Docking Facility 1) Unless specifically altered herein, this permit authorizes only the extension to the existing docking facility and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non. -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. 2)' No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized -work (See attached sheetS for Additional Conditions) This permit action may, be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site .to Department ,personnel when the project is inspected for compliance. Permit # 43-13 Page 2 of 3 A 1 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit does not authorize any formalized boat slips. General 7) The permittee understands and agrees that, if future operations by the United States requires the ¢. removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. The project is adjacent to an existing boat ramp. There will be no finger piers and will only have temporary tie -offs for vessels that are just being launched into the water or are about to be pulled out of river. This pier is/will be for East Point Estates community only and not to the general public. It is for leisure/recreational activities only. Standard construction methods (hammers, wrenches, pneumatic hand tools, etc..) will be used in the construction of the pier. The pilings will be brought in by boat and jetted in. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. Project Settinq The site of the proposed development is located at 172 Marsh Causeway (NC HWY 615), within the East Point Estates subdivision, approximately 0.4 miles south of the NCNA border on Knotts Island, Currituck County, and is adjacent to North Landing River. The subdivision is ±33 acres in size with elevations that range from 12' above Normal Water Level (NWL) at the center of the site, gradually tapering down to 5' within three general areas; to the north, the southeast, and to west along North Landing River. Major Permit #43-13 was issued to Currituck 34, LLC, on April 11, 2013. This Permit was issued forthe creation of a 22 lot subdivision, the removal of all existing building structures, the construction of two roads to access the lots, the construction of a roadway to access an existing boat ramp, the creation of a stormwater fire pond, the installation of aggregate walking trails, swales for drainage and repairs to an existing courtesy pier along the boat ramp. The permit was refined on 11/14/2013 to include bulkhead repairs, the replacement of decking, joists and girders on a larger pier, and widening a 90' section of elevated walkway over USACE 404-wetlands. Development authorized through Major Permit #43-13 is near completion and individual lots are for sale. The focus of this modification is on Open Space B of the subdivision which is located adjacent to the northern property line. Man-made features include a fire pond, cemetery, a gravel access road to a 14' wide concrete boat ramp with 35' long jetties on each side and a 50'x6' courtesy pier located immediately on the south side of the boat ramp. The shoreline of the open space is ±31' in length and has been hardened by a wooden bulkhead located at normal water level (NWL). The waters of North Landing River in this area are classified as SC and are closed to shellfish taking. Water depths at the end of the boat ramp are ±2' below NWL, the bottom substrate within the project area is made up fine sands and is void of Submerged Aquatic Vegetation (SAV). The adjacent property to the north is a large parcel that contains the Sandy Point Resort camping area as well as full time residences. The shoreline of this property has been hardened through bulkheading and riprap and a docking facility exists. The adjacent property to the south has a natural shoreline and is also a large parcel containing the Flyway Club hunting lodge. The lodge and barn are located near the shoreline and the upland areas are agricultural fields. Development Proposal The applicant proposes to extend an existing courtesy pier adjacent to the boat ramp an additional 50'x6' for a total length of 100' beyond NWL. Water depths within the alignment area range from 2' to 3' below NWL and SAV's are not found within the alignment. The pier extension is to serve as a temporary tie -off area for launching and retrieving boats only, no formalized slips are proposed. PROJECT SUMMARY: The applicant proposes to extend an existing pier located on the subdivisions Open Space B area to facilitate prospective property owners with launching and retrieving vessels. Proiect Settin The site of the proposed development is located at 172 Marsh Causeway (NC HWY 615), within the East Point Estates subdivision, approximately 0.4 miles south of the NCNA border on Knotts Island, Currituck County, and is adjacent to North Landing River. The subdivision is ±33 acres in size with elevations that range from 12' above Normal Water Level (NWL) at the center of the site, gradually tapering down to 5' within three general areas; to the north, the southeast, and to west along North Landing River. Major Permit #43-13 was issued to Currituck 34, LLC, on April 11, 2013. This Permit was issued for the creation of a 22 lot subdivision, the removal of all existing building structures, the construction of two roads to access the lots, the construction of a roadway to access an existing boat ramp, the creation of a stormwaterfire pond, the installation of aggregate walking trails, swales for drainage and repairs to an existing courtesy pier along the boat ramp. The permit was refined on 11/14/2013 to include bulkhead repairs, the replacement of decking, joists and girders on a larger pier, and widening a 90' section of elevated walkway over USACE 404-wetlands. Development authorized through Major Permit #43-13 is near completion and individual lots are for sale. The focus of this modification is on Open Space B of the subdivision which is located adjacent to the northern property line. Man-made features include a fire pond, cemetery, a gravel access road to a 14' wide concrete boat ramp with 35' long jetties on each side and a 50'x6' courtesy pier located immediately on the south side of the boat ramp. The shoreline of the open space is ±31' in length and has been hardened by a wooden bulkhead located at normal water level (NWL). The waters of North Landing River in this area are classified as SC and are closed to shellfish taking. Water depths at the end of the boat ramp are ±2' below NWL, the bottom substrate within the project area is made up fine sands and is void of Submerged Aquatic Vegetation (SAV). The adjacent property to the north is a large parcel that contains the Sandy Point Resort camping area as well as full time residences. The shoreline of this property has been hardened through bulkheading and riprap and a docking facility exists. The adjacent property to the south has a natural shoreline and is also a large parcel containing the Flyway Club hunting lodge. The lodge and barn are located near the shoreline and the upland areas are agricultural fields. Development Proposal The applicant proposes to extend an existing courtesy pier adjacent to the boat ramp an additional 50'x6' for a total length of 100' beyond NWL. Water depths within the alignment area range from 2' to 3' below NWL and SAV's are not found within the alignment. The pier extension is to serve as a temporary tie -off area for launching and retrieving boats only, no formalized slips are proposed.
