This permit, issued on \\—VIA 6 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and -notes set forth below. Any violation of these terms may
be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) In order to protect juvenile finfish populations, no excavation or filling may take place between
February 1 and October 1 of any year without prior approval of the Division of Coastal Management
in consultation with the Division of Marine Fisheries.
2) The temporary placement or double -handling of excavated or fill material within Public Trust
Waters or vegetated wetlands is prohibited.
3) No excavation or fill material will be placed at any time in any wetlands or Public Trust Waters,
outside of the alignment of the project work area indicated on the approved work plans.

This permiLaction may be appealed by the pemrittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31,199

ADDITIONAL CONDITIONS
4) Excavation will not exceed three feet below the elevation of mean low water (MLW).
5) Prior to commencement of work, during completion or after completion, appropriate erosion and
sedimentation control devices, measures or structures will be used to prevent any sedimentation from
occurring in any wetlands or watercourses (i.e., silt fencing, turbidity curtains, diversion swales,
water control structures, establishment of vegetated buffers, etc.).
Ramp Construction
6) Wet cement in contact with water is toxic to aquatic organisms; therefore, the cement slab for
the boat ramp should be poured on an upland site and slid into place once hardened.
Mitigation
7) All work authorized by this permit must be performed in strict compliance with the permit
plans and the October 17, 1996 Mitigation Plan.
8) No vegetated wetlands will be excavated or filled outside of the permitted project area, or
below the normal water level of Areneuse Creek within the residential lots of Danson's Grant
Subdivision.
NOTE: An Erosion and Sedimentation Control Plan will be required for this project.
This plan must be filed at least thirty (30) days prior to the beginning of any
land -disturbing activity. Submit this plan to the Dept. Of Environment,
Health and Natural Resources, Land Quality Section, 1424 Carolina Avenue,
Washington, NC 27889.
NOTE: The Division of Water Quality authorized the canal/ramp project on August 8,
1996 under General Water Quality Certification No. 3025.
NOTE: The Division of Water Quality approved Danson's Grant S/D as a low density
project for storm water management on June 7, 1995.

ink on an 8 1/2" by 11" white paper. (Refer to
Coastal Resources Commission Rule 71.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue -line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or. location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the

Dear Mr. Small:
Reference your revised application for a Department of the Army (DA)
permit to undertake excavation activities within Section 404 Department of
the Army jurisdictional wetlands, and construct an access channel, boat basin,
boat ramp, and pier, to provide boating access to Danson's Grant Subdivision,
located off N.C. 343, adjacent to Areneuse Creek, near the Community of
Taylors Beach, in Camden County, North Carolina.
Your revised proposal has been reviewed and found to be consistent with
the provisions and objectives of General Permit No. 198000291. Therefore, you
may commence construction activity in strict accordance with applicable State
authorization and your revised plans. Failure to comply with the State
authorization or conditions of the general permit could result in civil and/or
administrative penalties.
If any change in your work is required because of unforeseen or altered
conditions or for any other reason, plans revised to show the change must be
sent promptly to this office and the North Carolina Division of Coastal
Management prior to performing any such change or alteration. Such action
is necessary as revised plans must be reviewed and the authorization modified.

It is my understanding the subject applicant has successfully satisfied the US COE
requirements for minimization of impacts to "404" wetlands since my September 21, 1996
correspondence to you. In addition, the applicant has subsequently offered to mitigate for
unavoidable wetland losses by creating a 10,000 sf. "404" wetland area adjacent to the impact
area. This is a 2:1 compensation ratio.
In consideration of these recent resolutions, I recommend approval of this project with the
following conditions below.

5. All unsold lots as of the permit date will have a deed restriction forbidding dredge and fill
additional impacts to any wetlands located on these lots. These deed restrictions shall be recorded at
the county courthouse.
6. The permittee will prepare a mitigation plan acceptable to the US COE. This plan shall
C address, at a minimum, the mitigation site, the present and proposed site elevation, plant type
and proposed planting time schedule. The plan will also address monitoring and long term
mitigation site success acceptable to the US COE.

The applicant proposes to construct, across wooded wetlands, a water access channel and a boat ramp
on Areneuse Creek. This proposed work includes the excavation and fill of freshwater wetlands and
Public Trust Waters. Construction includes the excavation of a 196 ft. by 26 ft. wide access channel, a
30 ft. long by 20 ft. wide concrete ramp and a 40 ft. long by 6 ft. wide pier adjacent to the proposed boat
ramp. Approximately one-half of the pier will be placed over Public Trust Waters. Approximately 10 ft.
of the proposed boat ramp will be waterward of the NWL and require filling of approximately 200 sf.
of Public Trust Waters.
Damson's Grant Subdivision is located in Camden County off NC 343, approximately 2 miles northwest
of the Taylors Beach community. The proposed construction site is on a small pre-existing gut or slip
along Areneuse Creek, a tributary to the Pasquotank River. The waters of Areneuse Creek are classified
by the Division of Marine Fisheries as Inland Waters and are also classified by the Division of Coastal
Management as Public Trust Waters and are part of the Estuarine System Area of Environmental Concern.
The shoreline and proposed access area, as well as the shoreline of the Damson's Grant Subdivision is
vegetated in a 100 to 150 foot wide wetland fringe of freshwater herbaceous, woody and hardwood
wetland plant species, the area adjacent to the access area is vegetated in Taxodium distichum, Ayssa
aquatica, Liquidambar styraciflua as well as Myrica cerifera, Magnolia virginiana and Acer rubrum with
various herbaceous vines and perennials. This proposed boat access has been designated as an US COE
jurisdictional wetland.
This project has slightly over one -tenth of an acre of impacts. The applicant has not proposed any
mitigation to compensate for wetland habitat losses, nor has the applicant proposed shoreline stabilization
to minimize erosion and sedimentation after the channel and basin work are complete..
The proposed work will directly impact about 2400 sf. (0.055 A.) of freshwater US COE jurisdictional
wetlands and about 2900 sf. (0.067 A.) of Public Trust Waters. The proposed boat ramp will be
constructed landward of the current wetland boundary. The proposed spoil and drive access areas will
be landward of any wetlands. The proposed work will not directly impact any Coastal Wetlands,
Estuarine Waters or Estuarine Shoreline.

The proposed facility will be for private use for the Danson's Grant Subdivision. Currently, there are no
public boat ramps located in Camden County. The applicant has not requested authorization to stabilize
any of the proposed access channel, basin or boat ramp. The proposed project will increase turbidity in
the adjacent Public Trust Waters.
The Division has received continents from several agencies on this proposed work ranging from caution
to denial, considering the following.
[i] There is no evidence that any other sites were examined which might have less negative
impacts to wildlife and fishery resources. It appears that a ramp facility located near the
SR 343 bridge might have less impacts to these resources.
[ii] A sedimentation plan has been approved for this subdivision however, the Division of
Water Quality will not require that a stormwater runoff plan or permit be issued, that the
site poses no threats to water quality. It is my feeling that if this entire neighborhood
removes all the wooded wetland fringe along Arenuese Creek that this will impact water
quality, that a stormwater plan will be important.
[iii] According to the District Health Department, the "proposed subdivision" will come under
a management entity. This will require that the septic systems on each individual lot be
inspected annually.
[iv] The applicant has not proposed to stabilize the shoreline of any of the boat ramp, basin
or access facility. This will certainly add to sedimentation of Arenuese Creek and the
proposed channel in the long run.
[v] The applicant proposes a water depth of 3.0 ft. below normal water level in the basin
portion of the facility. Several large stumps (from recently logged cypress) are in this
vicinity. The removal of these stumps will create holes at depths greater than 3 ft. below
the NWL.
[vi] The US F & W Service has serious concerns about the proposed facility. The NC
Division of Marine Fisheries has recommended a denial of this project, heavily based on
concern [i], above.
In addition to the above comments, I believe the proposed shape and alignment of the access channel will
hinder flushing. Therefore, I recommend this project be denied authorization.

Consistency Determination: So long as this request satisfies applicable CAMA permit
regulations, it will be consistent with the Camden County LUP.
Basis For Determination: The CRC certified Camden County July 29,1994 LUP Update
was used to review this project. The subdivision area appears to be classified as "Rurar', on
the County's Land Classification Map. LUP text statements regarding the Land Classification
System (page 65), under the Introduction section second paragraph notes: "However, the
land classification system makes no restrictions on land use. Any development is permitted on
any site if such development complies with existing local regulations and with various permit
requirements of the state and federal agencies with jurisdiction."
Public Trust Waters Policy, page 39: "The County supports the guidelines of the Coastal
Area Management Act and efforts and programs of. ..... to protect coastal wetlands, estuarine
waters, estuarine shorelines, and public trust waters of Camden County.".... "The County will
rely on the NC DEHNR, DCM, to regulate development in coastal wetlands and along the
estuarine shorelines and to protect estuarine waters through the CAMA permitting process.
Also, it will rely on the regulations of other state and federal agencies with regulatory
authority, as well as on existing local development regulations to mitigate threats to AFC's."

The following comments by the North Carolina, Division of Marine Fisheries are
provided pursuant to General Statute 113-131. The Division objects to the project as
proposed based on the following reasons.
Areneuse Creek functions as a spawning and nursery area for blueback herring and
alewife. Resident species also utilize the creek.
The 196 ft. by 26 ft. proposed access canal will impact 2400 sq. ft. of wetlands,
according to the DCM Bio-report. It seems that the impacts to wetlands would even be
greater based on the proposed length and width. The Division is concerned with the loss of
these wetlands. Wetlands are of great importance serving as sources of biological
productivity and providing food directly and indirectly. Finally, wetlands perform important
roles in modifying acute impacts of hydrologic events, moderating stormwater flows,
trapping sediments, and providing nutrients for incorporation into resident plants.
The proposed excavation of the canal will result in circulation and flushing problems.
Designs of this type have resulted in dissolved oxygen level problems, which may result in
fish kills and degradation of water quality to the adjoining waters. Algae blooms may also
result.
The Division is also concerned that if the permit is issued, no request has been made
for any stabilization of the canal, basin, or boat ramp. With no stabilization proposed the
wetlands will continually be subject to erosion. The constant erosion and sluffmg off of the
shoreline will increase the required frequency of maintenance dredging and the turbidity in
the area.

Biologists on the Wildlife Resources Commission staff have reviewed this permit
application and are familiar with habitat values of the project area. In order to further assess
project impacts on fish and wildlife resources, an onsite inspection was conducted on July 30,
1996. Our comments are provided in accordance with provisions of the Coastal Area
Management Act (G.S. 113A-100 through 113A-128), as amended, and the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to dredge an access channel and basin in wooded wetlands
(swamp) adjacent to Areneuse Creek. The applicant will then construct a boat ramp and access
pier. Waters at the site are classified as SB.
The proposed facilities will be for the residences on Danson's Grant Subdivision and not
for the general public. We prefer the development of community facilities instead of the
proliferation of individual ramps and piers. Areneuse Creek and other creeks in the vicinity are
documented to be productive spawning areas especially for heron. We make the following
recommendations in order to minimize impacts to spawning fish populations.
1. To avoid heron spawning season, dredging of the access channel and basin should be
prohibited between March 1 and September 30.
% 2. Wet cement in contact with water is toxic to aquatic organisms; therefore, the cement
slab for the boat ramp should be poured on an upland site and slid into place once
hardened.

Dear Mr. Small:
As an agency involved in the Division of Coastal
Management's major permit application review process, we have
determined that more than one acre will be disturbed by the
activities as described. Therefore, in addition to a permit from
the Division of Coastal Management, an erosion and sedimentation
control plan must be submitted to and approved by this office
before development begins.
Contrary to the answer provided to question "ell on form DCM-
MP-3, there is no approved erosion and sedimentation control plan
for this portion of the project known as Danson's Grant.
The requiring of an erosion and sedimentation control plan
is based on a mandatory standard for land -disturbing activity of
the Sedimentation Pollution Control Act of 1973 [NCGS 113A-57(4)
and 113A-54(d)(4)], which states:
No person shall initiate any land -disturbing activity, if at
least one acre is to be uncovered, unless an erosion and
sedimentation control plan for the activity is filed with
the agency having jurisdiction and approved.
The plan must be submitted at least thirty (30) days prior
to project commencement. The plan must include, but is not
limited'to, the following:
1. All roads and drainage constructed beyond that shown on
the erosion and sedimentation control plan for Phase 1.
2. A scaled plat plan of the site, showing the affected
areas as well as -adjacent properties which may be
affected. Include contours if available.

3. Indicate critical areas such as wetlands, creeks,
streams, drainageways, marsh, etc.
4'. Include a brief narrative describing the activities to
be undertaken and a construction schedule.
5. Indicate on the plat the measures to be utilized to
prevent sediment from entering adjacent properties,
such as location of silt fences, silt basins, diversion
ditches, areas to be seeded, etc.
6. Include seeding and mulching specifications for both
temporary and permanent stabilization.
7. Include any other pertinent information directed at
controlling offsite sedimentation, slope degradation,
and erosion.
Please be advised that the plan will be considered
incomplete, and the statutory review period will not begin,
unless a non-refundable plan review processing fee, payable by
check or money order made out to the Department of Environment,
"Health:and Natural Resources, is included. The amount of the fee
is based on $30 for the first disturbed or affected acre, plus
$20 for each additional whole or fractional acre of land to be
disturbed (including offsite borrow or waste areas).
To begin this project without the approval of an erosion/
sedimentation control plan will be considered a violation of the
Act and may lead to the assessment of a civil penalty of up to
$500.00 per day for each day the project is deemed in violation.
For your convenience, we are enclosing a guideline for
developing a plan. If you should have any questions, feel free
to contact me.

Dear Mr. and Ms. Small:
This office has completed its review of the erosion and
sedimentation control plan for the referenced project. The
project will disturb 6..8± acres for construction of residential
roads and 23 lot line swales. Based upon the information
provided, we find the plan to be acceptable and hereby issue this
LETTER OF APPROVAL.
The Sedimentation Pollution Control Act requires the
owner/developer to use appropriate methods for the protection of
adjoining natural resources and properties, both during and after
construction, from the effects of accelerated erosion. This
program is performance oriented. It is your responsibility to
understand and comply with the requirements of the Act.
The following minimal mandatory standards of the Act are
hereby made a part of the approved plan:
-- a copy of the latest approved soil erosion and control
plan must be on file at the job site;
--- a buffer zone, sufficient to restrain sedimentation, must
be maintained between the land -disturbing activity and
any adjacent property or watercourse;

-- new or affected slopes must be at an angle that can be
retained by vegetative cover and exposed slopes must be
provided with a ground cover sufficient to restrain
erosion within 30 working days of completion of any phase
(rough or final) of grading (RYE GRASS IS NOT in the
approved seeding specifications nor is it an ACCEPTABLE
substitute for the providing of a ground cover); and
-- a permanent ground cover, sufficient to restrain erosion,
must be provided within the shorter of 30 working or 120
calendar days after completion of construction or
development.
Be advised that unannounced periodic inspections of the
project will be made to ensure compliance with the approved plan
and the program requirements. If the plan and/or its
implementation is determined to be inadequate, this office may
require that it be revised to comply with state law. Failure to
comply with the approved plan or with any requirements of this
program or to affect areas in other than to those designated to
be affected in the approved plan, could result in a civil penalty
assessment of up to $500 per day for each day the site is out of
compliance against the financially responsible party (Gaston E.
Small, Jr. and Beverly M. Small).
In recognizing -the desirability of early coordination of
sedimentation control, we believe it would be beneficial for you
and your contractor to arrange a pre -construction conference to
discuss the requirements of the approved erosion and scdimen--
tation control plan. It would be appreciated if you would
contact this office to let Richard Peed know the date of
construction start-up and the date of the pre -construction
conference.
The land -disturbing activity described in this plan may
require approval or permitting from other Federal, State or local
agencies. These could include the U.S. Army Corps of Engineers
under Article 404 jurisdiction, the Division of Environmental
Management under water quality regulations (contact Bill Moore,
919--946-6481), county, city or town agencies under other local
ordinances, or other approvals that may be required. This
approval cannot supersede any other approval or permit.
Please be advised that all land -disturbing activities
affecting 5 acres or more are required to have a PIPDES permit.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and where applicable,
the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored form) is
retained by you and it must be available on site when the project is inspected for compliance. Please sign both the
original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1
or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, P.O. Drawer 11666, Raleigh, NC 27611, (919) 733-2698 within twenty (20) days of this
decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance require
additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved.
If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all
permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning
permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for
assistance. By working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Community of Taylors Beach, in Camden County, North Carolina.
The Federal agencies have completed review of the proposal as presented
by the application and your field investigation report.
We recommend that the following condition(s) be included in the State
authorization:
1. All work authorized by this permit must be performed in strict
compliance with the permit plans and the October 17, 1996 Mitigation Plan.

Lam g2. No vegetated wetlands will be excavated or filled outside of the
permitted project area, or below the normal water level of Areneuse Creek
within the residential lots of Danson's Grant Subdivision.
4 3. Excavation will not exceed three feet below the elevation of mean low
water (MLW).
4. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
5. The authorized structure and associated activity will not cause an
unacceptable interference with navigation.
6. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or

waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or
less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or
less in trout waters, are not considered significant.

1. All work authorized by this permit must be performed in strict
compliance with the permit plans and the October 17, 1996 Mitigation Plan.
2. No vegetated wetlands will be excavated or filled outside of the
permitted project area, or below the normal water level of Areneuse Creek
within the residential lots of Danson's Grant Subdivision.
3. Excavation will not exceed three feet below the elevation of mean low
water (MLW).
4. The temporary placement or double handling of excavated or fill
materials within waters or vegetated wetlands is not authorized.
t 5. The authorized structure and associated activity will not cause an
unacceptable interference with navigation.
6. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction -related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or
less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or
less in trout waters, are not considered significant.

The U.S. Fish and Wildlife Service (Service) has reviewed the
project plans and field investigation report for activities
proposed by Gaston Small (representing the Danson's Grant
Subdivision) (Action I.D. no. 199604830). The applicant proposes
to excavate a 196 feet long by 26 feet wide access channel through
riverine wetlands. At the landward terminus of the canal, the
applicant proposes to construct a concrete boat ramp and wooden
pier. The waterward terminus of the channel is a pre-existing gut
along Areneuse Creek, a tributary of the Pasquotank River. No
erosion control or other stabilization structures are proposed.
The proposed facilities are for the private use of residents of
Danson's Grant Subdivision.
This is the report of the Service submitted pursuant to, and in
accordance with, provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the
Endangered Species Act of 1973 (87 Stat. 884, as amended; 16 U.S.C.
1531 et seq.).
The Service recommends that the District Engineer exercise his
discretionary authority regarding the disposition of the proposed
activities. As currently proposed, the "proposed activity would
have more than minimal individual or cumulative net adverse effects
on the environment or otherwise be contrary to the public
interest..." (33 CFR 330.1(d)). Further, the causative agent for
the proposed activities, construction of a housing subdivision, is
non -water -dependent. If the proposed activities are non -water -
dependent, the applicant is obligated to rebut the assumption that
less environmentally damaging practical alternatives exist.
The applicant has not presented any alternatives analysis, nor
sought means to avoid, minimize, or mitigate the wetland impacts
associated with this proposal. Additionally, we believe that it is
reasonable and prudent to anticipate cumulative impacts to fish and
wildlife resources from this proposal. The proposed channel will
require frequent in -water maintenance and other support activities
which may adversely impact the subject wetlands (temporal impacts).
Further, since the activities will, in effect, encourage boating
activities among subdivision residents, it is reasonable to assume
that residents will soon desire boat access to private lots
(spatial impacts).
The applicant should demonstrate that no reasonable alternatives
which would avoid impacts to fish and wildlife resources are
available (alternatives include, but not limited to, moving the
location of the boat access site to an area outside the present
boundaries of the Danson's Grant subdivision). Should avoidance be
impractical, the applicant should modify the proposal to identify
and minimize individual and cumulative impacts. Additionally,
mitigation should be proposed for these minimal impacts.
The Service recommends that the applicant revise the application to
include an alternatives analysis, evidence that adverse impacts
have been avoided or minimized, and if unavoidable wetland impacts
remain, provide mitigation for affected fish and wildlife
resources.

In accordance with Part II, Section 4 of the current Memorandum of
Agreement between the Departments of Commerce and the Army, I am
offering the following comments on permit application 199604830
dated July 17, 1996. The applicant, Danson's Grant Subdivision,
proposes to excavate wetlands to construct a boat basin and ramp
adjacent to the waters of Areneuse Creek in Camden County, North
Carolina.
The proposed project consists of the construction of a 196-foot-
long by 26-foot-wide access channel through wetlands and the
construction of a 30-foot-long by 20-foot-wide boat ramp. A 40-
foot-long by 6-foot-wide pier would be constructed adjacent to the
proposed boat ramp. The purpose of the work is to provide boating
access to the proposed subdivision.
The project area is located on a peninsula between Areneuse Creek
and another unnamed tributary of the Chowan River. Information
provided by the North Carolina Division of Coastal Management
(NCDCM) indicates that the proposed subdivision will offer 100
building lots aligned along a 1000-foot-long portion of these
creeks. Wetlands in the project area are vegetated with a variety
of species including bald cypress (Taxodium distichum), tupelo gum
(Nyssa aquatica), tulip poplar (Liriodendron tuliDifera), wax
myrtle (Mvrica cerifera), and red maple (Acer rubrum). During
periods of high water, these wetlands provide habitat for fishery
resources and export organic detritus that is an important
component in the aquatic food chain in the downstream waters of
Albemarle Sound. They also function to remove sediment, nutrients,
and pollutants from upland runoff before it reaches surface waters,
thereby improving water quality.'

Based on our knowledge of the project area and coordination with
the NCDCM, we are concerned that this work would be detrimental to
fishery resources. The proposed access channel will result in the
loss of a small but important area of wooded wetlands. There is no
indication in the public notice that the proposed alignment is the
least damaging alternative for community access or that any other
alternatives were considered. Furthermore, no mitigation for
unavoidable wetland losses is offered.
We are also concerned that the proposed development could result in
additional wetland losses and degradation of water quality in
Areneuse Creek. Areneuse Creek provides habitat for a variety of
commercially, recreationally, and ecologically important fishery
resources. Species found in the project area include the
anadromous striped bass (Morone saxatilis), blueback herring (Alosa
aestivalis), and white perch (Morone Americanus) and estuarine
dependent species such as flounders (Paralichthvs spp.) and
Atlantic menhaden (Brevoortia tyrannus).
Upon completion of this project, each waterfront property owner
(100) could receive authorization to construct piers, docks, and
boat ramps or place fill in shoreline wetlands pursuant to
Nationwide Permit #18, which allows for the filling of up to one
tenth of an acre for each application. This could result in an
additional wetland loss of up to ten acres.
We believe that it is appropriate to assess the impact of the
proposed subdivision as a unit rather than as a number of small
impacts which cumulatively are difficult to assess and for which a
requirement for mitigation is unlikely. Accordingly, we recommend
that the Corps of Engineers (COE) evaluate the cumulative secondary
impacts of this project and determine whether all feasible measures
to avoid or minimize both direct and indirect impacts have been
taken. We recommend that the COE consider special permit
conditions that would require the applicant to provide community
boating facilities and by deed restrictions prohibit the
construction of individual facilities. Any issued permit should
also include the requirement of up front compensatory mitigation
for unavoidable wetland losses.
In view of the above, the National Marine Fisheries Service
recommends that federal authorization of this work not be granted
unless the federal authorization includes special conditions as
outlined above.

Danson's Grant Subdivision is located in Camden County off NC 343, approximately 2 miles northwest of
the Taylors Beach community. The proposed construction site is on a small pre-existing gut or slip along
Areneuse Creek, a tributary to the Pasquotank River. The waters of Areneuse Creek are classified by the
Division of Marine Fisheries as Inland Waters and are also classified by the Division of Coastal
Management as Public Trust Waters and are part of the Estuarine System Area of Environmental Concern.
The shoreline and;.Rroposed access area are vegetated in a 100 to 150 foot wide wetland fringe of
freshwater herbaceous, woody and hardwood wetland plant species, the area adjacent to the access area is
vegetated in Taxodium distichum, Nyssa aquatica, Liquidambar styrac j2ua as well as Myrica cerifera,
Magnolia virginiana and Acer rubrum with various herbaceous vines and perennials. This site has been
delineated as an US COE jurisdictional wetland.
This project has slightly over one -tenth of an acre of impacts. The applicant has not proposed any
mitigation to compensate for wetland habitat losses.
Anticipated Impacts
The proposed work will directly impact about 2400 sf. (0.055 A.) of freshwater US COE jurisdictional
wetlands and about 2900 sf. (0.067 A.) of Public Trust Waters. The proposed boat ramp will be
constructed landward of the current wetland boundary. The proposed spoil and drive access areas will be
landward of any wetlands. The proposed work will not impact any Coastal Wetlands, Estuarine Waters or
Estuarine Shoreline.
The proposed facility will be for private use for the Danson's Grant Subdivision. Currently, there are no
public boat ramps located in Camden County. The applicant has not requested authorization to stabilize
any of the proposed access channel, basin or boat ramp. The proposed project will increase turbidity in the

This letter is with reference to Danson's Grant Subdivision (Action ID # 199604830).
After considerable discussion with regards to comments by US Fish & Wildlife, National
Marine Fisheries, NC Division of Marine Fisheries, and the NC Division of Coastal
Management, we have coordinated with our client and propose the attached mitigation to
offset the unavoidable impacts associated with the project.
The purpose of the proposed activity is to provide a community access area for
navigation to Areneuse Creek and to minimize the number of piers or other activity to
access the adjoining navigable waters. By virtue of this being a community facility we
feel this will minimize the impact on the adjacent wetland area. In light of the comments
that have been received, we feel that an offering of mitigation is appropriate. In order to
mitigate for the 4.578 sq. ft. of unavoidable impacts associated with the access channel
that will cross hardwood bottom swamp and shallow water, we propose to create 10,000
sq. ft. of wetlands adjacent to the proposed project by excavating the highground wetland
interface to the adjoining wetland elevation. This will result in a 2:1 ratio. We propose
to allow this area to revegetate naturally and to use the overburden in the community
access area. This material will be stabilized with lawn grass at the same time that the
spoil from the excavation is smoothed and stabilized. We propose that this mitigation be
accomplished concurrently with the excavation occurs for the access channel.
We appreciate your consideration of this proposal and remain available to discuss its
applicability to this project and the possibility that it could adequately compensate for the
unavoidable loss of wetlands at the project site.

This .is to confirm the completion of the soil evaluation for
the use of ground absorption sewage disposal systems on your
proposed subdivision located off of 343 South. Several soil
borings were made with the following indicated results:
1. A soil, wetness condition indicated at approximately 36
inches based on soil color on all borings.
2. A severe clay soil on some borings.
These soil qualities ,cause a soil classification of
unsuitable. However, if the following major modifications
can be made, the soil_ may be reclassified to provisionally.
suitable.
Modifications:
I. Due to natural drainage, tile will not be needed along
river.
II. Increased lot size:
Lot size will be based on developer restrictions as to the
number of bedrooms, size and location of the home and •other
structures. The lot shall have a square footage of. 25,000.
III. All lots must be supplied with county water.
IV. Sewage system and water restricting modifications will be
required as a part of the improvements permit.
V. Provisional agreement: As the lots are developed, a
notarized statement must be provided acknowledging the severe
soil conLAitions and agreeing to increased system maintenance
and repairs as needed or as directed by the health
department.
These requirements are based on the application of current
policies and rules. your subdivision is subject to any
future changes in these policies and rules.

Tile above recommended modifications were done to comply with
the "Rules for Sanitary Sewage Collection, Treatment and
Disposal" section 1948d. Another alternative would be
employing the services of an engineer to develop a plan that
meets the provisions outlined in 1948d. These plans should
be submitted to the local environmental Health section to be
reviewed with the assistance of the regional and state
environmental health staff.
The provisions outlined in this letter shall be valid for a
period of 36 months from the date of this letter. if the
improvements and modifications have not been completed daring
this time period, this provisional approval will become void
and it will be necessary to submit a new appl.icat.ion for
consideration.
The site- evaluation was made in accordance with Rules
.1940-.1948 of the Laws and Rules for the Sanitary Sewage
Collection, Treatment and Disposal. We are enclosing

The Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located at Danson's Grant Subdivision,
Camden County, Areneuse Creek. It was received on June 24, 1996, and appears to be
adequate for processing at this time. The projected deadline for making a decision is
September 8, 1996. An additional 75-day review period is provided by law when such time
is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard
which must be posted at the property of your proposed development. You should post this
notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a
private road would lead one into your property. Failure to post this notice could result in an
incomplete application.
An onsite inspection will be made, and if additional information is required, you will
be contacted by the appropriate State or Federal agency. Please contact me if you have any
