This letter is in response to an email received on November 12, 2013, from Mike White, P.R.Y WOWYwas
requested that Major Permit #43-13 be modified to include the following:
Bulkhead repair (within the existing footprint) comprising of top cap board replacement along the
length of the bulkhead as needed.
- Replacing the decking, joists and girders on the main pier, platform and finger piers. (Main pier
section measures 150'x6' w/ 16'x16' platform and three 24'x3' finger piers on south side). No
expansion proposed.
- Widen a 90' section of elevated walkway over USACE 404-wetlands from the permitted width of 4'
to a proposed width of 6'.
Major Permit #43-13 was issued to Currituck 34, LLC, on April 11, 2013. This Permit was issued for the
creation of a 22 lot subdivision, the removal of all existing building structures, the construction of two roads to
access the lots, the construction of a roadway to access an existing boat ramp, the creation of a stormwater fire
pond, the installation of aggregate walking trails, swales for drainage and repairs to an existing dock along the
boat ramp.
The project is located at 172 Marsh Causeway (NC HWY 615), Knotts Island, Currituck County, adjacent to
North Landing River.
Your modification request as described and/or depicted in an email received November 12, 2013, is hereby
authorized as a refinement to CAMA Major Permit #43-13. All existing conditions remain in effect, including
the expiration date of December 31, 2016. This letter is provided to you as a record of the authorization, and
should be included with the Permit file.
You may need to obtain a building permit from Currituck County.

Pls find attached the agent authorization form ... signed by Mr. Sifen of the Currituck 34, LLC.
With the submittal of the attached ... will this be sufficient to move ahead with NCDENR's
authorization of the following work effort?:
1) bulkhead repair,
(2) the replacement of the joists, girders and decking on the main pier and
(3) the expansion of the walkway over USACE wetlands from 4' wide to 6' wide, can be done
under a permit refinement

I heard back from our Major Permits Coordinator and it was decided that the (1) bulkhead repair, (2) the replacement of
the joists, girders and decking on the main pier and (3) the expansion of the walkway over USACE wetlands from 4' wide
to 6' wide, can be done under a permit refinement. That is a simple letter that can be issued from our office authorizing
the work. The only thing we will need for this is a statement from Currituck 34, LLC authorizing you to modify the permit
on their behalf. I've attached our agent authorization form.
The extension of the 50' pier next to the boat ramp will have to go through a Major Modification to MP#43-13. The
reason for this is that there was no previous agency review of development within the waters of North Landing River
since all proposed development was landward of normal water level. This means that the same process that was done
for the original Major Permit will have to be repeated. A new application, narrative and scaled site plans will have to be
submitted as well as notifying the adjacent riparian property owners of the intended pier extension. There will also be z
fee of $250 and a processing time of 75-150 days for permit issuance after it is accepted as complete. I've attached all
required forms as well as a checklist.
I should note that this pier is close to the property line and if any portion of it comes within 15' of the property line
extended into the water, then a 15' waiver from the adjacent riparian property owner will be required.
If you have any questions, feel free to contact me. Once I get that Agent Authorization form, I can get the refinement
issued.

I'm still waiting to hear back from our Major permits Coordinator, my understanding is that he was out
of the office the past couple of days. If it does turn out to be a Minor Modification, I will need a written
request listing all the "proposed modifications to the permit in detail as well as an updated scaled site
plan (can be added to the approved site plans). A minor modification also has a fee of $100 payable to
NCDENR. A minor modification typically is not circulated to all reviewing agencies, but instead to ones
that may have a concern; however, there is. a time period for any comments to be submitted.

Is this correct? Are there any proposed slips involved with the pier extension? I have
sent an email to the Major Permits Coordinator to determine if this will fall under a
Minor or Major Modification.

today as well working in south Va Beach (Pungo) trying to finish
up a project ... cell phone service is spotty in. this area.
Yes we are talking about CAMA Major Permit #43-13 that was
issued to Currituck 34, LLC. I am working with Currituck 34, LLC
to obtain this permit ... either to amend / add to what was
previously issued or apply for a new permit for this work effort =>
as directed by you.
Please find attached a PDF copy of the dock work @ the East
Point Estates project that we are trying to permit. FYI - Broad Bay
Contracting is the sub contractor to Currituck 34, LLC that will be
doing the actual work
Please let me know if the attached info is adequate to meet your
review needs or will you need add'I info.?
Do we need to fill out an amended / new permit application and
are there review fees? If there are review fees ... how much and
who to we make the fees payable to?

Hopefully I got this email address right because the message was in and out of
reception. I just want to make sure we are talking about CAMA Major Permit #43-13
issued to Currituck 34, LLC. If so, then I need to know exactly what is being proposed
(dimensions, etc...). Since there is an existing Major Permit, we will need to do a
modification to it, but the type of modification will depend on the proposed changes.
Also, a site plan will be required.
