Any violation of these terms may ae subject to tines, imprisonment or civil action; or may cause the Docking Facility to be nun ana vota. 1) Unless specifically altered herein, this permit authorizes only the additional docking facility and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 3) No portion of the authorized docking facility shall extend beyond the established pier head line. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2016 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 5) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 7) This permit authorizes three additional boat slips for a maximum of four formalized boat slips. General 8) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 9) No Coastal Wetlands or open water areas shall be excavated or filled, even temporarily. 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) The permittee and/or his contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. SAW- 2013-01113. PROJECT DESCRIPTION: DCM-MHDCITY The project site is located at 52 Newport Street, adjacent to a man-made canal, in Ocean Isle Beach, Brunswick County. To locate the property from Ocean Highway South (US 17 S) near Shallotte, approximately 3 miles south of Shallotte, turn left onto Ocean Isle Beach Road SW and travel across the bridge to the island. Turn left onto East Second Street and travel approximately 0.60 miles to Newport Street. Turn left onto Newport Street and follow to the street end. The project site will be located on the right side of the road. The property consists of a 0.21 acre lot, with an approximate shoreline length of 210 feet. The property is adjacent to a man-made canal on the north and east side, is adjacent to Newport Street to the west and a residential home site to the south. The high ground portion of the property is approximately 9 feet above mean high water (MHW) and is primarily vegetated with landscape shrubs and grasses. The high ground development consists of a single family residence, swimming pool with concrete and wooden decking and a gravel drive. The shoreline of the property has been stabilized with a sloping concrete wall. There is no wetland vegetation present adjacent to or waterward of the concrete wall. An existing floating dock which measures approximately 8 feet wide by 20 feet long originates from the high ground on the east side of the property. The floating dock is connected to the high ground by an access ramp that measures approximately 4 feet wide by 16 feet long. The existing floating dock meets the 15 foot setback form the adjacent riparian property boundary and does not extend beyond the established pier head line within the canal. The existing access pier and floating dock were authorized by CAMA General Permit #56573D issued on 12/21/2010. The waters of the man-made canal are classified SA by the Division of Water Quality. The project area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is CLOSED to the harvest of shellfish. There are no known archaeological sites within the project vicinity. 10. PROPOSED PROJECT: The applicant proposes to construct a second access pier with a floating dock and boatlift to provide mooring for a total of four (4) vessels. The applicant proposes to construct a 6 feet wide access walkway originating from the ground level entry door on the north side of the property. The 6 feet wide walkway would extend toward the canal and would be connected to an access ramp measuring approximately 4 feet wide by 16 feet long. The access ramp would connect to a proposed 5 feet wide by 26 feet long floating dock. As proposed, the floating dock would have a landing for the access ramp that would measure approximately 6 feet in width by 5 feet in length and would be in alignment with the access ramp and walkway. The applicant is also proposing to install a four (4) piling boatlift measuring approximately 12 feet wide by 13 feet in length at the western end of the proposed floating dock. The proposed boatlift and floating dock would be located in an area with water depths of approximately 2.0 feet at NLW. The applicant has also proposed to designate two (2) jet ski slips adjacent to the existing floating dock located on the eastern shoreline of the property. As proposed, both facilities would provide docking space for a total of four (4) vessels; two (2) jet -ski slips on the east dock, one (1) boatlift slip and one (1) slip on the outboard side of the proposed floating dock on the northern shoreline. The applicant states the width of canal is approximately 100 feet at the project location. The proposed boatlift would not encroach into the adjacent 15' riparian corridor setback of the neighbor to the west. The permittee must install and maintain, at his expense, any signal lights and signals prescribed bythe U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 5. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 6. The existing access pier and floating dock were authorized by CAMA General Permit #56573D issued on 12/21/2010. The waters of the man-made canal are classified SA by the Division of Water Quality. The project area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is CLOSED to the harvest of shellfish. There are no known archaeological sites within t%ff%W vicinity. 10. PROPOSED PROJECT: JUN 2 0 2013 The applicant proposes to construct a second access pier with a floating dock and boatlift to provide mooring for a total of four (4) vessels. The applicant proposes to construct a 6 feeMMM walkway originating from the ground level entry door on the north side of the property. The 6 feet wide walkway would extend toward the canal and would be connected to an access ramp measuring approximately 4 feet wide by 16 feet long. The access ramp would connect to a proposed 5 feet wide by 26 feet long floating dock. As proposed, the floating dock would have a landing for the access ramp that would measure approximately 6 feet in width by 5 feet in length and would be in alignment with the access ramp and walkway. The applicant is also proposing to install a four (4) piling boatlift measuring approximately 12 feet wide by 13 feet in length at the western end of the proposed floating dock. The proposed boatlift and floating dock would be located in an area with water depths of approximately 2.0 feet at NLW. The applicant has also proposed to designate two (2) jet ski slips adjacent to the existing floating dock located on the eastern shoreline of the property. As proposed, both facilities would provide docking space for a total of four (4) vessels; two (2) jet -ski slips on the east dock, one (1) boatlift slip and one (1) slip on the outboard side of the proposed floating dock on the northern shoreline. Robert and Susan Alexander Page 2 9. PROJECT DESCRIPTION: The project site is located at 207 Trent Court, adjacent to Banks Channel, between the Atlantic Ocean and Greenville Sound. The site is located within the Town of Wrightsville Beach, in New Hanover County. To locate the property travel east from Military Cut -Off Road (N.C. Highway 17) approximately 1 mile towards Wrightsville Beach. From the drawbridge, continue heading east on Causeway Drive (N.C. Highway 76) approximately 0.8 miles. Turn right onto Live Oak Drive, just before the bridge over Banks Channel. Continue approximately 0.1 miles until you reach Jasmine Place on the left. Turn left onto Jasmine Place and take the immediate right onto South Channel Drive. The property of interest will be located on the left hand side. The property is currently undeveloped and is adjacent to residential properties with existing single family structures and private docking facilities. The applicant received CAMA General Permit No. 60601 on 6/20/2012 for the construction of a private docking facility; however, to date the construction has not been initiated and the permit expired on 10/20/2012. Highground vegetation consists of maintained lawn grass and ornamental landscaping. The lot is approximately 0.25 acres in size and has an average elevation of approximately 6' above normal high water (NHW). The project site has approximately 66.5 linear feet of shoreline frontage stabilized by a concrete bulkhead. There are currently no coastal wetland waterward of the existing bulkhead. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground area of project site as Conservation. There are no known archaeological sites located in the project vicinity. The waters of Banks Channel are classified SB by the Division of Water Quality. T designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CL�e harvest of shellfish. PROPOSED PROJECT: JUL 0 2 2013 The applicant proposes to construct a new private �l4in a�i t within Banks Channel. A new access pier would extend towards the east into Banks Channel, mess r �gp r ately 17' in length by 6' in width. The pier would then terminate into a covered "L shaped" platform, measuring approximately 10' in length by 16' in width, which would be oriented towards the north. An access ramp would lead from the platform onto a new floating dock, measuring approximately 48.5' in length by 8' in width, which would run in the same alignment as the pier. Another floating dock, measuring approximately 9' in length by 5' in width would extend from the most landward end of the main floating dock towards the north, creating an "L shaped" configuration. A new boatlift, measuring approximately 12' in length by I in width would be installed on the northern side of the most waterward end of the proposed floating dock. The application also states that two (2) tie pilings would be located on the south side of the main floating dock. The application states that the existing water depths in the location of the proposed docking structures range from approximately -3' to -7' at normal low water (NLW), and would accommodate up to five (5) slips at this location (See Sheets 1 and 2 of 2). 10. ANTICIPATED IMPACTS: The new docking facility would incorporate 827 sq. ft. of Estuarine Waters and Public Trust Areas. Some of the proposed structures would encroach into both the adjacent 15' Riparian Corridor Setback Area requirement; however, the applicant has received a waiver from the property owner to the north through a deed agreement (See Exhibit "A"); however, the applicant has not received a waiver from the property owner to the south for the encroachment of the proposed mooring pilings. During a phone conversation with the agent, the applicant is currently in the process of obtaining the waiver. The docking facility would extend approximately 80' into a waterbody, which measures approximately 1,200' across. The applicant is proposing to construct a second access pier with a floating dock and boatlift to provide mooring for a total of four (4) vessels. Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters and Public Trust areas. Waters at the project site are classified as SA and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Ocean Isle Beach Land Use Plan and offer the following comments. The general area of the project is classified as Residential. In general, Ocean Isle Beach allows development in residential/conservation classified AECs which is consistent with the State's minimum use standards. The Ocean Isle Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project appears to be consistent with the Ocean Isle Beach Land Use Plan update. It borders Canal 10, and is approximately 600 feet south of the Atlantic Intracoastal Waterway. The property has approximately 211 feet of concrete bulkhead shoreline. The existing home was constructed in 1988. There is also an existing pier and floating dock on the Eastern shoreline of the property that was permitted in December 2010. The applicant proposes to construct a fixed 6 foot walkway and pier, leading to a 5 foot by 26 foot floating dock, which would be accessed by a 4 foot by 16 foot ramp. An area approximately 12 foot by 12 foot is designated on the Western end of the floating dock for a boat lift, supported by additional pilings.
