NC 28527 Authorizing development in Pamlico County at adi. to the Bay River, at 1174 Murphy Road, ,-in Merritt as requested in the permittee's application dated 1/17/13. including the attached workplan drawings (2), 1 dated revised 1/24/13 and l dated 1/30/13 This permit, issued on April 23, 2013 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be'subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes only the reconfiguration of the existing docking facility with associated boat house, gazebo, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or 'other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or coutinhance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. CONDITIONS 2) structures shall have a minimum setback distance of 15 feet between any parts djacent property owner's riparian access corridor. 3). The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct Lie and must be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. j 4) The roof of the covered gazebo shall not be designed for second story use. 5) - No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable ? waters at or adjacent to the authorized work ',6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. f ' 7) This permit does not authorize the interference with any existing or proposed Federal project, and the `. permittee will not be entitled to compensation for damage to the authorized structure or work, or injury i 'which may be caused from existing or future operations undertaken by the United States in the public ( interest. 8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 9) This permit authorizes a maximum of two formalized boat slips. General 10) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. s' 11) No Coastal Wetlands or open water areas shall be excavated or filled, even temporarily. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many development or land disturbing activities are not allowed within the Environmental Management Commission's Tar Pamlico River Buffer. Project Summary: The applicant wishes to extend and reconfigure an existing docking?aca for private use in order to achieve deeper water depths in the Bay River, Pamlico County. D17N!-Y!ID CITY a 10. Field Investigation Report: Thomas Cowan Page 2 Narrative Description: The property is located in Merritt at 1174 Murphy Farm Road (SR 1332), off of Florence Road (SR 1324) in Pamlico County. This site is developed with a single family residence, driveway, bulkhead, and a docking facility. The lot is 0.71 acres. The adjacent lot to the east is similarly developed, and the adjacent lot to the west is undeveloped. Both of the adjacent properties are owned by the same individual. The elevation of the high ground of the parcel is about +4' above the normal water level (nwl). Vegetation on the lot mainly consists of lawn grasses. There are no Coastal Wetlands on this property. This lot has approximately 100' of continuous shoreline along the Bay River. Immediate offshore water depths adjacent to the lot range from-1' to —4' nwl. The subaqueous substrate is firm without shell. There is a cultural resource in the nearby vicinity of the project area (PM23). This waterbody is approximately 4,183 feet across at this location. These waters are not classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as SCA; Sw, Nutrient Sensitive Waters. There is not a defined Federal Channel in this area. This project area is subject to the Neuse River Riparian Buffer Rules. Proposed Development: The applicant wishes to extend and reconfigure the existing private docking facility adjacent to the Bay River, near Merritt. The proposed development will take place at 1174 Murphy Farm Road (SR 1332), off of Florence Road (SR 1324). The purpose of extending the docking facility is to gain access to deeper water depths. There is a firm sandy shoal immediately adjacent to this section of shoreline. The -3' NWL water depth contour is not measured until approximately 400' waterward of the applicant's bulkhead. The existing docking facility has a main access pier that leaves the bulkhead and connects to an uncovered "T" platform that supports an uncovered boatlift on the western side. This existing docking facility extends approximately 260' waterward of the bulkhead at the NWL. The water depth at the end of the existing platform is -2' NWL. The applicant wishes to remove the existing "T" platform and boatlift and extend the 5'-wide walkway another 200' waterward. The applicant will then reconstruct the 9' by 40' "T" platform at the waterward terminus of this proposed extension. The proposed platform will be partially covered on the western side. The 13' by 13' boat lift will be constructed on the western side and a 14' by 26' boat house will be constructed over this boat lift. The water depth at the terminus of the proposed extension is 4' NWL. Anticipated Impacts: The docking facility will not pose a hazard to navigation because it will be less than'/4 of the width of the waterbody and approximately 850' from the channel. The proposed docking facility will not be longer than the pier head line established by the adjacent docking facilities. The docking facility will be greater than 15' from both of the adjacent riparian property lines. This proposed private docking facility will usurp and shade 3,024 ft of Public Trust Waters. This proposed extension will result in a 1,364 f? increase in shading of Public Trust Waters from the existing docking facility. The proposed docking facility will extend the existing docking facility by another 200', and thus will extend 470' waterward of the bulkhead at NWL. The Bay River is 4,183' wide at this location. This proposed extension will give the applicant access to deeper water depths of -4' NWL. Traditional marine construction methodology will be utilized during the construction of this private docking facility. Temporary, short-lived turbidity impacts are anticipated during the setting of the docking facility's pilings. There is no proposed change in the number of boat slips, nor any proposed change in the usage of the dock. There is a cultural resource in the nearby vicinity of the project area (PM23). This project area is subject to the Neuse River Riparian Buffer Rules. Water depths within the proposed boat slip are deep enough to prevent scouring of the bottom habitat. These waters of the Bay River are not classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as SC; Sw, Nutrient Sensitive Waters. There is not a defined Federal Channel in this area. The project consists of extending the existing 5' x 260'dock another 200' feet and relocating the 9' x 40' platform to the end of the extension. A 9' x i 0' gazebo is planned for the left hand side of the platform followed by a 26' x 14' boat house. The boat house and gazebo will have a hip roof and the dock and platform will be constructed with concrete slats. The boat house is located approximately I' off the western riparian line and the platform is located approximately 12' from the eastern riparian line. The water depth at the end of the current dock is inaccessible by boat and therefore the current boat lift is useless. The current water depth is barely 3' on N WL. By extending the dock to 469' allows 4' of depth in order to use boat life. This is a private residential dock. The width of the water body at this point on the Bay River is approximately 4183' and the distance to the channel is approximately 850' The property consist of a 100' x 300' lot with no wetlands present, the lawn is mowed up to the wooden bulkhead with a few trees and shrubs. The lot has a home with a gravel driveway, a concrete parking pad and a 260' concrete pier and a wooden bulkhead. The property is not near a PNA, the property does lie within the prohibited shell fishing area as seen on Area F-6 (map 19). The elevation of the high ground of the parcel is about +4' above the normal water level (nwl). Vegetation on the lot mainly consists of lawn grasses. There are no Coastal Wetlands on this property. This lot has approximately 100' of continuous shoreline along the Bay River. Immediate offshore water depths adjacent to the lot range from —l' to —4' nwl. Proposed Development: The applicant wishes to extend and reconfigure the existing private docking facility adjacent to the Bay River, near Merritt. The proposed development will take place at 1174 Murphy Farm Road (SR 1332), off of Florence Road (SR 1324). The purpose of extending the docking facility is to gain access to deeper water depths. There is a firm sandy shoal immediately adjacent to this section of shoreline. The -3' NWL water depth contour is not measured until approximately 400' waterward of the applicant's bulkhead. The existing docking facility has a main access pier that leaves the bulkhead and connects to an uncovered "T" platform that supports an uncovered boatlift on the western side. This existing docking facility extends approximately 260' waterward of the bulkhead at the NWL. The water depth at the end of the existing platform is -2' NWL. The applicant wishes to remove the existing "T" platform and boatlift and extend the 5'-wide walkway another 200' waterward. The applicant will then reconstruct the 9' by 40' "T ' platform at the waterward terminus of this proposed extension. The proposed platform will be partially covered on the western side. The 13' by 13' boat lift will be constructed on the western side and a 14' by 26' boat house will be constructed over this boat lift. The water depth at the terminus of the proposed extension is -4' N WL. The applicant states that there are two existing boat slips, and that there will be no increase in the number of boat slips at this private residential docking facility. A 9' x 10' gazebo is planned for the left hand side of the platform followed by a 26' x 14' boat house. This site is developed with a single family residence, driveway, bulkhead, and a docking facility. The lot is 0.71 acres. The adjacent lot to the east is similarly developed, and the adjacent lot to the west is undeveloped. Both of the adjacent properties are owned by the same individual. The elevation of the high ground of the parcel is about +4' above the normal water level (nwl). Vegetation on the lot mainly consists of lawn grasses. There are no Coastal Wetlands on this property. This lot has approximately 100' of continuous shoreline along the Bay River. Immediate offshore water depths adjacent to the lot range from —1' to —4' nwl. The subaqueous substrate is firm without shell. There is a cultural resource in the nearby vicinity of the project area (PM23). This waterbody is approximately 4,183 feet across at this location. These waters are not classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as SCA; Sw, Nutrient Sensitive Waters. There is not a defined Federal Channel in this area. This project area is subject to the Neuse River Riparian Buffer Rules. Proposed Development: The applicant wishes to extend and reconfigure the existing private docking facility adjacent to the Bay River, near Merritt. The proposed development will take place at 1174 Murphy Farm Road (SR 1332), off of Florence Road (SR 1324). The purpose of extending the docking facility is to gain access to deeper water depths. There is a firm sandy shoal immediately adjacent to this section of shoreline. The -3' NWL water depth contour is not measured until approximately 400' waterward of the applicant's bulkhead. The existing docking facility has a main access pier that leaves the bulkhead and connects to an uncovered "T" platform that supports an uncovered boatlift on the western side. This existing docking facility extends approximately 260' waterward of the bulkhead at the NWL. The water depth at the end of the existing platform is -2' NWL. The applicant wishes to remove the existing "T" platform and boatlift and extend the 5'-wide walkway another 200' waterward. The applicant will then reconstruct the 9' by 40' "T" platform at the waterward terminus of this proposed extension. The proposed platform will be partially covered on the western side. The 13' by 13' boat lift will be constructed on the western side and a 14' by 26' boat house will be constructed over this boat lift. The water depth at the terminus of the proposed extension is -4' NWL. Anticipated Impacts: The docking facility will not pose a hazard to navigation because it will be less than'/4 of the width of the waterbody and approximately 850' from the channel. The proposed docking facility will not be longer than the pier head line established by the adjacent docking facilities. The docking facility will be greater than 15' from both of the adjacent riparian property lines. This proposed private docking facility will usurp and shade 3,024 ft of Public Trust Waters. This proposed extension will result in a 1,364 ft increase in shading of Public Trust Waters from the existing docking facility. The proposed docking facility will extend the existing docking facility by another 200', and thus will extend 470' waterward of the bulkhead at NWL. The Bay River is 4,183' wide at this location. This proposed extension will give the applicant access to deeper water depths of -4' NWL. Traditional marine construction methodology will be utilized during the construction of this private docking facility. Temporary, short-lived turbidity impacts are anticipated during the setting of the docking facility's pilings. A 9' x 10' gazebo is planned for the left hand side of the platform followed by a 26' x 14' boat house. The boat house and gazebo will have a hip roof and the dock and platform will be constructed with concrete slats. The boat house is located approximately I' off the western riparian line and the platform is located approximately 12' from the eastern riparian line. The water depth at the end of the current dock is inaccessible by boat and therefore the current boat lift is useless. The current water depth is barely 3' on N W L. By extending the dock to 469' allows 4' of depth in order to use boat lift. This is a private residential dock. The width of the water body at this point on the Bay River is approximately 4183' and the distance to the channel is approximately 850' the property consist of a 100' x 300' lot with no wetlands present, the lawn is mowed up to the wooden bulkhead with a few trees and shrubs. The lot has a home with a gravel driveway, a concrete parking pad and a 260' concrete pier and a wooden bulkhead. The property is not near a PNA, the property does lie within the prohibited shell fishing area as seen on Area F-6 (map 19). The project consist of extending the dock 200' and relocating the 9' x 40' platform to the end of the extension. This site is developed with a single family residence, driveway, bulkhead, and a docking facility. The lot is 0.71 acres. The adjacent lot to the east is similarly developed, and the adjacent lot to the west is undeveloped. Both of the adjacent properties are owned by the same individual. The elevation of the high ground of the parcel is about +4' above the normal water level (nwl). Vegetation on the lot mainly consists of lawn grasses. There are no Coastal Wetlands on this property. This lot has approximately 100' of continuous shoreline along the Bay River. Immediate offshore water depths adjacent to the lot range from —l' to —4' nwl. The subaqueous substrate is firm without shell. There is a cultural resource in the nearby vicinity of the project area (PM23). This waterbody is approximately 4,183 feet across at this location. These waters are not classified as a Primary Nursery Area and there is not any submerged aquatic vegetation present. This area is closed to shellfish harvest and is classified as SCA; Sw, Nutrient Sensitive Waters. There is gOt 1kdefined Federal Channel in this area. Proposed Development: ✓ , The applicant wishes to extend and reconfigure the existing private docking facility adjacent to the Bay River, near Merritt. The proposed development will take place at 1174 Murphy Farm Road (SR 1332), off of Florence Road (SR 1324). The purpose of extending the docking facility is to gain access to deeper water depths. There is a firm sandy shoal immediately adjacent to this section of shoreline. The -3' NWL water depth contour is not measured until approximately 400' waterward of the applicant's bulkhead. Ovi The existing docking facility has a main access pier that leaves the bulkhead and connects to an uncovered "T" platform that supports an uncovered boatlift on the western side. This existing docking facility extends approximately 260' waterward of the bulkhead at the NWL. The water depth PS at the end of the existing platform is -2' NWL. The applicant wishes to remove the existing "T" S L platform and boatlift and extend the 5'-wide walkway another 200' waterward. The applicant will then reconstruct the 9' by 40' "T" platform at the waterward terminus of this proposed extension. The proposed platform will be partially covered on the western side. The 13' by 13' boat lift will be constructed on the western side and a 14' by 26' boat house will be constructed over this boat lift. The water depth at the terminus of the proposed extension is -4' NWL. Q, s 10. This proposed extension will give the applicant access to deeper water depths of 4' NWL. f�Frw Traditional marine construction methodology will be utilized during the construction of this private docking facility.
