-Head with 2' overhangs, (2) 5'
X 12" jetski ramps and a new 12' X 22' floating dock. All dockage shall be installed outside the
existing pier head alignment established by the Town of Sunset Beach.
ExistingEnvironment.
The subject is located at 1525 North Shore Drive on the barrier island of the Town of Sunset Beach
in southern Brunswick County along a feeder canal of Jinks Creek on the Atlantic Intracoastal
Waterway (AIWVI). The project is located approximately Latitude: N 33°52'29.5" and Longitude:
W 78°29'35.9". Coastal wetlands ate present on site and are to be protected as stated above.

The North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has
reviewed the subject permit application for proposed actions that impact fisheries and fisheries
habitats. The CAMA Major permit application from John and,Pamela DeBell proposes to
expand an existing docking facility and excavate a new boat basin near Tubbs Inlet in Sunset
Beach, NC. Water depths in the proposed slips at this location are zero at MLW.
Shallow areas adjacent to coastal wetlands, such as this site, serve as fish habitat for a variety
of fish species. In order to minimize the impact to shallow habitat, it is recommended that the
dredge footprint be reduced to include only the areas necessary to serve the proposed docking
facility, instead of the entire allowable dredge area.

Division of Water Resources (DWR) on July 31, 2013. After reviewing your application, we have
decided that the impacts are covered by General Water Quality Certification Numbers 3883 (GC
3883) and 3885 (GC3885).
These Certifications can also be found on line at:

use the Regional General Permits #197800056 (GP 56) and #197800080 (GP 80) when issued by
the U.S. Army Corps of Engineers and the CAMA permit when issued by the Division of Coastal

state or local permits before you go ahead with your project including (but not limited to) Erosion
and Sediment Control, Non -discharge, and stormwater regulations. Also, this approval to
proceed with your proposed impacts or to conduct impacts to waters as depicted in your
application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change

The Additional Conditions of the Certification are:
1. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the CAMA Major application. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur.
2. Standard Erosion and Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices:

operated, and maintained in accordance with the most recent version of the North
Carolina Sediment and Erosion Control Planning and Design Manual.

3. Construction Stormwater Permit NCGO10000
Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division
of Energy, Mining, and Land Resources (DEMLR) or a DEMLR delegated local erosion
and sedimentation control program, an NPDES General stormwater permit (NCGO10000)
administered by DEMLR is automatically issued to the project. This General Permit
allows stormwater to be discharged during land disturbing construction activities as
stipulated by conditions in the permit. If your project is covered by this permit
[applicable to construction projects that disturb one (1) or more acres], full

The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be
exceeded as described in 15 A NCAC 2B .0200. Appropriate sediment and erosion

The Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of the
CAMA Major Permit Application for the subject project on July 30, 2013. Staff review of the plans and specifications
has determined that the development activities proposed at this time will not pose a threat to surface water quality
from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as
not posing a water quality threat from stormwater runoff should not be subject to the stormwater management
permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are informing you that
this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

Proposed Development:
The project consists of dredging around an existing dock located on North Shore Drive in Sunset
Beach. The proposed dredge area is approximately 280.4 cubic feet of sand and mud material. All
dredging activities will be limited within the subject riparian area. A ten foot (10� buffer will remain
undisturbed around all existing vegetation, dock pilings and bulkheads. Materials removed from the
site will be shipped by barge to an approved disposal area located just north of the site on the lands
of Big Pine Holdings, LLC (see Letter of Percussion). No dredge spoil material shall be disposed of
within 30 feet of the mean high water line of any coastal waters. Proposal for dock improvements
are shown on plan and consist of a 12' X 12' boat lift, a 12' X 12" T-Head with T overhangs, (2) 5'
X 12" jetski ramps and a new 12' X 22' floating dock. All dockage shall be installed outside the
existing pier head alignment established by the Town of Sunset Beach.

The subject is located at 1525 North Shore Drive on the barrier island of the Town of Sunset Beach
in southern Brunswick County along a feeder canal of Jinks Creek on the Atlantic Intracoastal
Waterway (AIWW). The project is located approximately Latitude: N 33°52'29.5" and Longitude:
W 78°29'35.9". Coastal wetlands are present on site and are to be protected as stated above.

received complete on 07/25/13, and appears to be adequate for processing at this time. The projected deadline for making a decision is
10/09/13. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from July 25, 2013, you may request a meeting with the Director of
the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a
"Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to
a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal
agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of my field report and/or

Dear Mr. Varnam,
Mr. John DeBell, owner of Lot 37, Block 14-R in Sunset Beach, is in the process of applying for
a C.A.M.A. Permit to dredge a boat basin within his riparian area to gain better water access to
his property. In accordance with Division of Coastal Management regulations, the purpose of
this letter is to obtain permission from you to place dredged spoil material on your property
known as Riverside in Sunset Beach, NC. Per the survey (attached), the total amount of spoil
material to be disposed of is approximately 414 cubic yards. Spoil material will be placed during
the dredging process and must be contained within silt fence and kept at least 30' from the mean
high water line.
If you agree t low spoil material from this project to be placed on your property as shown on
the attached ap, please sign, da and return this letter as proof of your authorization and
agreement.

Development Permit with the North Carolina Division of Coastal Management (DCM) for any

with the DCM's rules as an adjacent riparian property owner, we notified you of this permit
request. During this permit process our Clients have decided to move forward with a
modification to the existing dock system which requires you to be notified of this modification.

copy of the revised drawing which reflects the proposed dock system which encroaches slightly
within the required 15' setback.

7) Filling in or piping of any vegetative conveyances (ditches, swales, etc.) associated with the development
except for average driveway crossing, is strictly prohibited by any persons.
8) Each lot will maintain a 30 foot wide vegetated buffer between all impervious areas and surface waters.
9) All roof drains shall terminate at least thirty feet from the mean high water mark of surface waters.
10) Lots within CAMAS Area of Environmental Concern may have the permitted maximum built -upon area

Good Morning and happy Friday,
I would like to request that you make a few minor changes to the DeBell application in order for me to deem is complete
and send it out for review. The followings items will need to be corrected:
1. DCM MP-1 Form Number 3.b. and d. Please clarify that the project is located nearest to a manmade feeder canal
and the nearest major water body as Jinks creek.
2. DCM MP-1 Form Number 4.e. Please include ornamental landscaping and grasses as vegetation found on the
tract
3. DCM MP-1 Form Number 5.e. please indicate that "new" work is proposed.
I will also need a check in the amount of $150 for the processing fee. The fee for dredge and fill is $400.
Just s few minor changes and we will be good to go!! Feel free to scan in the documents and mail the check. I can
continue my review and send it out as soon as we get the check. Thanks so much and call me if I can be of assistance to
