Shore Drive in the Town of Sunset Beach , as requested in the permittee's application dated 5/22/13 (MP-1) 7/22/13 This permit, issued on October 22 2013 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 4) Unless specifically altered herein, this permit authorizes only the reconfiguration and expansion of the existing docking facility, as well as the associated uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures maybe conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or ':other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or %continuance as the case may be. -This permit must be accessible on -site to Department 'personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires farther Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. CONDITIONS Should adjacent property to the west be sold prior to the initiation of construction, the permittee shall be ` required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structure within the 15 foot riparian corridor. 3), The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct r . view and must be permeable to air and water. Screen or wire on the sides along with benches and knee i walls are permitted. Lattice is specifically excluded from being used under this authorization. The roof of the covered gazebo shall not be designed for second story use. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7)-,• This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. .8) ' This permit authorizes a maximum of three additional boat slips, resulting in a total of four formalized boat slips at the authorized facility. Excavation 9) In order to protect juvenile shrimp and finfish populations, no excavation shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management.. Excavation shall not exceed —5.0 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. No Coastal Wetlands shall be excavated or filled, even temporarily. ; j2 The temporary placement or double handling of excavated materials within waters or vegetated wetlands is not authorized. The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause i unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions 1 . caused thereby, without expense to the United States or the state of North Carolina. No claim shall be = made against the United States or the state of North Carolina on account of any such removal or ° alteration. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 1;8) , ` The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. f NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. 'NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water,level. NOTE: The N.C. DeBell Page 2 9. PROJECT DESCRIPTION: The project site is located at 1525 North Shore Drive, adjacent to a man-made canal, in the Town of Sunset Beach, Brunswick County. To locate the property site take Highway 17 south from Wilmington towards Sunset Beach. Turn left at Grissettown on N.C. Highway 904 and travel approximately 3.6 miles to the intersection with N.C. Highway 179 (Sunset Blvd). Travel west approximately 2.0 miles and turn right to cross the bridge to Sunset Beach. Travel approximately 1.25 wiles and turn left onto Main Street East and travel approximately 0.50 miles to 12`h Street. Turn left onto 12`h Street, at the stop sign turn right onto Canal Drive and make an immediate left onto Cobia Street. Follow Cobia Street approximately 0.15 miles and turn right onto North Shore Drive. The subject property will be located approximately 0.35 miles to the east on the left side of the road. The lot is approximately 0.25 acres with approximately 135 feet of shoreline frontage. The lot averages 2.95 feet above mean sea level and the shoreline has been stabilized with a vinyl bulkhead. The applicant maintains a single-family residence with a swimming. pool and pier. The highground vegetation consists primarily of lawn grass and ornamental landscaping. The bulkhead curves from east to west along the shoreline and an area of coastal wetlands exists waterward of the existing bulkhead on the east side of the property. The area of coastal wetlands is vegetated with primarily with Smooth Cord Grass (Spartina alterniflora). On June 26, 2013 CAMA General Permit #59285D was issued authorizing the construction of an approximately 35 feet long by 6 feet wide pier with a floating dock connected via ramp to the east side of the pier. The existing floating dock measures approximately 8 feet wide by 16 feet long. The existing pier is located approximately 14 feet from the edge of the existing dredged channel. The dredge channel in this location is approximately 40 feet wide and is maintained to a final depth of -5 feet at MLW. No dredging has been previously authorized in association with the existing docking facility. The adjacent riparian property to the west is a vacant lot and to the east is a developed single-family residence with a private docking facility. There are no known archaeological resources within the project vicinity. The Town of Sunset Beach Land Use Plan classifies the adjacent high ground portion of the project area as Residential. The waters of the man-made feeder canal are classified SA by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The width of the man-made canal in this location is approximately 120 feet wide at this location. # BECEWM 10. PROPOSED PROJECT: AUG 0 1 2013 The applicant proposes to expand an existing docking facility and excavate a new boatCITY connecting to a man-made canal. The dimensions of the proposed boat basin would be approximately 109 feet in length by 40 feet in width and a final project depth of -5 feet at normal low water (NLW) is requested. As proposed, the applicant would maintain a 10 foot buffer from the existing bulkhead and marsh grass. Excavation of the basin would be accomplished by barge mounted mechanical excavator. Excavated material would be placed on the barge for dewatering and then shipped to an approved offsite location. The proposed spoil disposal area is located on the high ground property located on the north side of the canal. The work plan drawing states that the disposal area would be DeBell Page 3 maintained 30 + feet from the mean high water line. A letter of from the property owner of record has been provided authorizing the spoil disposal location. The applicant is proposing to expand the existing docking facility by installing a boatlift, floating jet ski dock, a floating dock, and gazebo. As proposed the gazebo would be constructed on the terminal end and as an extension of the existing fixed pier and would measure 14 feet long by 14 feet wide as measured from the drip line. The proposed boat lift would be located on the west side of the proposed gazebo and would measure approximately 12 feet wide by 12 feet long. The proposed floating platforms would replace the existing floating dock and would be accessed via ramp originating from the east side of the fixed pier. The ramp would be connected to a proposed floating dock measuring 12 feet wide by 22 feet long that would be oriented perpendicular to the shoreline. The proposed floating jet -dock would be anchored on the west side of the proposed floating dock and would measure approximately 10 feet wide by 14 feet long. The proposed jet -dock would be located between the proposed floating dock and gazebo. As proposed the docking facility would provide docking space for four (4) vessels. 11. ANTICIPATED IMPACTS: The proposed boat basin excavation would result in the disturbance of approximately 4,360 square feet of shallow bottom. Approximately 280 cubic yards of spoils material would be excavated from below MHW. The final project depth would be -5 feet at MLW and would connect to the existing depths of the dredge channel. The spoil disposal area would result in approximately 3600 square feet of high ground fill at an approved offsite location. Short term increases in turbidity can be expected during dredging activity. The excavation of the basin by mechanical means will create steep side slopes and subsequent sloughing, thereby increasing the top width dimensions of the proposed project. As proposed the applicant would maintain a 10 foot buffer from the existing bulkhead and marsh grass to prevent disturbance to the areas resulting from sloughing. The proposed docking facility would incorporate approximately 744 square feet, of which 600 square feet is shading impact. The proposed boatlift would encroach into the 15-foot adjacent riparian property owner setback. The structures would exceed the X width limitation however; the Town of Sunset Beach has an established pier head alignment which conforms to the third width rule. The proposed docking facility would be located approximately 5 feet from the edge of the dredge channel footprint and would comply with the Town of Sunset Beach pier head alignment. As proposed the docking facility would provide mooring for four (4) vessels. This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3. PROJECT DESCRIPTION: The project site is located at 1525 North Shore Drive, adjacent to a man-made canal, in the Town of Sunset Beach, Brunswick County. To locate the property site take Highway 17 south from Wilmington towards Sunset Beach. Turn left at Grissettown on N.C. Highway 904 and travel approximately 3.6 miles to the intersection with N.C. Highway 179 (Sunset Blvd). Travel west approximately 2.0 miles and turn right to cross the bridge to Sunset Beach. Travel approximately 1.25 wiles and turn left onto Main Street East and travel approximately 0.50 miles to 12`h Street. Turn left onto 12th Street, at the stop sign turn right onto Canal Drive and make an immediate left onto Cobia Street. Follow Cobia Street approximately 0.15 miles and turn right onto North Shore Drive. The subject property will be located approximately 0.35 miles to the east on the left side of the road. The lot is approximately 0.25 acres with approximately 135 feet of shoreline frontage. The lot averages 2.95 feet above mean sea level and the shoreline has been stabilized with a vinyl bulkhead. The applicant maintains a single-family residence with a swimming. pool and pier. The highground vegetation consists primarily of lawn grass and ornamental landscaping. The bulkhead curves from east to west along the shoreline and an area of coastal wetlands exists waterward of the existing bulkhead on the east side of the property. The area of coastal wetlands is vegetated with primarily with Smooth Cord Grass (Spartina alterniflora). On June 26, 2013 CAMA General Permit #59285D was issued authorizing the construction of an approximately 35 feet long by 6 feet wide pier with a floating dock connected via ramp to the east side of the pier. The existing floating dock measures approximately 8 feet wide by 16 feet long. The existing pier is located approximately 14 feet from the edge of the existing dredged channel. The dredge channel in this location is approximately 40 feet wide and is maintained to a final depth of -5 feet at MLW. No dredging has been previously authorized in association with the existing docking facility. The adjacent riparian property to the west is a vacant lot and to the east is a developed single-family residence with a private docking facility. There are no known archaeological resources within the project vicinity. The Town of Sunset Beach Land Use Plan classifies the adjacent high ground portion of the project area as Residential. The waters of the man-made feeder canal are classified SA by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The width of the man-made canal in this location is approximately 120 feet wide at this location. 10. PROPOSED PROJECT: The applicant proposes to expand an existing docking facility and excavate a new boat basin connecting to a man-made canal. The dimensions of the proposed boat basin would be approximately 109 feet in length by 40 feet in width and a final project depth of -5 feet at normal low water (NLW) is requested. As proposed, the applicant would maintain a 10 foot buffer from the existing bulkhead and marsh grass. Excavation of the basin would be accomplished by barge mounted mechanical excavator. Excavated material would be placed on the barge for dewatering and then shipped to an approved offsite location. The proposed spoil disposal area is located on the high ground property located on the north side of the canal. The work plan drawing states that the disposal area would be DeBelt Page 3 maintained 30 + feet from the mean high water line. A letter of from the property owner of record has been provided authorizing the spoil disposal location. The applicant is proposing to expand the existing docking facility by installing a boatlift, floating jet ski dock, a floating dock, and gazebo. As proposed the gazebo would be constructed on the terminal end and as an extension of the existing fixed pier and would measure 14 feet long by 14 feet wide as measured from the drip line. The proposed boat lift would be located on the west side of the proposed gazebo and would measure approximately 12 feet wide by 12 feet long. The proposed floating platforms would replace the existing floating dock and would be accessed via ramp originating from the east side of the fixed pier. The ramp would be connected to a proposed floating dock measuring 12 feet wide by 22 feet long that would be oriented perpendicular to the shoreline. The proposed floating jet -dock would be anchored on the west side of the proposed floating dock and would measure approximately 10 feet wide by 14 feet long. The proposed jet -dock would be located between the proposed floating dock and gazebo. As proposed the docking facility would provide docking space for four (4) vessels. 11. ANTICIPATED IMPACTS: The proposed boat basin excavation would result in the disturbance of approximately 4,360 square feet of shallow bottom. Approximately 280 cubic yards of spoils material would be excavated from below MHW. The final project depth would be -5 feet at MLW and would connect to the existing depths of the dredge channel. The spoil disposal area would result in approximately 3600 square feet of high ground fill at an approved offsite location. Short term increases in turbidity can be expected during dredging activity. The excavation of the basin by mechanical means will create steep side slopes and subsequent sloughing, thereby increasing the top width dimensions of the proposed project. As proposed the applicant would maintain a 10 foot buffer from the existing bulkhead and marsh grass to prevent disturbance to the areas resulting from sloughing. The proposed docking facility would incorporate approximately 744 square feet, of which 600 square feet is shading impact. The proposed boatlift would encroach into the 15-foot adjacent riparian property owner setback. The structures would exceed the % width limitation however; the Town of Sunset Beach has an established pier head alignment which conforms to the third width rule. The proposed docking facility would be located approximately 5 feet from the edge of the dredge channel footprint and would comply with the Town of Sunset Beach pier head alignment.
