This permit,'issued-on August 21, 2014 is subject to` compliance with the application (where:consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Docking Facility
1) Unless specifically altered herein, this permit authorizes only the extension to the existing docking
facility and uses located in or over the water that are expressly and specifically set forth in the permit
application. No other structure, whether floating or stationary, shall become a permanent part of this
docking facility without permit modification. No non. -water dependent uses of structures shall be
conducted on, in or over public trust waters without permit modification.
2)' No attempt shall be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized -work

This permit action may, be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site .to Department
,personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval..
- All work must cease when the permit expires on
December 31, 2017
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit does not authorize any formalized boat slips.
General
7) The permittee understands and agrees that, if future operations by the United States requires the
¢. removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
r removal or alteration.
8) The permittee and/or his contractor shall meet with a representative of the Division of Coastal
Management prior to project initiation in order to discuss the conditions set forth in this permit
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
. 10) This major modification shall be attached to the original Permit No. 43-13 which was issued on 4/11/13,
- ' and copies of both documents shall be readily available on site when Division personnel inspect the
project for compliance.
11) All conditions and stipulations of the active permit remain in force under this minor modification unless

The purpose of this project is to construct a new 50ft addition/extension of the existing 50ft pier changing the
length from 50ft to 100ft Both existing and new extension are 611 in width. The project is adjacent to an existing boat ramp.
There will be no finger piers and will only have temporary tie -offs for vessels that are just being launched into the water or
are about to be pulled out of river. This pier is/will be for East Point Estates community only and not to the general public. It
is for leisure/recreational activities only. Standard construction methods (hammers, wrenches, pneumatic hand tools, etc..)
will be used in the construction of the pier. The pilings will be brought in by boat and jetted in.

The purpose of this project is to extend existing pier from 50ft to 100ft. Pier will be for recreational boating and fishing
activities for the community of East Point Estates.

Dear Sir or Madam:
The enclosed permit constitutes authorization under the Coastal Area Management Act, and where
applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The original (buff -colored
form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign
both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and
proceeding means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-
121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office
of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty
(20) days of this decision on your permit. You should also be aware that if another qualified party submits a valid
objection to the issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation.
The Coastal Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be
carried out in accordance with your application. Modifications, time extensions, and future maintenance requires
additional approval. Please read your permit carefully prior to starting work and review all project plans, as
approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully
understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that
you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise
concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel
at any time for assistance. By working in accordance with the permit, you will be helping to protect our vitally
important coastal resources.

8. PROJECT SUMMARY: The applicant proposes to extend an existing pier located on
the subdivisions Open Space B area to facilitate prospective property owners with
launching and retrieving vessels.
Project Settinq
The site of the proposed development is located at 172 Marsh Causeway (NC HWY 615),
within the East Point Estates subdivision, approximately 0.4 miles south of the NCNA border
on Knotts Island, Currituck County, and is adjacent to North Landing River.
The subdivision is ±33 acres in size with elevations that range from 12' above Normal Water
Level (NWL) at the center of the site, gradually tapering down to 5' within three general areas;
to the north, the southeast, and to west along North Landing River.
Major Permit #43-13 was issued to Currituck 34, LLC, on April 11, 2013. This Permit was
issued forthe creation of a 22 lot subdivision, the removal of all existing building structures, the
construction of two roads to access the lots, the construction of a roadway to access an
existing boat ramp, the creation of a stormwater fire pond, the installation of aggregate walking
trails, swales for drainage and repairs to an existing courtesy pier along the boat ramp. The
permit was refined on 11/14/2013 to include bulkhead repairs, the replacement of decking,
joists and girders on a larger pier, and widening a 90' section of elevated walkway over USACE
404-wetlands. Development authorized through Major Permit #43-13 is near completion and
individual lots are for sale.
The focus of this modification is on Open Space B of the subdivision which is located adjacent
to the northern property line. Man-made features include a fire pond, cemetery, a gravel access
road to a 14' wide concrete boat ramp with 35' long jetties on each side and a 50'x6' courtesy
pier located immediately on the south side of the boat ramp. The shoreline of the open space is
±31' in length and has been hardened by a wooden bulkhead located at normal water level
(NWL). The waters of North Landing River in this area are classified as SC and are closed to
shellfish taking. Water depths at the end of the boat ramp are ±2' below NWL, the bottom
substrate within the project area is made up fine sands and is void of Submerged Aquatic
Vegetation (SAV).
The adjacent property to the north is a large parcel that contains the Sandy Point Resort
camping area as well as full time residences. The shoreline of this property has been hardened
through bulkheading and riprap and a docking facility exists. The adjacent property to the south
has a natural shoreline and is also a large parcel containing the Flyway Club hunting lodge.
The lodge and barn are located near the shoreline and the upland areas are agricultural fields.
Development Proposal
The applicant proposes to extend an existing courtesy pier adjacent to the boat ramp an
additional 50'x6' for a total length of 100' beyond NWL. Water depths within the alignment area
range from 2' to 3' below NWL and SAV's are not found within the alignment. The pier
extension is to serve as a temporary tie -off area for launching and retrieving boats only, no
formalized slips are proposed.

The proposed pier extension will be 17.9' from the adjacent riparian corridor line and will meet
the '/< width rule. A ±200' long docking facility is located approximately 440' to the north and a
±166' long docking facility is located approximately 320' to the south. There is no highground
development associated with the proposed pier extension.
Anticipated Impacts
The proposed development will result in the additional shading of 300 sf of PTA and EW
AEC's. (Total shading will be 600 sf on Open Space B).

Consistency Determination: The request is consistent with/not in conflict with the Currituck
County 2006 Core Land Use Plan (LUP) certified by the CRC
on May 18, 2007 as amended through June 24, 2009.
Overview: The subject property is a 5.04 acre open space area designated as "Open Space
B East Point Estates" with 31 linear feet of shoreline along the North Landing River.
Improvements associated with the 22-lot East Point Estates single-family residential
subdivision were approved in April of 2013 under Major Permit #43-13. These improvements
included repairs to an existing courtesy pier. The permit was refined- in November of 2013 to
include bulkhead repairs and other improvements. Development authorized is near
completion and individual lots are for sale. Existing site improvements on Open Space B
include a fire pond, cemetery and gravel access road. Existing shoreline improvements on
Open Space B include wooden bulkhead, a 14 foot wide concrete boat ramp with 35 foot long
jetties on each side and a 6 foot wide by 50 foot long courtesy pier. Water depths at the boat
ramp are 2 feet below Normal Water Level (NWL).
A 50 foot extension to the existing courtesy pier for a total pier length of 100 feet is proposed.
Water depths range from 2 to 3 feet below NWL along the extension alignment. The
extension is to serve as a temporary tie -off for the subdivision community only with no
formalized slips. Access to the general public will not be provided.
The waters of the- North Landing River in this area are classified as SC and are closed to
shellfish taking. Submerged Aquatic Vegetation (SAV) are not located within the alignment.

Anticipated impact: resulting from this project is expected to. include: the shading of 300 sq. ft.
of Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC).
Basis for Determination:
The project site is located entirely over Public Trust Area/Estuarine Waters Area of
Environmental Concern (AEC) which are designated as "Conservation Areas" as indicated on
Page 11-1 of the Currituck County Land Use Plan.
As indicated on Page 11-1, the purpose of the Conservation designation is to provide for the
long-term management and protection of significant, limited, or irreplaceable areas. Proper
management is needed to conserve the natural, cultural, recreational, scenic or biologically
productive values of these areas. The designation is applied to areas that should not be
developed at all (preserved), or if developed, done so in a very limited manner characterized
by careful planning and cautious attention to the conservation of environmental features. As
indicated on Page 11-2, the standards of the Conservation class shall be applied in
accordance with the site specific information made available during special studies and/or the
land development process.
Definitions of key words are provided on page 9-2. These words include "Encourage: to favor
or foster", "Should: Ought to, if no valid reason not to", and "Support: to�shore up, may imply
financial support".

the quality of life of residents and visitors, as well as the economy of the area.

8. PROJECT SUMMARY: The applicant proposes to extend an existing pier located on
the subdivisions Open Space B area to facilitate prospective property owners with
launching and retrieving vessels.
Proiect Settin
The site of the proposed development is located at 172 Marsh Causeway (NC HWY 615),
within the East Point Estates subdivision, approximately 0.4 miles south of the NCNA border
on Knotts Island, Currituck County, and is adjacent to North Landing River.
The subdivision is ±33 acres in size with elevations that range from 12' above Normal Water
Level (NWL) at the center of the site, gradually tapering down to 5' within three general areas;
to the north, the southeast, and to west along North Landing River.
Major Permit #43-13 was issued to Currituck 34, LLC, on April 11, 2013. This Permit was
issued for the creation of a 22 lot subdivision, the removal of all existing building structures, the
construction of two roads to access the lots, the construction of a roadway to access an
existing boat ramp, the creation of a stormwaterfire pond, the installation of aggregate walking
trails, swales for drainage and repairs to an existing courtesy pier along the boat ramp. The
permit was refined on 11/14/2013 to include bulkhead repairs, the replacement of decking,
joists and girders on a larger pier, and widening a 90' section of elevated walkway over USACE
404-wetlands. Development authorized through Major Permit #43-13 is near completion and
individual lots are for sale.
The focus of this modification is on Open Space B of the subdivision which is located adjacent
to the northern property line. Man-made features include a fire pond, cemetery, a gravel access
road to a 14' wide concrete boat ramp with 35' long jetties on each side and a 50'x6' courtesy
pier located immediately on the south side of the boat ramp. The shoreline of the open space is
±31' in length and has been hardened by a wooden bulkhead located at normal water level
(NWL). The waters of North Landing River in this area are classified as SC and are closed to
shellfish taking. Water depths at the end of the boat ramp are ±2' below NWL, the bottom
substrate within the project area is made up fine sands and is void of Submerged Aquatic
Vegetation (SAV).
The adjacent property to the north is a large parcel that contains the Sandy Point Resort
camping area as well as full time residences. The shoreline of this property has been hardened
through bulkheading and riprap and a docking facility exists. The adjacent property to the south
has a natural shoreline and is also a large parcel containing the Flyway Club hunting lodge.
The lodge and barn are located near the shoreline and the upland areas are agricultural fields.
Development Proposal
The applicant proposes to extend an existing courtesy pier adjacent to the boat ramp an
additional 50'x6' for a total length of 100' beyond NWL. Water depths within the alignment area
range from 2' to 3' below NWL and SAV's are not found within the alignment. The pier
extension is to serve as a temporary tie -off area for launching and retrieving boats only, no
formalized slips are proposed.

The proposed pier extension will be 17.9' from the adjacent riparian corridor line and will meet
the'/4 width rule. A ±200' long docking facility is located approximately 440' to the north and a
±166' long docking facility is located approximately 320' to the south. There is no highground
development associated with the proposed pier extension.
Anticipated Impacts
The proposed development will result in the additional shading of 300 sf of PTA and EW
AEC's. (Total shading will be 600 sf on Open Space B).

The applicant proposes to extend an existing pier located on the subdivisions Open Space B area
to facilitate prospective property owners with launching and retrieving vessels.
The site of the proposed development is located at 172 Marsh Causeway (NC HWY 615), within
the East Point Estates subdivision, approximately 04 miles south of the NCNA border on
Knits Island, Currituck County, and is adjacent to North Landing River.
The development proposal involves the Estuarine Waters (EW) and Public Trust Area (PTA)
Areas of Environmental Concern (AFC's).

The applicant proposes to extend an existing pier located on the subdivisions Open Space B area
to facilitate prospective property owners with launching and retrieving vessels.
The site of the proposed development is located at 172 Marsh Causeway (NC HWY 615), within
the East Point Estates subdivision, approximately 0.4 miles south of the NCNA border on
Knotts Island, Currituck County, and is adjacent to North Landing River.
The development proposal involves the Estuarine Waters (EW) and Public Trust Area (PTA)
Areas of Environmental Concern (AEC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:
15A NCAC 07H.0203 Management Obiective ofthe Estuarine and Ocean System
It is the objective of the Coastal Resources Commission to conserve and manage estuarine
waters, coastal wetlands, public trust areas, and estuarine and public trust shorelines, as an

The NC Division of Coastal Management hereby acknowledges receipt of the
application submitted on behalf of Currituck 34, LLC for State approval for
development of their property located at 172 Marsh Causeway in Knotts
Island, Currituck County. It was received on June 9, 2014, and appears to
be adequate for processing at this time. The projected deadline for making
a decision is August 23, 2014. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from June 9,
2014, you may request a meeting with the Director of the Division of Coastal
Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the
location of the proposed development. Enclosed you will find a "Notice of
Permit Filing" postcard which must be posted at the property of the
proposed development. You should post this notice at a conspicuous point
along the property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along
the road right-of-way fronting the property, or at a point along the road
