with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

1) Unless specifically altered herein, this minor modification authorizes the 7' X 12' platform, as well as
E the associated uses located in or over the water that are expressly and specifically set forth in the permit
drawing. No other structure, whether floating or stationary, may become a permanent part of this
t 1 < docking facility without permit modification. No non -water dependent uses of structures may be
conducted on, in or over public trust waters without permit modification.

Mr. John DeBell is requesting a minor modification of State Permit No.114-13. State Permit #114-13 was issued to
John and Pamela DeBell on October 22, 2013 for the construction of a 3-slip residential docking facility located at 1525
North Shore Drive adjacent to a man-made canal that is contiguous with Jink's Creek and the Atlantic Intracoastal
Waterway in the Town of Sunset Beach, Brunswick County. LAMA Major Permit# 114-13 is due to expire on December 31,
2016.
Mr. DeBell is requesting that the permit be modified to extend the docking facility 7 feet water ward of the
authorized and to construct a fixed platform extension. The proposed platform extension would measure approximately
7 feet long by 12 feet wide and would be located water ward of the authorized gazebo roof. The proposed modification
does not encroach into the channel portion of the waterbody and does not exceed the Town of Sunset Beach's
established pier head line. No increase in the overall slip count is proposed with this modification request and the
facility will continue to provide mooring for 3 vessels. The proposed modifications are in keeping with the original spirit,
purpose and intent of the original permit.
The agent has submitted check #7771 in the amount of $100.00 for the processing of the modification request
This Office has no objection to the permit modification request. By copy of this memo, DCM is requesting
that the USACE, DWR and DCM/Flsherles Resource Specialist, etc (whichever is applicable) provide any comment
that your agency may have on the proposed project to Jonathan Howell of DCM's Morehead City office within 10
days of receipt of this memo.

Please find attached a revised sketch to create an open platform of 7' X 12' off the
end of the proposed 12' X 12' T Head structure as shown on our initial plan. We will
use the existing ramp and floating dock, as shown on the attached revised plan.

Dear Sir or Madam:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable, the
State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is retained by
you and it must be available on site when the project is inspected for compliance. Please sign both the original and the
copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
1137229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits.a valid objection to the
issuance of this permit within twenty (20), days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all:work must be carried,
out in accordance with your application. Modifications, time extensions, and future maintenance requires' additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirement's.
From time to time,.Departmeni personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.
By working in accordance with the permit, you will be helping to protect our vitally important coastal resources.
